Wells LLC, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct a glass enclosure for the second floor exterior balcony for the existing office building located at 1099 S. Wells Street. The subject site is currently zoned L -O (Limited Office). DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required Two (2) sets of the approved plans are to be submitted to the Building Department with the permit application. Site Specific Conditions of Approval 1. The elevations prepared by Dave Evans Construction, dated 12/02/10, are approved (stamped "approved" on 12/08/10 by the City of Meridian Planning Department) with no changes. 2. The applicant shall comply with the approved site plan and landscape plans approved with CZC- 05-134. 3. The building elevations shall not be altered without prior written approval from the City of Meridian Planning Department. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 3. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 4. The applicant shall comply with the outdoor lighting provisions asset forth in UDC 11-3A-11. 5. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A -3B. Conditions Document Silver Creek Realty CZC and DES EXPIRATION Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. The administrative design review shall be exercised with the approval period of the underlying permit (CZC) or the approval shall expire. In accord with the above provisions, the subject Certificate of Zoning Compliance and Design Review is valid until December 8, 2011. CITY COUNCIL REVIEW The applicant, Director, or a party of record may appeal this decision or a condition of approval by requesting City Council review of this decision. Wells Street, Silver Creek Realty Glass Enclosure Design Review & Certificate of Zoning Compliance The proposed project is to enclose the existing exterior second story with glass storefront. Because the balcony faces and is located so closely to Interstate 84 the constant noise is problematic to the building's users. Installing this glass will mitigate much of the sound and make the outdoor balcony space more useable. The continuous, transparent and clean look of the new curtain wall is compatible with the original look of the building's fagade. Please refer to the attached application and submittal for additional information. Because the proposed project is so limited, only those items applicable to the addition have been included.
