You have before you I think the preliminary plat for The Lake at Cherry Lane Subdivision I think we are calling it number 6 now which is consistent with I think the Conditional Use Permit. I think we have agreed that we are calling this one six. It has been tough, I have been guessing half of the time myself. I believe it is consistent with the conditional use permit with the planned unit development which you approved last, 1 guess we were in March or April, the first part of April. We believe that it :responds to all of the concerns that had been expressed by the City Engineer, the City zoning staff. I Fod spoken with both Gary and Shari and over the cour~:a of the last couple of weeks to try to determine if there are any other issues that they were concerned with and they both responded in the negative that is it appears to be acceptable - to them. Since you have seen this darn thing so many times I am not sure that 1 want to take up your time explaining it any more. I would simply respond to any questions that you have. G. The transportation system will be adequate to accommodate the additional traffic generated by this proposed development. H. The first preliminary plat for The Lake at Cherry Lane No. 6 was submitted in December of 1995. The District did not proceed with the preliminary plat because a digital disk of the subdivision was not submitted. A revised preliminary plat for The Lake at Cherry Lane No. 6 was received by the District on June 28, 1996. A digital disk of the subdivision has been received and the preliminary plat can be processed. This application was scheduled for a public hearing by the City of Meridian Planning and Zoning Commission on July 2, 1996. The following requirements are provided to the City of Meridian as conditions for approval: Site Specific Requirements: If the final plat for The Lake at Cherry Lane #5 has not be approved by the District prior to the District's approval of this final plat, the following conditions shall be required: Dedicate 45-feet of right-of--way from the ultimate street centerline of Ten Mile Road abutting the parcel (20 additional feet) prior to issuance of building permit (or other required permits). The owner will be compensated for this additional right-of--way from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of--way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance, with Section 15 of ACRD Ordinance #188. Construct a 5-foot wide concrete sidewalk on Ten Mile Road abutting the parcel (approximately 440-feet). Dedicate and construct the east-west residential collector street (Teter Boulevard) abutting the entire north boundary of the site as required in the District's approval of The Lake at Cherry Lane #5. Construct a temporary turnaround at the east end of the site/road if a turnaround or loop roadway has not been constructed by The Lake at Cherry Lane #5. Standard Requirements: A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the Development Services Supervisor. The request shall ~necificall~identifv each requirement to be reconsidered and include a written explanation of why su,~ch a r~uirement would result in a substantial hardship or inequ~. The written request shall be submitted to the District no later than 9.00 a.m. on the day scheduled for Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested reconsideration. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. A request for an appeal of the Commission's action shall be made in writing to the Development Services Supervisor within 15 calendar days of the action and shall include a minimum fee of $110.00. Submit site drainage plans and calculations for review and appropriate action by ACRD prior to issuance of building permit (or other required permits). The proposed drainage system shall retain all storm water on-site (may be coordinated with The Lake at Cherry Lane #5) and shall conform to the requirements of the city or county having jurisdiction. Public street drainage facilities shall be located in the public right-of--way or in a common lot owned by a homeowners association set aside specifically for that use. There shall be no trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage lots and their use restrictions shall be noted on the plat (when applicable). 5. Locate driveway curb cuts a minimum of 5-feet from the side lot property lines when driveways are not being shared with the adjacent property. 6. Construct pedestrian ramps on the corner of all street intersection in compliance with Idaho Code, Section 40-1335. 7. Dedicate a up to a 20-foot x 20-foot right-of--way triangle (or appropriate curve) to keep street improvements within the public right-of--way at all intersections abutting and/or within the development prior to issuance of building permit (or other required permits). 8. Continue existing irrigation and drainage systems across parcel. 9. Continue borrow ditch drainage abutting parcel (culvert may be required). 10. Provide written approval from the appropriate irrigation/drainage district authorizing storm runoff into their system. 11. If street improvements are required, locate obstructions (utility facilities, irrigation and drainage ditches and appurtenances, etc.) outside of .the public right-of--way. Authorization for relocations shall be obtained from the appropriate entity. If determined by the District, existing irrigation facilities may remain in the right-of-way with District review and approval of easements recorded for future relocation at a later date. CHERRYL6.WPD Page 5 • 12. Locate proposed sign(s) out of the public right-of--way and out of the clear-vision sight- triangle of all street and driveway intersections. 