Plaintiffs' counsel, and based upon the verified Complaint, the
Affidavit of Fredric V. Shoemaker, Affidavit of Chuck Smith, the
Affidavit of Publication and proof of service, the Court FINDS,
CONCLUDES, ORDERS AND ADJUDGES as follows:

Plaintiffs in this action are Gordon R. Wood and Margaret
M. Wood, husband and wife, Dan Wood, an individual, Norman R.
Barker and Donna D. Barker, husband and wife, and Albert E.
Monroe and Maxine M. Monroe, husband and wife, sometimes
hereinafter referred to as "Plaintiffs". Defendants are Phyllis
R. Akerstrom, an individual, and Richard T. Akerstrom, an
individual, sometimes collectively referred to herein as
"Akerstroms", Idaho Power Company, an Idaho corporation, and the
unknown heirs of John Post and Florilla E. Post, husband and
wife, now deceased.
II.
• On November 3, 1993, a verified Complaint to Quiet Title
was filed by Plaintiffs against the Akerstroms, Idaho Power
Company, and the unknown heirs of John Post and Florilla E. Post,
both deceased, for the purposes of quieting title to certain
lands and rights thereto for certain property located in Ada
County, Idaho, commonly known as a portion of "North Dixie Lane",
together with certain property immediately abutting a portion of
North Dixie Lane to the west.

III.
Although not a party to this action, the Ada County Highway
District, a political subdivision of the State of Idaho has,
through the Affidavit filed by Chuck Smith, its Senior Right-of-
Way Agent, dated October 5, 1993, confirmed the status of North
Dixie Lane as a private roadway, which Affidavit also expresses
that the Ada County Highway District has no interest or claim to
any portion of North Dixie Lane.
IV.
From the files in this matter, it appears that Defendant
Richard T. Akerstrom was served with a Summons and Complaint on
November 4, 1993 and Phyllis R. Akerstrom was served with a
Summons and Complaint on November 10, 1993. Defendant Idaho
Power Company was served, pursuant to an Acceptance of Service
dated November 8, 1993.
V.
The Defendants Akerstroms, their attorney, Plaintiffs, and
their attorney, have entered into and have filed with this Court
a Stipulation regarding Richard T. Akerstrom and Phyllis R.
Akerstrom parcel dated February 28, 1994, which the Court has
reviewed and which sets forth the respective rights and
responsibilities of the Plaintiffs and the Akerstroms with
respect to North-Dixie Lane and the property abutting North Dixie
Lane to the west.

VI.
Based upon the Affidavit of counsel and the verified
Complaint, this Court signed an Order for Service by Publication
dated February 4, 1994, authorizing service by publication upon
the heirs of John Post and Florilla E. Post, husband and wife,
now deceased, and it appearing from the files and records in this
proceeding that said .heirs were duly and lawfully served by
publication in the Idaho Statesman for four (4) consecutive weeks
beginning with February 12, 1994 and ending on March 5, 1994, and
no answer or other responsive pleading has been presented to or
filed with this Court, the relief sought in Plaintiffs' Complaint
as against these Defendants should be granted.
VII.
Plaintiffs Gordon R. Wood and Margaret M. Wood, husband and
wife, and Dan Wood (collectively "Woods"), are residents of the
County of Ada and own the real property described in Exhibit "A"
hereto (the "Wood Parcel").
vIII.
Plaintiffs Norman R. Barker and Donna D. Barker, husband
and wife ("Barkers"), own the real property described in Exhibit
"B" hereto (the "Barker Parcel").
IX.
Plaintiffs Albert E. Monroe and Maxine M. Monroe, husband
and wife ("Barkers"), own the real property described in Exhibit
"C" hereto (the "Monroe Parcel").

