A. Findings of Fact
Trip Generation: This development is estimated to generate 782 additional vehicle trips per day (0
existing) based on the Institute of Transportation Engineers Trip Generation Manual.
2. Impact Fees: There will be an impact fee that is assessed and due prior to issuance of a building
permit. The assessed impact fee will be based on the impact fee ordinance that is in effect at that
time.
3. Traffic Impact Study: A traffic impact study was not required with this application. This site was
originally part of Bridgetower Crossing Subdivision which ACHD reviewed in November 2001. A
traffic impact study was required with the preliminary plat, and the impact study analyzed the school
site as part of the project. However, the proposed access points for this application are different than
what was proposed with the preliminary plat.

7. Roadway Improvements Adjacent To and Near the Site
• McMillan Road is currently improved with two travel lanes and no curb, gutter, or sidewalk
abutting the site. Sidewalk will be constructed on the north side of McMillan Road with Kelly
Creek Subdivision.

8. Existing Right-of-Way
• McMillan Road currently has 50-feet of existing right-of-way abutting the site (25-feet from
centerline).

The site currently has no defined access point to McMillan Road.
10. Site History
The ACRD Commission reviewed and approved this site as part of the preliminary plat of Bridgetower
Crossing Subdivision in November 2001 (MPP01-005/MCUP01-006/ MAZ01-003/MZA01-001).
When the preliminary plat was submitted the developer proposed that the elementary school would
take access from the internal collector roads. The applicant at that time did not propose any direct
access to McMillan Road. The access to the collector roadways was reviewed, and it was
determined that the internal street system would be capable of handling the school related traffic,
including buses. The traffic impact study determined that access to McMillan Road was not needed.
Subsequent to the preliminary plat approval, the school site property has been divided from the
Bridgetower Crossing site and sold to the school district. The phases of Bridgetower Crossing
Subdivision adjacent to the school site have not yet final platted, and the internal roadways have not
yet been constructed adjacent to the school site. Therefore, the school site currently only has public
road frontage on McMillan Road. However, recently ACHD learned that the Bridgetower Crossing
developer will be building the collector roadway abutting the school site's southern boundary later this
year. The developer of Bridgetower is currently working with ACHD staff on the design and
construction of N. Palatine Way, which is immediately west of the school site, as part of Phase 9
In January of 2004 the Hunter Elementary School architect met with ACHD staff to discuss the
relocation of school access from within the Bridgetower Subdivision, as originally preliminary platted,
to McMillan Road. This change was needed due to the school wanting to be open in the fall of 2005,
and Bridgetower not having their phase immediately south of the school completed until a year or two
later. (However, as noted in the previous paragraph, the roadway abutting the school's southern
boundary is planned to be constructed later this year). A secondary reason given was that the school
will at least initially serve a broader area than Bridgetower, and they did not want to encourage a
great deal of outside traffic to use the internal subdivision roads.
Capital Improvements Plan/Five Year Work Program
There are currently no roadways, bridges, or intersections within the general vicinity of the area that
are included in the District's Five Year Work Program.
The intersection of Linder and McMillan is scheduled in the District's Capital Improvements Plan to be
signalized in 11 to 15 years. With the signalization, the intersection will be widened to three lanes.

Land Use Master Plan/Anticipated Future Development in the Area
The proposed school site is located adjacent to Bridgetower Crossing Subdivision. Bridgetower
Crossing was a planned community with a mix of residential housing opportunities and commercial
development. The properties to the north are proposed for single-family residential development
(Kelly Creek Subdivision).

