It is my understanding that Mr. Jones, operating a used car sales operation at the above-referenced address,
was given a 30-day temporary license based upon my notation on the application. I appreciate your
working with the City of Meridian to ensure that applicants comply with our Ordinance. Mr. Jones just
recently closed on the property and has been working diligently with Ada County Highway District to
complete the needed improvements, but various issues have taken longer than anticipated. As we have a
letter of credit on file that is valid until December 28, 1998, the City has no objection to extension of the
temporary permit until that time. This should allow Mr. Jones ample time to complete the needed
improvements.
On another subject, it appears that numerous vehicles are being bought and sold by either John Nesmith,
Steve Nesmith, Meridian Automotive, and/or Nesmith Brothers at 505 East First Street in Meridian. Could
you look that address up and inform me if they are in compliance with State requirements? They are in
violation of several Meridian City Ordinances.

referenced Applicant, which is available upon presentment of your sight draft drawn on us marked: "Drawn under Farmers
& Merchants State Bank, 703 East 1st Street, Meridian, Idaho 83642 Irrevocable Letter of Credit No. 438, dated
September 28, 1998." The sight draft must be accompanied by a copy of a signed and notarized affidavit of a duly
authorized representative of The City of Meridian (the "Municipality") attesting to the Municipality's intent to draw on the
Letter of Credit due to the Applicant none performance of landscaping improvements, required by the Municipality for the
project located at 813 East Fairview, Meridian, Idaho, as follows:
"City of Meridian hereby certifies that Richard E. Jones has not completed the required landscaping improvements
for the construction project located at 813 East Fairview. The City of Meridian hereby certifies that the following
specific requirements have not been completed:"
We hereby engage with you that your draft and the required document presented under and in compliance with the terms
of this Credit will be honored by us if presented to our office before our close of business on December 28, 1998. A draft
presented to our office, but not later than 5:00 o'clock P.M., shall be honored within two business days of presentment in
accordance with your payment instructions accompanying such draft. If requested by you, payment under this Credit may
be by wire transfer of immediately available funds to your account as specified in the draft.
We affirm that we are not in a "troubled condition" as that terms is defined in applicable sections of the Code of Federal
Regulations (including, as applicable, 12 CFR 5.51, 225.71, and 574.9 [1996]).
This Credit is subject to the Uniform Customs and Practice for Documentary Credits, International Chamber of Commerce
Publication 500, or the successor publication thereof or revision thereto.
