Project is subject to all current Meridian City Code (MCC) and conditions of approval for the
Annexation/Zoning/Preliminary Plat/Final Plat/Variance and Time Extension for the Olson &
Bush #2 Development. The issuance of this permit does.not release the Applicant from any
requirements of the previous approvals issued for this site. With the approval of Olson & Bush
Subdivision #2, of which this site is a part, conditions for improvements/infrastructure were
required. The findings of Fact and Conclusions of Law for the annexation of this property are
very specific and include a requirement fora "landscaped setback, area along the property's
southern boundary with tree plantings that will grow to a height in excess of 20 feet and not
more than 40 feet, and which shall be not more than 25 feet apart at the time of planting, shall
be six feet in height when planted, and an irrigation system shall be constructed, water and
fertilizer supplied to the trees to allow adequate growth." Therefore, prior to occupancy of the
proposed building on the subject site, the subdivision improvements required with Olson
& Bush Subdivision #2 (including landscaping along the southern boundary) shall be
completed.
Landscaping_ The landscape plan is approved per the plan prepared by GJJ, labeled L-1, dated
5-12-04 and stamped "approved" on 6-1-04 by the Meridian Planning & Zoning Department.
No field changes to site -plan permitted; prior written approval of all material changes is
required. NOTE: A supplemental landscape plan, showing landscaping along the southern
boundary, has also beeri submitted and approved. This supplemental plan was prepared by GJJ,

Site Plan: The site plan is approved per the plan stamped by Brian Hull, labeled SP-1, dated 5-
12-04 and stamped "approved" on 6-1-04 by the Meridian Planning & Zoning DeparEment, with
no changes. NOTE: The site plan shows a 20-foot wide driveway on the west side of the
development. Driveway widths fall under the jurisdiction of the ACRD. However, staff
anticipates that there will be large trucks and trailers utilizing this driveway. Therefore, staff
recommends that the proposed 20-foot wide driveway on Lanark Street be widened in
accordance with the ACRD standards for commercial driveway widths, which is typically 24-
feet wide (minimum). The approved site plan is not to be altered without prior written approval
of the Planning & Zoning Department.
Irri ation: An underground, pressurized irrigation system must be installed to all landscape
areas per the approved specifications and in accordance with MCC 12-13-8 and MCC 9-1-28.
Curbing: Per MCC 12-13-7-9, all landscape areas adjacent to driveways, parking lots, or other
vehicle use, areas, must be protected by curbing, wheel stops, or other approved protective
devices. Curbing maybe cut to allow for storm water runoff.
Protection of Existin Trees: Any existing trees on site must be protected in accordance with
the Tree Preservation section of the City's Landscape Ordinance. Per MCC 12-13-13-4,
coordinate with the Parks Department Arborist (Elroy Huff) for approval of protection measures
prior to construction. Any severely damaged tree must be replaced in compliance with MCC
12-13-13-6.
Parkin: Off-street parking is approved as shown on the approved site plan (9 standard stalls, 1
handicap-accessible stall). In accordance with MCC 11-13-5, all standard parking stalls must be
constructed 9-feet x 19-feet minimum and drive aisles must be at least 25-feet wide. The project
engineer/architect shall certify that the number, location and size of handicap-accessible
space(s) conforms to the Americans with Disabilities Act (ADA). Handicap accessible stalls
must have signage in accordance per ADA. The Applicant shall be responsible for meeting the
requirements of ACHD as they pertain to this development.
Sidewalks: All sidewalks shall be constructed as submitted and in accordance with MCC 12-5-
2.x. Sidewalks shall be constructed prior to occupancy. -
Draina~e: Storm water drainage swales shall not have a slope steeper than 3:1, shall be fully
vegetated, and shall be designed in compliance with the MCC.
Li htin Lighting shall not cause glare or impact the traveling public or neighboring
development.
Sig_nage: No signs are approved with this CZC. All signs will require a separate sign permit
incompliance with the sign ordinance.
Trash Enclosure: Any dumpster(s) must be screened in accordance with MCC 11-12-1.C.
Trash enclosures must be built in the location and to the size approved by SSC.
Handicap-Accessibility: T'he structure, site improvements and parking must be in compliance
'with all federal -handicap-accessibility requirements. NOTE: Staff does not believe that the
proposed location of the handicap stall conforms to the ADA requirements for location, as it is
the furthest stall from the accessible door (see ADA Accessibility Guidelines, 4.6.2).
ACHD Acceptance: All impact fees, if any, shall be paid prior to the issuance of a building
permit. If any changes must be made to the site plan to accommodate the ACHD requirements, a
new site plan shall be submitted to the City of Meridian Planning and Zoning staff for approval
prior to the issuance of a building permit.