2. School Bus Plan
On the revised layout, the school buses will access off N. Palatine Way, sharing the driveway with a
parent drop-off movement, but with separate stacking loop and drop off point on site to enhance
safety. School bussing routes are determined by the school district. Bridgetower Crossing
Subdivision is planned with local roadways and residential collectors, and the adjacent road
(McMillan Road) is an arterial roadway. The intemal subdivision roadway system and the external
arterial roadway systems are sufficient to handle school buses.
3. Access Safety and Control
McMillan Road, abutting the site's north property line, is an arterial roadway. Access to arterial
roadways is restricted based on speed and distance from existing or future roadways and driveways.
McMillan Road is 50 MPH. Driveways on arterials that are 50 MPH are required to either align or
offset other driveways or roadways by 255-feet (measured near edge to near edge). The revised
access plan proposes one access point on N. Palatine Way (an internal subdivision road intersecting
with McMillan). The location of N. Palatine Way was determined to meet District policy with the
approval of the preliminary plat for Bridgetower Crossing Subdivision.
4. Pedestrian Plan, School Zone & Traffic Control Signals
The developer of Bridgetower Crossing Subdivision is required to construct sidewalk abutting all of
the internal roads, as well as abutting the frontage on McMillan Road. The school district will be
required to construct sidewalk abutting their site on McMillan Road which will tie into the sidewalk to
be constructed with Bridgetower Crossing. The developer of Kelly Creek Subdivision on the north
side of McMillan Road is required to construct a sidewalk abutting the site on McMillan Road. The
construction of sidewalk abutting the school site and the surrounding properties will provide
pedestrian access adjacent to the school.
Initially with all of the access proposed to McMillan Road, ACHD was requiring a road trust deposit for
a pedestrian signal on McMillan Road as well as advance school zone flashing beacons. Due to the
revised location of the school access point on N. Palatine Way and the school district proposal to
construct a fence along the Lemp Canal, ACHD will not require the construction of advance school
zone flashing beacons or a road trust deposit for a pedestrian signal. With the absence of a
signalized pedestrian facility crossing McMillan Road, ACHD anticipates that the school district will
provide bus service for those students coming from the north side of McMillan Road to the elementary
school.
5. Anticipated Future Improvements and Roadway Projects
McMillan Road currently has two travel lanes and no center turn lane. McMillan Road is not
scheduled to be widened in either the District's Five Year Work Program or the Capital Improvements
Plan. However, the developer of Bridgetower Crossing Subdivision was required to install left turn
lanes on McMillan Road at the intersections with N. Palatine Way.

The proposed elementary school is estimated to generate 782 vehicle trips per day. It is anticipated
that the existing roadways, with the required improvements (i.e. turn lanes, pedestrian facilities), will
not exceed an acceptable level of service.
7. Acceleration and/or deceleration lanes
The north property line of the site, abutting McMillan Road, is bordered by the Lemp Canal. If the
school district were to take access to McMillan Road, they would normally be required to construct a
right-turn lane and acceleration tapers abutting their site. However, the physical barrier of the canal
prevents that construction. With the revised layout, showing all access to N. Palatine Way, ACHD will
require that N. Palatine Way be widened to a 40-foot street section within 54-feet of right-of-way
abutting the school site's west property line to accommodate three lanes at the intersection with
McMillan Road and a left turn lane into school site.
8. Internal traffic circulation
The revised site layout proposes one driveway to N. Palatine Way that provides internal traffic
circulation for the use of the bus drop-off, the parent drop-off, and the parking facilities. ACHD
recommends that the school district maximize the stacking potential for the two drop-off loops on the
site in order to prevent backing onto the public road system.
9. Required Striping and Signing modifications
The school district will be required to stripe the new left turn lane into the site on N. Palatine Way.
North Palatine Way, at the intersection with McMillan Road, will be required to be striped for a
northbound left turn lane, northbound right turn lane, and a southbound travel lane.

10. Funding of Highway Improvements to accommodate Development
The new internal subdivision roads abutting the school's- south and west property lines are developer
funded and will be constructed by the developer of Bridgetower Crossing Subdivision. The developer
of Bridgetower was required to construct N. Palatine Way as a 36-foot street section within 50-feet of
right-of-way. Due to the revised layout showing all access for the school site on N. Palatine Way, the
road will need to be constructed as a 40-foot street section within 54-feet of right-of-way from the
intersection of McMillan Road to the school site's driveway on N. Palatine (approximately 200-feet
south of the intersection). The school district will need to work with Bridgetower to coordinate the
construction of N. Palatine Way. The impact fees that the school district and the surrounding
developments are required to pay will help fund future system improvements within the vicinity.
C. Findings for Consideration
1. Right-of-Way & Sidewalk
McMillan Road
District policy requires 96-feet of right-of-way on arterial roadways (Figure 72-F1 B). This right-of-way
allows for the construction of a 5-lane roadway with curb, gutter, 5-foot concrete detached sidewalks
and bike lanes.
District policy requires 5-foot wide (minimum) concrete sidewalk on all collector roadways and arterial
roadways (7204.7.2).
As part of the North Meridian Trafhc Study, McMillan Road from Mc Dermott Road to Locust Grove
Road has been identified as a 3-Lane Minor Arterial with 70-feet of right-of-way. The District requires
that all irrigation facilities be located outside of road rights-of--way. The Lemp Canal is too large to be
piped and/or moved, and in order to accommodate the Lemp Canal, the District will not require
additional right-of-way as it normally would. The District will require that the additional 20-feet of
right-of-way needed for McMillan Road be obtained from the properties north of McMillan Road.
Therefore, no additional right-of-way will be required with this application.
The applicant will be required to construct a minimum 5-foot concrete sidewalk located on the south
side of the Lemp Canal. The applicant should provide the District with an easement for the sidewalk.
2. Street Sections
North Palatine Way
District policy 72-F1A, 7202.3.2 and 7202.3.5, requires that residential collectors be constructed as
36-foot street sections with curb, gutter and 5-foot wide concrete sidewalks with no front-on housing.
The access restrictions for these street segments should be stated on the final plat. Unless otherwise
noted, parking should be prohibited on these street segments. Coordinate the signage Program with
District staff.
The applicant should be required to construct N. Palatine Way as a 40-foot street section from
McMillan Road south to the school's driveway. The additional width will allow for the striping of turn
lanes and accommodating the bus traffic. This construction should be coordinated with the developer
of Bridgetower Crossing Subdivision and the required improvements for Bridgetower Crossing
Subdivision.
The school district should be required to stripe the new left turn lane into the site on N. Palatine Way.
North Palatine Way, at the intersection with McMillan Road, should be required to be striped for a
northbound left turn lane, northbound right turn lane, and a southbound travel lane.

