CONTENTS OF CONDITIONAL USE APPLICATION
An-application for a conditional use permit shall be filed with the Administrator
by the owner of the property for which such conditional use is proposed. At a
minimum, the application shall contain the following information:

2. Name, address and phone number of owner of subject property;
3. Legal description of property;
4. Proof of ownership of subject property (warranty deed) and notarized
consent of property owner;
5. Description of existing use;
6. Present use of subject property;
7. Proposed use of the subject property;
8. The District (present zoning) that pertains to the subject property;
9. Thirty (30) copies of a vicinity map of a scale of one inch equals three
hundred feet (1 " = 300');
10. Characteristics of subject property which make a conditional use desirable;
11. A listing of the mailing addresses of all property owners (from authentic
tax records of Ada County) who are within three hundred feet (300') of
the external boundaries of the land being considered, and a list of all
owners within the area being considered for a conditional use;
12 A fee established by the Council; $275.00 + $1.42 each ~ for certified
mailings for each property owner listed within the 300 feet =Total Fee
13. . A statement that the applicant or user of the property agrees to pay any
additional sewer, water or trash fees or charges, if any, associated with the
use, whether that use be residential, commercial or industrial; and
14. The application shall be verified by the applicant which shall state that he
has read the contents thereof and verifies that the information contained
therein is true and correct.
15. The property will be posted 1 week before the hearing stating they have
applied for a Conditional Use Permit or Zoning. There must be a signed
affidavit that this will be done as part of the application.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meridian and
the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of
Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:00 p.m., on January 16, 1997, for the purpose of
reviewing and considering the Application of Raymond Chace, for a Conditional Use
Permit for land located in the W 1 /4 corner of Section 7, T.3N, R.1 E, Boise Meridian, Ada
County, Idaho, and which property is generally located at 1302 East First Street. The
Application requests a Conditional Use Permit for a Child Care Center for 12+ children.
Amore particular legal description of the above property is on file in the City Clerk's
office at Meridian City Hall, 33 East Idaho Street, and is available for inspection during
regular business hours.
A copy of the Application is available upon request. Any and all interested persons
shall be heard at said public hearing and the public is welcome and invited to submit
testimony.

Chace: Would you like me to offer a brief syropsis. We put in an offer to purchase the
property at 1302 East First Street. The City of Meridian requested the conditional use
permit for a child care center for 12 or more children. I sit on the board of directors of
the parent company and we have reviewed the comments from the engineer, the
planning director, the fire department. I personally attended the ACHD hearing and
reviewed the district health and welfare comments and irrigation questions and the
proposal. 1 am prepared to answer any questions you have. This is the last hurdle I
believe before the purchase contract is corr~ieted.

Morrow: Mr. Mayor, you are in agreement then with all of the staff conditions and you
have no problem with complying with any of those?
Chace: Yes sir and no we don't have any problem complying.
Corrie: Thank you Mr. Chace. Council, have you had a chance to read the findings of
fact and conclusions of law, any questions? .
Stiles: Mr. Mayor and Council, I had a question on page 10, item G. The last part of
that statement. It says °a conditional use should not be restricted to a period of
authorization but may be reviewed annually upon notice to the applicant for violation of
any conditions imposed herein and in other day care conditional uses and other
conditional use applications." I guess I just didn't understand if they are going to have
to abide by conditions placed on other conditional use permits. Should, the previous
one had that comment in it too, I wonder if it should be stopped at herein.

Crookston: That would be fine.

Crookston: It would be herein, in the fourth line, period the end.