Defendants Akerstroms are residents of the County of Ada
and own the real property described in Exhibit "D" hereto,
hereinafter referred to as the "Akerstrom Parcel".
XI.
The Plaintiffs claim no interest and have no interest to or
in the Akerstrom Parcel.
XII.
North Dixie Lane is located in the South 1/2 of the
Northeast 1/4 of the Southwest 1/4 of Section 5, Township 3
North, Range 1 East of the Boise Meridian, Ada County, Idaho, and
is legally described as follows:
A strip of land 20 feet wide, being the West
20 feet of the South 1/2 of the Northeast 1/4
of the Southwest 1/4 of Section 5, Township 3
North, Range 1 East of the Boise Meridian,
Ada County, Idaho.
A portion of North Dixie Lane abuts the Akerstrom Parcel
immediately to the west and is legally described as follows:
Commencing at the Southwest corner of the
Northeast 1/4, Southwest 1/4, Section 5,
Township 3 North, Range 1 East, Boise
Meridian, Ada County, Idaho;
thence North 145 feet;
thence East 20 feet;
thence South 145 feet;
thence West 20 feet to the POINT OF
BEGINNING.
This portion of North Dixie Lane is referred to in the
Stipulation and shall be referred to herein as the Akerstrom
Access.

Plaintiffs own in fee simple and are entitled to the quiet
and peaceful possession of North Dixie Lane by virtue of a Deed
dated March 17, 1908, recorded March 18, 1908, as Instrument No.
19088, recorded in Volume 70, at page 158, records of Ada County,
Idaho, and the Stipulation dated February 28, 1993, subject
however to the following:
(a) A permanent and perpetual easement hereby granted unto
the Akerstroms, their successors and assigns, for the quiet,
peaceful and non-exclusive use of the Akerstrom Access for
purposes of pedestrian and vehicular access to the Akerstrom
Parcel, as same may be necessary and reasonable to provide access
to a public right-of-way through other lands not owned by any
party to this litigation, but which the Court having taken
judicial notice, constitutes an extension of Dixie Lane to the
south, which runs generally in a southerly direction, having as
its northerly terminus the southerly terminus of North Dixie Lane
and as its southerly terminus the Fairivew Avenue public right-
of-way. Said lands, referred to herein as South Dixie Lane and
the ownership thereof, was not the subject matter of Plaintiffs'
Complaint and is not the subject matter of this Judgment; and
(b) The rights of Idaho Power Company as the grantee and
beneficiary by reason of an easement recorded for its benefit as
Instrument No. 168008 on February 17, 1936, and an easement
recorded as Instrument No. 156390, recorded on March 29, 1934,

under authority of which Defendant Idaho Power Company has
installed-poles, lines and other electrical apparatus pursuant to
those easements and to which easements and rights thereunder
Plaintiffs and Akerstroms are subject and subordinate to .'
xiv.
Plaintiffs shall not interfere with Akerstroms, their
successors or assigns, in respect to their peaceful and quiet use
of the Akerstrom Parcel and the Akerstrom Access for purposes of
providing pedestrian and vehicular access to the Akerstrom Parcel
for residential purposes.
XV.
John Post and Florilla E. Post, husband and wife, now
deceased, were the last persons having an express recorded
grantee's interest in the following described real property,
sometimes referred to herein as the "Ten Foot Strip", which
immediately abuts and adjoins North Dixie Lane and the Akerstrom
Access to the west:
A strip of land ten feet wide, being the East
ten feet of the South Quarter of the
Northwest Quarter of the Southwest Quarter of
Section 5, Township 3 North, Range 1 East of
the Boise Meridian, Ada County, Idaho.
XVI.
Based upon the Stipulation and the verified Complaint,
Plaintiffs are the owners in fee simple and are entitled to the
quiet and peaceful possession of the Ten Foot Strip by reason of
their succession to the interest of Plaintiffs Woods, together

with Woods' predecessors-in-interest, who have had the exclusive,
complete, actual, open notorious, hostile and continuous
possession of the Ten Foot Strip adverse to the unknown heirs of
John Post and Florilla E. Post, husband and wife, now deceased,
and all other parties and persons for the requisite statutory
period, to wit: five (5) years.
XVII.
Plaintiffs are entitled to judgment against Defendants,
Idaho Power Company, Akerstroms, and the unknown heirs of John
Post and Florilla E. Post, husband and wife, now deceased,
subject to those Defendants' respective rights and easements as
` set forth hereinabove, and each party shall bear their respective
costs and attorneys fees, except that the cost of recording this
Judgment shall be borne by Plaintiffs.
XVIII.
The foregoing constitutes this Court's Findings of Fact,
Conclusions of Law, and Judgment quieting title.

