ThL e CONTENTS OF CONDITIONAL USE APPLICATION An application for a conditional use permit shall be filed with the Administrator by the owner of the property for which such conditional use is proposed. At a minimum, the application shall contain the following information: 1. Name, address and phone number of applicant; 2. Name, address and phone number of owner of subject property; 3. Description of existing use; - ~ ~ -~~ ~~~ E 6. Present use of subject property; 7. Proposed use of the subject property; 8. The District (present zoning) that pertains to the subject property; ~ ~ 9. Thirty (30) copies of a vicinity map of a scale of one inch equals three hundred feet (1 " = 300'); 10. Characteristics of subject property which make a conditional use desirable; 11. A listing of the mailing addresses of all property owners (from authentic tax records of Ada County) who are within three hundred feet (300') of the external boundaries of the land 1being considered, and a list of all owners within the area being considered for a conditional use; 12. A fee established by the Council; $275.00 + $1.42 each for certified mailings for each property owner listed within the 300 feet =Total Fee 13. A statement that the applicant or user of the property agrees to pay any additional sewer, water pr trash fees or charges, if any, associated with the use, whether that use be residential, commercial or industrial; and 14. The application shall be verified by the applicant which shall state that he has read the contents thereof and verifies that the information contained therein is true and correct. 15. The property will be posted 1 week before the hearing stating they have applied for a Conditional Use Permit or Zoning. Gordon: Mr. Mayor and Council as of 12:00 today the State of Idaho has revoked the liquor license for Mr. Winn, he no longer has a State liquor license. Corrie: Any questions from Council? Morrow: I guess my question would be, if he doesn't have a liquor license, there can't be any retail sale of alcohol is that what you are saying? Gordon: Yes sir that is correct. It was a permanent revocation. Corrie: Dc es the Council have any questions of the attorney, Mr. raddlemoser your opinion on that. --- Riddlemoser: My opinion on that with it being revoked this matter here is now moot and terminated. Riddlemoser: I think there I would just move that based upon the representation by the Police Chief that this matter is declared moot and null and the application tonight. Dwayne Winn, 3793 Manchester, Boise, was sworn by the City Attorney. Winn: I don't know what to say, in 1978 I put in for a liquor license in the City of Meridian and it came thru this year. I had an agreement with Moe for the EI Zocalo and he was going through a divorce and right when I got. my license and the judge awarded her the building over here. So I was out and Mr. Mayes leased me part of his building and that is what I am trying to do. I have to maintain alcohol beverages for 6 months to retain this license and that is all I am trying to do. I only have seating capacity for 4 or 5 people. I will only be open from 9 to 5:30 and that is it. Hepper: What happens after the six months? Winn: After 6 months you can keep it, you don't have to sell anything. The way the laws when I put in in 1978 for, you didn't have to open anything but now they have it so you have to be able to sell alcoholic beverages for six months it has to be in operation for 6 months. After six months I put in my (inaudible) that is all I am trying to do is keep the license. Johnson: In that regard Mr. Winn have you checked with the proper authorities as to whether or not the building you are contemplating using the Mayes building will meet the code necessary for the occupancy? Winn: I have gone into agreement with the health department, they have been there and there are a few items like I had to have a spring loaded door and had to put things in the toilet. I am in the process of fixing Johnson: When you say things to the toilet are you talking about to accommodate handicapped? Winn: No, the inlet has to be an inch above the outlet so you can't get any back pressure. Anyway the health department has conditionally .approved it for this six months to get my license to maintain my license. Johnson: Shari, are you familiar with what might be entailed other than the health department for the State with respect to our local ordinance, any local ordinance might apply to fire safety, health standards? Stiles: Chairman Johnson I am not sure what that all would entail as far as handicap accessibility maybe the sinks are required to be, if he can furnish some kind of an approval • Meridian .Planning & Zoning Commission June 11, 1996 Page 9 from Central District Health with what he is planning to do and all of the other requirements , I wouldn't have any problem with it. Johnson: What would be pefiaps where he should go to verify that. I am thinking in terms of the Fire Marshall, exit doors whatever. I think he is going to have to meet all those standards of public gathering place and I just think that it would be in your best interest to touch those bases as soon as possible with our local city agencies. I would start with the fire department and maybe go to the building department as well. I would do that. Stiles: The public safety issue definitely needs to be (Inaudible) Johnson: The public safety issues, our. requirements may differ from Central District Health and also from State requirements. Winn: The way it is right now it is single container throw away, nothing. It is single container, I can't touch the ice I have to use an ice prong. Johnson: I am more interested in things like fire safety, does the door go in or does it go out. Does it