Johnson: 1 will now open this pubic hearing and invite the applicant or the
representative of the applicant to address the Commission.
Raymond Chace, 586 W. Criterion, Meridian, was sworn by the City Attorney.
Chace: We have put in an offer to purchase the property at 1302 E. First Street, City of
Meridian and request the conditional use permit for a child care center for 12 or more
children. I sit on the Board of Directors of the parent company, we have reviewed the
comments from the City Engineer, the Planning Director, the Fire Department. I
attended the ACRD hearing and have reviewed the Central District Health and the
irrigation questions in the proposal. We are prepared to comply with all of the facts and
findings in the outline and comments. Which specifically I should probably address.
The driveway, we are prepared to pave with cement the existing driveway and expand it
to the 24 by 30 foot wide curb that was recommended in item C of the ACRD
comments. As far as the engineering goes we will light it appropriately and conform to
the City's guidelines.
Johnson: Thank you very much, questions of the applicant?
MacCoy: Yes 1 do, you mentioned you have seen the City's comments that is the
January 13t`' sheet.
Chace: My comments are dated January 10~'.
MacCoy: I want to make sure we are talking the same thing. (Inaudible) we will just
vying it from here. You know we have a fence height requirement, you are aware of
that?
Chace: Yes I am.
MacCoy: How about your gates being lockable?
Chace: As they surround the play area, yes.
MacCoy: Signage is in accordance with our ordinance, no blinking lights, not neon.
Your outside lighting should not be a nuisance to your neighbors and that always
seems to come- back and haunt us because people say that to us and then do whatever
they darn well please.

Chace: My understanding is that an inspector and engineer comes in as we are not
necessarily converting but shaping up the property. We will be in compliance.
MacCoy: What about, are you familiar with the ADA, the handicapped code, federal
code?
Chace: That would be used in the rear, to the property.
MacCoy: (Inaudible) do you plan to have a facility that will take care of kids that are
handicapped?
Chace: No, we are not able to take handicapped children, however we can conform to
the ADA Federal guideline.
MacCoy: Which is the ramps and the hand rails and (inaudible)
Chace: That is correct in the event that children's parents or guardians are incapable of
climbing stairs.
MacCoy: (Inaudible) as a business to take care of the handicapped because there is
the other part which was already mentioned here (inaudible) parents may also have the
same problem.
Chace: 1 will just interject, I just received a copy of the January 13`~ sheet that you
mentioned, I will submit a floor plan of the house to scale. I do not have it with me, prior
to the next meeting or should I have it in sooner than that?
Johnson: Well as soon as you have it done so it can be distributed v+rould be the best,
that would be the ideal situation.
Chace: Very good, our appraiser is scheduled to go out next week.
Johnson: Any questions?
MacCoy: One other thing, have you, I am just curious about this one here. Your
neighborhood people, have any of them come to you and told you of a problem they
have got with-this or anything?
Chace: No, my understanding is area was surveyed and sent out via certified mail and
we have not received any complaints at this point.
Johnson: Mr. Borup, any questions?

Borup: The turn around area, there is going to need to be a turn around the cars can
turn around and head back out if they not backing out. I assume you were already
planning that.
Chace: Yes
Borup: Do you feel like you will be okay on parking and a turn around area and the
area that you have in there?
Chace: Yes I did receive an off site parking design and dimensional table from the City
of Meridian which I passed to our contractor which he was able to fairly easily comply
with. I don't know if you want that.
Fitzgerald: Can I ask you two questions, what is your hours of operation?
Chace: Normal day light, 7 a.m. to 5:30 to 6:~ p.m., w+e will have no overnight hours of
operation.
MacCoy: How about Saturday?
Chace: As far as I know no Saturdays, Saturdays and Sundays will be closed.
Fitzgerald: Do you have any swimming pools, or canals or ditches around the area?
Chace: There is a, on the south side there is a pump, it is covered however and my
understanding is that it is in compliance with City ordinance. I think it is a valve for the
irrigation ditch. Yes it is approximately 67 feet east of First Street on the northern
border, I am sorry on the southern border where the fence to the post office is. It is
covered and secured. That is a way, probably getting more to your question that is
away from the play area. Probably 45 feet away from the play area so there are two
fences that separate children from that particular hazard.
Johnson: Thank you Mr. Chace, is there anyone from the public that would like to
testify?
Dale Ownby, 1824 South Sportsman Way, Meridian, was sworn by the City Attorney.
Ownby: Just for clarification in regard to the Nampa Meridian Irrigation ditch that is
(End of Tape) out near the sidewalk that is between the curb and, the back of the
sidewalk,. it adjoins the sidewalk. The one that is back, like Mr. Chace, approximately
64 feet that is covered with a grate, a steel grate, all the rest of it is underground. It is
my understanding that the boundary line is the center of the ditch. However the post
office chose to put their chain link fence on the south side of the ditch so the ditch is

exposed on this side. However it is all covered. So they did not put their fence where
the boundary line is. That is all I have.