Ordinances for a Final. Plat for the above subdivision. As stipulated by said ordinance, please find enclosed the

1. 30 copies of the Application for a Final Subdivision Plat, with an 8-1/2U x 11~ reduction of the plat.
2. 30 copies of the Final Plat, Sheet 1, 18"x27", at a scale of 1" = 100'.
3. 3 copies of the Final Plat signature page, Sheet 2, 18" x 27".
4. 10 copies of a reduced copy of the Final Plat at a scale of 1" = 300'.
5. A check in the amount of $530.00 for the Final Plat application fee from the Developer.

Streets, curbs, gutters, and sidewalks will be constructed to standards as required by Ada County

IMPORTANT INFORMATION
Inspection requests must be made 24 hours prior to the need for inspection. Persons making the requests must provide the
following information: 1) owner/contractor, 2) project location, 3) date and time when the inspection is needed, 4) type of inspection,
5) permit number. The inspection request line is available 24 hours a day, 365 days a year, inspections will be performed Monday
Friday, between 8:00 AM and 5:00 PM, ezcluding holidays.
Other Permits are Required for the installation of any electrical wiring, plumbing piping and mechanical installations
related to gas fired equipment.
Permit RevoCation/Expirstion. The Building Official reserves the right to revoke any permit issued in error or on the basis
of incorrect information. Permits expire in 180 days if: work is never commenced, or is discontinued for a period ezeeeding 180 days
or 6 months.
Declaration -This permit is being issued subject to the ordinances and laws of the City of Meridian, and it is herby agreed that

is just because they want to put a name up I would think that is fine. If it is some kind of
posturing so that the street across Eagle Road won't be considered public I don't know,
I don't know what the purpose is except to maybe just put a sign up.

part of St. Luke's or whoever is submitting this application.

Construction is currently underway for the newest part of our subdiulsion,
Wingate Place ll. Originally, the gateway to this newest addition was going
to be Oakcrest Drive (parallel to Chateau Drive). However, the owner of the
property at the end of Oakcrest Drive declined to sell to the developer, Dan
Wood. Meanwhile, construction was appproued showing Dixie Place as a
gateway to the new addition. However, Dixie Place is a private lane. We are
told by Dan that eventually Wingate Place I I will connect to Doue Meadows
(the small subdiulsion oft of Fairview). However, Meridian Planning and
Zoning tells us Doue Meadows 1I, the second phase of Dove Meadows, which
has to be built before Wingate Place I I can connect, hasn't even been
submitted for approval. Therefore, it could be a very long time, it ever,
before this addition is built. Meanwhile, Chateau Drive will be the only
entrance for the additional 55 houses about to be built. We are opposed to
this for the following reasons:
*The tremendous Increase in traffic (potentially over 198 cars
a day assuming each house has 2 drivers), causes a danger to
our children playing out front.
*The increase in traffic could cause a drop in our property values.
(who wants to live on a main thoroughfare!)
*Hauing only.one,entrance to a subdiulsion can cause substantial
delays for emergency vehicles. (not to mention the fact that it is
fliegal to have only 1 entrance to a subdivision of more than 198
houses). ~ ~ ~ ~ "
We realize the building of new homes is Inevitable. In all fairness, we simply
want another entrance to the new addition to our subdiulsion at the time the
first house is built (not years down the road!). We feel we have invested
substantially in our home, and we shouldn't have to suffer due to those
anxious to make a buck, uncaring to the situation it puts us in!
If any of you are as opposed to what is happening as we are, please call any
or all of the following individuals and express your concern. We should have
some say in this as it concerns all of us!

Morrow: Why was that tabled at our last meeting?

