Kings or Ma or rctSOL' UTION ' N0: ' 108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MERIDIAN, IDAHO, PROVIDING FOR THE CONDITIONAL ANNEXATION AND ZONING OF A PORTION OF LOT 7, SECTION 6, TOWNSHIP 3 NORTH, RANGE 1 EAST, BOISE MERIDIAN, ADA COUNTY, IDAHO. WHEREAS, the owners of the land described in Exhibit "A" attached hereto and by this referrence incorporated herein as if set forth in full, and hereafter referred to as the "PROPERTY", have consented to the request by C & 0 Construction that the City of Meridian annex and zone their property; WHEREAS, it has been requested by the Applicant that the property be zoned (R-40) High Density Residential; WHEREAS, the City has fully processed the annexation and zoning request and has prepared and adopted the Findings of Fact and Conclusions pertaining to said annexation and zoning; 358 WHEREAS, it is not in the best interest of the City to finally annex and ~zo~e the property until such time as actual development is imminent and apparent; WHEREAS, it is likely development would not occur if possible lenders and builders are not assured of municipal services; WHEREAS, the action of annexation by a City is a legislative function and thus may be conditioned upon certain events or occurrances; and WHEREAS, pursuant to Section 50-222, Idaho Code, annexatior~~can only be accomplished by means of approval and passage of an ordinance; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, IDAHO: Section 1. That upon meeting the following conditions and requirements the City of Meridian shall finally annex and zone, by ordinance, the property, which conditions and requirements are as follows: a. Amendment to the zoning ordinance allowing R-40 development outside of the OLD TOWN area; b. Receipt of a conditional use permit for development of a planned unit development and R-40 development for the property; c. That the applicant and property must meet the development time requirements set forth in Section 11-g-916 or be subject to having this resolution repealed; and d. The Applicant and property must comply with the Ordinances of the City of Meridian. Section 2. That upon final annexation and zoning by Ordinance the property will be subject to site planning review which shall specifically include adequate access to the parcel for the intended use and meeting the planned unit development guidelines found in the Zoning Ordinances and the Comprehensive Plan and stated in the Findings of Fact and Conclusions of Law. Section 3. That the property shall be deemed to have been annexed and zoned subject to conditions precedent which shall be those set forth in Section 1 & 2 above. Section 4. That if the property is finally annexed by Ordinance, the terms and conditions set forth in Section 1 & 2 shall both be attached to the property and shall be personal to the Applicants or any Developers; that the above terms and conditions shall survive the passage of this resolution and any annexation and zoning ordinance. Section 5.