Tom Spader, 334 Lakeside Avenue South, Seattle, WA, was sworn by the City
Attorney.
Spader: I am the applicant for the project, Tom Spader of Freiheit and Ho Architects on
behalf of Foodmaker Inc. and Bodice Oil Company. We are applying for a conditional
use permit for a fast food restaurant 2,800 square feet with a drive thru. What we were
proposing here is a single story wood frame building with the associated site
improvements which include all the, necessary parking, grading and drainage, irrigation
requirements and landscaping. We got a copy of the comments, staff review comments
as well as the comments from the Ada County Highway District. We see no problem
meeting their requirements and recommendations. ,

1302. EAST FIRST STREET
MERIDIAN, IDAHO
FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled matter having come on for public hearing on
January 16, 1997, at the hour of 7:00 o'clock p.m., the Applicant,
Raymond Chace,. hereinafter referred to as the "Applicant,"
appearing in person, the Planning and Zoning Commission of the City
of Meridian having duly considered the evidence and the matter
makes the following Findings of Fact and Conclusions of Law:
FINDINGS OF FACT
1. A notice of a public hearing on the Conditional Use
Permit was published for two ( 2 ) consecutive weeks prior to the
said public hearing scheduled for January 16, 1997, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the January 16, 1997
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations.
2. This property is located within the City of Meridian.
3. The Applicant does not own the land. The land is owned
by Gary and Peggy Timson, and they have consented to the
application.

4. The property is currently zoned C-C, Community Business
District; that in the ZONING SCHEDULE OF USE CONTROL, Section 11-2-
409 B., Commercial, Child Care Center is listed as a conditional
use in the C-C District and, therefore, in the C-C District a
conditional use permit for the operation of a Child Care Center is
required.
5. The C-C, .Community Business District is described in the
Zoning Ordinance, 11-2-408 B. 9 as follows:
(C-C) Community Business District: The purpose of the
(C-C) District is to permit the establishment of general
business uses that are of a larger scale than a
neighborhood business, and to encourage the development
of modern shopping centers with adequate off-street
parking facilities, and associated site amenities to
serve area residents and employees;. to prohibit strip
commercial development and encourage the clustering of
commercial .enterprises. All such districts shall have
direct access to a transportation arterial and collector
and be connected to the Municipal Water and Sewer systems
of the City of Meridian.
6. Conditional Use Permit is defined in the Zoning And
Development Ordinance, City of Meridian, Idaho as follows:
"Permits allowing an exception to the uses authorized by this
Ordinance in a zoning district."
7. The property is located at 1302 East 1st Street,
Meridian, Ada County, Idaho.
8. The Applicant testified that they have placed an offer to
purchase the property, and their intention is to operate a day care
for children for twelve (12) or more children.
9. The Applicant testified as follows. They have reviewed
the comments from the City Engineer, the Planning Director, the

Meridian Fire Department, Central District Health and the
irrigation questions. They attended the ACRD (Ada County Highway
District) hearing. They are prepared to comply with all of the
comments. With regard to the driveway, they are prepared to pave
with cement the existing driveway and expand it to the curb which
was recommended in item C. of the ACRD comments and conform to the
City's guidelines..
10. The Applicant testified as follows in response to
questions of Commissioner MacCoy. They are aware of the fence
height requirements. The gates of the fence surrounding the play
area will be lockable. They will comply with signage requirements
so as not to create a nuisance to neighboring properties. They are
unable to and will not offer their day care services to handicapped
children, but they will conform to the Americans With Disabilities
Act Federal guidelines for handicap access to the property. They
will submit floor plan of the house on the property. To the
Applicant's knowledge, they have received no complaints from
surrounding neighbors.
11. The Applicant testified as follows in response to
questions of Commissioner Borup. They received an off-street
parking design and dimensional table from the City of Meridian,
with which they will be able to comply.
12. The Applicant testified that the hours of operation will
be 7:00 a.m. to 6:00 p.m., Monday through Friday; there will be no
overnight hours of operation. The operation will be closed
Saturdays and Sundays.

