Conditional use is being sought for a learning center for approximately fifty students. The lot is a L.O. Limited Office Zone. The learning center is a desirable alternative to public schools. Students receiving a certificate of completion from our center achieve higher than average testing results. The administration consists of two people and the students are generally dropped off and picked up by parents, thus keeping the parking impact very low. Engineer Gene Smith is here this evening and handed me a copy of a- license agreement from Nampa Meridian Irrigation District and I guess maybe it is going to get down to a point of the attorneys for the developer and the irrigation district fighting this out as far as whether or not this easement is an exclusive easement for Nampa Meridian or if other utilities can be located within that easement. It is Gene Smith's attitude that after he read the license agreement that it is not exclusive to Nampa and Meridian irrigation district. I guess that remains to be seen from their attorney's interpretation of it. They verbally had told us I believe Bruce Freckleton anyway that they didn't want the utilities within their easement. Rountree: 1 have a question before we take action which we would probably be to table this item, but for Shari or Gary is there sufficient parking set up for this? It looks like ultimately you could have 11,000 square feet of building with both phases with 51 parking spaces. Stiles: I believe our ordinance only requires one space for every .ten students. I would have to double check that but they do show adequate parking for what our ordinance requires. Haacke: I know we are required with the development on this we are required to have 28 on this I know we have substantial parking for what the code is asking us to provide. I really didn't have any more to bring up towards it. It was my understanding that it was going to be approved from the last meeting after ACRD findings were submitted which I gave the next day to Planning and Zoning. Haacke: Yes I have seen Ms. Stiles and the engineering departments requirements for landscaping, berms, lighting, and ACRD all of their requirements, half of 4th Street West being paved, curb and gutter, and various radius changes and we have agreed to all recommendations. Martinez: Mayor and members of the Council I brought several things since our last public hearing that validated some concerns. One which is my dog, I have a German Shepherd dog, I had a few of my parents I expressed the concern about my dog to them and I had asked a few of them if they would write a letter or notification to you guys and I have those letters right here and I would like to present those to you. I don't want to make this long so I won't read them. But if you could read them I would appreciate it. Since we last spoke I have acquired my State license, I have that here. I don't have a copy for you because it has to be (inaudible) present for parents to see so you can go ahead, I will get you a copy of this too. Since then I have also acquired my CPR and first aid certificate which we discussed last time I didn't have a copy of it at that time but I was taking that for the Children's safety and pediatrics. Since then I have also acquired a letter from Robert Speck who I believe you might be familiar with the name, he deals with the State regulations. According to my pole and fence height, I had talked to Jim Rabitt and Shari regarding this .matter. They directed me to go to the State and see .what the State regulations were and kind of try and comply with that so I could have that done before the previous hearing that we had. This is a copy of the letter he mailed me, I am just going to read a couple of the things that he says here. He says,"although there-are no specific rules covering the swimming pools located in the yards of the homes based in family group day care facilities. I .generally recommend that a fence from 3 to 4 feet minimum in height be used for this purpose." He says please the type B which is also in here and you will find in here which is semi-public pools which you would find in athletic clubs, country clubs, swimming, clubs, hotels and apartments, etc. are only- required to have four feet. My fence is 6 foot on 15 feet of it, the other is upon the deck so that is four feet. The reason why I bring this up even those this is a conditional use for the learning center is it affects the size of the building. I have another layout of the building. I don't know if you guys received copies of the site plan from Shari Stiles but there are two phases shown, one and two. Here I have both phases together, the top portion of 6900 feet is basically your phase 1 showing that he had a first. The reason why I am addressing this is the learning center, one of the things brought up by Shari Stiles was if we did phase 2 how many more students we are going to be bringing on and it would be (inaudible) we would basically move the learning center and the administration to the second phase. Move H & R Block to the front and have the other offices for lease, insurance offices or. other permitted uses. Backerboard doesn't travel well on the planes, I apologize for that. The school