SUBJECT: TE-10-026 -Blackstone Subdivision No. 2
1. APPLICATION SUMMARY
The Applicant, Landmark Planning, has requested approval of a time extension to obtain the City
Engineer's signature on a final plat for Blackstone Subdivision No. 2. The Applicant has been unable
to meet the time requirements specified in Unified Development Code (UDC) 11-6B-7. The applicant
attributes the delay to the downturn in the real estate market.
2. STAFF RECOMMENDATION
Staff recommends approval of a 24 month time extension to obtain the City Engineer's signature on
the final plat for Blackstone Subdivision No. 2 to expire on October 1, 2012.

5. PROCESS FACTS
A. The subject application is a request fora final plat time extension. Per Meridian City Code, a
public hearing is required before the City Council on this matter.

6. LAND USE
A. Existing Land Use(s): A vacant residential lot zoned R-8.
B. Character of Surrounding Area and Adjacent Land Use and Zoning:

C. History of Previous Actions:
The subject site was platted as Lot 5, Block 1, with the Blackstone Subdivision (fka.
English Gardens Subdivision).
7. UNIFIED DEVELOPMENT CODE
Per UDC 11-6B-7A, approval of a preliminary plat shall become null and void if the applicant fails to
obtain the City Engineer's signature on the final plat within two (2) years of the approval of the
preliminary plat.
Per UDC 11-6B-7C, upon written request and filing by the applicant prior to the termination of the
allowed time period, the Director may authorize a single extension of time to obtain the City
Engineer's signature on the final plat not to exceed two (2) years. Additional time extensions up to
two (2) years as determined and approved by City Council may be granted. With all extensions, the
Director or City Council may require the plat to comply with current provisions of the UDC.
8. STAFF ANALYSIS
On February 17, 2009, an 18-month time extension was granted by the Director but has now expired.
Thus, the applicant is requesting another approval of another extension by City Council. The
Applicant has met the necessary deadline by filing a written request for a time extension before the
final plat expired.
A development agreement (DA) for this project was approved that limited the number of home sites
to three and bound elevations to the DA. The approved elevations are attached as Exhibit A.3 below.
Staff is of the opinion that the recorded DA adequately addresses future development (density and
design) of the site. Therefore, staff is not recommending any new conditions of approval with the
subject application. The applicant shall comply with all previous conditions of approval for this site.

SITE SPECIFIC CONDITIONS
1. The applicant is to meet all terms of the approved rezone (RZ-07-023), development agreement (Inst.
#108059796), preliminary plat/final plat (PFP-07-004).
2. The applicant shall have 24 months, until October 1, 2012, to obtain the city engineer's signature on the
final plat, satisfy the applicable requirements set forth in the conditions of approval, and begin the process
of acquiring building permits and commencing construction of permanent footings or structures.
