On January 27, 2004, the District reviewed and approved a development application (Mussell Corner Subdivision / MAZ03-038 / MCUP03-071 / MPFP03-07) requesting annexation, rezone, conditional use, preliminary plat and final plat approval to construct a 4-lot commercial subdivision on 21.38-acre site. As a part of the development application, the District had a number of conditions of approval. Due to the fact that this application (MCZC-04-083) is part of the Mussell Corner Subdivision plat, the applicant will be required to meet the conditions of approval that were attached to Mussell Corner Subdivision. The applicant is required to: Construct Victory Road (from State Highway 69 for approximately 250-feet east of State Highway 69) as one-half of a 68-foot street section with vertical curb, gutter a 5-foot (or 7-foot attached) detached concrete sidewalk and pavement widening. Due to the fact that this segment of Victory Road is a classified as a collector, the applicant is only responsible for the costs and construction of one half of a 46-foot street section with vertical curb, gutter, and sidewalk. To obtain compensation for the difference between the 23-foot and the 34-foot half street sections, the applicant should enter into a Cooperative Development Agreement with the District. 2. Construct the remainder of Victory Road as one-half of a 46-foot street section with curb, gutter, a 5- foot (or 7-foot attached) detached concrete sidewalk and pavement widening abutting the site. 3. Construct a new driveway that intersects Victory Road approximately 185-feet east of Meridian Road (69) OR the applicant may utilize the existing driveway that is located approximately 345-feet east of Meridian Road (SH 69). The applicant may not have both driveways. No matter which driveway the applicant chooses, the applicant will be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot curb radii abutting the existing roadway edge. The applicant is required to close the other driveway with standard vertical curb, gutter and sidewalk. 4. Comply with requirements of ITD for State Highway 69 frontage. Submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building permit (or other required permits), whichever occurs first.