13. Install a stop sign on every unsignalized approach of a project street to an intersection involving a collector or arterial as the cross-street. The stop sign shall be installed when the project street is first accessible to the motoring public. 14. The developer is required to install street name signs at the locations approved by the Ada County Highway District. Purchase street name signs, sign poles, and mounting hardware from ACHD's Traffic Operations Department or an approved outside supplier. The District will not manufacture street signs until a copy of the recorded plat showing the recording data has been provided to Development Services staff. 15. Provide a clear vision sight triangle at all driveway and street intersections. Within this triangle no obstruction higher than 36-inches above the top of pavement will be allowed, including but not limited to landscaping, berms, fences, walls or shrubs. The triangle shall be defined with the long leg measured 200-feet to 540-feet (depending on speed limit) along the centerline of any road; and the short leg measured from the curb line of the road 20-feet along the centerline of the intersecting driveway or street (see District policy Figure F7). Provide notes of these restrictions on the plat/site plan and street construction plans. 16. Submit three sets of street construction plans to the District for review and appropriate action. 17. Provide design data for proposed access to public streets for review and appropriate action by ACHD. 18. All public streets and drainage systems shall be designed and constructed in conformance with District standards and policies. 19. Specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to ACHD shall be sealed, signed and dated by a Registered Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code, Section 54-1215. 20. We believe that it responds to all of the concerns that had been expressed by the City Engineer, the City zoning staff. 1 hid spoken with both Gary and Shari and over the cour°:e of the last couple of weeks to try to determine if there are any other issues that they were concerned with and they both responded in the negative that is it appears to be acceptable to them. You will also rot;all that in connection with that application, Steiner Development requested relief from certain of the standard setback requirements applicable to residential structures in an R-15 zone. In approving the conditional use permit, the City Council granted some of the requested setback relief (that is, reducing the front yard setbacks from 20 to 15 feet) but denied the request that street side yard setbacks be reduced from 20 to 15 feet. Bradbury: Thank you Mr. Mayor, members of the Council my name is Steve Bradbury as you know I am an attorney representing Steiner Development, the applicant who is seeking approval for the Lake at Cherry Lane Subdivision. I guess there are actually two things that we are here to talk about and I would like to take the second one first because it probably fits better. Some time back in April I sent a letter to the Mayor and Council asking the Council to take a second look at the findings and conclusions that they adopted on the second of April with respect to that subdivision and you recall the one 1 am talking about is the proposed senior complex over there. What the developer had requested in connection with that project was that, it was a conditional use permit for a planned development for this subdivision. Part of that planned development request the developer was requesting release from certain of the setback requirements which are typically required in the applicable zone in that case it was an R-15. The Council granted a number of the developers requests in that respect but there was one that the Council did not and that had to do with the reduction of the street sideyard setback from 20 feet to 15 feet, the R-15 zone requires 20 feet setback between a structure and the street when it is a side street. Since that time Mr. Campbell and I have been scratching our heads and try to figure out how we might be able to suggest to you that perhaps you take another look at it and give you a couple of reasons why. We were trying to think of what the issues might be in your minds and I guess we have come up with a couple of the and there are probably others but we have at least two. Those would be, I have to expect that one of the things that you are worried about is safety for the driving public. As they motor around corners you want to be able to see around the corner. And that is why the State, the City and the highway district all have vision triangle requirements. That is one issue that we figure is probably of some concern. The second issue is the aesthetics, you don't want to have houses all jammed up against the streets. You want to have a little bit of space. So we understand both of those issues and we think that we can accomplish both of them even with a 15 foot setback. What I did is I sent a letter to you folks dated the 31st and I have a drawing that looks something like this, did you folks all get one of those? What we did is or Mr. Campbell asked his project engineer Keith Jacobs to do a layout and to show out the streets might