Certificate of Occupancy: All required improvements must be complete prior to obtaining
a Certificate of Occupancy. A Temporary Certificate of Occupancy may be obtained by
providing surety to the City in the form of a Letter of Credit or cash in the amount of 110% of
the cost of the remaining improvements. A bid must accompany any request for Temporary
Occupancy. No occupancy will be granted until the final plat for the property is recorded.
Plan Modifications: The approved Site Plan and Landscape Plan, stamped "approved" on 6-1-

Please find attached a Revised Certificate of Zoning Compliance Application for the
-above merttioned project. This new building is located on East Lanark Street in the new
Olson And Bush Subdivision #2. The original site was on lot #9 of this subdivision we
have flipped the building across the street to lot #3. This is the' only change to the
project.
The owner is proposing to constnact an industrial building in an IL zone. The building
will be 16'-0"above finish grade. There will be 10 parking stalls as shown on the site
plan. The building is 5000 sq. ft. and is on 46,483 sq. ft. {1.06 ac.) of land. We have
proposed 3548 sq. ft, of landscaping along the street, in front of the. building, and along
each side of the lot. The landscaping selected will provide variety and these plant
materials will survive well in this climate and match the existing landscaping in the area.
The back of the lot will be fenced and utilized for storage.
John Deere Landscapes is a retail, wholesale sales, and storage facility of landscaping
and irrigation tools and supplies.

SITE SPECIFIC COMMENTS:
Sanitary sewer service to this site will be via an extension from the existing main that is
within the proposed development. Applicant will be responsible for constructing the
sewer mains to .and through this proposed development. Subdivision designer to
coordinate main sizing and routing with the Public Works Department. Sewer manholes
afire to be provided to keep the sewer lines on the south and west sides of the centerline.
2. Water service to this site will be via extensions of existing mains installed in adja,cent
developments. Applicant will be responsible to construct the water mains to and through
this proposed development. Subdivision designer to coordinate main sizing and routing
with the Public Works Department.
3. The Evans Drain is located within a 60' easement across the northern portion of the
properly. The Snyder Lateral is located within a 40-foot-wide easement on the western
boundary. Plans will need to be approved by the appropriate inrigation/drainage district,
or lateral users association, with written confirmation of said approval submitted to the
Public Works Department. A letter of credit or cash will need to be submitted for tiling
of the ditches prior to signature on the final plat.
4. Minimum 20-foot-wide planting strips will be required to buffer adjacent incompatible

be six feet in height when planted, and an irrigation system shall be constructed, water
and fertilizer supplied to the trees to allow adequate growth." Due to the fact that
development of separate lots may happen over several years, staff recommends that the
trees and irrigation system be constructed prior to obtaining building permits.

Your proposal to post bond for the required landscaping along the south of the subdivision sounds like a great
idea to me. I believe I can issue the CZC if we have a landscape plan and a surety that ensures that
landscaping along the southern boundary will be consistent with the conditions of approval for this site (at least
until you are able to ask the Council to modify the condition for said landscaping). If the council does not
approve the modification request, we will not issue occupancy until the landscaping is installed though.
The way the condition of approval is worded you need to provide a plan and surety for the entire southern
boundary of the subdivision. Did Gayle show you how the condition is phrased? The condition is pretty specific
about where and what type of materials are needed. Again, the City will not be able to release occupancy until
the landscaping is in, or the Council modifies the condition, but at least construction can get under way while
we process your landscape modification request.
If you get me a landscape plan that depicts landscaping along that southern boundary that is consistent with
the conditions of approval (and a surety to reflect said landscaping) I will issue the CZC. I forwarded your e-
mail to Anna yesterday, but she has been out, so I don't know how involved she will be since time is of the
essence for this project.
I am not trying to be a thorn in your side, I'm just trying to do my job and enforce the existing conditions of
approval. It sounds like the circumstances regarding landscaping of the southern boundary have significantly
changed since the sub was approved, and you have a good case for a modification. I'm willing to work with you
on coming to a resolution and getting the John Deere project moving forward. Let me know if you need

Just discussed with Gayle Jensen the John Deere Certificate of Zoning compliance... Gayle may or
may not have told you that the reason for the move to the south side of East Lanark is the possibility of
adding a wholesale nursery in the future. The nursery will be located on the 5 acres we own-which
runs along the southerly boundary of lots on the south side of East Lanark. This 5 acres was
purchased after the approval of the preliminary plat for the Olsen Bush project and was in response to
the request of Ben Barham and Ken Valentine the city asked that we landscape the southerly
boundary of the subdivision.
We purchased Ben Barham's property (5 acres) and Ken Valentine hung himself in his shed and the
property has been sold and rezoned to commercial and has been converted to an office building. The

former Valentine house is the brick front house on Franklin Road
It might make sense for me to ask the city for a modification of the landscape requirements since we
now own the parcels contiguous to the south and the use has changed on the former Valentine
residence. In addition, there is a good chance that the 5 acres will be used in conjunction with the
John Deere facility and landscaping at the rear of the property would not be possible.
A good solution may be for me to post a bond for the cost of the landscaping and then apply for a
modification of the subdivision requirement so that we can eliminate the landscaping at the southern
boundary. Needless to say the John Deere corporate guys are not pleased with the delays in getting
the approvals for the building. We all thought that moving the building to the south side of the road
would be no big deal, but it is turning out to be a bigger deal than we thought.
We need to get this project going as soon as possible and any help you can offer would be
appreciated. Could you talk with Anna and see if the idea above makes any sense.

Our Olsen Bush II subdivision had a requirement that we install a landscape buffer on the southern boundary.
That requirement was removed by the City Council, MI-05-009 on 9/13/05. We currently have a bond on deposit
with the City of Meridian for this landscaping which will no longer be needed due to the waiver of the requirement.
Can you please release the bond which is due for renewal in June.
