I have reviewed the above -referenced site plan and have the following comments/requirements
prior to issuing a building permit:
The owner needs to send a letter requesting payment for the required additional 20' of
right-of-way along Linder Road to Larry Sale, ACHD, Director of Development Services.
A legal description of the property also needs to be included with the letter. A copy of the
recorded deed needs to be provided to the City prior to obtaining building permits. The
City of Meridian also requires that a copy of the right-of-way permit for work within the
right-of-way be submitted to the Public Works Department. The letter should also
indicate that the access proposed meets with ACHD's policies.
2. The Public Works Department needs to grant approvals for all sewer, water, private road,
grading and drainage construction prior to obtaining building permits.
3. All requirements resulting from the building plan review need to be complied with (Daunt
Whitman should have a list of any additional information needed for UFC/UBC
compliance).
4. A landscape plan is needed for the 20' planting strip along Linder Road (outside of the
required 45' right-of-way from centerline). Council determined at their meeting of 7/10/96
that this development must include the 20' planting strip as part of the initial construction
for the entire frontage of the property. City ordinance also requires that 5' sidewalk is
provided along all public rights-of-way.

For the site plan review, the applicant needs to submit eight copies of the detailed building site
plan and the overall future plan which was included in the building permit application package.
Section 11-2-410.0 of the Meridian City Ordinance states as follows:
2-410 C SITE PLANNING REVIEW
In addition to any other requirements contained in this Zoning Ordinance or in the
Subdivision Ordinance, the City in its discretion may require, as a condition of approval,
that any use, development or construction have the plans, design, plat, specifications,
drawings, actual construction, landscaping, etc., reviewed and approved by the City. The
purpose of this review is to ensure that development and construction occurs as it is
represented it will occur. Any violations of the representations or conditions of approval
shall be violations of this Ordinance or the Subdivision Ordinance. (Ord. 456, 9-3-85)
The definition of site planning in the Ordinance is:.
Site Planning - The location of buildings and activities within a physical environment. A
site plan includes shapes and location of buildings and structure, circulation and parking
layouts, landscaping features and numerous other design factors that relate to the
improvement of a parcel of land.
Due to the unique characteristics of this development, and the fact the City has not had a
development such as this occur to my knowledge, it has been determined that the City Council
should review the site plan and clear up some questions that have come up. 1 talked to Walt
Morrow about this requirement and he concurs. The applicant should come prepared to answer
any questions the Council may have. Also, the City needs to receive a copy of the recorded deed
for additional ACRD right-of-way, as well as their approval of the access shown, prior to issuing
a building permit.
I have asked Anna to go ahead and put this on the agenda, so hopefully the applicant can have
these plans submitted by noon/early afternoon Friday.

I reviewed the site plan you faxed yesterday with Shari Stiles, Planning Director. Based on
the proposed use, which I understand to be Tec Pac tractor truck and trailer parking for
between 8-12 trucks on a semi -frequent basis, the area actually used for parking would need
to be paved and fenced. As I mentioned to you, the City has allowed compacted gravel to be
used on a very limited, case-by-case basis for long-term storage areas where the amount of
vehicular use is very infrequent (i.e. a mini -storage company that designates areas for boats
and trailers that are picked up once or twice a year). However, in TecPac's case, where
trucks would potentially be accessing the parking area several times a week, we feel paving
is necessary to control dust levels and minimize tracking gravel on to Linder.

I performed an inspection of the Tec Pac site at 199 N. Linder Road on January 7, 1998. All
trees and shrubs have been planted. As reported by James Adams at The Nature Company,
the sprinkler system is 75% complete and the final grade for sodding is 50% complete.
Please have a check cut to Steve Maglecic, 65 E. Clear Creek Drive, in the amount of
$6,014.80 as a release of 50% of the funds deposited with the City in the form of a cashier's
check. Let me know when the check is ready so I can let Mr. Maglecic know he can pick it
up. Thank you.

This letter will confirm that your temporary occupancy, originally dated 11/21/97 for a 30 -day
period, has been extended 90 days from 12/20/97 to allow completion of your landscaping
requirements. This new date has been noted in the Building Department's computer files. A
final Certificate of Occupancy will be issued once all items have been approved.
Also, enclosed is a check in the amount of $6,014.80 as a return of 50% of the amount
deposited for landscaping improvements. The remaining 50% will be returned upon
completion of the landscaping this spring. Please contact me if you have questions or need