be set up and what we have here is a layout of the subdivision showing the foot prints of the proposed structures on the lots as well as the patterns of the streets and the sidewalks which would be built. What we asked Mr. Jacobs to do is to show the vision triangles on each one of these corners that we are talking. It is these comers here, here and here and around here that we are asking for a reduction in the setback from 20 to 15 feet. What we asked Mr. Jacobs to do is to show the vision triangle and how it meets Meridian City Council June 4, 1996 Page 22 • the requirements not only of State code but the policies of the Highway District and in fact exceeds the requirements of the City's ordinance to meet those vision triangles even though we may only have a 15 foot setback. So that you are not mislead in any way there are a couple of proposed lots, structures here that actually encroach by a couple of as I understand it a couple two or three inches into that vision triangle and we fully acknowledge that we would have to deal with that if the Council was inclined to reconsider the setback requirement. For the most part the vision triangle is required by State law, it can be complied with even with a 15 foot setback. Now the other thing that we expect probably are thinking about is just the aesthetics and that is-are these houses going to be jammed up against the roads. You will recall that these are private streets, you approved them as private streets and they are proposed to have 42 feet total right of way width, but only 37 of those feet are actually going to be improved that is there is going to be 28 feet of asphalt, 2 feet of curb and gutter on either side and then there is going to be a 5 foot sidewalk on one side. So that gets us up to 37 feet, so five feet of unimproved road right of way. What we also asked Mr. Jacobs to do is to design, to depict on the drawing and show in the design how it is that if the improvements for the right of way were all put over within one foot of the sidewalk side of the streets we would end up with an additional four feet of unimproved area adjacent to each one of these corner lots that we were worried about that we are asking to have some relief from the setbacks. That is what Mr. Jacobs has done and our artistry, my artistry is not particularly good but the green is the area that we are showing on the map as being those additional four feet which would exist of unimproved area that when added to the 15 foot setback which is depicted on the drawing would then result in there being a total of 19 feet between any structure and any portion of the road right of way. So in essence what we are hoping the Council wit( recognize is even with a 15 foot sideyard setback we are going to have nearly the 20 feet of separation between homes and streets. We are hopeful that the Council will recognize given the fact that these are private streets, they don't attach, there are no through streets here, they service only this portion of the subdivision. We don't expect there will be a great deal of traffic in the subdivision. It is a senior citizens complex or proposed to be one. We are hopeful that it makes good sense in order to allow the project to proceed as it is presently designed to reconsider your previous determination not to allow fora 15 foot side yard setback and grant that relief at this point. With that I guess since you have so much more business yet to do tonight I will be pleased to answer any questions if you have them. Morrow: I have a question Mr. Bradbury, as t recall is this not a gated corrr~nunity? Bradbury: Yes, the proposal is to have a gate in there. I guess the other thing that is on your agenda tonight is the preliminary plat and of course we are holding onto the plat until we know what you folks have in mind for the setbacks. Our expectation would be depending on the outcome of this request then we would be able to present that preliminary plat to you at a future date. • Meridian City Council June 4, 1996 Page 23 Morrow: Mr. Mayor I would ask for comments from staff either Shari or Gary. Smith: Mr. Mayor and Council members, I spoke with the developer and Mr. Bradbury a week or more ago concerning these corner lots. The one thing that I asked them to consider is the situation we find ourselves in quite often with people wanting to build fences in the setback area on corner lots. Typically the corner lots are the same size as the interior lots and the property owners which to have a back yard because they are forced or faced with a side yard and front yard setback. So they come to the fence variance committee that the City Council has formed requesting some relief from that side yard setback fora 6 foot privacy fence. When we move five feet closer to the road, closer to the street this becomes another issue or maybe a bigger issue because the fence committee has been pretty much steadfastly holding to ten feet minimum from property line. Those property lines in a standard subdivision are 2 feet behind the sidewalk. So that from the sidewalk, the back of sidewalk to the building is 22 feet typically. We are counting 10 feet off the back of .sidewalk. So I don't know how this is going to be met with the people building on the lots and the desires of having a sideyard fence closer than the setback distance which in this case has been reduced to 15 feet or could be reduced to 15 feet with your action. In other words, there is not going