1981-077 Water/Sewer District Opposition486 RESOLUTION N0. 77 A RESOLUTION SETTING FORTH THAT THE CITY OF MERIDIAN IS IN OPPOSITION TO THE ORGANI- ZATION OF THE MERIDIAN SEWER AND WATER DISTRICT, ADA COUNTY, IDAHO, AND THAT ALL ACTION NECESSARY TO RESIST ORGANIZATION OF SAID DISTRICT SHALL BE TAKEN. WHEREAS, a special meeting of the City Council of the City of Meridian was held pursuant to notice to hear the presentation of the Meridian Sewer and Water District and its affect and impact upon the City of Meridian; WHEREAS, Jim Potter, spokesman for the Organization Committee of the Meridian Sewer and Water District did present a statement and answered questions of the Mayor and the City Council; WHEREAS, almost two-thirds (2/3) of the proposed District is within the confines of the City Limits of the City of Meridian; WHEREAS, the City, having duly questioned the impact of the proposed District on the City of Meridian, and the Mayor and the City Council believing and finding that the proposed District would not be in the best economic interest of the City; that the proposed District may have a detrimental impact upon the structured planning and growth of the City; may create grave financial. difficulties with the ability of the City to pay off its bonds incurred to finance the City of Meridian water and sewer expansion; that the District cannot operate, as proposed, without the City of Meridian treating the sewage effluent from the District, in that the District does not propose to have its own treatment facility; that the City has jurisdiction over at least two-thirds (2/3) of the land area within the proposed District; that much of the remaining area of the proposed District is within the ~l Urban Services Planning Area of the City of Meridian and/or the City of Meridian's Area of Impact; that the City of Meridian has adopted a Comprehensive Plan which includes much of the land area within the proposed District and should have complete control of the sewer and water plans in that area; and that all of the land area in the proposed District, which is within the City Limits of the City of Meridian, was annexed at the request of the owner, based upon the owner's full knowledge and agreement that the owner or developer of the property would be required to connect to the City of Meridian water and sewer at the sole expense of the owner or developer and not at the expense of any taxpayer through taxes, NOW, THEREFORE, BE TT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF MERIDIAN, IDAHO to take all action necessary to object to and stop the creation of the Meridian Sewer and Water District, and to direct its City Attorney to effect this Resolution in "In the Matter of the Organization of Meridian Sewer and Water District, Ada County, Idaho, Case No. 75488, Fourth Judicial District, Ada County, Idaho".
