The subject property received CUP (CUP-04-022) (Planned Development) approval that granted reduced lot size, reduced lot frontages and a reduced private street width. All associated site improvements including the private drive and utilities were completed with the subdivision improvements. The subject site is currently zoned R-8 (Medium-Density Residential District) and the proposed use is a principally permitted use in accord with Table 11-2A-2. DECISION The applicant's request for CZC, DES and ALT is approved with the conditions listed in this report. Note: This is not a building permit. Prior to any construction, you should contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required Site Specific Conditions of Approval 1. The site/landscape plan prepared by Hansen Drafting and Design, dated 03/11/08, labeled A.1, is approved (stamped "approved" on 6/25/10 by the City of Meridian Planning Department) with the following changes (see redlines on the approved plans): a. See comment d. above. 3. The site/landscape plan and/or building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. 4. The applicant shall submit a revised the site/landscape plan and building elevations to the Planning Department for review prior to submitting for building permits. Secret Garden Single Family Attached Homes CZC and DES Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11- SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 5. If any changes must be made to the site plan to accommodate ACfID requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 6. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 7. Per UDC 11-SB-SB2, the Deputy Director (at the applicant's request) approved alternative compliance regarding the use of vinyl siding as the primary building material. (See analysis section and Findings below for further details.) Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site (AZ-04-015; CUP-04-022; PP-04-020; FP-04-077). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3B. ANALYSIS OF UDC REQUIItEMENTS RELATED TO SITE SPECIFIC CONDITIONS AND ALTERNATIVE COMPLIANCE REQUEST: UDC: The proposed site/landscape plan depicts a total of twelve (12) 1.5-2.25 inch caliper flowering pear trees to be planted on site. Per UDC 11-3B-SB and UDC 11-3B-SD, the minimum deciduous tree size shall be 2 inch caliper and a minimum of three (3) species need to be planted. A revised site/landscape plan is required to ensure the proposed changes are complied with in accord with the UDC. Secret Garden Single Family Attached Homes CZC and DES 2 In addition, the approved planned development (CUP-04-022) required an amenity (picnic tables) to be located within the common lot approved with the Secret Garden Subdivision. This amenity shall be completed prior to receiving any occupancy of the residential buildings. The Meridian Design Manual (E-2.5.2.3. and Figure 41, page 139) states where materials transition or terminate provide a detailing to express the natural appearance of the material. For example stone-like products should convey the appearance of mass and should not appear as a thin veneer. The proposed building elevations depict a stone veneer along the garage fronts which gives the appearance of a thin veneer. Per the Meridian Design Manual (E.2.5.2.3. and Figure 41), the stone veneer proposed along the face of the garages shall be extended along the north and south garage walls and terminate next to the front door (see the highlighted walls on the approved site plan sheet A.1.). Revised elevations are required to ensure the proposed changes are complied with. ALTERNATIVE COMPLIANCE: The applicant is requesting alternative compliance to use vinyl siding as the primary finish material for all of the three residential buildings. UDC 11-3A-19.2.b restricts vinyl siding as an accent material in accord with the Meridian Design Manual. The Meridian Design Manual discourages vinyl siding as an exterior material if applied to cover large wall areas. Vinyl may be appropriate for accents and to create an interest in the design. The Planning Department is in the process of updating the Meridian Design Manual and the UDC that encourages a mix of vinyl material patterns into the building design and incorporating vinyl siding standards for residential structures. Unified Development Code (UDC) 11-3A-19B allows for an applicant to submit an alternative compliance if they can meet the requirements set forth in UDC 11-SB-5. The purpose of administrative design review, among others, is to encourage high quality building design that employs the use of good design principles and features quality, durable materials. For maintenance purposes and consistency with other surrounding residences, the applicant's proposal includes using a mix of vinyl siding patterns and stone veneer along the front of the garages. The proposed vinyl siding patterns include board and batten, shake and vertical lap siding in three different color tones. The Meridian Design Manual (E.2.5.2.4) encourages incorporating a mix of materials and color changes to promote a quality appearance and character. After reviewing the applicant's proposal, the Deputy Director find the proposal to use a mix of vinyl material patterns meets the intent of the Meridian Design Manual and contributes to the overall building design. Thus, the use of vinyl siding as the primary siding material is approved. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval for alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Although the majority of the buildings will be sided with vinyl; the mixture of vinyl material patterns, colors and stone veneer contributes to the overall building design. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Deputy Director finds the alternative compliance demonstrates consistency with the Meridian Design Manual. The variety in material patterns and tones of the vinyl product creates a cohesive design as expressed in the Meridian Design Manual. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties. It is my desire and request to use vinyl siding on the entire exterior along with stone accents as shown on the elevations plans attached. The concept behind Secret Garden Townhomes is maintenance free living while being a good steward to the environment. Vinyl siding lasts for decades and never requires additional painting just a periodic pressure wash. Please make note that our elevations plans have been modified to reflect board and Batt applications on the upper side gables of townhomes siding furthest to the north and south property boundaries as suggested by Planning Department at resent design meeting. The fronts of the townhomes are set back over 120 feet from Locust Grove and are buffered by an office building along with several trees and landscaping. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 1 I-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 5. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 6. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 7. Per UDC 11-SB-SB2, the Deputy. Director (at the applicant's request) approved alternative compliance regarding the use of vinyl siding as the primary building material. (See analysis section and Findings below for further details.) Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11- 3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site (AZ-04-015; CUP-04-022; PP-04-020; FP-04-077). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3B. ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS AND ALTERNATIVE COMPLIANCE REQUEST: UDC: The proposed site/landscape plan depicts a total of twelve (12) 1.5-2.25 inch caliper flowering pear trees to be planted on site. Per UDC 11-3B-SB and UDC 11-3B-SD, the minimum deciduous tree size shall be 2 inch caliper and a minimum of three (3) species need to be planted. A revised site/landscape plan is required to ensure the proposed changes Secret Garden Single Family Attached Homes CZC and DES C (_ are complied with in accord with the UDC. In addition, the approved planned development (CUP-04-022) required an amenity (picnic tables) to be located within the common lot approved with the Secret Garden Subdivision. This amenity shall be completed prior to receiving any occupancy of the residential buildings. The Meridian Design Manual (E-2.5.2.3. and Figure 41, page 139) states where materials transition or terminate provide a detailing to express the natural appearance of the material. For example stone-like products should convey the appearance of mass and should not appear as a thin veneer. The proposed building elevations depict a stone veneer along the garage fronts which gives the appearance of a thin veneer. Per the Meridian Design Manual (E.2.5.2.3. and Figure 41), the stone veneer proposed along the face of the garages shall be extended along the north and south garage walls and terminate next to the front door (see the highlighted walls on the approved site plan sheet A.1.). Revised elevations are required to ensure the proposed changes are complied with. ALTERNATIVE COMPLIANCE: The applicant is requesting alternative compliance to use vinyl siding as the primary finish material for all ofthe three residential buildings. UDC 11-3A-19.2.6 restricts vinyl siding as an accent material in accord with the Meridian Design Manual. The Meridian Design Manual discourages vinyl siding as an exterior material if applied to cover large wall areas. Vinyl may be appropriate for accents and to create an interest in the design. The Planning Department is in the process of updating the Meridian Design Manual and the UDC that encourages a mix of vinyl material patterns into the building design and incorporating vinyl siding standards for residential structures. Unified Development Code (UDC) 11-3A-19B allows for an applicant to submit an alternative compliance if they can meet the requirements set forth in UDC 11-SB-5. The purpose of administrative design review, among others, is to encourage high quality building design that employs the use of good design principles and features quality, durable materials. For maintenance purposes and consistency with other surrounding residences, the applicant's proposal includes using a mix of vinyl siding patterns and stone veneer along the front of the garages. The proposed vinyl siding patterns include board and batten, shake and vertical lap siding in three different color tones. The Meridian Design Manual (E.2.5.2.4) encourages incorporating a mix of materials and color changes to promote a quality appearance and character. After reviewing the applicant's proposal, the Deputy Director fmd the proposal to use a mix of vinyl material patterns meets the intent of the Meridian Design Manual and contributes to the overall building design. Thus, the use of vinyl siding as the primary siding material is approved. ALTERNATIVE COMPLIANCE FINDINGS: In order to grant approval far alternative compliance, the director shall determine the following findings: 1. Strict adherence or application of the requirements is not feasible; OR Although the majority of the buildings will be sided with vinyl; the mixture of vinyl material patterns, colors and stone veneer contributes to the overall building design. 2. The alternative compliance provides an equal or superior means for meeting the requirements; and The Deputy Director finds the alternative compliance demonstrates consistency with the Meridian Design Manual. The variety in material patterns and tones of the vinyl product creates a cohesive design as expressed in the Meridian Design Manual. 3. The alternative means will not be materially detrimental to the public welfare or impair the intended uses and character of the surrounding properties.