13. The Applicant testified that there is on the southern
border an irrigation ditch which is covered and secured. There is
a pump which is covered. There are two fences which separate the
children from the ditch and pump.
14. Dale Ownby testified concerning the location and coverage
of the ditch. He testified that the ditch is covered with a steel
grate and the remainder is underground.
15. E. Faye Brewer Buchanan submitted a letter objecting to
this application, which letter is incorporated herein as if set
forth in full.
16. The Assistant to the City Engineer, Bruce Freckleton,
submitted comments which are incorporated herein as if set forth in
full. His comments included that all driveway and parking areas
shall be paved; that graveled driveways, parking and access are
unacceptable; that a drainage plan designed by the State of Idaho
licensed architect or engineer is required and shall be submitted
to the City Engineer (Ord. 557, 10-1-91) for all off-street parking
areas; that all site drainage shall be contained and disposed of
on-site; that any existing irrigation/drainage ditches crossing the
property to be included in this groject shall be tiled per City
Ordinance 11-9-605 M.; that plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users
association, with written confirmation of said approval submitted
to the Public Works Department; that outside lighting shall be
designed and placed so as not to direct illumination on any nearby
residential areas and in accordance with City Ordinance Section 11-

2-414 D. 3.; that all signs shall be in accordance with the
standards set forth in 2-415 of the City of Meridian Zoning and
Development Ordinance; that sanitary sewer and water to the
facility would be through existing service lines; that assessments
for sewer and water service will be reviewed to determine whether
additional load justifies an adjustment to the assessments; that
the Applicant provide any information that .they may have with
regards to your anticipated water demand; and that the Applicant
will be required to enter into an Assessment Agreement with the
City of Meridian.
17. The Planning and Zoning Administrator, Shari Stiles,
submitted comments which are incorporated herein as if set forth in
full.
18. Meridian City Police Department, Meridian Fire
Department, and Nampa & Meridian Irrigation District submitted
comments, which respective comments are hereby incorporated herein
as if set forth in full.
19. Central District Health Department submitted comments,
which comments are hereby incorporated herein as if set forth in
full. Its comments included that after written approval from
appropriate entities are submitted, it can approve this application
for central sewage and central water; and that it will require
plans be submitted for a plan review for the child care center.
20. Ada County Highway District submitted comments and
requirements, all of which comments and requirements are hereby
incorporated herein as if set forth in full, and some of which are

more particularly set forth as follows. As site specific
requirements that the Applicant reconstruct the existing 12-foot
curb cut driveway as a 24 to 30 foot wide curb return driveway with
15-foot curb radii, located on the south property line; that the
Applicant pave the drive its full required width of 24 to 30-feet
beyond the edge of pavement on East 1st Street; that as required by
District policy, restrictions on the width, number and locations of
driveways, shall be placed on future development of the property;
and that other than the access point(s) specifically approved with
this application, direct lot or parcel access to East 1st Street is
prohibited.
21. There was no further testimony given at the hearing.
coNCLVSioxs of LAw
1. All the procedural requirements of the Local Planning Act
and of the Ordinances of the City of Meridian have been met
including the mailing of notice to owners of property within 300
feet of the external boundaries of the Applicant's property.
2. The City of Meridian has authority to grant conditional
uses pursuant to Idaho Code Section 67-6512 and pursuant to 11-2-
418 of the Revised and Compiled Ordinances of the City of Meridian.
3. The City has the authority to take judicial notice of its
own ordinances and proceedings, other governmental •statues and
ordinances, and of actual conditions existing within the City and
state of Idaho.
4. The City of Meridian has authority to place conditions on
a conditional use permit and the use of the property pursuant to
FINDINGS OF FACT AND CONCLUSIONS OF LAW - Page 6.