basically stresses achievement as far past as the students can achieve on their own. One of the things that Shari brought up was wanted to know age groups, number of students. We actually have offices right now in Nampa where there are 35 total students. Five of them being in a beginning class and age ranges of 5 to 8 years old. Junior classes in the ages of 9 to 12 there are 10 students and 20 student seniors ages of 13 to 17 years old. She also expressed a (inaudible) for the existing tenants we are proposing 20 employees, that being almost a quarter H & R Block is actually a seasonal office. During the tax season, January 1st to April 15th we have seven to ten employees there and that reduces down to zero after April through December. The administrative offices we have (inaudible) working the non tax season and up to four during the tax season at that location. So at the maximum load 35 of that being 20 students and just to express that 20 students are dropped off and picked up very few are of age to even be driving. Any questions? MacCoy: I went out and looked at the site (inaudible) I think the area is a good area for you to be into it is a location that I think is well suited to what you want to do (inaudible). Looking at your layout I thought it had good possibilities. I raise the question, do you plan to have any handicapped children in this building? Haacke: We currently don't have any handicapped children in Nampa and don't plan on advertising for them. I understand buildings the new buildings that everything needs to Meridian Planning & Zoning Commission March 12, 1996 Page 59 be handicapped accessible as far as my knowledge. We don't plan on it. MacCoy: If you had to you could retrofit later which would be costly. (Inaudible) Haacke: (Inaudible) MacCoy: By the way have you looked at her sheet that she has? Haacke: I have, I didn't know if you wanted me to, being as late as it was, express each issue but I plan on meeting each and every .one of the drainage and fencing requirements, fire related issues, bringing it all up to UBC standards. MacCoy: I had requested information on external security lighting because I felt that type of facility you had and the location that you need that for sure for your own safety as well as (inaudible). You just told us how many (inaudible) on your phase one. Haacke: Yes, what was the question for phase one? MacCoy: Any youth during phase one (inaudible). Haacke: Basically I will only do phase one if conditional use on the learning center is denied. Then the learning center will be omitted and H & R Block the administrative will be there and the rest will be tenants. So I will have the foot print of phase 1 irregardless of the conditional use. MacCoy: What kind of building material do you plan to use? Haacke: I am planning on having it stick framed, type 5, one hour with 5/8 inch gypsum board, stucco .and the upper areas is (inaudible} with steel rib roofing, glass front and various glass around the perimeters. MacCoy: I would assume that (inaudible) your refuge area was not fenced before. Haacke: We presented that on the site plan being on the east of the project and have kind of, the reason why you didn't get this is we kind of, the more we thought about it it made sense to do the full phase if we have conditional approval and move that around towards the rear and close that in, cinder block enclosed fence type enclosure, 6 feet tall to visually secure. Meridian Planning & Zoning Commission March 12, 1996 Page 60 Hepper: Would the street to the end of your property be paved? Haacke: Are we talking about 4th Street West? Currently that is unpaved, I am not sure. I do most of by building in Salt Lake and along Wassatch front and I am pretty sure that second hand ADA will probably require us to pave the whole side and even possibly curb and gutter I have heard. Hepper: You haven't gotten your comments back from them? Haacke: I haven't put in for a building permit and (inaudible) based on not completely obtaining the blue prints depending on the phase one or two. Hepper: I am pretty sure the highway department will require you to pave that to the end of your property, probably have curb gutter and sidewalk. Haacke: I have heard that expressed but haven't had any. Hepper: I guess that is all we have then. MacCoy: What does PHP.HP stand for on your drawing? You haven't got a key that shows (inaudible) property line and so on. Haacke: I was trying to go through that myself, I am not sure if we can't rectify that with all the other concerns of Shari Stiles. Something to do with the property lines, I know there was something that came up with the church having a right of piece going through that 4th Street West and we rectified that situation with them. That may have something to do with that. I know that some faxes have been sent back and forth between Shari Stiles and I know they have rectified that right of way issue. Hepper: Any other questions? Thank you, anyone else wish to comment? Rory Lowe, 1607 West 4th, was swom by the City Attorney. Lowe: Just two questions that we had written down that the Council didn't ask was we had one on hours of operation for the school, just want to know when their sessions ran. And the other