The site is located on the North side of E. Magic View Cir approximately one-half of a mile West of S. Eagle Road. The site is annexed into the City of Meridian. The site is bounded by Snorting Bull Sub Phase 2 to the West; Greenhill Estates Sub Phase 2 to the North and Magic View Sub Amd to the South and East. The applicant in requesting a map amendment of 4.83 +/- acres from Light Office (L-0) to Medium - Density Residential (R-8) in order to provide a high-quality, residential development that can be considered complimentary to the established homes to the North and West while providing transitional land use between those lower density properties and future light office developments to the South and East as identified on the Comprehensive Land Use Map. An application for a rezone to R8, Preliminary Plat, Conditional Use Permit and Final Plat for this site will also be filed with the City of Meridian Planning and Development Services concurrently with this application. Prior to making application, the property was approved by City Council on February 271h, 2007 for Annexation, Zoning from RUT to L-0; Preliminary Plat for 6 multi -family residential buildings lots, 4 common lots, and Conditional Use Permit for 24 multi -family dwelling units in a proposed L-0 zone known as Waverly Place Subdivision. (see Case No(s) AZ -06-047, PP -06-049, & CUP -06-030). Developmental improvements such as streets, sidewalks and underground utilities are substantially complete with the exception of pressurized irrigation pump station upgrades, 0 0 perimeter fencing, common lot landscaping and amenities. The Final Plat was not recorded and currently the project remains incomplete and vacant. My Client has recently purchase the property with intentions of completing the development improvements as well as constructing 25 residences as opposed to 6 four-plex units utilizing the existing streets and utilities in the same configuration as the previously approved applications and plan. The current zoning and approvals will be substantially met, however ,do not allow individual platting of land for each residential unit. It is felt that townhouse and/or homes on individual lots would be more attractive than four-plexes due, in -part, to individual front and backyards and only vertically shared walls rather than vertically and horizontally shared walls/floors which reduces noise between neighbors as well as provides better fire separation. It is further understood that "end user" mortgage requirements are less restrictive when units are situated on their own parcel rather than "condoed", thus providing better housing opportunities for all income levels. The development is proposing a density of 5.2/AC and 13.7% open space (0.47 AC "usable"). See attached Waverly Concept Sketch. While the City of Meridian Comprehensive Plan Land Use Map calls out the site to be "Light Office", the argument can and should be made that current property approvals allow for residential development and provide for an appropriate transition between the existing R-1/11-4 subdivisions and future Light Office developments (currently undeveloped). There are several goals and policies within the Meridian City Comprehensive Plan that we believe this development encompasses. These are outlined below: Chapter VII - Goal IV: Encourage compatible uses to minimize conflicts and maximize land use. Objective A: Address conflicts with compatible uses and impact areas Action 6: Require screening and buffering of commercial and industrial properties and residential use with transitional zoning: Response: This development abuts two existing R-1 and R-4 subdivisions and would function as transitional zoning between them and future commercial developments Objective C: Encourage residential infill to utilize existing services. Action 1: Protect existing properties from incompatible land use development on adjacent parcels. Action 9: Adopt land use designations which will allow for housing opportunities for all income levels. • • Response: This development will utilize existing city services and provide further transitional zoning between the current R-1 and L-0 while adding housing diversity in the immediate area that is needed. Chapter VII - Goal V: Offer a diversity of housing types for a greater range of choice. Objective A: Encourage quality housing projects for all economic levels in a variety of areas. Response: This property is currently approved as a suitable residential development While the Meridian City Comprehensive Plan land use map calls out the site to be Light Office, the argument can and should be made that there are Comprehensive Plan goals that allow for flexibility. Idaho Ave. Meridian, Idaho 83642 RE: Waverly Place Subdivision Preliminary Plat and Zone Change — Letter of Intent Dear Mayor and Council, As representative for Mountain West, please accept this application for Waverly Place Subdivision, located at 2510 E. Magic View Drive, approximately 1/3 mile west of Eagle Road in Meridian, Idaho. This application includes a preliminary plat for 28 lots (24 residential, 4 common) and zone change from L -O to R-8. The property contains 5.17 acres and is currently constructed with improvements including streets and utilities. The property was previously approved for multi -family residential development, but was'abandoned prior to final plat recordation. A comprehensive plan amendment for the property has been submitted to the City of Meridian and is waiting to be combined