My prior memo dated July 23 suggested that you submit for a Certificate of Zoning Compliance (CZC) for your expansion. That is incorrect. If your use were `permitted' in the C-G zone, your expansion could be processed as a CZC. However, `Automobile Repair' is a conditional use in the C-G zone per the Schedule of Use Control. Therefore any expansion of your operation, whether attached to the existing structures or not, must be approved through the Conditional Use Permit (CUP) process. This is the same process you went through for your original approval. When we met on July 23, you stated that you intend to go through the process to expand your business this fall. T'he deadline for submittal of CUP applications is noon on the 15~' of every month. This past deadline filled the hearing dates through September and we are now working on the October hearing dates. Therefore, if you intend to be heard this fall, I recommend that you get your application in as soon as possible. In the meantime, the automobiles need to be removed from the undeveloped right-0f--way for the Pennwood Street extension. As you know from your prior CUP approval, this expansion will also trigger development of Pennwood Street, and associated landscape buffers and other improvements. Bins From; Steve Siddoway CC: Code Enforcement Dam 23 July 2002 Ree John's Alignment Per our phone conversation, I researched the issue regarding the automobiles you have pazked along the north side of your property. The area is not approved for parking, storage, or any such use related to your automobile repair and service facility. I base this statement on the following findings: 1. The area where the automobiles are pazked is unimproved future right-of--way for the Pennwood Street extension. 2. As stated in the staff report (item 11) for your Conditional Use Permit, "Pazking areas shall not be located closer than four feet to an established or proposed road or alley right-of-way." 3. The Conclusions of Law (item 4.8) for the project state that the property is to be developed in accordance with the approved site plans. Said plans show no use of the property where the automobiles aze currently being pazked. 4. Even if the pazking use were allowed in the azea in question (which it is not), City ordinances require all such azeas to be paved and landscaped. No such improvements exist in the area. The automobiles need to be removed from the future right-of--way azea and kept on the area that is paved, landscaped, and approved for pazking on the approved site plan. I also find .evidence in the file that you own additional unimproved property west of the current site that is intended for future expansion. If the autos aze too numerous to keep on the improved portion of the property, it is time to apply for a Certificate of Zoning Compliance to expand your operation to the west.