Idaho Code Section 67-6512 and pursuant to that section conditions
minimizing the adverse impact on other development, controlling the
duration of development, assuring the development is maintained
properly, and on-site or off-site facilities, may be attached to
the permit; that 11-2-418 (D) authorizes the City to prescribe a
set time period for which a conditional use may be in existence.
5. Section 11-2-418 D. states as follows:
In approving any Conditional Use, the' Commission and
Council may prescribe appropriate conditions, bonds, and
safeguards in conformity with this Ordinance. Violations
of such conditions, bonds or safeguards, when made a part
of the terms under which the Conditional Use is granted,
shall be deemed a violation of the Ordinance and grounds
to revoke the Conditional Use. The Commission and
Council may prescribe a set time period for which a
Conditional Use may be in existence:.
6. The City has judged this Application for a conditional
use upon the basis of guidelines contained in Section 11-2-418 of
the Revised and Compiled Ordinances of the City of Meridian and
upon the basis of the Local Planning Act of 1975, Title 67 Chapter
65, Idaho Code, the Comprehensive Plan of the City of Meridian, and
the record submitted to it and the things of which it may take
judicial notice.
7. 11-2-418(C) of the Revised and Compiled Ordinances of the
City of Meridian sets forth the standards under which the Planning
and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area and assuming that the above conditions or

similar ones thereto would be attached to the conditional use, the
Planning and Zoning Commission concludes as follows:
a. The use, would in fact, constitute a conditional use
and a conditional use permit would be required by
ordinance;
b. The use would be harmonious with and in accordance
with the Comprehensive Plan but the Zoning Ordinance
requires a conditional use permit to allow the use;
c. The use. is designed and constructed to be
harmonious in appearance with the character of the
general vicinity; that if the conditions set forth herein
are complied with the use should be operated and
maintained to be harmonious with the intended character
of the general vicinity and should not change the
essential character of the area;
d. That the use would not be hazardous nor should it be
disturbing to existing or future neighboring uses if the
conditions are met; that traffic will increase, but due
to the drop-off-and pick-up being off of the street it
should not be a problem;
e. The property has sewer and water service already
connected, but Applicant may have to pay additional fees
for the use;
f. The use would not create excessive additional
requirements at public cost for public facilities and
services and the use would not be detrimental to the
economic welfare of the community;
g. If the conditions are met, the use should not
involve a use, activity, process, material, equipment or
conditions of operation that would be detrimental to
person, property or the general welfare by reason of
excessive production. of traffic, noise, smoke, fumes,
glare or odors;
h. Sufficient parking for the proposed use will be
required to meet the requirements of the City ordinance;
and
i. The development and uses will not result in the
destruction, loss or damage of a natural or scenic
feature of major importance.

8. Since conditions may be placed upon the granting of a
conditional use permit to minimize adverse impact on other
development, it is recommended by the Planning and Zoning
Commission that the following conditions of granting the
conditional use be required, to wit:
a. The children, if outside, shall be maintained in the
fenced area, as required below;
b. There shall be fencing, gates and locks for the outside
play area such that no children can leave the property without
an adult unlocking and opening the gate to let the child or
children out of the play area; no children shall be allowed
outside of the play area or the home without an adult being
present; the fence shall be maintained in good repair and the
children, when outside, shall stay in the fenced area and the
children shall not be allowed outside of the fenced area or
the home, except for drop-off and pick-up times, and an adult
shall be with them at all times if the child or children are
waiting to be picked up;
c. The Applicant shall meet the state of Idaho requirements
for staff to children ratio;
d. The Central District Health Department and the state of
Idaho Department of Health and Welfare have requirements for
day cares and the Applicant shall meet those requirements of
the Central District Health Department and the state of Idaho
Department of Health and Welfare;
e. The conditional use, pursuant to the Zoning Ordinance,
shall not be transferable to another owner of the property or
to another property;
f. The Applicant shall meet the requirements of the City
Engineer's office, the Planning and Zoning Administrator, and
other governmental agencies submitting comments, which
comments specifically include:
1. All driveway and parking areas shall be paved;
2. Graveled driveways,. parking and access are
unacceptable;
3. A drainage plan designed by the State of Idaho
licensed architect or engineer is required and

shall be submitted. to the City Engineer for all

Ordinance Section 11-2-414 D. 3.;
7. All signs shall be in accordance with the standards
set forth in 2-415 of the City of Meridian Zoning
and Development Ordinance;.
8. Sanitary sewer and water to the facility would be
through existing service lines;
9. Assessments for sewer and water service will be
reviewed to determine whether additional load
justifies an adjustment to the assessments, and
that the Applicant provide any information that
they may have with regards to the anticipated water
demand; and
10. The Applicant will be required to enter into an
Assessment Agreemeat with the City of Meridian.
g. The conditional use should not be restricted to a period
of authorization but may be reviewed annually, upon
notice to the Applicant, for violation of any conditions

