SILVER OAKS CONDITIONAL USE PERMIT, DESIGN REVIEW AND
DEVELOPMENT AGREEMENT MODIFICATION
Silver Oaks Apartments, LLC (Graye Wolfe), hereby applies for a conditional use permit, design
review and a development agreement modification for the Silver Oaks Apartments (part of
Umbria Subdivision).
The Silver Oaks project was initially planned and approved in 2005. The development consisted
of (70) four-plex buildings (280 units) and (1) commercial/office lot. A single four-plex
elevation accompanied the original project approval. The four-plex design was ordinary and
plain.
The project was designed and over $1,000,000.00 of infrastructure was installed (sewer, water,
utilities, storm drainage, gravel base, and partial concrete) between 2006 and 2008. The
developer, Charter Builders, could not complete the project due to financial difficulties. The
project was in the process of foreclosure by Banner Bank and ownership was returned to the
original property owner, Ten Mile Development, LLC (Graye Wolfe).
A time extension application was required to retain the original approvals. In 2008, a second
request for a time extension was submitted. During the process, new elevations for the multi-
family buildings were required. The proposed elevations consisted of row houses and
condominium buildings. Three different styles of buildings were submitted which included
Prairie, Cape Cod and Mediterranean versions.
The Council granted approval of the time extension and tied the new elevations to the Silver
Oaks development. After further analysis and meetings with lending institutions, it was
determined the project as proposed with the row houses and condominiums was financially
infeasible. Without the necessary financing, the row house/condominium project was dead. The
development was abandoned and stewardship of the project returned to Ten Mile Development,
LLC (Graye Wolfe).
In 2009, applications for modifications to the conditional use permit (MCU -09-002) and design
review (DES -09-026) were submitted. New elevations for four-plex and apartment buildings
were submitted utilizing similar design styles as approved by the City Council in 2008. Three
different designs - Prairie, Cape Cod and Mediterranean — were included to provide diversity
within the project. The Planning & Zoning Commission approved the modified site plan and
multi -family structures.
The current applications submitted are for an entirely new conditional use permit and for a
modification of the existing development agreement. The primary differences between the old
project and the new project are the number of units proposed has increased from 280 to 369 and
the four-plex buildings have been eliminated and replaced with five types of multi -family
structures. The previous development agreement (approved by City Council on January 3,
2006, recorded on January 6, 2006, as Instrument No. 106002636) was.based on the old
Meridian Zoning and Development Ordinance. It is our intent that an entirely new development
agreement is entered into based upon the new Findings of Fact and Conclusions of Law, and that
the previous development agreement is rendered null and void.

The subject property consists of 24.16 acres and is improved with sewer, water, pressure
irrigation, public utilities, retention ponds, partial sidewalk and curbs. The improvements were
installed according to the original site plan in 2006. The new site plan includes (25) multi -family
buildings, surface parking and (8) parking garages. The proposed multi -family structures are two
and three stories in height and consist of (5) building types. The building types are as follows:
Building 1 - two-story with 12 units, Building 2 - three-story with 18 units, Building 3 - two-
story with 16 units, Building 4 — three-story with 24 units and Building 5 — two story duplex with
garage.
The total open space provided with the new site plan is 13.82 acres. The qualified open space
consists of 5.62 acres or 22 percent of the site. The proposed amenities include a clubhouse,
pool, spa, fitness center, play equipment, picnic area, tennis court and community garden.
The new development concept is superior to the previously approved four-plex plans. The
increase in density to 14.99 dwelling units per acre will create a more viable apartment complex.
Based on information provided by multi -family developers, there is an optimum density and mix
of units. The addition of the different multi -family buildings has improved the diversity of the
project. We believe the new proposal is more consistent with the Medium High Density
designation specified in the Ten Mile Interchange Specific Area Plan.

Please accept this Design Review Application for the above referenced project. This application is for two
& three story apartment buildings, clubhouse and fitness center on W. Perugia St. and N. Umbria Hills
Ave. 369 dwelling units are proposed within 26 buildings with approximately (100) one -bedroom units,
(192) two-bedroom units and (77) three-bedroom units. Garage structures and carports are included in this
application. Several of the carports are in utility easements within the site. These carports will required to
be disassembled in the event utility work needs to be done in this area per City of Meridian requirements.
Therefore the carports are proposed to have flat roofs to allow them to be disassembled and reassembled
as required.
Amenities provided with this development include: Clubhouse, Fitness Center, pool/spa, tennis court,
playground, community garden area, and picnic area.
Type of open space provided: Landscaping, playground, clubhouse, tennis court, fitness center, pathways,
community garden area, water feature, pool and spa.
The proposed project addresses the guidelines contained in the Meridian Design Manual and UDC 11-3A-
19:
1. Architectural Character:
a. The building design utilizes facade modulation and changes in materials, details and
colors to offset the visual mass of the building and provide interest at different scales.
b. The building entrances provide additional visual interest, a more pedestrian scale and
reduce the appearance of the overall building mass.
C. Roof lines are modulated through the use of hip & gable roof forms.
d. Pattern variations are achieved by the use of different types of siding, overhangs,
columns and entrance details.
e. Window openings have been placed in appropriate locations for spaces within the
buildings as well as providing a balanced window arrangement.
f. The mechanical equipment will be screened by landscaping.
2. Color and materials. See attached color & material sample board. Colors are utilized to reduce the
overall mass of the building and emphasize the modulation of the building mass.
3. Site Plan and Building Layout
a. The buildings are clustered along the parking areas to provide convenient walking
distances for pedestrians.

b. Parking areas are located at the interior of the project and contain large planting islands
for trees and shrubs. The parking is screened from adjacent uses and the street by the
buildings.
C. Access to the project is provided via a driveway connected to both N. Umbria Hills
Avenue and W. Perugia Street which are small local roads.
d. The internal vehicular circulation is an appropriate and efficient configuration for a
residential project of this size.
e. The pedestrian walkways provide good connections to all areas within the site. The site
includes designated areas for recreation, connection to adjacent open spaces as well as
seating areas.

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11 -5A -5D, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing

required date, the hearing will be continued.