to be much gain on a fence as far as the fence variance committee and I am speaking myself but from the fence committee's past performance in hearing and acting upon requests for variances. I think they are going to hold to the ten feet in other words. So I don't want the impression that there is going to be more room in these back yards because of this closer setback because I personally don't feel that there will be. Thank you. Corrie: Shari, any comments? Do you understand what he has said here? Bradbury: I do Mr. Mayor and I apologize, I remember that we had this discussion a week ago and I should have phrased it because at the time Mr. Campbell and I put our heads together and said we understand what the City Engineer's concern is and it is a legitimate issue and we kind of in our short hand talked back and forth and said we could probably handle that in the restrictive covenants. Understanding that in addition to the City's requirements we can adopt restrictivve covenants which can regulate the location of fences. Which Mr. Campbell is more than willing to do and we would of course accept any kind of condition along those lines that you folks though was appropriate. Let me add one more thing that we tend to forget as we go through these as months go by and we talk about these projects in little bits and pieces. One of the primary features of this project is the developer is going to build it out not only the subdivision improvements but also the homes within the subdivision and also the landscaping on each of the lots including the fencing. And so it is a total build out so the developer is going to have in essence at least initial construction complete control on where everything is put and how it is built and the way it appears. So to that extent I think by imposing an appropriate condition on location of • Meridian City Council June 4, 1996 Page 24 fences and so that you folks all feel comfortable with it I think we can at least establish the , line in the sand if you will from the beginning. I will expect that the residents then would probably have a tendency to accept what it is they buy when they buy it. And of course the (inaudible) pleased to live with the reasonable condition with respect to fencing if that is (inaudible). Morrow: I have a question, with respect to the fences Steve, this is a PUD, planned unit development basically, and it is an issue here where you are doing the build out. (Inaudible) you don't see the typical 6 foot cedar fencing you see something more along the lines of 3 foot rod iron fences and so on my question would be what is your plan for fencing, you commitment to the fencing issue? Bradbury: I am going to have to look over at Mr. Campbell because I have to tell you I don't know the answer to the question. My reaction is like yours I would be surprised to see 6 foot cedar fencing around these lots. I would be very surprised to see 6 foot cedar fences along any of these side yards. Campbell: We will probably handle it with a 6 foot rod iron, probably 4 inches on center, more of an open look. Corrie: Thank you, any further comments from Council? Morrow: I guess a follow up question Mr. Mayor to Gary Smith, the issues of is there a difference in terms of rod iron and open fences as opposed to close fences with respect to your committee? Smith: Yes sir, by ordinance the fence can be in the setback area and be classified as open up to 4 foot in height, up to 3 foot in height as a closed fence. An open fence is if my memory serves me correct 20% of the space can be occupied by solid material. Morrow: Thank you Smith: So in one foot of length in fence 12 inches, 20% of that would be 2.4 inches of solid material in one foot. Corrie: Any other comments? Rountree: I have another question for Gary, with the kind of proposal that has been indicated here would that take care of your concern? Smith: I don't know if I have an answer to that Councilman Rountree, if it taller than 4 foot • Meridian City Council June 4, 1996 Page 25 even if it is open, I don't think the ordinance addresses anything that is taller than 4 feet- if it is open. I know there are some 6 foot chain link fences that exist, I am not sure they were permitted into existence but they are there. Bradbury: If it is will help I just asked Mr. Campbell if 4 feet was satisfactory to him and he indicated to me that was just fine. I hope the Council does get hung on the six foot fence because that is what Mr. Campbellinee f eel better abso utelyWith. If the four foot makes you feel better and makes the eng Cowie: I guess Council we don't have a procedure for reconsideration, however I guess if there are no changes in the plat is that correct Shari does this change anything as far as the plat is concerned? This specific change can be made in your conditional use permit. Counselor we discussed this this afternoon, do you want to further with that. Crookston: (Inaudible) that the City Council has the authority even though we do not have a reconsideration procedure that the Council can just of its own motion address a reconsideration request. As I have previously stated though we do need a get a procedure for it but that does not mean the Council does not have the authority to do it. Rountree: I guess my question would be that it would follow the parliamentary process, Roberts Rules process of a motion made by council person previously casting an affirmative. If you voted for it last time you can