9. The above-conditions are concluded to be reasonable and
the Applicant shall meet these conditions.

to the City Council of the City of Meridian that they approve the

found justified and appropriate by the City Council and that the
property be required to meet the water and sewer requirements, the
fire and life safety codes, Uniform Fire Code and other Ordinances

Raymond Chace, 586 W. Criterion, Meridian, was sworn by the City Attorney.
Chace: We have put in an offer to purchase the property at 1302 E. First Street, City of
Meridian and request the conditional use permit for a child care center for 12 or more
children. I sit on the Board of Directors of the parent company, we have reviewed the
comments from the City Engineer, the Planning Director, the Fire Department. I
attended the ACHD hearing and have reviewed the Central District Health and the
irrigation questions in the proposal. We are prepared to comply with all of the facts and
findings in the outline and comments. Which specifically I should probably address.
The driveway, we are prepared to pave with cement the existing driveway and expand it
to the 24 by 30 foot wide curb that was recommended in item C of the ACRD
comments. As far as the engineering goes we will light it appropriately and conform to
the City's guidelines.
Johnson: Thank you very much, questions of the applicant?
MacCoy: Yes I do, you mentioned you have seen the City's comments that is the
January 13th sheet.
Chace: My comments are dated January 10th.
MacCoy: I want to make sure we are talking the same thing. (Inaudible) we will just
wing it from here. You know we have a fence height requirement, you are aware of
that?
Chace: Yes I am.
MacCoy: How about your gates being lockable?
Chace: As they surround the play area, yes.
MacCoy: Signage is in accordance with our ordinance, no blinking lights, not neon.
Your outside lighting should not be a nuisance to your neighbors and that always
seems to come back and haunt us because people say that to us and then do whatever
they darn well please.

Chace: My understanding is that an inspector and engineer comes in as we are not
necessarily converting but shaping up the property. We will be in compliance.
MacCoy: What about, are you familiar with the ADA, the handicapped code, federal
code?
Chace: That would be used in the rear, to the property.
MacCoy: (Inaudible) do you plan to have a facility that will. take care of kids that are
handicapped?
Chace: No, we are not able to take handicapped children, however we can conform to
the ADA Federal guideline.
MacCoy: Which is the ramps and the handrails and (inaudible)
Chace: That is correct in the event that children's parents or guardians are incapable of
climbing stairs.
MacCoy: (Inaudible) as a business to take care of the handicapped because there is
the other part which was already mentioned here (inaudible) parents may also have the
same problem.
Chace: I will just interject, I just received a copy of the January 13`h sheet that you
mentioned, I will submit a floor plan of the house to scale. I do -not have it with me, prior
to the next meeting or should I have it in sooner than that?
Johnson: Well as soon as you have it done so it can be distributed would be the best,
that would be the ideal situation.
Chace: Very good, our appraiser is scheduled to go out next week.
Johnson: Any questions?
MacCoy: One other thing, have you, I am just curious about this one here. Your
neighborhood people, have any of them come to you and told you of a problem they
have got with this or anything?
Chace: No, my understanding is area was surveyed and sent out via certified mail and
we have not received any complaints at this point.

Borup: The turn around area, there is going to need to be a turn around the cars can
turn around and head back out if they not backing out. I assume you were already
planning that.
Chace: Yes
Borup: Do you feel like you will be okay on parking and a turn around area and the
area that you have in there?
Chace: Yes I did receive an off site parking design and dimensional table from the City
of Meridian which I passed to our contractor which he was able to fairly easily comply
with. I don't know if you want that.
Fitzgerald: Can I ask you two questions, what is your hours. of operation?
Chace: Normal day light, 7 a.m. to 5:30 to 6:00 p.m., we will have no overnight hours of
operation.
MacCoy: How about Saturday?
Chace: As far as I know no Saturdays, Saturdays and Sundays will be closed.
Fitzgerald: Do you have any swimming pools, or canals or ditches around the area?
Chace: There is a, on the south side there is a pump, it is covered however and my
understanding is that it is in compliance with City ordinance. I think it is a valve for the
irrigation ditch. Yes it is approximately 67 feet east of First Street on the northern
border, I am sorry on the southern border where the fence to the post office is. It is
covered and secured. That is a way, probably getting more to your question that is
away from the play area. Probably 45 feet away from the play area so there are two
fences that separate children from that particular hazard.
Johnson: Thank you Mr. Chace, is there anyone from the public that would like to

