time with them, but it appears they have removed all trees that were previously shown in the
City's utility easement. They moved the majority of them to the planter along the east wall of
Sportsman's Warehouse. Another 5 trees were relocated to the SE entry area. Could you please
review and confirm that the proposed locations are not in conflict with any existing or future
utilities? Thanks.

Attached is a copy of a section of the SE corner of the revised Sportsman's Warehouse Landscape
Plan, which you sent over 1-31-00. All of the proposed changes for relocation of the trees that were in
the utility easement are fine, with the exception of one (1) tree. The most southerly tree within the
landscape bed along the east wall of the Sportsman's Warehouse building is still in the easement.
Please relocate this tree to another place on the site. Thanks.

Thank you for addressing the water line/landscaping conflict in your memo dated 12/20/99.
The following are clarifications or comments the itemized comments in your memo:
1. The 8" water line is not a fire service line. The 6" services that come off of it and
connect to the building(s) are fire lines and the City has no easement for those. The
8" is the water main that loops around the entire site. It is part of the system that
provides domestic service to the rear of the buildings.

4. I do not believe that simply because we did not identify the conflict prior to issuance of
a building permit that the devebper is not responsible for the problem. Public Works,
until the last month or iwo, has not been in the business of checking for tree locations
(as you are probably aware, we have recently taken on that additional responsibility).
Since we are now being required to coordinate landscaping and utilities, I believe the
developer's consultants and subconsultarlts should be just as responsible. It seems
too often we are being asked to coordinate the improvements .of the
consultants and, in essence, become the "quality control".
5. The existing easement agreement states that the developer'tivill not place or allow to
be placed any permanent structures, large trees or brush within the area described
for this easement... ". It also states that the City 'wvill not

the area described in this easement" In short, an agreement such as what you
describe already exists.
The only option I see as acceptable to the Water Department is the relocation of the trees
to another bcation. I agree that the costs associated with relocation of the landscape
islands are likely not minimal. However, the developer's designers, I presume, are
required to coordinate with each other on other issues. The easement was a condition of
plan approval and, therefore, the locations of the easement were known prior to
construction of the Sportsman's Warehouse landscaping islands. The legal descriptions
for the easemerrts were transmitted to Public Worlcs in March '99 with copies to Quadrant
Consultants (memo from Tom Bauwens to Brace Freddeton, 3/12/99).
The water lines were substantially complete by June 15, 1999 (although not yet placed in
service at that time). I question whether or not the landscape islands were constructed at
that time. Regarclless, the water line easement had been reviewed and approved prior to
the landscape islands being constructed. The easement was not recorded, however,
until the water line was given final acceptance. This is standard practice to ensure that
the legal description in the easement describes what was actually constructed.
I discussed this issue with Gary Smith. There is not a problem with small landscaping
over the water line. Trees, however, are another matter regardless of the root depth. It
appears from my site visit the week of 12/20/'99 that a number of trees are planted in the
landscape strip abng the barrier wall. Could their tree requirements be met with
additional trees in this area?

Brad,
I reviewed the Sportsman's Warehouse plans you sent up last week showing the conflict between the
existing fire line on the south side of Family Center (pads J, K, L and Office Depot) and the landscape
islands, which were installed in November. I called Nick Kraus at Quadrant and asked him to propose a
solution to this conflict. He subsequently asked Doug Russell of The Land Group to review the tree
species and root depth of the trees within the 20-foot water line easement. Doug's reply is in the
attached memo to Tom Bauwens dated 12-16-99. His opinion is that, with a water line depth of 4' - 5',
the trees will. not interfere with the line and should remain.
When you initially brought this problem to my attention, I did not understand the planter islands were
already constructed. The problem could be fairly easily fixed if it were only a matter of adjusting tree
locations on the plans. However, the landscape plan for Phase 1 of The Family Center is approved and
the site is meeting the minimum number of trees required by ordinance. In addition, these trees are
located between the stores and Crossroads Subdivision and will provide a much needed buffer at
maturity.
I know we (the City) have a policy to not allow any tree plantings in City utility easements. However, I'd
like to request that an exception be made in this case for the following reasons:
1. As I understand it, the 8" water line in conflict with the planters is only a fire service line and does
not provide domestic service.
2. The 18 trees that would need to be moved outside the 20-foot easement cannot be planted
anywhere else within Phase 1 and are required to meet the minimum number of required trees.
3. According to The Land Group, the trees selected are specifically developed as street trees and
have non-invasive root systems and no tap root.

4. We (the City) did not identify this problem prior to issuance of a Certificate of Zoning Compliance
and building permit for Phase 1 construction. They have constructed the landscape planters and
line as, I assume, per the approved permit.
5. The City could enter into a written agreement with Dakota Company placing all responsibility for
repair, replacement and maintenance of the landscaping in the easement on them should the City
ever need to repair the water line in the future. Tom Bauwens has already verbally committed that
they would sign such an agreement.
In order for Dakota to remain in landscape compliance for Phase 1, the only other viable option I see for
this problem is to require a relocation of the planter islands from their present location to the north
(closer to the buildings). I don't know what the cost associated with the relocation of nine (9), 40-foot
planters would be, but I'm sure iYs substantial. One other option might be to permit large shrubs in
these planters and require the 18 trees to be placed somewhere in Phase 2 or 3, but Shari would need
to make that call.
Could you please give this some consideration and get back to me? I can probably get a few samples
of language for easement agreements that would place responsibility for future repair and replacement
costs on Dakota if that would be helpful.

I have checked into the trees which are planted in the planter islands over the City of Meridian's
water main. The trees in question aze the Parkway Maple (Ater platanordes 'Coluntnarbroad ~
and the Autumn Purple Ash (Fraxinus americans Autumn Purple ~. These trees were prirnanily
developed as street trees and one of their best qualities is their non-invasive root systems. Neither
of these trees have a significant tap root and they grow at moderate rates. I am of the opinion that
these trees will not affect the water tine which is located at a depth of approximately 4'-5'. I
would recommend allowing these trees to remain in order to maintain an acceptable landscape
for this rear parking lot. Please give me a call if you have any questions or would like to discuss
this issue further.

Tom,
I have checked into the trees which are planted in the planter islands over the City of Meridian's
water main. The trees in questiozt are the Parkway Maple (Ater platanoides 'Columnarbroad ~
and the Autumn Purple Ash (Fraxinus americans Autumn Purple ~. These trees were primarily
developed as street trees and one of their best qualities is their non-invasive root systems. Neither
of these trees have a significant tap root and they grow at moderate rates. I am of the opinion that
these trees will not affect the water line which is located at a depth of approximately 4'-5'. I
would recommend allowing these trees to remain in order to maintain an acceptable landscape
for this rear parking lot. Please give me a call if you have any questions or would like to discuss
this issue further.