thing was we were just wanting to know what the landscaping was going to be like on West 4th. That is all I had. Robert Polk, was swom by the City Attorney. Just a few questions like that. And the paving of the streets, will the City pave the opposite side on our side of the property? Oslund: That would be up to ACRD. Crookston: The City would not. Oslund: More than likely ACRD would require this applicant to pave only half of the street and we don't know how wide that street is until we get their comments back. Polk: Okay (inaudible) Hepper: Is there anyone else from the public? Mr. Haacke, would you like to address those comments? Haacke: Just to hit on the hours, we are actually 3 days a week, Tuesdays, Wednesdays, and Thursdays from 8 to 12 p.m., so four hours three days a week. As far as extracurricular activities children are just there for their studies, they are not out on breaks outside running around other peoples's properties. They are watched pretty close in that regard, we do have a break room designed in there for that but we keep them such a short time and the break is such a time period that it doesn't give them a lot of time to cause any problems. Landscaping I don't have any definite plans but I plan to meet the UBC code percentage of landscaping and plan on having a long and bermed islands with bushes and trees to buffer and make it a pleasant property not an eyesore to took at whatsoever. As far as paving goes whatever Ada County Highway Department requires us we will comply with whether it be half way or both sides we will work with them. Crookston: The City of Meridian requires paving on the lot and your parking areas and things like that. Hepper: This school is it an alternative public school or is that in addition to public school? Haacke: It is an alternative, it does qualify for an alternative program. Hepper: So the students who go to your program probably would not go to a public school this would be their main source? Haacke: That is correct, many of them do attend extracurricular activities at public schools in addition to this but as far as academics. Hepper: But for four hours a day 3 days a week. Haacke: Yes, the first time I heard about this I was very speculative about it, reservations about the project. But students that are graduating from there, certificates are actually having 10 points higher GED equivalent tests. There are some really positive results coming out of these students, really promote them to achieve outside of the classroom. Hepper: What did you say the hours were? Haacke: Eight to twelve Tuesday, Wednesday, Thursday. Hepper: A.M. or P.M.? Haacke: A.M., have I addressed all those questions? Hepper: Yes, thank you. Is there anyone else? Crookston: But if you have them (inaudible) then they are written down and the applicant then knows what is required what the City is requiring which with ACHD they are exactly the same thing as what ACRD is requiring .but it is just nice to have them written down so the applicant knows he has to meet those. Shearer: The problem 1 see Wayne is that the architect will not submit to ACRD until he gets his plans done and he can't, he doesn't want to do plans for a building that he can't build because we don't approve a conditional use. That the zoning of Limited Office District, (L-O) is defined in the Zoning Ordinance at 11-2-408 B. 11. as follows: (L-Ol Limited Office District: The purpose of the (L-O) District is to permit the establishment of groupings of professional, research, executive, administrative, accounting, clerical, stenographic, public service and similar uses. Research uses shall not involve heavy testing operations of any kind or product manufacturing of such a nature to create noise, vibration or emissions of a nature offensive to the overall purpose of this district. The L-O District is designed to act as a buffer between other more intense non- residential uses and high density residential uses, and is thus a transitional use. Connection to the Municipal Water and Sewer System of the City of Meridian is a requirement in this district. 4. That the Applicant, Millstream Properties, L.L.C., is the owner of record of the property. 5. That the property is currently vacant with no present use; that the conditional use is being sought for a learning center for approximately fifty (50) students and for the professional offices of H & R Block Income Tax Services and other leased office space. 6. That at the public hearing Mr. Haacke testified that the learning center is a desirable alternative to public schools; that students receiving a certificate of completion from the center achieve a higher than average testing results; that the FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 2 MILLSTREAM PROPERTIES L.L.C. • administration consists of two people; that students are generally dropped off and picked up by parents, thus keeping the parking impact low; that classes are held three times weekly in four hour lengths; that this proposed project is also for professional office space, including a tenant being H & R Block; that the sizable portion of the building will be dedicated to a learning center, which is operated three (3) days a week, Tuesdays, Wednesdays and