The site is located at 1815 S. Meridian Road. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required If a building permit is required, two (2) sets of the approved plans are to be submitted to the Building Department with the permit application. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. 4. The site plan prepared by Stantec Architecture on 3/9/11, labeled Sheet SD1.0 is approved (stamped "approved" on 3/14/11 by the City of Meridian Planning Department) with no changes. 5. The landscape plan prepared by Stantec Architecture on 3/9/2011 labeled Sheet L1.0 is approved (stamped "approved" on 3/14/11 by the City of Meridian Planning Department) with no changes. 6. The elevations prepared by Stantec Architecture on 7/7/10, labeled Sheets A4.0 & A4.1, are approved (stamped "approved" on 12/6/10 by the City of Meridian Planning Department) with no changes. 7. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 8. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. Conditions Document 1 Jack in the Box CZC 9. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 10. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 11. At such time that the multi -use pathway along SH 69/Meridian Road connects from one major street to another and is greater than one-half mile long, the applicant may petition the City to assume maintenance responsibilities. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The subject property adjoins a state highway (SH 69); the only approved access to the state highway is as shown in Exhibit B. 3. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP -10-012; DES -10-046; VAR -05-027; PP -07-003; FP -7- 013; AZ -04-031; MI -07-002; Development Agreement Inst. 105134293 & 10709963 0) 4. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 5. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 6. The applicant shall have an ongoing obligation to maintain all pathways. 7. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 8. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. 9. The applicant and/or assigns shall have the continuing obligation to meet the speck use standards for drive-through establishments as set forth in UDC 11-4-3-11. CITY COUNCIL REVIEW The applicant or a party of record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Department on or before [date], within fifteen (15) days after the written decision is issued, and contain the information listed in UDC 11 -5A -6B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. You have the right to request a regulatory taking analysis under Idaho Code 67-8003. Meridian. Rd The proposed project is to include a new 2,370 SF Jack in the Box with one drive thru lane that provides an escape route as required. 1. The architectural character of the building will provide its own identity and character that is consistent with the Jack in the Box branding image. a. The building facades that face public roadway to the east incorporate fagade modulations that define the building entrances and provide visual interest. b. Primary public entrances at the front faces the public roadway to the east and another public entrance at the side faces to the parking area to the north. c. The roof structure is flat but the variation in height of the exterior parapets that enhance the building form. d. The exterior of the building is exterior cement plaster and the variation of the location, size, and type of control joints in the stucco create a variation of patterns at the exterior facades. e. Fenestration provided is cohesive with the geometric aesthetics of the exterior. f. Mechanical equipment will be screened behind the roof parapet walls and out of view. 2. The exterior building material is exterior cement plaster that incorporates three different colors that help define the articulation of the facades. Color samples are included. Metal awnings and permanent display posters are other materials that are incorporated. 3. Site plan and Building Layout - The site is .6 acres and is approximately 109'x243' in dimension. The building size is 77'-rx35'-10". a. The building is located approximately in the center of the lot and approximately 115' feet from the street and 75' from the public sidewalk. b. Two parking areas are provided and the parking requirements are met. One parking area with 9 stalls including ADA parking is located to the north of the building adjacent to the building sidewalk and one parking area with 7 stalls is located to the east of the building between the building and the public roadway. c. Access to the property is by right in and right out only to Meridian road. Access to Overland road is provided through the neighboring development to the north. d. Internal circulation of the property is provided by 2 -way traffic around the entire perimeter of the lot. e.