Kingsford: 1 think in part as a result of Mr. Smith's comments about water pressure. Is that
tnae, were there other items from staff members. Mr. Smith and I discussed that at some
length today and I guess I won't speak for Gary. 1 think we were comfortable that we have
water, adequate volume and that well will be on long before.
Morrow: And everything else is fine then as far as you are concemed and Shari is
concerned?
Smith: Mr. Mayor and Councilmen, the developers's engineer responded to my comments
and they also came and met with Bruce Freckleton and myself conceming our comments.
We resolved some of the questions that they had concerning our comments. I did want
to make one comment though. The Highway District has seen fit to require the
homeowners association to maintain storm water drainage facilities outside of the right of
way. I thought I had an agreement with ACRD such that the homeowners association
could maintain the surface of the drainage way if it was a common lot area so that, and
then the Highway District would maintain anything that was sub-surface. They wanted the
common lot so they had good permanent access to the subsurface facilities. They didn't
want to have to fight something on the surface in order to get in and maintain the pipe or
the seepage pit whatever it might be. I thought we had that worked and I recently had
correspondence from ACHD on another subdivision and the individual that wrote the letter
was saying otherwise. I did get a confirmation from them in fact just today whereby they
say under specific criteria they will maintain the subsurface facilities as long as the surface
is maintained by others. One of the conditions on this Wingate Place No. 2 Subdivision
is the maintenance of the subsurface drainage facilities by the homeowners association.
I don't have it ironed out with the Highway District apparently because of this last
correspondence that I received from them. I don't know what their specific criteria is, I
haven't had a chance to talk to them about it. My personal feeling is it should not be up
to the homeowners association to take care of drainage facilities underground. The water
is generated on the Highway District's right of way, some of it of course comes from the
lots from the hard surface of the driveways, perhaps the roofs of the homes. But at a
greater extent it comes from the roadways themselves. I think it is an unfair burden to put
on a homeowners association. That most generally doesn't function very well anyway
because it is difficult for a group of people to get together and especially to take care of
something like that. So, I am just letting you know that situation exists and they have this
one set up to be maintained by the homeowners association. I guess if the homeowners
association wants to do it that is fine. The developer is saying that now placing that burden
on future homeowners. I just feel that it should be the highway district. That is the only
comment that I had on this particular plat that has not been resolved completely. I think it
is resolvable because we did get a favorable comment from the highway district on this

other subdivision.
Morrow: I guess from my perspective I have always been under the impression that was,
these things that we were approving that ACHD was going to maintain the underground
for the very simple reason that homeowners associations don't have that type of expertise,
how would they know when it is working or not working and it needs to be maintained. So
I guess if the rules are changing it appears to me we need to find out what the rules are
going to be or what the criteria is going to be. Because I am not in favor of casting the
burden on a homeowners association that I know doesn't have the expertise to do that, it
doesn't make sense.
Smith: I think we can get that information from them Councilmen, I don't have it in written
format other than the facsimile that I received today from their development analyst
commenting that there are specific criteria that need to be met in order for them to maintain
the subsurface. I believe the criteria would be a common lot area above the facility so that
the highway district does have good clear access for maintenance and not an easement.
Morrow: Would this be blanket criteria or site specific for each subdivision.
Smith: I'm not sure, I have to get that resolved. Apparently the only way I can do it is to try
a letter again and see if I can get a response. Other than that everything looks fine.
Kingsford: Mr. Come has APA taken any further lead in creation of a county wide drainage
district. They discussed it at some length before.
Corrie: It is just in the discussion stage now Mr. Mayor, there is nothing solid about it.
They haven't even set up a committee for it yet but they have discussed it, that is as far
as it has gone. Also Mr. Mayor if I may Shari, June the 18th you had some statements
(inaudible) talk with the developer, have those all been taken care of particularly #10 and
11?
Stiles: Councilman Corrie and Mayor and Council, I haven't had any response from the
developer on these issues. I would assume that they would agree to all of these
conditions if they haven't expressed any problem with them, we still do need to have the
protective covenants reviewed that I guess would address what Gary is talking about prior
to signature.

Kingsford: Here are her comments if you don't have a copy of them. Council have any