have a panic bar, those kinds of things I think you may have to meet some of those requirements as well. I am not trying to discourage you I just want you to go in with your eyes opened that you know you might have to do some of those things as well. Winn: This was not my dream, I mean in 1978 I was hoping it would be a nice cafe or (inaudible) this is not what I expected. Johnson: The only thing that I still have that I had in 1978 is I used to play better golf. Any other questions of Mr. Winn? MacCoy: 1 have the first question to give to our Council is there in the Idaho law a distance set forward from a drinking establishment of issuance of liquor to either a public building or next to a library like where we have children involved. Crookston: Yes there is, it is 300 feet. MacCoy: Since I only have a parking layout are you planning to do nothing except just be there. MacCoy: Okay, what about signage? • Winn: The only thing I have is no one under 21 to enter, I am not advertising at all. What the law says is I have to be open for 6 months and that is all, it doesn't say I have to sell anything. It says I have to be open and that. is all I want. MacCoy: That is all I have. Oslund: Not necessarily a question, let me just start off by saying that I, since your hours are so restricted you won't catch me down there taking a drink because I don't drink during the day usually. On the map that was provided.with the application just a clarification at least the one I have it shows the location of the block, it shows, where mine shows anyway is about where the library is right here. Winn: No it is right across from the 127 Club. MacCoy: That was the reason for my question because I saw that map. That will be on our next scheduled meeting July 9 then from July 9 it goes to the City Council for their approval and if everything goes through the earliest it can be approved is, it could be the 23rd of July, could be that is with no hang ups. It might make it to the 16th. (Inaudible) Johnson: Yes you went there for the license now you have to get permission to zone for it to use the license. That is kind of a lengthy process but I wanted you to know that before you left and I should have told you that. (Inaudible) Johnson: Well that is really not our function to do that, all we can do is provide you with all of the information that you need so that you can tell them this is the process 1 have to go through, I started it in good faith and just because the fact that we only meet once a month you are kind of restricted see. The City Council they meet twice a month and you have to fall in with those dates because we are required by law to notice the public twice 15 days in advance. When you are working with a newspaper that is a weekly then we have to advertise it in the weekly it is a local paper instead of a daily. You start putting all of those. dates together it just stretches the process out. Even if you hit everything smoothly it can take 90 days or so. (Inaudible) Johnson: What I would do is certainly prevail upon them with the extenuating circumstances that you are doing everything that you can. When did this license become available to you? Locust Grove which is approximately 200 feet south of Lanark. I am located on the east side of this proposed project. We have lived on Locust Grove since 1986 and kind of got used to the quality of life out there. I am not really opposed to this type of building, I did come to try and find out down here at the City they didn't have the information as to what type of business was going in there. So I (inaudible) I am kind of concerned on the business hours. I don't know if you have restrictive covenants for these kinds of things that are built in a residential area. I would like to see something similar to a 6 a.m. to a 10 p.m. type of arrangement if we could at least along what is now Locust Grove Road. I don't know what you are going to change it to. 1 see that you are relocating it and aligning it with, on the north and south side. I live right behind Cope Auto Parts and that is pretty (inaudible) real big problem, it doesn't bother me that much and I wondered if anybody could answer, is there any kind of hours set up for this type of businesses? Johnson: I don't think that we are going to be able to answer a whole lot of questions because the applicant isn't here. IDAHO STREET .~ .,-~~ \ JJ -v FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing June 11, 1996, at the hour of 7:30 o'clock p.m., the Petitioner, Dwayne Winn, appearing in person, the Planning and Zoning Commission of the City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions of Law: FINDINGS OF FACT 1. That a notice of a public hearing on the Conditional Use Permit was published for two (2) consecutive weeks prior to the public hearing scheduled for June 11, 1996, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the June 11, 1996, hearing; that the public was given full opportunity to express comments and submit evidence; and that copies of all notices were available to newspaper, radio and television stations. 2. That this property is located within the City of Meridian and the Applicant is not the owner of the property; that the owner of the property, Dean Mayes, Jr., has submitted his consent to the application and the application is not at the request of the City FINDINGS OF FACT AND CONCLUSIONS OF LAW - DWAYNE WINK PAGE 1 • • of Meridian; that the property is described in the application which description is incorporated herein. 3. That the property~is zoned Old Town, which requires a conditional use permit for the sale of alcoholic beverages. 