3. Driveways
Location
District policy F2-F4 (1) and 72-F4 (2), requires driveways located on local residential roadways to
offset a controlled and/or uncontrolled intersection a minimum of 50-feet (measured near edge to
near edge).
District policy 72-F4 (2) requires driveways located on collector roadways near a stop controlled
intersection to be located a minimum of 150-feet from the intersection for afull-access driveway and a
minimum of 110-feet from the intersection for aright-in/right-out only driveway.
Applicant's Proposal
The applicant has proposed, in the revised layout, to construct one driveway on N. Palatine Way,
located approximately 970-feet south of McMillan Road. Staff is supportive of this proposal and
recommends that it be approved with this application.
Width
District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles
to a maximum width of 35-feet. Most commercial driveways will be constructed as curb-cut type
facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for
driveways accessing collector and arterial roadways.
District policy 7207.9.3 restricts industrial driveways to a maximum width of 40-feet. Most industrial
driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type
driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways.
In order to provide for three lanes (left turn, right turn, and travel lane), staff recommends that the
school district construct a 40-foot driveway onto N. Palatine Way. Staff recommends that this
driveway/drive aisle be required to be 40-feet wide extending into the site from the intersection with
N. Palatine Way to the first northern parking lot driveway.
Paving
Graveled driveways abutting public streets create maintenance problems due to gravel being tracked
onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to
pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the
roadway.
4. Turn Lanes
District policy 3004.1, 72-F8, AASHTO guidelines and the MUTCD guidelines require the turn lane to
be constructed to provide a minimum of 100-feet of storage with shadow tapers for both the approach
and departure directions. Coordinate the design of the turn lane with District staff.
District policy 3004.1 and AASHTO Guidelines require tapers to be constructed on a varying basis
contingent upon the posted speed limit. Coordinate the design of the taper with District staff.
Traffic Services staff has reviewed the revised school site plan and recommends that the school be
required to widen N. Palatine Way from McMillan Road to the school driveway to a 40-foot street
section to accommodate three lanes at the intersection with McMillan Road and a turn lane into the
school site.

5. Signals
Due to the revised location of the school access point on N. Palatine Way (with no access to McMillan
Road) and the proposal to construct a fence along the Lemp Canal, ACHD will no longer be requiring
the construction of advance school zone flashing beacons or a road trust deposit for a pedestrian
signal. This assumes that the school district will provide bus service to students along McMillan
Road, including the proposed subdivision immediately north of the school site.
6. Other Access
McMillan Road is classified as a minor arterial. No access directly from the school site to McMillan
Road is approved with this application. When the additional phases of Bridgetower Crossing
Subdivision are built, the school has proposed to utilize the drop-off driveway and parking area off the
south side of the school site on the internal, collector roadway for the subdivision. This access was
approved with the preliminary plat of Bridgetower Crossing Subdivision.
D. Site Specific Conditions of Approval
1. Construct a minimum 5-foot sidewalk located on the south side of the Lemp Canal. The applicant
should provide the District with an easement for the sidewalk.
2. Construct N. Palatine Way as a 40-foot residential collector from McMillan Road south to the school's
driveway. This construction should be coordinated with the developer of Bridgetower Crossing
Subdivision and the required improvements for Bridgetower Crossing Subdivision.
Stripe a southbound left turn lane into the site on N. Palatine Way. North Palatine Way, at the
intersection with McMillan Road, shall be striped for a northbound left turn lane, northbound right turn
lane, and a southbound travel lane.
3. Construct one 40-foot wide curb return driveway on N. Palatine Way located approximately 170-feet
south of McMillan Road. Extend the 40-foot wide driveway/drive aisle into the site from the
intersection with N. Palatine Way to the first northern parking lot driveway.
4. Stripe the driveway/drive aisle for a travel lane into the site, a westbound left turn lane, and a
westbound right turn lane.
5. Construct a fence abutting the site's north property line along the south side of the Lemp Canal.
6. Comply with all Standard Conditions of Approval.
E. Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of--way.
2. All utility relocation costs associated with improving street frontages abutting the site shall be borne
by the developer.
3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the
construction of the proposed development. Contact Construction Services at 387-6280 (with file
number) for details.