Thursdays, at four hours per day, 8:00 a.m. until noon; that the students are there for studies; that there is a break room provided for such and that the time allowed is monitored closely and the children are not out on breaks running around the neighborhood; that this is an alternative program of academics to public school and that many students attend extracurricular activities at public schools after hours; that the school stresses achievement as far past what the students can achieve on their own; that a school now operating in the Nampa, Idaho, area has a total of 35 students, with five in the beginning class and age ranges of 5 to 8 years old, junior classes in the ages of 9 to 12 with 10 students, and 20 senior students ages 13 to 17; that the learning center will occupy approximately 6,900 square feet of the building, basically being phase 1 of the project; that if phase 2 is begun, the question was how many more students could be expected; that the learning center and administration would be moved to phase 2 of the project and H & R Block put to the front and have the other offices for lease including insurance offices or other permitted uses; that the FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 3 MILLSTREAM PROPERTIES L.L.C. proposed number of employees at the building would be approximately 20, with a quarter of those being from H & R Block; that H & R Block is actually a seasonal office, during the months of January through April, with seven (7) to (10) ten employees; that the building structure would be stick framed, type 5, stucco with steel rib roofing, glass front and various glass around the perimeters; that in the original site plan it was presented that the refuse area would be on the east end of the project; that if the conditional use was granted, it made better sense to do the full phase and enclose the refuse area with cinder block type fencing, six (6) foot tall, and move it to the rear of the project. Mr. Haacke further testified that there are no plans to have handicapped children in this building and no plans are being advertised to do that; that the understanding is for new buildings to have handicapped accessibility; that regarding drainage and fencing requirements and fire related issues, all will be met and brought up to UBC standards. Additionally, Mr. Haacke testified that only phase one (1) of the project would be built if the conditional use permit on the learning center is denied; that the learning center will be omitted and H & R Block, the administrative and the rest will be tenants, so the foot print of phase 1 will be the same regardless of the conditional use. 7. Commissioner Hepper stated that the comments from ACHD have not been received but that the highway department would require the. paving of 4th Street West at the end of this property FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 4 MILLSTREAM PROPERTIES L.L.C. and pretty sure that would include curb gutter and sidewalk. 8. Rory Lowe, 1607 West 4th Street, testified regarding the hours of operation for this project and what kind of landscaping could be expected along West 4th Street. 9. That Robert Polk testified as to his concerns regarding ~ the kids "piled" on that side of the street, whether you could expect them to be running across the street, and a question regarding the paving. 10. Commissioner Oslund stated that more than likely the Ada County Highway District would require the Applicant to pave only half of the street, but that comments have not been received from ACHD regarding this Application. 11. That a letter from Steven K. Ricks, of Ricks Properties and a property owner within 300 feet of this proposed project, submitted a written statement, which is incorporated herein as if set forth in .full, stating that he is in favor the proposed facility by Millstream Properties L.L.C. and stated that this would positively contribute to the development of the area. 12. Commissioner Shearer commented that the comments from the Ada County Highway District really has nothing to do with the conditional use permit for the school portion of this project; that the ACRD findings will be binding on the building permit process._ 13. City Attorney, Wayne G. Crookston, Jr., stated that the ACRD comments are nice to have in order to incorporate them into the findings for the conditional use; that when they are written FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 5 MILLSTREAM PROPERTIES L.L.C. • • the Applicant then knows, along with the City, what Ada County Highway District (ACRD) requirements the Applicant must meet. 14. That the Assistant to the Meridian City Engineer, Bruce Freckleton, submitted comments, stating that irrigation and drainage ditches must be tiled, off-street parking, paving and stripping done, a drainage. plan submitted, and signage shall all be provided in accordance with City Ordinances; that any existing wells and/or septic systems will have to be removed but that wells may be used for non-domestic purposes such as landscape irrigation; that outside lighting shall be designed and placed so as not to direct illumination on any nearby residential areas and in accordance with 11-2-414 D 3.; and that sewer and water assessments will be determined during the building plan review process. He further commented that the City of Meridian owns and maintains an 8 inch diameter water main and sewer main along the west side of the proposed site, in West 4th Street. 