Dale Ownby, 1824 South Sportsman Way, Meridian, was sworn by the City Attorney.
Ownby: Just for clarification in regard to the Nampa Meridian Irrigation ditch that is
(end of Tape) out near the sidewalk that is between the curb and, the back of the
sidewalk; it adjoins the sidewalk. The one that is back, like Mr. Chace, approximately
64 feet that is covered with a grate, a steel grate, all the rest of it is underground. It is
my understanding that the boundary line is the center of the ditch. However the post
office chose to put their chain link fence on the south side of the ditch so the ditch is

exposed on this side. However it is all covered. So they did not put their fence where
the boundary line is. That is all I have.

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
1. All driveway and parking areas shall be paved. Graveled driveways, parking and access are
unacceptable. A drainage plan designed by a State of Idaho licensed architect or engineer is
required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street
parking areas. All site drainage shall be contained and disposed of on-site.
2. Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users association, with written confirmation
of said approval submitted to the Public Works Department.
3. Outside lighting shall be designed and placed so as to not direct illumination on any nearby
residential areas and in accordance with City Ordinance Section 11-2-414.D.3
4. All Signs shall be in accordance with the standards set forth in 2-415 of the City of
Meridian Zoning and Development Ordinance.
5. Sanitary Sewer and Water to this facility would be via. existing service lines. Assessments
for sewer and water service will be reviewed to see if additional load would justify an
adjustment. Please provide any information that you may have with regards to your
anticipated water demand. Applicant will be required to enter into an Assessment
Agreement with the City of Meridian.

Following are comments to be considered during your review of this project:
Applicant has stated it is their intent to utilize the existing home as a residence and a
daycare until future need may dictate use of entire building for a child care center.
Applicant is to submit a floor plan of the house (to scale) to determine allowable area for
children and number of parking spaces needed.
2. Provide copy of daycare license from Idaho Department of Health & Welfare. Operator's
licenses shall be available on the premises at all times for inspection. Applicant has
submitted a copy of a day care permit for Cindy E. Chace.
3. Provide Social Security Numbers of owner, operator and all employees for this facility.
4. Screening of adjacent residential properties is to be provided through landscaping and
fencing.
5. No unpaved areas are to be used for parking.
6. This Conditional Use Permit shall be subject to annual review, or more often if conditions
warrant.
7. All signage shall be subject to design review. A-frame and other signs of a temporary
nature will not be permitted as part of this conditional use permit.
8. Applicant is to provide a 25-foot-wide driveway in accordance with City Ordinance. This
would eliminate the space shown as 6 on the site plan. All parking and driveway areas are
to be paved. The proposed parking plan is not to scale, but it does not appear to provide
adequate turnaround area. All parking spaces are to be a minimum of 9'x 19' (90 °) or
9'x23' (parallel) with 25-foot-wide driveways.

Parents should be able to enter the parking lot and turn around without dropping off
children at the curb on East First Street. ACRD is requiring that the existing curb cut be
reconstructed as a 24- to 30-foot-wide curb return driveway with 15-foot curb radii.
9. Applicant to obtain a Certificate of Occupancy prior to operation of the child care center.
A letter of credit or cash for all improvements would be needed prior to granting
temporary occupancy.
10. Drainage plan and calculations prepared by an architect or engineer licensed in Idaho is
required to be submitted to the Public Works Department for review and approval for all
parking areas.
11. Landscaping and underground sprinkling of all landscaped areas shall be provided per City
Ordinance.
12. Illumination of site shall not cause glare or impact adjacent properties, as determined by
the City.

reconstructs it as a 24 to 30-foot wide curb return driveway with 15-foot curb radii.
D. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. In accordance with past action by the District the applicant should
be required to pave the driveway its full required width of 24 to 30-feet to at least 30-feet
beyond the edge of pavement of E. 1st Street.
E. As required by District policy, restrictions on the width, number and locations of driveways,
may be placed on future development of this parcel.