make a motion if you didn't vote for it last time you are out of line. Morrow: Mr. Mayor, I would move that we approve the 15 yard set back for Cherry Lane at the Lake No. 5 subject to any and all fencing meeting current City ordinances and set back regulations. Crookston: I think that it would be appropriate to state which lots that pertains to because if you leave. it as is then that would apply to all lots. Bentley: Mr. Mayor, Walt can you restate that motion because if I heard you correctly you stated the motion was approve the 15 foot setback in accordance with the existing ordinances for setbacks. Morrow: No, that is not what I said, my motion was I believe to approve the 15 foot side yard setback and that the existing ordinances with respect to fences be adhered to. In answer to Mr. Crookstons point, in a PUD, we are addressing, the discussion here is we are addressing the issue of these specific lots that are corner lots. But in the interior lots we don't have a side yard setback problem. At this point in terms of the motion if we are going to include the description of each of the lots that it applies then we need a menu of Meridian City Council June 4, 1996 Page 26 those lots. Crookston: That is correct, possibly the easiest way to handle it is to just as Mr. Bradbury indicated they could meet the vision triangle within a foot as I understood it is that not correct Mr. Bradbury? That you could meet the vision triangle (End of Tape) Bradbury: If I am understanding the question our engineer in calculating the vision triangles has concluded that all of the lots would meet except there are a couple that had a few inches that we would have to deal with through a redesign or somehow accomplish which we would of course do. I think I can, if you feel it is important I can give you the menu that you are asking for on the lots. But I might suggest that you simply talk in terms of the 15 foot street side yard setback on corner lots. Now, I hate to make it more complicated than it already is but there were these two lots up here at the entrance that were allowed a 10 foot side yard setback so they would need to be excluded from consideration. They already have the 10, like I say I hate to make it already complicated than it is but we we are really talking about is the corner lots that would otherwise require 20 foot side yard setback simply requesting it be reduced to 15 and the motion could be phrased in that form. If you would like a menu I could try and give that to you. Morrow: Well at this point I want to withdraw the motion. I think given the discussion that just took place and the other entry lots my preference now would be to have a menu of the lots that we are talking about per the counselor's suggestion for sake of (inaudible). Maybe I might suggest while they are putting that menu together that we continue this and press on with items 3 and 4 and then come back to this Mr. Mayor rather than wait or take a recess while they put that together. Are you ready for that now? Bradbury: I can read it to you, it is going to be Lots 38, 39, 40, 41, 42, 46, 47, 51, 56, all in Block 11. Morrow: That is all of them then, those are the ones that show on our map here. Bradbury: That is correct, wait I missed one, I am sorry, and 23, same block. EBERLE (1922-1977) Re: Request for Reconsideration on Conditional Use Permit for The Lake at Cherry Lane No. S Dear Mayor Corrie and Members of the City Council: I write in order to provide you with additional information in support of Steiner Development's Request for Reconsideration of the City Council's Apri12, 1996, Findings of Fact and Conclusions of Law on its application for a conditional use permit for a planned unit development for The Lake at Cherry Lane Subdivision No. 5. You will recall that in connection with that application, Steiner Development requested relief from certain of the standard setback requirements applicable to residential structures in an R-15 zone. In approving the conditional use permit, the City Council granted some of the requested setback relief (that is, reducing the front yard setbacks from 20 to 15 feet) but denied the request that street side yard setbacks be reduced from 20 to 15 feet. By my letter dated April 16, 1996, I requested that the City Council permit Steiner Development an opportunity to discuss the street side yard setback further and attempt to demonstrate to the City Council that a reduction of that setback would not be injurious to the City or the public. It appears to us that there are at least two reasons why the City might seek to require a relatively large street side yard setback. First, the City is likely to be concerned about the safety of the traveling public in maintaining reasonable sight lines across corner lots, which sight lines might be lost if structures were built too close to the street. Second, the City probably would like to maintain an open and spacious appearance along its rights of way, which appearance might also be lost if homes were built too close to the street. In this case, however, we think we can solve both of those problems even with a 15 foot street side yard setback. • Mayor Come and City Council May 31, 1996 Page 2 Attached to this letter is a drawing of the proposed subdivision plat showing the location of the proposed dwelling structures on each lot. Also depicted on this drawing is the location of the proposed street improvements, including sidewalks, curbs, and