146 Setting Time/Place of Hearing on LID No. 90-1RESOLUTION NO. 146 A RESOLUTION OF THE CITY OF MERIDIAN, FIXING THE TIME AND PLACE OF HEARING ON THE LOCAL IMPROVEMENT DISTRICT NO. 90-1, ASSESSMENT ROLL; PROVIDING THAT OWNERS IN THE LOCAL IMPROVEMENT DISTRICT MAY APPEAR AT SAID HEARING AND OBJECT TO THEIR ASSESSMENT, THE CORRECTNESS OF THE ASSESSMENT, OR TO THE REGULARITY OF THE PROCEEDINGS. THEY MAY FILE WRITTEN OBJECTIONS WITH THE CITY CLERK PRIOR TO THE HEARING OR THEY MAY FILE WRITTEN OBJECTIONS AND APPEAR AND TESTIFY AT THE HEARING REGARDING THEIR OBJECTIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Local Improvement District No. 90-1 of the City of Meridian ("LID No. 90-1") was formed by Ordinance No. 540 of the City of Meridian adopted, July 17, 1990 and a contract for the improvements therein has been awarded; and WHEREAS, Gary D. Smith, P.E. City Engineer has been appointed by the City as Engineer for LID No. 90-1 and has submitted a cost spreadsheet and pay request form showing in detail the total cost and expenses of the improvements, the dollar amount payable from assessments and from other sources, and a form of assessment roll showing the amount chargeable to each lot or parcel of property. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Meridian, as follows: Section 1. The form of assessment roll prepared by the City Engineer shah be filed in the office of the clerk of the City of Meridian where it shall be available for public inspection. Section 2. At 7 o'clock .p.m. on Mai 19.1992, the City Council shall meet in open session at the Cit,~, 3:3 East Idaho Avenue, Meridian. Idaho 83642 for the purpose of considering the report on the assessment roll and hearing all objections to the assessment roll by the property owners of LID No. 90-1. Section 3. The City Clerk shall give notice of the hearing on the assessment roll by publication in the Valley News, the weekly official newspaper of the City, in two successive issues the first such publication being not less than fifteen days prior to the hearing. The City Clerk shall also mail notice of the hearing to each owner of property, if known, or his agent if know, within the limits of LID No. 90-1 addressed to such person at his post office address, if known; or, if unknown, to the main Meridian post office. The notice required by this section shall be in substantially the followi:~g form: LOCAL IMPROVEMENT' DISTRICT NO. 90-1 CITY OF MERIDIAN NOTICE OF HEARING ON ASSESSMENT ROLL NOTICE IS HEREBY GIVEN that on May 1x,1992, at 7 o'clock p.m. the City Council of the City of Meridian will hold a hearing on the assessment roll for Local Improvement District No. 90-1 at the Meridian City Hall. 33 East Idaho Avenuer Meridian. Idaho 83642. The assessment roll is on file in the office of the City Clerk and is available for inspection by the public. At the hearing, the City Council will hear and determine all objections to the regularity of the proceedings in making assessments, the correctness of assessments, and the amount levied on particular lots or parcels in relation to the benefits accurring therein and in relation to the proper proportionate share of the total cost of the improvements in the project. Pursuant to Idaho Code "SO-1713 -Notice of Hearing on Assessment Roll", each owner of property within Local Improvement District No. 90-1 is hereby further notified that in revising the assessment roll, at or after the hearing, the City Council may increase any assessment or assessments up to twenty percent (20%) of the original amount thereof without giving further notice and holding a new hearing. Forrey,~ RE: Project Updates as of December 1, 1992. Here is the status of several ongoing items: 1. American Paving will return in March or February 1993 to repair several asphalt blemishes. Need 45 degree and rising weather conditions. 2. Federal Aviation Administration grant funds can only be used to enhance fire departments that provide primary airport protection (Gowen Field/Boise City Fire Department). However, FAA indicates that Boise could choose to include the Meridian Fire Department in air, fire and rescue training programs. Enhanced mutual aid agreement. 3. Planning Grant has been submitted. Council should know prior to December 15th (next Council meeting) if the City will be invited to submit a full application and receive funding. 4. New Tree Cirant program,. SO% management and 2U% tree planting. Oriented to funding volunteer committees. Meridian Centennial Committee is potential user. Application due December 18, 1992. 5. Ada Planning Association Demographics Committee meeting, December 2, 1992 at ten o'clock. WSF will attend and report back to the Council regarding APA growth projections. 6. Settler's Canal Piping Situation - a. Glennfield Manor developer ill n participate in funding a solution. b. Mr. Max Bosieger, Jr. will participate in funding. c. Four of sixteen affected property owners favor a LID to help fund the pipe. (in writing) d. The Glennfield Manor Property Owners Association Board does not favor a LID. e. The Settler's Irrigation District Board will not participate at this time. The chairman wants to help --- but unless the property owners participate, they do not feel obligated. For Your Consideration: One more letter to the affected property owners. Indicate the following: 1. A summary of the current situation. 2. Property owners need to deliver a petition containing at least 60°!0 of the affected property owners in favor of a LID to the City by 5:00 p.m., January 4, 1993. 