Dear Mayor and City Council,
Relating to the Development Agreement issue for the Normandy Subdivision, the Development
Agreement for the property was not required by staff with the original application submittal since
Development Agreements for building elevations were not "standard" at that time in 2006. Even so, the
original application did include proposed Building Elevations. The Development Agreement
requirement came as a recommendation of approval by City Council at the annexation, rezone, and
preliminary plat hearing in March of 2007. The original applicant did not follow through on the
Development Agreement requirement since the economic conditions did not warrant any work on the
Final Plat/Development Agreement after the Preliminary Plat approval. Since no Final Plat work has
been initiated at this time, the Development Agreement has been left unfinished. We apologize for any
inconvenience.
On behalf of the Property Owner, James Patterson, we wish to keep the approvals received in 2007 to
provide the best marketability for the property. As such, we wish to follow through with the
Development Agreement requirement within 60 days of the Time Extension approval as Staff
recommends, however, we would respectfully request a waiver of the Development Agreement Fee
since the Development Agreement condition was made 1 year prior to the City of Meridian establishing
a fee for Development Agreements. In these tough economic conditions, and with the amount of money
spent on the original application and 2 extensions, we would appreciate the waiver. We look forward to
discussing the application further on November 3rd.

No problems with the Staff Report. We will be asking for a waiver of the DA Fee since when it was
