Narrative Outlining Project Request
In the fall of 2005, Dyver Development LLC ("Developer") ~~~ purchased the
property known as Trilogy Subdivision (the "Property") with the full intent of
running it through the planning and entitlement process to a final plat, and to
ultimately sell the lots and build homes for end users. In 2005, the future of the
construction and real estate industry still looked positive and strong.
The Property was in fact put through the entitlement process and the preliminary
plat (PP-06-032) was approved by the City of Meridian City Council on
November 21, 2006. The Development Agreement (Instrument #107025553) was
signed January 22, 2007. As part of the City's Findings of Fact, Conclusions of
Law and Decision and Order, paragraph D, the Developer was advised that the
plat would become null and void if Developer failed to record a final plat within
two years or one year of the combined preliminary and final plat or short plat
(November 21, 2008).
It was at this time, however, that the economic downturn and the catastrophic
loss of real estate business in the Treasure Valley were beginning. The
downturn left Developer with little choice but to hold on completion of entitlement
and/or development of the Property. According to the City of Meridian's Unified
Development Code (UDC 11-6B-7), the Director may authorize one
administrative time extension to record the final plat, not to exceed eighteen
months. On October 17 2008, Developer requested and received a time
extension for eighteen months until May 21, 2010.
The Treasure Valley continues to weather the changes in the economy, and
there remains for sale a number of new homes still unsold, as well as re-sale
homes with pricing continuing to adjust down. Further, the number of
foreclosures, while lessening, remains an issue affecting the timing and strength
of any economic recovery in the Treasure Valley.
Developer fully intends to develop the Property; has every intention of selling the
lots to end users and building the homes. However, the timing remains
somewhat unknown. As a result, Developer is respectfully requesting an
additional extension of two (2) years to May 2012 in which to finalize the
preliminary plat and obtain the City engineer's signature.

owner.

Conger Management Group has requested approval of an eighteen month time
extension to record the final plat for Trilogy Subdivision No. 1. CMG is proposing to
submit an application to the City to request the extension in May 2010. This letter is to
request your attendance at a neighborhood meeting to provide information regarding
the proposed extension.
Meeting Information
Purpose: Discuss Trilogy Subdivision request for time extension
When: Tuesday, May 4, 2010 @ 5:30pm.
Where: The meeting will be held at the site of the subdivision on the
corner of Black Cat Road and W Ramblin Court
Project Description: Request for an 18 month time extension to record the final

COMMITMENT OF PROPERTY POSTING
Per Unified Development Code (UDC) 11-SA-SD, the applicant for all applications requiring a
public hearing (except for a UDC text amendment, a Comprehensive Plan text amendment
and/or vacations) shall post the subject property not less than ten (10) days prior to the hearing.
The applicant shall post a copy of the public hearing notice of the application(s) on the property
under consideration.
The applicant shall submit proof of property posting in the form of a notarized statement and a
photograph of the posting to the City no later than seven (7) days prior to the public hearing
attesting to where and when the sign(s) were posted. Unless such Certificate is received by the
required date, the hearing will be continued.
The sign(s) shall be removed no later than three (3) days after the end of the public hearing for
which the sign(s) had been posted.