F. The existing transportation system will be adequate to accommodate the additional traffic
generated by this proposed development with the requirements outlined within this report.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
1. Reconstruct the existing 12-foot curb cut driveway as a 24 to 30-foot wide curb return
driveway with 15-foot curb radii, located on the south property line.
2. Pave the driveway its full required width of 24 to 30-feet to at least 30-feet beyond the edge
of pavement of E. 1st Street.
3. As required by District policy, restrictions on the width, number and locations of driveways,
shall be placed on future development of this parcel.
4. Other than the access point(s) specifically approved with this application, direct lot or parcel
access to E. 1st Street is prohibited.
Standard Requirements:
1. A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Development Services Supervisor. The request shall
apecificauy identify each requirement to be reconsidered and include a written explanation of

request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for

action do not provide sufficient time for District staff to remove the item from the consent
agenda and report to the Commission regarding the requested modification, variance or
waiver. Those items will be acted on by the Commission unless removed from the agenda
by the Commission.
2. After ACRD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the
action and shall include a minimum fee of $110.00. The req»PSt for reconsideration shall
~necifically identify each requirement to be reconsidered and include written documentation
of data that was not available to the Commission at the time of its original decision. The
request for reconsideration will be heard by the District Commission at the next regular
meeting of the Commission. If the Commission agrees to reconsider the action, the applicant
will be notified of the date and time of the Commission meeting at which the reconsideration
will be heard.

3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building
permit (or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
7. No change in the terms and conditions of this approval shall be valid unless they are in
writing and signed by the applicant or the applicant's authorized representative and an
authorized representative of the Ada County Highway District. The burden shall be upon the
applicant to obtain written confirmation of any change from the Ada County Highway
District.
8. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances,
plans, or other regulatory and legal restrictions in force at the time the applicant or its
successors in interest advises the Highway District of its intent to change the planned use of
the subject property unless awaiver/variance of said requirements or other legal relief is
granted pursuant to the law in effect at the time the change in use is sought.
Conclusion of Law:
ACHD requirements are intended to assure that the proposed use/development will not place
an undue burden on the existing vehicular and pedestrian transportation system within the
vicinity impacted by the proposed development.

Please consider this letter as testimony in the above application for
public hearing on January 16, 1997 and our disapproval of said as adjacent
property owners at 1303 East First Street.
Our concerns are voiced against this conditional use permit not because it
is for a day care center in this house, but because it is a day care center
at this location and East First Street, as well as Post Office traffic.
It does not seem feasible that a circular drive or rear parking lot would be
in the best interests of this home, as installation of these for proper and
safe ingress and egress would damage the yard, trees, etc., which seems to
be one of the reasons it would make a good day care center in the first
place.
That ;property's adjacent location to the Post Office lends itself to even
more traffic dangers than only general public traffic. It seems, that
parents delivering children in the early morning working hours and receiving
them in late afternoon hours would be a double hazard with Post Office delivery
trucks and employees coming and going at the same time. Children darting into
the center could easily be injured or killed.
It seems that a better use of this home would be a more "cottage" style
business with consumer hours and traffic.

Please consider this letter as testimony ie the above application for
public hearing on January 16, 1997 and our disapproval of said as adjacent
property owners at 1303 East First Street.
Our concerns are voiced against this condit.%onal use permit not because it
is for a day care center in this house, but because it is a day care center
at this location and East First Street, as well as Post Office traffic.
It does not seem feasible that a circular drive or rear parking lot would be
in the best interests of this home, as installation of these for proper and
safe ingress and egress would damage the yard! trees, etc., which seems to
be one of the reasons it would make a good dsy care center in the first
place.
That ;property's adjacent location to the Poet Office lends itself to even
more traffic dangers than only general public traffic. It seems, that
parents delivering children in the early mo~i.ng working hours and receiving
them in late afternoon hours would be a douale hazard with Post Office delivery
trucks and employees coming and going at t3~e same time. Children darting into
the center could easily be injured or killed.
It seems that a better use of this home wot~.d be a more "cottage" style
business with consumer hours and traffic.