4. That the Old Town District is described in the Zoning Ordinance, 11-2-408 B. 12. as follows: (OT1 Old Town District: The purpose of the (OT) District is to accommodate and encourage further expansion of the historical core of the .community; to delineate a centralized activity center and to encourage its renewal, revitalization and growth as the public, and quasi- public, cultural, financial and recreational center of the City. A variety of these uses integrated with general business, medium-high to high density residential, and other related uses is encouraged in an effort to provide the appropriate mix of activities necessary to establish a.truly urban City Center. The District shall be .served by Municipal Water and Sewer systems of the City of Meridian. Development in this district must give attention to the handling of high volumes of traffic, adequate parking, and pedestrian movement, and provide strip commercial development, and must be approved as a conditional use, unless otherwise permitted. 5. That the use proposed by Applicant is a specifically allowed conditional use in the Zoning Schedule of Use Control, 11- 2-409. 6. That the property has been in use for several years; that at present, one half of the building is used by Dean Mayes, Jr. to sell insurance, with the other half used for storage. 7. That the Applicant stated in the Application that Mr. Mayes has leased the Applicant a portion of the space used for storage in his building to sell alcoholic beverages at this location for six (6) months to meet the requirements of the Alcohol FINDINGS OF FACT AND CONCLUSIONS OF LAW - DWAYNE WINN PAGE 2 • Beverage Control Bureau; that the hours of operation will be from 10:00 a.m. to 6:00 p.m., six (6) days a week; that the Applicant agrees to pay any additional fees regarding trash, sewer, or water. _ 8. That sewer and water is available to the property. 9. That Mr. Winn testified before the Commission that the hours of operation would be from 9:00 a.m. to 5:30 p.m; that there would be seating capacity for 4-5 customers; that the Applicant has gone into agreement with the health department and is in the process of fixing a few items, such as the inlet to the toilet and a spring loaded door to the restroom; that the Applicant plans to just be there for the required time frame in order to obtain a liquor license; that the law says to be open for six (6) months and that is all; that the law doesn't say anything needs to be for sale; that this proposed establishment is right across from the 127 Club; that the only signage would be a "No One Under 21 Years of Age" sign. 10. Commissioner Johnson commented that there may be more requirements the Applicant may need to meet with regard to local ordinances and those particularly pertaining to fire, safety and health standards. 11. Commissioner MacCoy stated that there is an Idaho law about a drinking establishment being within 300 feet of a public building. 12. That the Meridian Planning and Zoning Administrator, Shari Stiles, and Assistant to the City Engineer, Bruce Freckleton, FINDINGS OF FACT AND CONCLUSIONS OF LAW - DWAYNE WINN PAGE 3 • • the Meridian City Police and Fire Department, Central District Health Department and the Nampa and Meridian Irrigation District submitted comments and they are incorporated herein as if set forth in full. 13. The Assistant to the City Engineer, Bruce Freckleton, commented that all signage shall meet Section 11-2-415; that off- street parking shall be provided in accordance with Section 11-2- 414; that outside lighting shall be designed and placed so as to not direct illumination on any nearby residential areas and in accordance with City Ordinance Section 11-2-414 D 3; and that sanitary sewer and water to this facility would be by means of existing service lines and that assessments for sewer and water service will be reviewed to see if additional load would justify an adjustment; that the Applicant provide any information with regard to the anticipated water demand and will be required to enter into an Assessment Agreement with the City of Meridian. 14. That the Planning Director, Shari Stiles submitted comments and they are incorporated herein as if set forth in full and include the following: 1. That Central District Health Department submitted comments and they are incorporated herein as if set forth in full; that the Central District Health. Departments comments are as follows: 1. Applicant is requesting a waiver to most of the requirements of the Rules Governing Food Sanitation Standards for Food Establishments (UNICODE). 2. The site the Applicant is currently proposing is an insurance office with two entrances and a toilet room. 3. Applicant must comply with Alcohol Beverage Code which requires the Applicant to be open for business six (6) days a week, eight (8) hours per day. 4. According to the Applicant he is not attempting to make money at this site and has said that is not necessary to get through the first six ( 6 ) month required and he can go out of business after six (6) months and still retain ownership of the liquor license. 5. That the location of the establishment lacks a handsink, mopsink, 3 compartment sink or dishwasher, toilet room with self-closing door and ventilation. 6. That the facility has an acceptable floor, ceiling and shielded lights, a domestic refrigerator for the FINDINGS OF FACT AND CONCLUSIONS OF LAW - DWAYNE WINN PAGE 5 • • storage of cans of beer and a bag of ice, a domestic ice bucket with clear plastic lid. 7. That the Applicant will use tongs to dispense ice and plastic single-use cups for beverages. Central District Health also stated in response to the waiver request, the following list of requirements or corrections shall be made to maintain approval .for a Central District Health Department license, based on the findings, the limited menu, and the low risk as defined in the UNICODE, appendix A.: 1. Remove submerged inlet in toilet tank; make toilet room door self-closing. 