The existing building envelope totals 749 square feet of which 338 square feet will be used for the indoor storage. The remaining portion of the building is used as the main office as previously approved. The subject site appears to be incorrectly zoned R-8. Previous approvals indicate the site is zoned C-G (General Retail and Service Commercial District). The existing 2,304 square foot major automotive repair facility was approved with a conditional use permit in 1989. Staff has attached a copy of the approved site plan (see Exhibit B) that shows the location of the existing building envelopes approved with the CUP. NOTE: The existing structures on the site are non-conforming because they do not meet the current setbacks of the C-G zoning district however; the existing building envelope is not proposed for expansion with the subject application. Thus, any future expansions of the site shall be subject to the requirements of the Unified Development Code (UDC). The subject site is located at 225 E. Fairview Avenue. DECISION The applicant's request for CZC is approved with the conditions listed in this report. Note: This is not a building permit. Please contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required Two (2) sets of the approved plans are to be submitted to the Building Department with the permit application. Site Specific Conditions of Approval 1. The site plan and/or building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. Conditions Document Rocky Mountain Collision CZC Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 4. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 5. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 2. The applicant shall comply with the specific use standards listed in UDC 11-4-3-37 for the major vehicle repair facility. 3. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site. EXPIItATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until December 6, 2011. CITY COUNCIL REVIEW The applicant, Director, or a party of record may appeal this decision or a condition of approval by requesting City Council review of this decision. All requests shall be filed in writing with the Planning Department within fifteen (15) days of the date of this report and comply with the provisions of UDC 11- SA-6B. Broadway St. Meridian, Idaho 83642 Re: Rocky Mountain Collision -Storage T.I. 225 East Fairview Ave. Meridian , Idaho Compliance with CZC Application This letter is to describe the proposed new Storage Area (338 s.f.) to be constructed as an enclosed space within the existing small Office (749 s.f. building) of Rocky Mountain Collision. The separate Office and the Repair Shop facility are shown on the Site Plan located on the "Cover sheet" of the Tenant Improvement Construction Drawings. The Shop Building is not a Part of this Application. The property was purchased by Mr. Terry Moore ,who has owned and occupied the small office building since 1995. Access to the site has utilized both of the existing curb cuts located on Second Street and East Fairview Ave. The floor plan "footprint" of the existing Office building shall remain unchanged as shown on our drawings. These drawings and applications aze respectfully submitted to both the Building Dept. and Meridian Planning & Zoning for review and staff level approval . The Tenant Improvement area consists of new non-structural exterior 2x6 stud walls that will enclose an azea previously used as an exterior use Carport. It had a completed roof structure, Class "B" roofing and an exposed plywood paint finished soffit /ceiling. Four existing surface -mounted fluorescent lighting fixtures had been previously install on the carport ceiling. The north Fairview Street Elevation of the enclosed azea will have a new 16 ft x 8 ft. high Overhead Door installed and painted off-white. The East and North walls of the Office building and upper fascia panels shall be painted red to match the existing building with dazk brown trim. The attached CD has digital photos and drawings which define how the Office Building with the Tenant Improved area would appear when completed. The land parcel is presently zoned C-G under an existing previously approved C.U. The attached small Site Plan from a previous submittal shows a retail pazking layout: The Meridian P & Z ordinance defines the required parking requirement as seven spaces. Our proposed pazking shows parking for nine (9) spaces minimum to be available and to be in compliance with the current City Zoning Ordinance. The Site shall continue to have required pazking spaces and existing necessary site drainage for the existing asphalt drive and vehicle pazking areas.
