These trees are proposed approximately 30-feet north of the southern property line, as shown on the attached Final Plat Landscape Plan. ACHD proposes that these trees be relocated to the planter strip as shown on the attached ACRD Construction Drawings. The intersection of E. McMillan Road & N. Locust Grove Road is scheduled to be reconstructed and widened starting in the fall of 2010. This will require the Lemp Canal to be relocated to the north side of E. The specific code we are requesting deviation from is Title 11, Chapter 3, Article B-7. Strict adherence to these requirements is not feasible for the following reasons: 1) The intersection of E. McMillan Road & N. Locust Grove Road is scheduled to be reconstructed and widened starting in the fall of 2010. This will require the Lemp Canal to be relocated to the north side of E. The trees are to be planted within a planter strip located between the detached sidewalk and the new roadway. This will allow the property owner to meet the intent of the ordinance, while allowing the necessary expansion of E. McMillan Road for the installation of a new traffic signal.