2. "Bartender" shall thoroughly wash hands after using the toilet. 3. Ice shall not be touched with bar hands and will be placed into cups using tongs or ice scoop. 4. The license holder will be certified as a trained supervisor and properly instruct the bartender in food handling practices. 5. The menu (drinks served) must be submitted for approval prior to licensing. No mixed drinks are allowed. No menu changes are allowed without prior CDHD approval. 6. The license will expire December 31, 1996 and not be renewed for this or any other site without full compliance with the Rules Governing Food Sanitation Standards for Food Establishments (UNICODE), June 30, 1995. 7. Failure of the Applicant to fully comply with this agreement or the Terms and Conditions of a License will result in immediate revocation of CDHD's license. 16. That Commissioner MacCoy submitted comments to the Application and they are incorporated herein as if set forth in full; that he questions the distance from the library, which is FINDINGS OF FACT AND CONCLUSIONS OF LAW - DWAYNE WINN PAGE 6 ! ~ used by children of minor age, and this type of establishment, which allows sales of alcoholic and intoxicating beverages, and what the State laws have to say about this; that a parking area/lot and signage information with regards to size, location, lighted, was not submitted. 17. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. 18. That no other testimony was offered regarding this application. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 D of the Revised and Compiled Ordinances of the City of Meridian, Idaho; FINDINGS OF FACT AND CONCLUSIONS OF LAW - DWAYNE WINN PAGE 7 • • 4. That 11-2-418 C of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area,. the. Planning. and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan but the Zoning Ordinance requires a conditional use permit to allow the use. c. The use apparently would be designed and constructed, to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use could involve a use, activity, process, material, equipment or conditions of operation that could be detrimental to people, property or the general welfare by reason of serving alcoholic beverages at the establi.ghment. g. That sufficient parking for the property and the proposed use is required. h. That the conditional use could be allowed if the below stated conditions are met. 5. That the conditions referenced in 4 f. above are as follows: 1. Idaho Street, but within the hours set forth below for the operation of the establishment. 2. That the hours of operation shall be from 10:00 a.m. to 6:00 p.m., Monday through Saturday, and not greater unless the Applicant requests the hours to be changed. 6. That the comments of the Assistant to the City Engineer and the Planning and Zoning Administrator must be met and complied with. 7. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, the Uniform Electrical Code, the Fire and Life Safety Code, all parking and paving requirements. 8. That the structure on the property must be brought up to all codes prior to issuance of an occupancy permit. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The Meridian Planning and Zoning Commission hereby adopts and approves these Findings of Fact and Conclusions. May 24, 1996 Dwayne Winn, dba Dwayne's Place at 120 E. Idaho, Meridian, is proposing to operate a tavern at this site. He is requesting a waiver to most of the requirements of the Rules Governing Food Sanitation Standards for Food Establishments (TJNICODE), June 30, 1995. Findings of Fact: According to applicant, Mr. Winn, he has received a liquor license after being on the waiting list since 197O's. If it is not actively used for a minimum of six months he loses the license back to the State of Idaho. He has been looking for a business which would like him to operate or share it's bar operation and has not been successful. The site he is currently proposing is an insurance office with two entrances, a toilet room. Mr. Winn must comply with Alcohol Beverage Code which requires that he be open for business 6 days a week, 8 hours per day. He is not attempting to make money at this site and has said that is not necessary to get through the first six month required. He can go out of business after six months and still retain ownership of the liquor license. Lacks: handsink, mopsink, 3 compartment sink or dishwasher, toilet room with self-closing door and ventilation. Has: acceptable floor, ceiling and shielded lights, a domestic refrigerator for the storage of cans of beer and a bag of ice, a domestic ice bucket with clear plastic lid. Will use tongs to dispense ice, plastic single use cups for beverage. Landlord cleans/mops floor with sponge mop. Dumps waste into toilet? Toilet has submerged inlet which will be corrected. Paper towel dispenser is to be installed in toilet room. In February 1996 I entered into an agreement with the owner of E1-Zocalo's cafe to place the alcohol beverage license and manage the alcohol beverage portion of his business. The last week of February ( 27 or 28 ) I was told that the business was awarded to his wife in a divorce settlement. On the 29th of February I was ordered to be on a disaster team for the flooding in North Idaho to leave March 3, 1996. This was one week before my completed application was to be into the Alcohol Beverage Control. On March 1, I gave my daughter Power of Attorney and on march 3, I left for north Idaho leaving my daughter and attorney Freeman to place the license and submit a completed application to the Alcohol Beverage Control, which