4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by
the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details.
5. All design and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all
applicable ACRD Ordinances unless specifically waived herein. An engineer registered in the State
of Idaho shall prepare and certify all improvement plans.
6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or
other required permits), which incorporates any required design changes.
7. Construction, use and property development shall be in conformance with all applicable requirements
of the Ada County Highway District prior to District approval for occupancy.
8. Payment of applicable road impact fees are required prior to building construction in accordance with
Ordinance #198, also known as Ada County Highway District Road Impact Fee Ordinance.
9. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The
applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant
shall be required to call DIGLINE (1-800-342-1585) at least two full business days prior to breaking
ground within ACRD right-of-way. The applicant shall contact ACRD Traffic Operations 387-6190 in
the event any ACRD conduits (spare or filled) are compromised during any phase of construction.
10. No change in the terms and conditions of this approval shall be valid unless they are in writing and
signed by the applicant or the applicant's authorized representative and an authorized representative
of the Ada County Highway District. The burden shall be upon the applicant to obtain written
confirmation of any change from the Ada County Highway District.
11. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other
regulatory and legal restrictions in force at the time the applicant or its successors in interest advises
the Highway District of its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the
time the change in use is sought.
F. Conclusions of Law
The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are
satisfied.
2. ACRD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.

Request for Reconsideration of Commission Action
1. Request for Reconsideration of Commission Action: A Commissioner, a member of ACHD staff
or any other person objecting to any final action taken by the Commission may request
reconsideration of that action, provided the request is not for a reconsideration of an action previously
requested to be reconsidered, an action whose provisions have been partly and materially carried
out, or an action that has created a contractual relationship with third parties.
a. Only a Commission member who voted with the prevailing side can move for reconsideration,
but the motion may be seconded by any Commissioner and is voted on by all Commissioners
present.
If a motion to reconsider is made and seconded it is subject to a motion to postpone to a
certain time.
b. The request must be in writing and delivered to the Secretary of the Highway District no later
than 3:00 p.m. on the day prior to the Commission's next scheduled regular meeting following
the meeting at which the action to be reconsidered was taken. Upon receipt of the request,
the Secretary shall cause the same to be placed on the agenda for that next scheduled
regular Commission meeting.
c. The request for reconsideration must be supported by written documentation setting forth new
facts and information not presented at the earlier meeting, or a changed situation that has
developed since the taking of the earlier vote, or information establishing an error of fact or
law in the earlier action. The request may also be supported by oral testimony at the meeting.
d. If a motion to reconsider passes, the effect is the original matter is in the exact position it
occupied the moment before it was voted on originally. It will normally be returned to ACRD
staff for further review. The Commission may set the date of the meeting at which the matter
is to be returned. The Commission shall only take action on the original matter at a meeting
where the agenda notice so provides.
e. At the meeting where the original matter is again on the agenda for Commission action,
interested persons and ACHD staff may present such written and oral testimony as the
President of the Commission determines to be appropriate, and the Commission may take
any action the majority of the Commission deems advisable.
f. If a motion to reconsider passes, the applicant may be charged a reasonable fee, to cover
administrative costs, as established by the Commission.

Ree Hunter Elementary School -Revised Site Plan
The CZC issued by the P8Z Dept on 421-04 was based upon a Site Plan that had
two points of access on McMillan Road. After issuing the CZC, ACHD required LKV
Arch~ects to remove the two McMillan driveways, which resulted in a re-configured
parking lot. The Director (Anna Powell) did not require a new CZC since the building
footprint did not change from the original plan. The handwritten edits on the attached
CZC reflect the revised Site Plan and Landscape Plan (revised June 2004).