15. That Shari Stiles, Planning and Zoning Administrator, submitted comments and they are incorporated herein as if set forth in full and include the following: a. That Commissioner MacCoy submitted statements regarding this application and they are hereby incorporated herein as if set forth in full; that this application shall meet all health and safety codes and ordinances; that the hours of operation, age and grade level of students, be stated; that this facility meet all the requirements of the Americans with Disabilities Act; that external security lighting be required; that fencing type and height be stated as well as kind and type of landscaping; that a fenced refuse area may be needed; that the structure material of this proposed building be stated in addition to an occupant load sign posted per Uniform Building Code. 19. There was no objecting testimony or other testimony given at the hearing. 20. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. 4. That 11-2-418(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan and Zoning Ordinance. c. The use apparently would be designed and constructed to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. That sufficient parking for the property and the proposed use will be required. i. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Electrical Code, the Fire and Life Safety Code, all parking and landscaping requirements and the comments of the Planning and Zoning Administrator and the City Engineers office must be met and complied with. 6. That the parking must be paved, the landscaping placed, and any outdoor storage and/or trash receptacles properly screened, prior to issuance of an occupancy permit. 7. That the Applicant shall provide proof of Health and Welfare licensing, if such is required, prior to issuance of an occupancy permit. 8. The following conditions shall also apply: (1) Acquire an occupancy certificate. (2) Provide one (1) off-street parking space per employee. (3) Provide for a pick-up and drop-off area located off the main-fronting street of Cherry Lane. (4) Provide for screening of adjacent properties to protect children from adverse impacts and to provide a buffer between properties. (5) Provide a fence of appropriate height/construction, to enclose play areas, protecting children from traffic. Wasatch Boulevard Salt Lake City, Utah 84109 Re: MCU-5-96 -- Staff Level Approval RE~E~~ED MAR 1 3 1996 CITY OF MERIDIAN The Ada County Highway District (ACHD) staff has received your application requesting conditional use approval fora 50 student learning center with the proposed two phase construction of a 15,300 square-foot building on a 0.83-acre site located on the southeast corner of Cherry Lane and W. 4th Street. This development is estimated to generate 498 additional vehicle trips per day based on the Institute of Transportation Engineers Trip Generation manual. The application and site plan stamped as received by the District on February 20, 1996, has been reviewed by the ACRD Development Services staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This item will not be heard by the ACHD Commission unless the site plan is changed in such a manner as to not conform with District standards/policy or if an appeal of the Development Services staff decision is submitted as described within the Standard Requirements outlined below. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. The following requirements are provided as recommendations for conditions of approval to the City of Meridian. Site Specific Requirements: Dedicate 45-feet of right-of--way from the ultimate street centerline of Cherry Lane abutting the parcel (5 additional feet) by means of recordation of a final subdivision plat or execution of a warranty deed prior to issuance of a building permit (or other required permits), whichever occurs first. If the owner wishes to be paid for the additional right-of--way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance, with Section 15 of ACHD Ordinance #188. 2. Dedicate 29-feet of right-of--way from the uliunate street centerline of W. 4th Street abutting the pazcel (29 additional feet) by means of recordation of a final subdivision plat or execution of a warrantee deed prior to issuance of a building permit (or other required permits), whichever occurs first (or submit documentation showing previous dedication). The owner will ~ be compensated for this additional right-of--way. 3. Construct curb, gutter, 5-foot wide concrete sidewalk and match paving on W. 4th Street abutting the parcel. Improvements shall be constructed to one half of a 41-foot street section. 4. Two 24-foot wide minimum, 30-foot wide maximum curb cut driveways shall be permitted on W. 4th Street. The driveways shall be a minimum of 50-feet from Cherry Lane measured from the back of curb on Cherry Lane to the near edge of the driveway. 5. If the driveways are not to be paved on site, pave the driveways their full required width of 24-feet minimum, 30-feet maximum to at least 30-feet beyond the back of sidewalk on W. 4th Street. 