gutters. At each of the corners in the subdivision is also shown the location of the vision triangle as required by Idaho Code § 49-221. As you can see, except on just two lots where the homes slightly encroach into the vision triangle (by a matter of a few inches) a 15 foot side yard setback is sufficient to meet the requirements of the state statute. Also attached is a drawing taken from Ada County Highway District's policy manual depicting the sight triangle which it requires on streets to be dedicated to it as well as a drawing taken from the City of Meridian Subdivision Ordinance depicting the sight triangle required by the city (which, by the way, is actually smaller than that imposed by the Ada County Highway District). In addition, the Council may recall that the road right of way width approved by the Council is 42 feet, only 37 of which, however, is to be improved (28 feet of asphalt, two feet on each side of curb and gutter and five feet of sidewalk on one side). That, of course, leaves five feet of unimproved road right of way which might be used to supplement the street side yard setbacks. If the road improvements were constructed on the road right of way as depicted on the drawing attached to this letter so that the improvements were located within one foot of the lot line adjacent to the sidewalk, there would be an additional four feet of unimproved right of way in the areas colored in green on the attached drawing. As you can see, that additional four feet of unimproved area is adjacent to the very corner lots for which Steiner Development seeks 15 foot side yard setbacks. If approved for construction in that fashion, there would be a total of 19 feet between any structure and an adjacent side street, effectively providing fora 19 foot street side yard setback. Recognizing that there is not likely to be a great deal of traffic on these streets (since none of them are through streets and they serve only the proposed senior citizen housing project) it appears to Steiner Development that an effective 19 foot street side yard setback should be sufficient to satisfy the City's concerns. It is with these thoughts in mind that Steiner Development requests that the City Council reconsider its decision and approve a 15 foot side yard setback .for the corner lots located in The Lake at Cherry Lane Subdivision No. 5. Removal of traffic hazards. - (1) It shall be the responsibil- ity of the owner of real property to remove from his property any hedge, shrubbery, fence, wall or other sight obstructions of any nature except buildings and trees where these sight obstructions constitute a traffic haz- ard. The above sight obstructions shall not extend more than three (3) feet in height above the existing center line highway elevation within the vi- sion triangle of vehicle operators. The boundaries of the vision triangle are defined by measuring from the intersection of the edges of two (2) adjacent highways forty (40) feet along each highway and connecting the two (2) points with a straight line. The sight distance obstruction is also applicable to railroad-highway grade crossings with vision triangle defined by mea- suring forty (40) feet along the railroad property line. (2) When the department or any local authority determines upon the basis of an engineering and traffic investigation that a traffic hazard exists, it shall notify the owner and order that the hazard be removed within fifteen (15) days. (3) The failure of the owner to remove the traffic hazard within fifteen (15) days shall constitute a misdemeanor and every day the owner shall fail to remove the obstruction shall be a separate and distinct offense. So it seems to me to make more sense to table this until the July 16th or thereabouts to give us time to implement a committee to do the study and take advantage of any changes we might opt to make. At that point in time we do new findings based on what the policy or the ordinance restructuring is going to be. Crookston: I think that it is mandatory that we keep the hearing open for whatever length of time you want to deal with it. But we have to keep it open to allow any additional testimony if there is, there may not be any. But if you are going to have workshops and things of that nature to change the ordinance or to have additional facts on that I think that you still need to leave this hearing open so that you can receive testimony on those from the workshops. Morrow: And tabling keeps the hearing open is that correct? Crookston: That is correct. Morrow: I move we table until July 16. We have not received any additional information, could we have, as I recall the reason for tabling was those four items and the resolution of those. Shari you are,indicating that there has been no progress made on the part of the applicant on all of those four items. Stiles: Councilman Morrow, Mayor and Council I am not aware of the progress if there has been any made. I know they were talking about tiling that ditch in cooperation with Wingate Subdivision but I still think that is an issue that needs to be taken care of prior to approval. And to the irrigation, maybe their representative is here and could address some of those items. Morrow: Mr. Mayor that would be my preference. Morrow: My question would be the four items that, when you were here last were as Shari alluded to is what has been the resolution of the ditch along the northerly boundary and the landscaping and irrigation