Thanks, Bill From: Becky Hanks [mailto:BHanks@brightoncorp.com] Sent: Wednesday, August 18, 2010 1:50 PM To: Bill Parsons Cc: Mike Wardle; David Turnbull; Rod Blackstead; Jay Walker Subject: SpurWing Greens Staff Report PP-10-001 and VAR-10-001 Good afternoon, Mr. Parsons, Below please find responses to specific Conditions of Approval for the hearing on Thursday, August 1 gtn: 1.1.1 The preliminary plat labeled Sheets 1-3, prepared by Engineering Northwest, dated 07/10, is approved, with the conditions listed herein: • Lots 34, 35, 39 and 40, Block 16 shall meet the lot frontage standards in accord with UDC-11-2A- 3B; or as an alternative, Lots 34 and 35~and Lots 39 and 40 shall be served by common driveways allowing for a reduction in lot frontage to 15 feet. Applicant Response: Add the underlined language as noted above. 1.1.3 Provide the stub streets (see section 6F above) as proposed on the plat with the exception of the northwest stub street to the Carnahan property (parcel #SO422315000). A new stub shall be proposed for Block 24 to provide westerly connection to said property, unless the variance is granted by Council. Applicant Response: No alternative action is proposed pending a decision by the Meridian City Council. 1.1.6 Provide a community center amenity that includes the following: club house, swimming pools, outdoor play areas, kitchen, and exercise facilities. All of these amenities shall be constructed and ready for occupancy prior to issuance of the 201St building permit for this development. Maintain all existing amenities constructed with Phase 1 of the Jayker Subdivision. Applicant Response: Residents of SpurWing Greens will be provided with social memberships to the 8/19/2010 RE: SWG Staff Report Page 2 of 2 Spurwing Country Club with access to all services and facilities, except golf, but including swimming and other amenities. Thus, with the addition of the tennis court complex currently under construction, Spurwing Greens residents will have access amenities proposed by the community center from the day they move into the project. A community center will be constructed at the site within the project as initially proposed but at a size, approximately 1,800 square feet, and character scaled to a community half the size of the original proposal, and with the above-noted facilities having already been provided Further, it is requested that the community center be constructed prior to issuance of the 351st building permit rather than the 201st as recommended. 2.2.1 This proposed developments sanitary sewer effluent is being planned to flow southwesterly into the existing Jayker Subdivision's sanitary sewer system. There are currently deficiencies in the sanitary sewer system within the Jayker Subdivision that are being addressed. No building permits will be issued until such time as the deficiencies are corrected to the satisfaction of the Meridian Public Works Department. Applicant Response: Based on the attached Letter of Understanding and Agreement issued by Meridian Ciry Public Works Director, dated July 30, 2010 it is our understanding that building permits will continue to be issued; however, no occupancy permits will be issued until the downstream deficiencies are corrected. Executive Drive Boise, Idaho 83713 FROM: Tom Barry, Public Works Director CC: Tammy De Weerd, Mayor, City of Meridian Bruce Freckleton, Development Services Manager, City of Meridian Warren Stewart, Engineering Division Manager, City of Meridian Max Jensen, Construction Division Manager, City of Meridian Tom Johnson, Chief Inspector, City of Meridian DATE: July 30, 2010 RE: Jayker Subdivision -Phase 1 Sewer Deficiencies On July 29, 2010, Tom Barry, Meridian PW Director, Bruce Freckleton, Meridian DS Manager, Warren Stewart, Meridian Engineering Manager, Tom Johnson, Meridian Chief Inspector, David Turnbull, Brighton Investments, LLC, Doug Carnahan, Formerly Tree Haven, LLC, and Rod Blackstead, Blackstead Building Co., Inc., met to discuss concerns associated with the sanitary sewer system within the Jayker Subdivision -Phase 1 and its relation to issuance of Building Permits. All present recognized that the sanitary sewer system within the Jayker Subdivision has been found to be deficient during the one year warranty inspection conducted on February 2, 2010. These deficiencies have yet to be Page 2 of 2 corrected and the City requires these deficiencies to be corrected prior to occupancy of any further buildings or structures within the Jayker Subdivision. In an effort to flexibly move forward with building while corrections are made to the sanitary sewer system within Jaykers Subdivision, all members present at the July 29`~ meeting agreed as follows: 1) Doug Carnahan will take the lead on coordinating with all other Jayker owners, partners, developers, and contractors (the "Parties") on development of a solution to correct fully the sanitary sewer system deficiencies within the Jaykers Subdivision - Phase 1. This work (hereafter called "Phase i ") shall take place within the first thirty days of the date of this letter. 2} Parties will endeavor to correct all deficiencies within 60 days of the completion of `'Phase I", baring no unforeseen complications. 3} City will continue to release building permits for the Jayker Subdivision -Phase 1 while improvements are being made to the sanitary sewer system within Jayker Subdivision -Phase 1. 4) In no case will the City issue Certificates of Occupancy (CO) for any home, building, or structure within the Jayker Subdivision -Phase 1 that received a building permit after July 29, 2010 until the following conditions are met: a. All sanitary sewer system deficiencies within the Jayker Subdivision - Phase 1 have been corrected and accepted by the City of Meridian OR all downstream sanitary sewer system deficiencies from the home, building, or structure applying for CO have been corrected and accepted by the City of Meridian. b. Developers/Owners/Builders shall notify all potential BuildersBuyers of the CO conditions contained herein. 5) If all sanitary sewer system deficiencies within the Jayker Subdivision -Phase 1 have not been corrected by the Parties and accepted by the City on or before January 1, 2011, the City will cease issuance of any further building permits and Certificates of Occupancy for any and all lots, buildings, or structures within the Jayker Subdivision -Phase 1.
