RE: Fence Variance Request :Lot 13 & 14 Block 2 Haven Cove.
We would appreciate an audience with the City Council for the meeting of July 16, 1996.
We have made repeated attempts to contact the architectural committee with regard to the
construction of a fence on the properties. However, the one remaining member, Leon
Blaser, has not returned any calls.
It is our contention after many different conversations with Mr. Stucker the fence will be
erected and there will be no future enhancement of said property. Mr. Stucker has further
indicated that the lots would then be utilized exclusively for storage areas. As such, we
contend this constitutes an accessory use which is not customarily accessory, nor
incidental, to the conduct of the principal permitted use.
We are unclear as to why the original request for a variance was declined by the City
Planning and Zoning committee at the meeting of 4/22/96 and subsequently approved by
letter sent to our homes on 6/21/96. The April meeting was attended by three households
of our subdivision all of whom were assured the fence issue was resolved and the variance
denied.

The Fence Variance Committee of the City of Meridian met at 4:45 P.M., Apri129, 1996, in City
hall to consider this request.
After due consideration, the Committee decided to allow construction of a six (6) foot tall
wooden fence in the front lot setback area of these two (2) lots subject to the following:
1. The face of the fence shall be set ten (10) feet from the back edge of sidewalk.
2. The area between the fence and sidewalk shall be landscaped and maintained by you.
The board side of the fence shall face W. Leonard Street. The east end of the fence shall
return along the west boundary of lot 12 for approximately 40 feet to match into lot 12's 6
foot tall fence.
4. The City of Meridian has no jurisdiction in the enforcement of the provisions of your
subdivisions Protective Covenants. Since this is a variance to a provision of your
covenants we suggest you also contact your Homeowners Association.
Please obtain a fence building permit from City hall prior to beginning construction.