Smith: Mr. Mayor, may I make a comment concerning the water pressure issue. We have,
I think I mentioned this at the last Council meeting, we have changed sequence operation
on some of the wells. Superintendent Stuart says he has noticed and our records
indicated along with some people who live out in the area that the pressure has become
more positive. We haven't resolved the complete issue yet but I think it is a short term
situation. I don't think, and our consulting engineers that I have talked to that are helping
us with our water system do not feel that it is a supply problem. Well No. 12 which has
been out of operation for some time for rehabilitation is schedule to fire up tomorrow. It
will pump water for a day or so before they turn it into the system. That alone is I think
going to be a help in supplying water to the northwest part of town and eliminating or
alleviating withdrawal of water from the northeast part of town and other parts of the City
also. So, relating to the other final plats that were tabled for a similar reason my
comments I think that we are in the same situation with them. The time as Mayor
Kingsford mentioned, the time line between when these subdivisions are approved and
constnaction takes place on site we should be in good condition for the pressure situation.
Again, I don't feel that it is a supply problem, we have the water supply available.
Kingsford: Certainly your information and I appreciate you providing that for myself and the
Council would indicate that we use less water this year so far than we did a year ago and
didn't seem to have as much of a pressure problem a year ago. Certainly the wells are not
putting out what they are capable of by any means.
Smith: They are not all running, generally speaking we have 3 wells running. Well No. 15
runs all the time, No. 10 is second well on and No. 8 and I think No. 11 falls in there close
by. Those might be reversed, but anyway, three of the wells over the last 5 day period that
Bruce was monitoring for me ran pretty much all the time. The other wells cycled on and
off. One Well No. 7 and of course Well No. 12 is not operating, Well No. 7 did not come
on at all. During that period of time there was one well in reserve at a minimum.
Tolsma: Have you figured out how many gallons per minute really we had on reserve. t

know CH2M Hill said we needed a 5% reserve capacity or something like this.
Smith: No I haven't.
Tolsma: But with the other wells how many GPM we could pump if we had to.
Smith: With Well No. 12 and Well No. 16, 16 will be on line in September, we'll have about
10,700 GPM capacity. Out of that you need to eliminate your large well in order to call it
firm capacity assuming that you have one well down. Our large well is No. 15 which is
pumping 1900 and some gallons per minute.
Kingsford: Any other questions of the Council? Gary I appreciate you giving us more
information we really needed. Is the Council prepared to take action?
Morrow: Mr. Mayor I would move that we approve the final plat for Wingate Place
Subdivision No. 2 subject to staff conditions.

or the Nampa Meridian Irrigation District. I would like to see that issue resolved and
addressed by the developer. Given recent events with respect to these subdivisions in
Meridian Greens I would like to see all that stuff as part of the record and on the record
and in writing. So I would invite both Gary's and Shari's comments with respect to Los
Alamitos Park Subdivision.
Smith: Mr. Mayor, Councilman Morrow, this issue came to light from a developer

SUBJECT: Final Plat for Wingate Subdivision No. 2 by D. W., Inc.
1. Any existing irrigation/drainage ditches crossing the property shall be tiled per City
Ordinance 11-9-605 . M. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department prior to signature on final plat.
2. Perimeter fencing must be in place prior to obtaining building permits for housing.
Particular attention needs to be given to the enclave at the southwest portion of the
property. Surety as approved by the City for fencing and other necessary improvements
will be required prior to signature of the final plat.
3. Any existing domestic wells and/or septic systems -within this project will have to be
removed from their domestic service per City Ordinance Section 5-104A. Wells may be
used for non-domestic purposes such as landscape irrigation.
4. Submit a letter from the Ada County Street Name Committee, approving the subdivision
name and street names.
5. Submit protective covenants for subdivision in accordance with City Ordinance Section
11-9-605.I. Note for recorded instrument number of restrictive covenants needs to be
added.
6. Pedestrian walkways shall be provided in accordance with City Ordinance 11-9-605.C.
7. Easements shall be provided as required by City Ordinance Section 11-9-605. D.
8. Provide public sites and open spaces in accordance with 11-9-605.H. Any changes to
existing natural features shall meet the approval of the City of Meridian and the
appropriate public agency prior to any construction activity taking place.
9. Provide and maintain planting and reserve strips in accordance with City Ordinance
Section 11-9-605.x.1.

10. Lot 23, Block 3, is anon-buildable lot with the present configuration.

14. I believe the changes in roadway alignments have been requested by ACRD, or are not

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
We have been receiving quite a few complaints of low water pressure from residents in
various parts of the City. Also, our water system has not been able to supply required flows
to fire sprinkler systems in some recent commercial developments. These developments have
had to install a pressure booster pump in their line in order to meet required fire sprinkler
flows. In light of these problems we don't feel comfortable adding more demand to our
already taxed water system, and we respectfully request that this application be tabled until
such time as we have the problems better defined and a clear plan of action in place.
GENERAL COMMENTS
1. Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Works Department.