issues and the 20 foot planting strip? • • Meridian City Council April 16, 1996 Page 9 have been going to conferences, and this year the northwest chapter will have their annual chapter meeting and training session over in Yakima, Washington in September. It is a 3 day affair and it is great. You meet all kinds of city planner and how to work and protect trees. Also as Dorothy mentioned in order to get some of the grants for Tree City USA you need to have matching funds, the work that we do in your City limits to remove and replace trees will count as matching funds for grants. So when you go to apply for the Tree City USA grants make sure you contact me and 1 will give you the dollars that we spend and you can use those for your matching funds.. As I mentioned we would be more than happy to buy you some new trees if your Parks Department wants to go out and look at the schools, the cemeteries, wherever you see overhead lines where kids may be and let's get some new small trees planted to eliminate somebody else coming in and planting a large growing species at a later date. Tree City USA author I brought a copy of one of the Tree City USA publications is Dr. James Fasio and fortunately he is from the University of Idaho and he writes the national publication that all cities are following. This also has a copy of the (inaudible) proper pruning of trees and a little article about the City of LaGrande (inaudible) $500 for stripping down trees. There is an Idaho overhead line safety act that has the $500 penalty for anybody working within 10 feet of the power lines unless they are qualified to work around energized lines. As far as I am concerned the $500 means nothing if they are not around. We do have some new brochures to give out to the customers prior to us contacting them which is why I wanted to come tonight to let you know the new procedures and new standards and that we do work with customers to remove trees also. A lot of them are just self starters. Here is a brochure that the City of Boise put in their sewer bill talking about stopping tree topping, mulching, watering, saving water and then another brochure on avoiding utilities. ACRD was reluctant to have a connection for fear that it would put traffic on Interlachen that they never anticipated. So whatever is done is going to have to be done with the City staff as well as ACHD. Corrie: Thank you Morrow: Mr. Mayor, for the record in the findings of fact and conclusions there is a reference to the deed for the golf course property to bring the Council up to speed the first draft of the second deed or second time around yesterday afternoon and that is being reviewed so that is under progress as we speak. Accordingly, please treat this letter as Steiner Development's request for reconsideration of the City Council's April 2, 1996, Findings of Fact and Conclusions of Law on Steiner Development's application for a conditiona! use permit for a planned unit development for The Lake at Cherry Lane No. 5, insofar as those findings and conclusions denied Steiner Development's request for a reduction in the street side yard setback from 20 feet to 15 feet. I would appreciate it if you would make the necessary arrangements to have this request placed on the agenda of the Ciry Council's next regularly scheduled meeting which, I believe, is May 7, 1996. At that time, we will be prepared to present information to the Council demonstrating why the requested setback reduction should, be allowed. TETER and VIOLA M. TETER, husband and wife (hereinafter referred to as "Grantors") and STEINER DEVELOPMENT, L.L.C., an Idaho limited liability company (hereinafter referred to as "Grantee"). WITNESSETH: WHEREAS, Grantors are the owners of certain real property located in Ada County, Idaho, more particularly described herein; and WHEREAS, Grantors desire to provide aright-of--way easement for an underground irrigation pipeline; and WHEREAS, the underground pipeline is to be constructed by Grantee; and WHEREAS, it will be necessary for Grantee to maintain and service the said pipeline from time to time; and WHEREAS, Grantors desire to provide a temporary easement for the construction of the said underground irrigation pipeline; NOW, THEREFORE, in consideration of the benefits to be received by Grantee, and other good and valuable consideration, the receipt and sufficiency of which is acknowledged, Grantors do hereby give, grant and convey unto Grantee aright-of--way easement for the constnaction, operation and maintenance of one underground irrigation pipeline under and across all that real property described in Exhibit A hereto. Said pipeline is for the sole benefit of the real property immediately north and adjacent to the real property described on Exhibit A. The easement hereby granted is for the purpose of construction and operation of one underground irrigation pipeline, together with its maintenance, repair and replacement at the convenience of Grantee, with the reasonable right of access to such facilities at any reasonable time; provided, however, that in the event the surface of the easement area is disturbed or other damage occasioned as a result of Grantee's maintenance, repair or replacement of the irrigation pipeline, Grantee shall,. at its sole expense, expediently replace and restore the easement area to a condition comparable to that existent prior to undertaking such maintenance, repair, or replacement. There shall be only one imgation