6. Other than the two driveways specifically approved with this application, direct lot or parcel access to W. 4th Street is prohibited. 7. Direct lot or parcel access to Cherry Lane is prohibited. Standard Requirements: 1. This decision of the Development Services Supervisor may be appealed to the Ada County Highway District Commission by the applicant or by an owner of property within 300-feet of the parcel within 15 calender days from the date of this report. The request will be heazd by the District Commission at an evening meeting within 20 calender days of the District's receipt of the appeal letter. The appellant will be notified of the date and time of the Commission meeting. 2. After Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the MCU596.WPD Paget • action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identify each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of it' original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will b~ notified of the date and time of the Commission meeting at which the reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as, Ada County Highway District Road Impact Fee Ordinance. 4. Submit site drainage plans and calculations for review and appropriate action by ACHD prior to District approval of the final plat or issuance of building permit (or other required permits), whichever occurs first. The proposed drainage system shall retain all storm water on-site and shall conform to the requirements of the city or county having jurisdiction. 5. Locate driveways a minimum of 5-feet from the side lot property lines when driveways are not to be shared with the adjacent property. 6. If sidewalk is to be constructed or is existing abutting the site, construct pedestrian ramps on the comer of all street intersection in compliance with Idaho Code, Section 40-1335. 7. Dedicate up to a 20-foot x 20-foot right-of--way triangle (or appropriate curve) to keep street improvements within the public right-of--way at all intersections abutting and/or within the development by means recordation of the final plat or prior to issuance of a building permit (or other required permits), whichever occurs first. 8. Continue existing irrigation and drainage systems across parcel. 9. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 10. If street improvements are required, locate obstructions (irrigation and drainage ditches and appurtenances, etc.) outside of the public right-of--way. Locate utility facilities outside the street improvements. Authorization for relocations shall be obtained from the appropriate entity. If determined by the District, existing irrigation facilities may remain in the right-of--way with District review and approval of easements recorded for future relocation at a later date. MCU596.WPD Page3 • • 11. Locate proposed sign(s) out of the public right-of--way and out of the clear-vision sight- triangle of all street and driveway intersections. 12. Provide a clear vision sight triangle at all driveway and street intersections. Within this triangle no obstruction higher than 36-inches above the top of pavement will be al- lowed, including but not limited to landscaping, berms, fences, walls or shrubs. The triangle shall be defined with the long leg measured 200-feet to 540-feet (depending on speed limit) along the centerline of any road; and the short leg measured from the curb line of the road 20-feet along the centerline of the intersecting driveway or street (see District policy Figure F7). Provide notes of these restrictions on the plat/site plan and street construction plans. 13. Submit three sets of street construction plans to the District for review and appropriate action. 14. Provide design data for proposed access to public streets for review and appropriate action by ACRD. 15. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 16. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered .Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 17. The applicant shall submit revised plans for staff approval, prior to District approval of the final plat or issuance of building permit (or other required permits) whichever occurs first. The revised plans shall incorporates any design changes required by the District. 18. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 19. The connection of driveways to the public street system is not allowed without approval of the District. To obtain approval, anyone proposing to construct a driveway is required to contact the Construction Services Division of the District to obtain a proper permit prior to commencing construction per District Policy 7207.9. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. Ehno Tiddens, 213 E. 2nd Street, was sworn by the City Attorney. Tiddens: I am here representing the Williams Addition Lateral Association which is a group of people who use flood irrigation for their yards in that subdivision which is, it adjoins Franklin Road. Franklin Road is the southern most boundary, it goes clear over to the rail road tracks is our northern boundary of our subdivision. On the east it is bounded at 3rd Street East and on the west it is bounded by Meridian Road. In that area there we have a lateral that flows through it and we want to keep the water flowing through it. In this plan that we got in the mail of the subdivision that is in question here it doesn't show any plans, any way of ,continuation. There is a ditch that runs along the park that is right on the extreme western edge of this subdivision that we are talking about here. It flows continually through the irrigation season and right now it is an open ditch. We want to make sure that there are provisions for approval of that plot plan that water continues to flow through and it goes under Franklin Road through our subdivision. Also, we would recommend a 14 inch the through there instead of leaving it an open ditch. MOTION CARRIED: All Yea ITEM #16: PUBLIC HEARING: REQUEST FOR A CONDITIONAL USE PERMIT FOR A LEARNING CENTER FOR 50 STUDENTS BY MILLSTREAM PROPERTIES: Charles Haacke, Salt Lake City, Utah, was swum by the City Attorney. Haacke: 1 am here to propose a project and I have some permitted tenants already involved that being H & R Block an administrative office. The reason why I bring this up even those this is a conditional use for the teaming center is it affects the size of the building. I have another layout of the building. I don't know if you guys received copies of the site plan from Shari Stiles but there are two phases shown, one and two. Here I have both phases together, the top portion of 6900 feet is basically your phase 1 showing that he had a first. The reason why I am addressing this is the teaming center, one of the things brought up by Shari Stiles was if we did phase 2 how many more students we are going to be bringing on and it would be (inaudible) we would basically move the learning center and the administration to the second phase. Move H & R Block to the front and have the other offices for lease, insurance offices or other permitted uses. Backerboard doesn't travel well on the planes, I apologize for that. The school basically stresses achievement as far past as the students can achieve on their own. One of the things that Shari brought up was wanted to know age grooms, number of students. We actually have offices right now in Nampa where. there are 35 total students. Five of them being in a beginning class and age ranges of 5 to 8 years old. Junior classes in the ages of 9 to 12 there are 10 students and 20 student seniors ages of 13 to 17 years old. She also expressed a (inaudible) for the existing tenantswe are proposing 20 employees, that being almost a quarter H & R Block is actually a seasonal office. During the tax season, January 1st to April 15th we have seven to ten employees there and that reduces down to zero after April through December. The administrative offices we have (inaudible) working the non tax season and up to four during the tax season at that location. So at the maximum load 35 of that being. 20 students and just to exQress that 20 students are dropped off and picked up very few are of age to even be driving. Any questions? MacCoy: I went out and looked at the site (inaudible) I think the area is a good area for you to be into it is a location that I think is well suited to what you want to do (inaudible). Looking at your layout I thought it had good po~bilities. I raise the question, do you plan to have any handicapped children in this builc~ng? Haacke: We currently don't have any handic~ped children in Nampa and don't plan on advertising for them. You just told us how many (inaudible) on your phase one. Haacke: Yes, what was the question for phase one? MacCoy: Any youth during phase one (inaudible). Haacke: Basically {will only do phase one if conditional use on the teaming center is denied. Then the learning center will be omitted and H & R Block the administrative will be there and the rest will be tenants. So I will have the foot print of phase 1 irregardless of the conditional use. MacCoy: What kind of building material do you plan to use? Haacke: I am planning on having it stick framed, type 5, one hour with 5/8 inch gypsum board, stucco and the upper areas is (inaudible) with steel rib roofing, glass front and various glass around the perimeters. MacCoy: I would assume that (inaudible) your refuge area was not fenced before. Haacke: We presented that on the site plan being on the east of the project and have kind of, the reason why you didn't get this is we kind of, the more we thought about it it made sense to do the full phase if we have conditional approval and move that around towards the rear and close that in, cinder block enclosed fence type enclosure, 6 feet tall to visually secure. • • Meridian Planning & Zoning Commission March 12, 1996 Page 60 Hepper: Would the street to the end of your property be paved? Haacke: Are we talking about 4th Street West? Currently that is unpaved, I am not sure. I do most of by building in Salt Lake and along Wassatch front and I am pretty sure that second hand ADA will probably require us to pave the whole side and even possibly curb and gutter I have heard. Hepper: You haven't gotten your comments back from them? Haacke: I haven't put in for a building permit and (inaudible) based on not completely obtaining the blue prints depending on the phase