they did on March 8, 1996. I arrived home from North Idaho late in the evening on Thursday, April 24, 1996. There was message on my answering machine from Special Agent, Fred Burn to see and meet me at my place of business on 120 E. Idaho. Since I had not seen the place myself I put him off until the next Tuesday March 30. He approved the location and I started preparation of the application for the Conditional Use Permit and the Permit to Sell Liquor and Beer for the City of Meridian and the Ada County Alcohol Beverage License procedures. On May 2, I spent most of the day at the Ada county Recorder as every owner of property within a 300 ft. Radius must be noticed for the conditional use permit. There were 32 property owners who's name and address were needed for the conditional use permit. The same day I was also notified that the State License was ready which I picked up that afternoon. I also met with Shari Stiles Meridian Planning and Zoning Administrator to go over my Conditional Use Permit, as if anything is missing, it will delay the process a month as planning and Zoning only meet monthly. She also informed me that it would not do me any good to have the applications in before May 17th because the City Council would not review them before that date for their Council meeting on May 21, 1996. 1 ~~ I completed both applications for Meridian and submitted and payed for them on May 14, 1996. I submitted and payed for the Ada County License on May 15, 1996. The Ada County License require both the Central District Health Departments approval and the Sheriff's Department approval prior to submitting the application to the County Commissioners. The Sheriff"s Departments approval was obtained on the 14th however the Central District Health Department required filling out an application and an inspection of the premisses. I submitted the application on May 15 and the first date they could inspect the location was May 23, 1996. I met with Christy Klaus and her Supervisor at 2.30 PM on May 23rd. They had several items that required changing which I accomplished and obtain their approval on May 29, 1996. On May 21, 1996 I attended the Meridian City Council's meeting, presented my proposal and they approved the application for the Sale of Liquor and Beer. On May 31, 1996 at 10.30 a.m.I attended the Ada County Highway's meeting inwhich they review all application prior to being sumitted to the Ada County Board of Commissioners which was scheduled for June 11, 1996. On June 6th I received notification that I was on the agenda for the Meridian Planning and Zoning meeting to be held June il, 1996. I picked up the agenda notice and since there was no objections received from the 32 property owner contacted, I stocked the bar with liquor and beer on Saturday June 8, 1996. On June 11, I attended the Meridian Planning and Zoning meeting. I presented my proposal the same as I had at the City Council's meeting and instead of acting on it, they submitted to the city attorney for a Finding of Fact. I was dumb founded. I called the City Clerk the next day, who also was at the meeting, and ask why they didn't act on it, as none of the 32 property owner had objected. He stated that the action they took was just standard procedures. That once the attorney made his finding of fact, they would approve it. I called Dean Mayes, the lanlord, on June 12, 1996 and ask him to sell anyone a drink if they ask for it as I couldn't wait any longer and that everything is in the process of being approved. He did not do it because he does not want to get in trouble with his insurance business being in the same building. I passed the Idaho Food Safety and Sanitation Supervisor test and received a card from the Department of Health and Welfare Division of Health, a requirement of the Central District Health Department. I received the Ada County License which was acted on during their June il, Commissioner's meeting and approved on June 17, 1996. 2 I do not know of any actions I have taken that has slowed or hindered this bureaucratic process, infact I have been to every known meeting to answer question to expedite the process if possible. I'm requesting that you reconsider you letter of June 18, 1996 as I have received everything except the Meridian City License which is contingent up on the Conditional Use Permit from Planning and Zoning. Your food establishment has two important publications -Rules Governing Food Safety and Sanitation Standards for Food Establishments (LJNICODE) (IDAPA 16.02.19) and Idaho Food Safety and Sanitation Manual (iVIANUAL). The UNICODE is the rules in which all food establishments must comply. The MANUAL, however, provides-for the understanding of the critical food safety and sanitation conditions -those conditions that relate directly to factors which lead to foodborne diseases -contained in the iJ1~TICODE and why they are important to your business. This is the purpose of the training. Enclosed is an Application/Test Form, a test, two certificates, an envelope, and a mailing label. Instructions for their use are as follows: 1. Provide the MANUAL to the supervisor being trained. Because the MANUAL may be used by other supervisors in the business, you may have special instructions on when and where to use it; 2. The MANUAL should be studied intently. Special attention should be given to specific parts of the MANUAL that relate to why foodborne diseases occur and how to prevent them; 3. After studying the MANUAL, the supervisor should complete the Application/ Test Form according to the instructions. A determination must be made by. the license holder who will certify the testing (see bottom of A~lication/Test Form). This person can be the license holder yr his/her designee.