benefit of the City of Meridian.
(11) ...Association. Blanket easements are hereby dedicated for the benefit of

Re: Wingate Place Subdivision No. 2
Dear Councilmen:
I have reviewed the zoning request and preliminary plat for
Wingate Subdivision No. 2 and find that it includes
approximately 53 homes assuming a median value of $95,000. We
also find that this subdivision is located in census tract 103.13
and in the attendance zone for Chief Joseph Elementary, Meridian
Middle School and Eagle High School.
Using the above information we can predict that these homes, when
completed, will house 18 elementary aged children, 13 middle
school aged children, and 12 senior high aged students. At the
present time Chief Joseph Elementary is at 119 of capacity.
The Meridian School District is not opposed to growth in our
district, however this subdivision will cause increased over-
crowding in all three schools. There is little opportunity to
shift attendance boundaries since the surrounding schools are
also well over capacity. Before we could support this
subdivision, we would need land dedicated to the district or at

best use of those tracts is not going to be 1 to 5 acre parcels. The highest and best use
will be found in the development of lots that are 6,000 to 8,000 square feet. Particularly
those tracts that are next to the Kearney Place Subdivision, Wingate Place and
Chamberlain Estates Subdivisions. For those parcels closer to Ustick Road most of that
redevelopment will most likely be similar to the development which has been approved
north of Wingate. So we ask that in your review of the findings and before you issue the
findings we would ask that you maybe take a look at those items that do not specifically
affect Packard No. 1 which is the 39.87 acres south of the lateral. Again, we are
contiguous to the City limits, your comprehensive Plan has designated this as a residential
zone. We are trying to provide for buffering between the Carol Subdivision which is an
acre lot subdivision currently under county jurisdiction and those smaller lot subdivisions
which are located within the Meridian City limits. Those basically have an R-8 density and
have lots as small as I believe about 6,000 square feet. We do comply with the provisions
of your Comprehensive Plan, the subdivision will be in compliance with your zoning
ordinance and development standards. We ask that you annex this property with the zone
of R-4. Are there any questions from the Council?
Kingsford: Questions from the Council? Mr. Morrow?
Morrow: l have some, is my packet missing, there is no proposed, in my information, there
is no proposed lot layout or any of those kinds of things.
Kingsford: He is indicating that is still at P & Z.
Morrow: The question is why is not with this?
Hutchinson: Mr. Mayor, Councilman Morrow, the application, the P & Z held it up they felt
comfortable with the annexation when they acted on the annexation. However, they had
a couple of questions for the City Engineer so they delayed the application for the
subdivision. At their last meeting the Planning and Zoning Commission did recommend
approval and passed the subdivision proposal on for you. I am not sure when that is going
to be scheduled for you.
Kingsford: You didn't receive this map, I thought that everyone received it. I don't have
it out here I have seen it.
Hutchinson: I have a view foil, I don't know if you have an overhead projector.

1. Any existing irrigation/drainage ditches crossing the property shall be tiled per City
Ordinance 11-9-605.M. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department prior to signature on final plat.
2. Perimeter fencing must be in place prior to obtaining building permits for housing.
Particular attention needs to be given to the enclave at the southwest portion of the
property. Surety as approved by the City for fencing and other necessary improvements
will be required prior to signature of the final plat.
3. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-104A. Wells may be
used for non-domestic purposes such as landscape irrigation.
4. Submit a letter from the Ada County Street Name Committee, approving the subdivision
name and street names.
5. Submit protective covenants for subdivision in accordance with City Ordinance Section
11-9-605.I. Note for recorded instrument number of restrictive covenants needs to be
added.
6. Pedestrian walkways shall be provided in accordance with City Ordinance 11-9-605. C.
7. Easements shall be provided as required by City Ordinance Section 11-9-605.D.
8. Provide public sites and open spaces in accordance with 11-9-605.H. Any changes to
existing natural features shall meet the approval of the City of Meridian and the
appropriate public agency prior to any construction activity taking place.