one or two. Hepper: I am pretty sure the highway department will require you to pave that to the end of your property, probably have curb gutter and sidewalk. Haacke: I have heard that expressed but haven't had any. Hepper: I guess that is all we have then. MacCoy: What does PHP.HP stand for on your drawing? You haven't got a key that shows (inaudible) property line and so on. Haacke: t was trying to go through that myself, I am not sure if we can't rectify that with all the other concerns of Shari Stiles. Something to do with the property lines, I know there was something that came up with the church having a right of piece going through that 4th Street West and we rectified that situation with them. That may have something to do with that. I know that some faxes have been sent back and forth between Shari Stiles and I know they have rectified that right of way issue. Hepper: Any other questions? Lowe: Just two questions that we had written down that the Council didn't ask was we had one on hours of operation for the school, just want to know when their sessions ran. And the other thing. was we were just wanting to know what the landscaping was going to be like on West 4th. That is-all I had. Robert Polk, was sworn by the City Attorney. Just a few questions like that. And the paving of the streets, will the City pave the opposite side on our side of the property? Oslund: That would be up to ACRD. Crookston: The City would not. Oslund: More than likely ACRD would require this applicant to pave only half of the street and we don't know how wide that street is until we get their comments back. Polk: Okay (inaudible) Hepper: Is there anyone else from the public? Mr. Haacke, would you like to address those comments? Haacke: Just to hit on the hours, we are actually 3 days a week, Tuesdays, Wednesdays, and Thursdays from 8 to 12 p.m., sa four hours three days a week. As far as extracurricular activities children are just there for their studies, they are not out on breaks outside running around other peoples's properties. They are watched pretty close in that regard, we do have a break room designed in there for that but we keep them such a short time and the break is such a time period that it doesn't give them a lot of time to cause any problems. Landscaping I don't have any definite plans but I plan to meet the UBC code percentage of landscaping and plan on having a long and bermed islands with bushes and trees to buffer and make it a pleasant property not an eyesore to look at whatsoever. As far as paving goes whatever Ada County Highway Department requires us we will comply with whether it be half way or both sides we will work with them. Crookston: The City of Meridian requires paving on the lot and your parking areas and things like that. Hepper: This school is it an altemative public school or is that in addition to public school? Haacke: It is an alternative, it does qualify for an alternative program. Hepper: So the students who go to your program probably would not go to a public school this would be their main source? Haacke: That is correct, many of them do attend extracurricular activities at public schools in addition to this but as far as academics. Haacke: Yes, the first time I heard about this I was very speculative about it, reservations about the project. But students that are graduating from there, certificates are actually having 10 points higher GED equivalent tests. There are some really positive results coming out of these students, really promote them to achieve outside of the classroom. Hepper: What did you say the hours were? Haacke: Eight to twelve Tuesday, Wednesday, Thursday. Hepper: A.M. or P.M.? Haacke: A.M., have I addressed atl those questions? Hepper: Yes, thank you. Is there anyone else? We have no clue what ACHD wants on this at this point.. Shearer: l would like to amend the motion for the attorney to prepare to include the ACHD findings when they arrive. Our conditional use is for the school, ACHD's findings will be binding on the building permit when he goes for a building permit on this thing therefore we really don't need ACRD material for this conditional use -because it has nothing to really do with this conditional use. Oslund: Wayne do you have an opinion that you would like to share? Crookston: I will share an opinion, you may be exactly right Jim but it is nice to have the ACHD findings and make them a requirement for the conditional use, the annexation or whatever. Shearer: It is going to be required for the building permit anyway. Crookston: But if you have them (inaudible) then they are written down and the applicant then knows what is required what the City is requiring which with ACRD they are exactly the same thing as what ACHD is requiring but it is just nice to have them written down so the applicant knows he has to meet those. Shearer: The problem I see Wayne is that the architect will not submit to ACRD until he gets his plans done and he can't, he doesn't want to do plans for a building that he can't build because we don't approve a conditional use. This is not a subdivision or a site situation it is going to be a building plan. Crookston: It is up to the Commission, I will do whatever you people direct.