3. City will reapproach Settler's with evidence of property owner financial contribution and request a firm financial commitment from the Dist. 4. If there is no LID or Settler's Irrigation District financial commitment then the City will consider the issue resolved, that is a majority of property owners do no feel the ditch needs to be covered at this time. MERIDIAN CITY COUNCIL DECEMBER 1, 1992 PAGE 6 The question was raised by the Council regarding the Fire Department and possible upgrades with FAA. We researched that out and basically FAA says the only grants can go to those Fire Departments that provide primary fire fighting to the airport, in this case Boise City, but Boise City could at their discretion use some of their grant funds to train the Meridian Fire Department in any air fire rescue techniques - that's grant eligible. So if your interested in pursuing that I think the proper way would be with probably the Mayor or the Airport Manager and Fire Department at that level to see if your Fire Department needs anything that they could provide by way of training. Item #3 - The Planning Grant has been submitted and I think we'll have an answer back from Commerce prior to your next meeting on the 15th. The next step is an invitation for a full application but that also means that your going to be funded, so it's essentially preparing the final contract documents. Item #6 - The Settlers Canal tSee tape) - Gave brief summary of status. Kingsford: Thank you. Crookston: The City has received a tort claim that really involves Western Ada Recreation District. The first name of the injured child is Aaron. Niemann: I talked to the Insurance Company yesterday and they were going to write a letter denying it. Crookston: I talked to the attorney that's handling this and told him that the City had absolutely no connection with the swimming pool at all. I think it's appropriate to go ahead and deny this. They did pay for cleaning the weeds up. We are going to have to have a environmental deal done before we can tear it down or burn it or anything else. Corrie: Can't we condemn that? Crookston: Also request Executive Session. Corrie: I would like the City Clerk to investigate a trailer house in the Golfview Estates, I think the Real Estate Group put a trailer up there to use temporarily, but what I understand is that they don't have a permit or anything. If you would find out what it is and then bring it to the Council's attention. Kingsford: Maybe Chief Gordon can take a look at just what it is and notify City Clerk to send letter. The offer that was sent out for the City to purchase the old post office was accepted, the amount was X165,000.00 this will be to relocate the Police Department. The other issue that I talked to the Council about individually because we needed to move along, was the tiling of the ditch in Glennfield and Crystal Springs. I had called you because of the fact that Max Boesiger had made that offer of the $10,000.00 to participate in the tiling. Our issue with Settlers had fallen through and the folks out there agreed to an LID and we need to have in the minutes that the Council approves of going ahead and pursuing that LID portion excepting Mr. Boesiger's gift for that and us pursuing the tiling of that ditch. The Motion was made by Yerrington and seconded by Tolsma to approve of the City going ahead with the tiling of Settlers Ditch through Glennfield, participating with the property owners on an LID there and Max Boesiger. (Explained further) This year they are saying our share due is X5,440.00 far this year. It would probably be a good idea to have some discussion as to whether or not we will agree to pay the full amount that they are asking for. Yerrington: How long have we been paying X1,000.00 a year? MERIDIAN CITY COUNCIL JANUARY 19, 1993 PAGE 8 Kingsford: Well we paid 5600.00 for probably three years and we paid 5900.00 a year for one year and 51,000.00 maybe for two or three years roughly. Tolsma: I'd be hard pressed to think we're getting 55,000.00 worth. Kingsford: I think that there's some real benefit in terms of the interaction. Tolsma: They are getting involved in more things every year and they just keep expanding and expanding and I think they have lost track of what they started out with when I first got on there. They just keep growing and taking on new things and I think they need more money to take on these new things. Kingsford: To give the Council and indication of dues. They are asking for $5440.00 and we pay, with the dues increased, Association of Idaho Cities 53200.00 for dues. Eng. Smith: I think that your statement concerning the APA Board functioning as a forum for all the City's in Ada County is very valid and very important. It does give us an opportunity at least monthly to meet with the other elected officials from the City's, from the County, from the Highway District, the School District's and so there is a good exposure. I feel it's a very worthwhile organization. Kingsford: Read a portion of letter received from APA explaining. (See tape) Crookston: I wonder if at the rate we are growing, we'll be a more significant player. Kingsford: I think that's a valid comment and I think probably all of us would say it's a very worthwhile meeting again I think it boils down to a dollar amount for me. Corrie: Could we ask them to adjust? Kingsford: Yes. Corrie: Do they want a dollar figure that we're looking at or we'll let them tell us? Kingsford: I think we should just request that it be a particular figure. Smith: Yes they have been out, in fact they called again this morning they were going back out to dig up some of their manhole covers so they could get down into that pipe and take a look. MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE it Yerrington: We have a letter from the Nampa Meridian Irrigation District requesting on the Vineyards Subdivision that they want to put in