The issuance of this permit does not release the applicant from any requirements of the approved Annexation and Rezone (AZ-02-011), Conditional Use (CUP- 02-014, ,CUP-03-014, CUP-03-054, and CUP-03-055), Preliminary Plat (PP-02-034), and Miscellaneous (MI-02-008, MI-03-003) permits issued for_this site. Landscanin~: The landscape plan prepared by Tamura & Associates, labeled CZC-1, File No..03-56 CZC1.0, dated 2-6-04, and stamped "approved" on 2-12-04 by the Meridian Planning and Zoning Department, is approved with the following changes: 1) The perimeter landscaping on the west side of the subject lot shall be installed prior to occupancy of the subject building. A note is currently on the plan stating that. the shaded trees and other perimeter landscaping will be constructed with the subdivision. This note is not accurate and should be removed; the landscaping on the west side ofthis lot shall be installed prior to occupancy (see site-specific requirement #3 for CUP-03-055); and 2) MCC 12-13-11-3.E requires all interior planters that serve a single row of parking spaces to be landscaped with at least one tree and to be covered with low shrubs, lawn, or other vegetative groundcover. None of the proposed planters on the east side of the site have trees proposed within them. Install approved trees within the proposed planters on the east side of the lot in accordance with MCC 12-13-11-3. Other than the changes listed above, the landscape plan is not to be altered without prior written approval of the Planning and Zoning Department. No field changes to site plan permitted; prior written approval of all material changes is required. Site Plan: The site plan prepared by Tamura & Associates, labeled CZC-1, File No. 03-56 CZC1.0, dated 2-6-04, and stamped "approved" on 2-12-04 by the Meridian Planning and Zoning Department, is approved with the following changes: 1) MCC 12-13-11-3.B requires landscape planters to contain a minimum of 50 square feet, with a planting area of not less than 5 feet in any dimension, measured inside curbs. All of the proposed landscape islands shall be constructed to be a minimum 5 feet wide, inside of the curbing, not 4 feet as shown on the plan; 2) all off-street parking shall be provided in ~. _ accordance with MCC 11-13 and MCC 12-13-11. All two-way drive aisles adjacent to 90-degree parking shall be at least 25-feet wide (measured back-of--stall to back-of-stall). All compact stalls, including the stall(s) near the drive-thru, shall be constructed in accordance with MCC. Any stalls that are not constructed to "standard" specifications (19 feet x 9 feet) should be painted for compact use only. With the overhang of the parking adjacent to Lakes Avenue, wheel stops shall be installed on the stalls on the east side of the site as proposed. Other than the changes listed above, the approved site plan is not to be altered without prior written approval of the Planning and Zoning Department NOTE:'Site-specific condition #6 for CUP-03-055 states that the west building elevation shall be designed without any service or delivery doors. Due to requirements for secondary access to the tenant space on the west. side of the subject building, an emergency door is shown on the west elevation. This door may be installed if the door is used during emergency situations only, and the lighting above the door is downcast as to not cause glare on the neighboring development. Irrigation: An underground, pressurized irrigation system must be installed to all landscape areas per the approved specifications and in accordance with MCC 12-13-8 and MCC 9-1-28. Curbin : Per MCC 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other vehicle use areas, must be protected by curbing, wheel stops, or other approved protective devices. Curbing maybe cut to allow for storm water runoff. Protection of Existin.~ T, reel: Any e~sting trees on site must be protected in accordance with the Tree Preservation section ofthe City's Landscape Ordinance.. Per MCC 12-13-13-4, coordinate with the Parks Department Arborist (Elroy Hui for approval of protection measures prior to construction. Any severely damaged tree must be replaced in compliance with MCC 12-13-13-6. Parkin: The project engineer/architect shall certify that the number and size ofhandicap-accessible spaces conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls must have signage in accordance per ADA. The applicant shall be responsible for meeting the requirements of ACRD as they pertain to this development Sidewalks: All sidewalks shall be constructed as submitted and in accordance with MCC 12-5-2.K. Sidewalks shall be constructed prior to occupancy. Drainage: Storm water drainage swales shall not have a slope steeper than 3 :1, shall be -fully vegetated, and shall be designed in compliance with the MCC. Li tin :Lighting shall not cause glare or impact the traveling public or neighboring development. Si a e: No signs are approved with this CZC. All signs will require a separate sign permit in compliance with the sign ordinance. Trash Enclosure: Any dumpster(s) must be screened in accordance with MCC 11-12-1.C. Trash enclosures must be built in the location and to the size approved by SSC. Handicap Accessibility: The structure, site improvements and parking must be in compliance with all federal handicap-accessibility requirements. ACRD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a new site plan shall be submitted to the City of Meridian Planning and Zoning stafffor approval prior to the issuance of a building permit. Certificate of Occupancy: All required improvements must be complete prior to obtaining a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of the cost of the ~- remaining improvements. A bid must accompany any request for Temporary Occupancy. No occupancy will be granted until the final plat for the property is recorded.
