This Annroval Letter is being issued in lieu of a Certificate of Zoning Compliance,. _ Plannine&
Zoning staff acknowledges that although the proposed improvements do not brim the site into full
compliance with current ordinances, it is a good faith effort to improve the site based on existing site
limitations. All new sig_nage is subject to desi~xl review and requires sepazate permits. No signag_e
is permitted in the ACRD right-of--way. No portable signs or temporary signage permitted. An
underground pressurized irri atg ion system must be installed to all landscaped azeas. All trees must
be planted as per the approved landscape plan. Lighting shall not cause glare or impact the traveling
public or neighboring residential development. The LandscaQe Plan is not to be altered without prior
written approval of the Planning & Zoning Department. No field chances to the site/landscape
plan are permitted; prior written approval of all changes is required.
The following reauired changes to the site plan have been discussed with. Gene Kelly on 8/10/99 and
must be accommodated as part of the site improvements:
1. Trees: A total of nine (~ trees minimum must be on the property. Planter A will have 1 tree,
planter B will have 2 trees planter C will have 2 trees planter D will have 1 tree, planter E will
have 2 trees and an additional tree will be added to the existing planter on the west side of the
bbuilding.
2. Plant Species: The Pfitzer Jutlipers shown in the planters will become 5-6 feet tall by 15-20 feet
wide. C e this species to the `Compacta' cultivaz, or some other low growing shrub.
3. Plant Sizes: Trees must be 3" caliper to meet City Ordinance. The owner must make all feasible
attempts to locate 3"caliper trees If smaller trees aze used. additional trees will have to be added
to the site plan (as many as possible given existing site limitations-ggt size substitutions
approved in advance by P&Z Dept-T).
4. Weed Barrier: Remove the 6 mil. Plastic from the planting requirements. Plastic weed barrier
does not allow air and water penetration to the root zone and stresses plants. Replace with a
fabric weed barrier and/or 3-4 inches of bazk mulch
5. Pazlcing Stalls: All pazkin~stalls must be a minimum of 9'x19' as per City Ordinance. The site

Shari,
I spoke with John Mackay of Kowallis & Mackay re: bonding for Papa John's occupancy. He said they will participate in
the common area parking/landscaping improvements. However, they expect to get credit for the improvements they are
already making on their lot. The required improvements on their lot alone that have already been approved include 9 3"-
caliper trees, parking lot striping, and a trash enclosure. He feels these costs will largely offset their portion of the cost of
the new improvements, when factored into the project as a whole.
He thinks their nine trees should be in place this week, but is willing to bond for his own approved landscaping, etc. if they
are not completed in time (when Papa John's temporary occupancy expires). The rest of the overall site improvements
seem messy enough and preliminary enough that I don't really want to waste a lot of time quabbling over what portion is
their responsibility.
John is supposed to be getting back to me with a timeline for the remaining trees, etc. I intend to require those trees and
other improvements to be in place or bonded for, but I'm not going to worry about the common area improvements since
the details have not been worked out among the owners. Let me know if you feel I should do otherwise.
