Clearwire Meridian Charter HS~P.~ ~~ CERTIFICATE OF ZONING COMPLIANCE REPORT DATE: TO: FROM: SUBJECT: OWNER: September 10, 2010 Clearwire US, LLC E IDIAN~-- tQAHO Sonya Wafters, Associate City Planner CZC-10-057/ALT-10-007 - Clearwire Meridian Charter High School Joint School District No. 2 DESCRIPTION OF APPLICANT'S REQUEST The applicant, Clearwire US, LLC, requests Certificate of Zoning Compliance (CZC) approval to replace an existing light pole with a new 80-foot tall wireless Internet facility at Meridian Charter High School. Alternative Compliance (ALT) is also requested to UDC 11-4-3-43F.5 which requires a 5-foot wide landscape buffer to be constructed outside the perimeter of the equipment compound at the base of the tower. The site is located at 1789 E. Heritage Pazk Lane. DECISION The applicant's request for CZC and ALT is approved with the conditions listed in this report. Note: This is not a building permit: Prior to any construction, you should contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required If a building permit is required, one (1) set of the approved plans is to be submitted to the Building Department with the permit application. Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. Process Conditions of Approval 1. Per UDC 11-SB-SB2, the Director (at the applicant's request) approved alternative compliance to UDC 11-4-3-43F.5 regazding the requirement fora 5-foot wide landscape buffer to be constructed outside the perimeter of the equipment compound at the base of the tower. See Analysis below for more information. 2. No signs aze approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 3. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement maybe accepted for other improvements in accord with UDC 11-SC-3C. 4. The conditional use may only be transferred or modified consistent with the provisions as set forth in UDC 11-SB-6G. The applicant shall contact Planning Department staff regarding any proposed modification and/or transfer of ownership. 5. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. The site plan prepared by Architecture Designs Plus, P.A. on 9/10/2010, labeled A-1.0, is approved (stamped "approved" on 9/10/2010 by the City of Meridian Planning Department) with no changes. 7. The landscape plan prepazed by Architecture Designs Plus, P.A. on 9/10/2010, labeled A-2.1, is approved (stamped "approved" on 9/10/2010 by the City of Meridian Planning Department) with no changes. 8. The approved site plan, landscape plan and/or elevations may not be altered without prior written approval of the City of Meridian Planning Department. 9. The elevations prepazed by Architecture Designs Plus, P.A. on 6/11/10, labeled Sheets A-2.0, A-3.0, and A-4.0 aze approved (stamped "approved" on 9/10/10 by the City of Meridian Planning Department) with no change. 10. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 11. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standazds as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CUP-10-003). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a m;n;mum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-1 L 6. The applicant and/or assigns shall have the continuing obligation to meet the specific use standards for the proposed use as set forth in UDC 11-4-3-43. ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS: Per UDC 11-4-3-43F.5, a 5-foot wide landscape buffer is required to be constructed outside the perimeter of the equipment compound at the base of the tower. In locations where the visual impact of the tower is minimal, the Director may waive this requirement through the alternative compliance process in accord with UDC 11-SB-5. The applicant requests approval of Alternative Compliance to this requirement. Due to the small lease area within the planter island there is not adequate azea on the north and south sides of the equipment compound to provide the required buffer. There is adequate azea for the buffer on the east and west sides and a buffer will be constructed on those sides as required. The Director has approved this request. Conditions Document Clearwire Meridian Charter High School CZC ALT cITY couNCit, REViEw The applicant, Director, or a party of record may appeal this decision or a condition of approval by requesting City Council review of this decision. All requests shall be filed in writing with the Planning Department within fifteen (15) days of the date of this report and comply with the provisions of UDC 11- SA-6B. EXPIRATION Certificates of Zoning Compliance issued in conjunction with a proposed use shall expire if said use has not commenced within one yeaz of the date of issuance of the Certificate of Zoning Compliance. Certificates of Zoning Compliance issued in conjunction with construction or alteration of a structure shall expire if said construction or alteration has not commenced within one year of the date of issuance of the Certificate of Zoning Compliance. For this very reason ClearWire US LLC is requesting a Certificate of Zoning Compliance for a new wireless Internet location that will be built on property owned by the Meridian School District. An existing light pole will be replaced and a new stealthed tower will be erected in its place. Clearwire's radio engineers have identified capacity issues in the area due numerous customers use of the system. Propagation Maps showing the poor coverage have been submitted along with this application. Existing Clearwire sites do not properly cover this area. Currently ClearWire does not have adequate coverage in the area to support its customers growing needs and demands. Clearwire's radio engineers have selected this proposed location to better support its customer's needs. ClearWire strives to have seamless coverage throughout its network, and this area is not seamless. The site was selected because of its central location to this area of the capacity issue and has the best potential of resolving problems in the area. ClearWire is receiving an increasing number of complaints from their customers and feel it is time to address this coverage issue. Continuous coverage at the highest quality of speed is of major importance for Clearwire's business model. Clearwire is proposing this facility as a new facility as there are no existing structures within the search area. The closest existing wireless telecommunications facility is located behind the Fred Meyers on Locust Grove and Cherry Lane. Clearwire is currently serving on this Clearwire US LLC 104 N. Milwaukee Road Boise, ID 83704 (208) 866-7725 -Office (208) 441-5836 -Fax u.~. ~... tower, and has expanded the site as much as possible. The existing tower is structurally at its capacity and no expansion can be done on this existing site. Clearwire strives to co-locate on as many existing structures as possible, but in this case this is not applicable as there are no existing structures within the search area. The equipment will be placed on the ground adjacent to the light pole and will be fenced off from access to the public. In 1992, ANSI adopted the 1991 IEEE standard as an American National Standard (a revision of its 1982 standard) and designated it ANSI/IEEE C95.1-1992. In 1996, the FCC adopted a modified version of its original proposal. The FCC's action also fulfilled requirements of the Telecommunications Act of 1996 for adopting new RF exposure guidelines. The FCC considered comments submitted by the EPA, FDA, NIOSH and OSHA, which have primary responsibility for health and safety in the Federal Government. The FCC's guidelines are based on recommended exposure criteria issued by the NCRP and ANSI/IEEE and are similar to the ANSI/IEEE 1992 guidelines except for differences in recommended exposure levels at lower frequencies and higher frequencies, and for controlled and uncontrolled access areas. Over a broad range of frequencies, NCRP exposure limits for the public are generally one-fifth those for workers in terms of power density. The NCRP and ANSI/IEEE exposure criteria are frequency dependent since the whole-body human absorption of RF energy varies with the frequency of the RF signal. The most restrictive limits on exposure are in the frequency range of _.. ,„.....„._..._30-300_._MHz where, the,..human,. bod.y,, absorbs RF energy._most._efficiently when_ exposed in the far field of an RF transmitting source. The exposure limits adopted by the FCC in 1996 are shown in Appendix 1. The NCRP and ANSI/IEEE exposure criteria and most other standards also specify "time-averaged" MPE limits. This means that it is permissible to exceed the recommended limits for short periods of time as long as the average exposure (over the appropriate period specified) does not exceed the limit. For example, Appendix 1 shows that for a frequency of 100 MHz z the recommended power density limit is 1 mW/cm with an averaging time of six minutes (any six-minute period) for occupational/controlled exposure. The Clearwire proposed transmitters operate in the FCC EBS/BRS services and broadcast in the 2500 - 2690 MHz frequency range. In addition, there may be additional point-to-point microwave transmitters operating between 5 and 23 GHz (see Table 1).