ITEM #12: REQUEST FOR FINAL PLAT AMENDMENT TO WINGATE SUBDIVISION N0.
2 BY DAN WOOD:
Wood: Mr. Mayor and Council members I am requesting I had swale lots intended for, well
first off do you have a copy of the information that I turned into the City. It is my letter as
well as the plat and then something 1 turned in Monday was a letter with ACHD's approval
of taking out the swales and putting in-subsurface drains. I wasn't sure that you had gotten
that one. It is dated the 15th. What I am asking for is originally when the Council
approved my preliminary plat there I was going to turn around and have two swate (ots,
two that are kind o grated there on that plat. They approved that with some concerns
about this homeowners association maintaining those swale lots and at the time ACRD
had a policy well since then ACRD has changed their policy and now what they want me
to do is they want the homeowners to maintain the surface as well and then they will
maintain.
Corrie: Excuse me for just a minute, Mr. Carmack, would you be sure to talk to Shari for
just a minute. I am sony Dan go ahead.
Wood: So ACRD has changed their policy and they want the homeowners to maintain the
surface and they will maintain the heavy duty subsurface of the swale lots. With their
additional changes they have required on my swale lots the point where I reanalyze it for
what they want me to do there I might as well put in the subsurface that way the
homeowners association won't have to be burdened with taking care of the swale lots,
paying the association fee to maintain them. I figure it is a benefit to them as well as to
everybody else not to wont' about those swale lots. So what I am requesting is to basically
make those two lots buildable lots. One is 7500 square feet the other one is 9000 square
feet. That is what I was hoping to do tonight. Other than that, if there are any questions.
Corrie: Questions from Council?
Rountree: I have none, it appears that it meets our ordinances.
Corrie: Counselor, do you see any problem with that as far as ordinances are concerned?
Crookston: No l don't.
Morrow: May I ask, Gary, is everything here is fine as far as you are concerned from the
Public Works Department standpoint?

Smith: I think my associate Bruce Freckleton had a couple of comments that were
submitted on this request but it doesn't appear that there is a problem. There will be some
modifications necessary but they can be done.
Corrie: I did talk to Shari about this afternoon she didn't have any problems. Shari any
comments or any problems with this request?
Stiles: Mr. Mayor and Council I asked Mr. Wood to come and ask the Council for this just
because I didn't feel 1 wanted to make that as a-staff level decision. I didn't know what
policy is as far as ACHD's policy. I haven't seen anything very definitive on what they
prefer and since these were going to add two lots to the buildable lots and take away
common area I would prefer that the Council acted on this change in the plat. Did you ask
Gary?
Corrie: Yes
Rountree: It looks like a reasonable request, it meets our ordinances, it meets the terms
or requirements for this particular subdivision zoning.
Morrow: I don't have any problem with it.
Corrie: 1 will entertain a motion for the approval of the request for a final plat amendment.

Re: Wingate Place Subdivision #Z
Dear Sirs:
At the present time, Lot 17, Block 3 (approx. 9,200 sq. ft.) and Lot 5, Block 5,
(approx. 7,500 sq. ft.) are designated as storm drainage retention ponds. I am
requesting that the Meridian City Council allow these lots to be changed to
residential lots on which homes would be built.
When the subdivision was approved Last July the requirements of ACHD were
such that it was cost effective to have the two storm drainage retention ponds. At
the present time, due to the changes that ACHD has made in their requirements
for storm drainage retention ponds since July, it is more cost effective to use sub-
surface drainage facilities instead.
Even though the cost of sub-surface drainage facilities exceed that of storm drainage
retention ponds, I feel this is the most economical with the least liability and most
benefits to the homeowners of Wingate #2.
The attached is the proposed cost of maintaining the two drainage retention ponds
by Community Management, a Division of Hubble Engineering. As you can see,
it would cost the 53 homeowners approximately $100.00 a year to maintain these
ponds, not to mention the additional liability involved. By removing the storm
drainage retention ponds, I feel this would be a benefit to the homeowners, the city
of Meridian, and ACHD; and that the homeowners would not want to pay this much
per year to maintain these ponds.

The drainage ponds located within this subdivision will be owned and maintained by .the
Wingate Place Subdivision Homeowner's Association. ACRD will accept all heavy
maintenance duties. required. The Homeowners Association will perform all light
maintenance.
The street plans for the above referenced subdivision will be acceptable with the modifications

1. Install proper sized sediment tanks in the location of M.H. #2 and M.H. #5.
2. Place a 3-foot layer of sand per section 8010.5 below detention facilities.
