Re: Development Agreement Modification -Volterra Subdivision
To Whom It May Concern:
On behalf of Primeland Investment Group, LLC and Primeland Development Company,
LLP; we are submitting this request to modify the development agreement governing the
Volterra Subdivision. The details associated with this request are outlined below:
1. Bews Family Limited Partnership and Primeland Investment Group, LLC
are the current owners of the property which is being affected by the
proposed modification. They are the successors to the original parties to
the agreement.
2. The Original Development Agreement was approved by the City of
Meridian on 17 February 2006 and was recorded on March 7, 2006 as
instrument number 106034786.
4. The "Second Amendment to Development Agreement" was approved by
the Meridian City Council on May 26, 2010 and recorded on June 3, 2010
as instrument number 110051282. The Second Amendment to
Development Agreement removed approximately 111 acres from the
Original Development Agreement and created a new development
agreement for this area.
We would like to modify the Original Development Agreement as outlined below:
Paragraph 3.4 "PROPERTY": means and refers to that certain parcel(s) of
"Property" located in the County of Ada, City of Meridian as
described in Exhibit "A", as modified by the "Second
Amendment to Development Agreement described above,

Paragraph 6 CONDITIONS GOVERNING DEVELOPMENT OF
SUBJECT PROPERTY:
6.1 "Owners" and/or "Developer" shall develop the "Property" in
accordance with the following special conditions:
1. That prior to approval of the 200th 9th residential lot
(including Volterra and Volterra South), the 10.2 acre park (James
Park) shall be constructed.
2. That the park shall include the proposed swimming pool and
restrooms, the water feature (fountain), and the tot lot.
3. That prior to approval of the 400th 9th residential lot
(including Volterra and Volterra South), the proposed 3 acre park
south of McMillan Road shall be constructed.
4. That the park shall include the proposed plaza area and
playground equipment.
5. That all buildings within the L-O and C-G zones contain
architectural features and bulk building concepts that will be
subject to the City of Meridian's ordinances in affect at the

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