pressurized irrigation and they would like to see us waive the well fund on this one subdivision at this time. I think we should do~ this. Tolsma: Did they give you any idea when they would have that design in? Yerrington: No they didn't. The only thing I have is this letter. Clerk Niemann: I have a request from Austin Moyle who lives at 2700 N. Meridian Rd. and he wants to hook to City water. Eng. Smith: I might mention, I don't know if your familiar with where his house is located, but it sets back away from Meridian Road a fair distance, there's a long driveway that goes back to it. He owns eight acres and as part of the Meridian Road Project he negotiated with the Highway District to provide two access points into his property so that it could be subdivided at a future time. At that same time the sewer and water lines were stubbed into those access points from Meridian Road, so his intent is to develop that. I don't know how far it is from the house to the street but it's a pretty good distance. I can't remember if we provided a meter the for his house or just the stubs into this future street stub, he may have to excavate down to the water main and tap on and set a t he so that he can get a meter in place, and then dig from there up to the house with his water service line. Of course the requirements for connection to the City system in the Ada County area is the double fee for sewer and water. Giesler: Wouldn't it be premature to have him hook onto the sewer if he's figuring on developing that? Eng. Smith: I guess maybe that's what I was saying. M. here at City Hall to look at the construction bids on Phase II downtown. Presented summary to Council of Bids. I would recommend that we award the bid to Conco Construction subject to them meeting all the State and Federal Requirements and giving the Contractor the opportunity to proceed to construction or formerly withdraw. In that's the case then we would ask for a forfeiture of the 10X bid bond, put that back into the budget then proceed to the next lowest bidder which would be Barton Construction. Crookston: How are we going to come up with the difference between the X136 - the forfeiture of the bond is X11,144.00 that doesn't - - Forrey: We have two other options to address that. This is the least amount of LID, we have a chance of increasing that. The second option is we've got the land acquisition budget, we've got a small budget for construction of a parking lot and we've the demolition budget, so we've got three other budgets we can shift funds out of and into the construction fund. Kingsford: It would be my recommendation that we go ahead and award the bid to Conco Construction and proceed in those recommendations one, two and three in those steps. The Motion was made by Corrie and seconded by Tolsma to award the bid to Conco Construction subject to meeting all the requirements, if Conco Construction fails to sign the required contract documents, secure forfeiture of the 10X bid bond and transfer that to the project and proceed to the next low bidder which is Barton Construction. Idaho Power just installed poles out there and I have heard that they are planning on constructing a major building out there and I would like to ask the Council's support in asking the building inspector to deny them a building permit until we get this problem resolved, if he comes forward with an application. In May of 1992, notices were sent for the assessment on this LID. Property owners could pay their assessment in full by July 20, 1992 or make ten annual installments. The first installment would be due in June 1993. Jack Sweet received his notices and felt that one of the assessments was too high. His concern and a copy of this assessment was given to the City Planner, for review. Jack would pay this assessment when the review was completed. The 1994 notices were due out in May and all unpaid notices were given to the Mayor & City Clerk. Three of the LID's were reviewed in June of 1994 and Jack Sweet's was revised to the now stated amount. Delinquency charges for the last two years have been annulled. The City's sidewalk construction price of $10.20 does not include the cost of concrete demolition. We understand that you personally hired a separate contractor to demolish your sidewalk. Therefore, we have used the sidewalk construction price of $10.20 to give you an accurate cost for improvements. This is the same cost the City paid for a new sidewalk construction. The revised field measurement indicate 35.5 square yards of constructed sidewalk and 8.9 square yards of constructed brick pavers. The revised measurements and corresponding costs have been updated in our computer records, and we have lowered your total add-on project cost. The City's sidewalk construction price of $10.20 does not include the cost of concrete demolition. We understand that you personally hired a separate contractor to demolish your sidewalk. As I mentioned in a previous e-mail to you, she has not called me with any concerns on this wall replacement either, as she had related to you. We have paid the contractor for his work, an amount slightly more than $2000 and I don't have anything else to talk to her about on this matter. I don't know what ACHD's issues are since a permit was not required by them to replace the wall, which was acceptable to them when the street was rebuilt a number of years ago. The replacement of this wall has addressed the property owners issue of instability and their concerns of the openings in the top of the original block wall. If she needs to talk to her attorney that is her perogative. In that regard I would suggest that her attorney talk to our city attorney. The LID bill is due and she needs to pay it.
