144 City Excessive Force Policy MERIDIAN CITY: BY ATTEST: JACK NIEMANN RESOLUTION NO. 144 CITY EXCESSIVE FORCE POLICY A RESOLUTION DF THE CITY COUNCIL OF MERIDIAN, IDAHO, ADOPTING A POLICY PROHIBITING THE USE OF EXCESSIVE FORCE AGAINST NON-VIOLENT CIVIL RIGHTS DEMONSTRATDRS. WHEREAS, the Congress of the United States has passed the Armstrong/Walker "Excessive Force" Amendment tP.L.101-144 section 519) prohibiting the use of excessive force by a local law enforcement agency against any individuals engaged in nonviolent civil rights demonstrations within its jurisdiction; AND WHEREAS, the City of Meridian has received a Community Development Block Grant and is required to comply with the Armstrong/Walker "excessive force" Amendment; AND WHEREAS, the use of excessive force against demonstrators may cause the CITY to lose its grant or eligibility for future federal grants; NOW THEREFORE, BE IT RESOLVED BY 7HE MAYOR AND COUNCIL OF THE CITY OF MERIDIAN, IDAHO: Section i. It is the POLICY of the CITY that excessive force by local law enforcement agencies shall not be used against individuals engaged in lawful and non-violent civil rights demonstrations within the City boundaries. Section 2. The City Council directs the Police Chief to implement this Resolution by amending applicable police department procedures. AMOUN7 OF FEES ESTABLISHED HEREUNDER MAY ~tE .INCREASED FKOM YEAR TO YEAR TO ADJUST FOR 7HE CONSTRUCTION COST INDEX, THE CDNSUMER PRICE INDEX, THE PREVAILING LAND PRICES FOR A WELL SITE, AND OTHER ADJUSTMENTS THAT ARE NECESSARY; AND ESTABLISHING THE DATE THAT SUCH FUNDS MUST BE PAID TO THE CITY IF THE SUBDIVIDER I5 TO TAKE ADVANTAGE OF THE WAIVER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 11-9-606 B. 14, of the Revised and Compiled Ordinances of the City of Meridian requires that each subdivider of land provide by underground tile, or other like satisfactory ~_inderground conduit, pressurized irrigation water to each and every lot within the subdivision; WHEREAS, Section I1-9-606 R, of the Revised and Compiled Ordinances of the City of Meridian authorizes the City Council to waive the above req~.iirement for two reasons, one of which is depositing with the City sufficient funds, or portions thereof, to purchase a well site, drill a well, purchase all necessary equipment including pumps, piping, valves, pressure equipment and all other necessary equipment and to put the well on line with the City domestic water system; WHEREAS, an average well in the City of Meridian pumps 1, 1;8,000 rlallons per day or 800 gallons Rer" minute, which on the average, will provide water for 800 residential homes and lots; one gallon of water per minute will provide an average daily flow to serve one residential Iot and household; the average monthly summer use in Cherry Lane Village in Rugust is 48,390 gallons and