with this current application. This letter is included with the land use application for preliminary plat and zoning, together with filing fees and various exhibits. The enclosed applications have been submitted in accordance with the requirements of the Meridian City Unified Development Code. The submitted preliminary plat has been designed in compliance with the UDC, therefore, this application does not include a request for variance to any sections of the Code. On March 13, 2007, the property was approved for 24 multi -family units (6 four-plexes) and an L -O zoning designation (AZ-06-047/PP-06-049/CUP-06-030). Prior to recording the final plat, however, the downturn in the residential market forced the previous developer to put the project on hold. Entitlements subsequently expired and the property has been sitting vacant ever since. This newly submitted development would include 24 lots with attached, individually owned townhomes in clusters of two sharing a common property line. An R-8 zoning designation is being requested with the rezone application, with the subdivision plat containing four (4) additional common lots that will contain open space and amenities that include a clubhouse and landscaped open area. The clubhouse is designed to include a caretaker/property manager unit in the upstairs portion of the building. A public, loop -street has already been constructed to provide access and frontage to all of the lots within the development. The street was constructed, along with curb, gutter and sidewalks, to Ada County Highway District and Meridian City standards. Drainage will be handled by on-site detention areas and will be designed to the standards of all appropriate regulatory agencies. A pressure irrigation • • system has been constructed as part of the original development, providing irrigation for all lots within the development. The density for the project remains at 4.64 dwelling units per acre, the same density approved under the original development plan. The comprehensive plan amendment is necessary in order to bring the zoning designation back in line with the residential use that was originally approved, and has been constructed on the site. At the time of the original approval, office, commercial and residential met the original intent of the current zone and comprehensive plan. Since that approval, however, the L -O zoning designation has gone through some changes, most notably, the removal of multi -family uses. It is understood that the Council was reluctant to change the comprehensive plan designation for a property immediately south of this development, several years ago. It should be pointed out that the original applicant's justification letter spoke of their special efforts to "submit a development plan that would require no amendment to the Meridian Comprehensive Plan". The new applicant is confident that the original intent of the property exists in this new application request. The applicant believes that this higher density residential use is the perfect transition from the existing Woodbridge development west of the property, to the office and commercial uses that exist, or are planned for the area east of the property. In analyzing the land uses across the square mile from Locust Grove to Eagle Road and the Interstate north, this area is shaping into a well planned multi -use development that contains a mixture of uses from low and medium density residential uses (R-1, R-2, R-4 and R-15) to office and commercial uses (L -O, CG) that include professional, financial and service/retail (hotels, gas station/C-store, restaurants). The new development provides for a diverse mixture of residential uses in the general area that compliment the other, non-residential uses. This is a concept that has been well received by many of the homeowners adjacent to the site. In conclusion, Waverly Place Subdivision will be a quality addition to the City of Meridian. Its close proximity to the medical and professional uses nearby, in addition to the I-84 corridor, make it a perfect location for the non -typical single family development. Aikens St., Suite B Eagle, ID 83616 RE: Preliminary soil information for Magic View Subdivision site You requested soils information for Lot 6 of the above referenced subdivision located in the Northwest 1/4 of the Southwest 1/4 of the Northeast 1/4 of Section 17, Township 3 North, Range 1 East. I have scheduled Friday morning, March 17 to excavate and describe a test hole on the site. To provide you with some initial data, I consulted the Ada County Area Soil Survey. Map sheet 18 shows that the entire area of Lot 6 is located in 4 delineation of map unit 178. The soil map unit name is Tindahay fine sandy loam, 0 to 2 percent slopes. The Soil Survey indicates that thesejare deep, well drained soils on alluvial fan terraces. This matches the landscape position of the Mountain View site. The interpretative tables for map unit 178 indicate that groundwater is below a depth of 72 inches and there should be no significant limitations to development of the site. The typical profile is sandy loam to a depth of about 3 feet over loamy sands and sands with varying amounts of gravel and cobbles that extends to more than 72 inches. If the onsite profile matches that of the published soil survey, there should be virtually no soil related problems with the site. Once we have completed the field investigation, I will provide you with a complete report of the onsite conditions.
