Dear Sonya, Bach Investments is requesting a development agreement modification and conditional use modification for the Regency at River Valley Apartment project, which is located at 2500 N. Eagle Rd. The changes which are being proposed to the conditional use permit and the development agreement which was approved by City Council on June 17th, 2008 and recorded with ADA County on December 12th 2008, instrument number 108131099 are as follows: Changes that affect either or both the Development Agreement and the conditional use permit are: • 5.1.a -Change in the number of apartment units from 204 to 240. • Change the site plan from 10 buildings to 9 buildings. • Change the buildings from 3 story height to 4 story height. • 5.1.b -New floor plan and elevation for the clubhouse. • 5.1.f -Increase the number of parking stalls to accommodate the additional apartment units. • 5.1.q -Eliminate the 6' chain link fence next to the South Slough, now that the slough pipe has been installed. • 5.1.s -The South Slough was piped in 2009, which negates the need for a bridge. We will replace the bridge with a public pathway in accordance with the Parks Department. • Minor changes in site plan, landscaping and building elevations. We respectfully request that these changes be approved to the development agreement and conditional use permit. Upon approval of the changes, we anticipate a construction start date of spring 2011.