pipeline installed and once the original pipeline is installed, it shall not be relocated. This easement shall not be construed to provide Grantors with any right to place any structures on the surface of the easement premises except such manholes and manhole covers as may be reasonably necessary or required by governmental agencies to provide for the maintenance and cleaning of the irrigation pipeline. Grantors shall have no obligation to repair or maintain the said IRRIGATION PIPELINE EASEMENT - 1 • underground irrigation pipeline as provided for herein and in the event Grantors are required to undertake to repair or maintain the said pipeline, Grantee shall reimburse them their reasonable costs incurred thereby. Grantors do further hereby give, grant and convey unto Grantee a temporary construction easement over all that real property described in Exhibit B attached hereto, for the purpose of construct the said underground irrigation pipeline herein described, the same to expire and terminate on June 1, 1996, or when the initial construction is completed, whichever is sooner. IT IS EXPRESSLY UNDERSTOOD AND AGREED by and between the parties hereto that Grantee will timely complete the work of laying the underground irrigation pipeline and restoring the premises used therefore to a condition comparable with that existing prior to the undertaking of the construction of such underground imgation pipeline., TO HAVE AND TO HOLD the said easements and right-of--way unto the said Grantee, its successors and assigns until such time as the said irrigation pipeline is no longer used for its intended purpose for a period of two years. GRANTEE shall hold harmless and indemnify Grantors and their successors and assigns from any claims, demands, or actions against them arising out of the use and occupation of the easement premises as provided for herein. In the event of any litigation between the parties hereto, Grantors shall be entitled to all attorneys fees incurred. GRANTORS DO HEREBY COVENANT AND AGREE that they will not place or allow to be placed any permanent structures on the area described for this easement which would interfere with the use of the said described easement for the purposes stated herein as Exhibit A, but no provision of this easement shall in any way limit Grantor's use of the property except as specified herein. This street section if it is centered in the 42 foot right of way, it will put the back of the sidewalk right on the right of way line, the street section could be off centered so that there could be a small space adjacent to the back of sidewalk between the back sidewalk and property line, but nevertheless if it is centered it will fit. It is my understanding although I have not had an opportunity to meet with him that the City Engineer has reviewed the pla# and has some concerns with respect tb some of the features of the plat. What we would like to ask you to do is table the matter for another two weeks in order to give us an opportunity to meet with the City Engineer and buff this thing up so we can take a rather unique approach to this and actually give you something to approve that is exactly right if we can get there. I know where you are coming from and I think it has to be a function or mechanism that the homeowners association has to handle and if there is a big function then they are going to have to handle it the best way they can. Even if they did double park the ideal situation, like I said we have the ideal situation with the one street parking even if someone did park on the other side there is still enough room for a fire truck to get through. It is just, the fire chief felt more comfortable going with the parking on one side and posting on the other side. We have agreed to that. Corrie: Any further questions for Doug or Steve? We just ran out of time, but we felt that we could work off of what you have here in front of you and then bring all of the corrections in and let the staff handle it at their level. Which I don't think I even answered your question, we will have it around this week. Morrow: Mr. Mayor, I guess a comment here for our staff and Attorney, the Council and Mr. Campbell is that in the chain of events the preliminary plat is the most important document. I have a great reluctance to move forward with this until we have a corrected preliminary plat in front of us. So as a point of discussion 1 believe my position here will be on item 13 that it goes no further until we have a valid preliminary plat in hand and address those issues at that point in time. Mike Wardle, 50 Broadway Avenue, Suite D, Boise, was sworn by the City Attorney. Wardle: Mr. Mayor and members of the Council, this project is similar in some respects to that that you just reviewed but substantially different in the planned character. I want to spend just a few minutes if we possible can so we don't belabor this evening. It is a little background, the location of this project for Ashford No. 2 is in the center part of the conditional use permit that the Council approved in December of 1994. This is actually the first of two medium density parcels. The parcel in the center was approved at that point conceptually for up to 8 units to the acre. Overall density of the project at that time as originally approved was 3.55 units to the acre including the medium density parcels. With this change as submitted this property is coming in at a density of approximately 4.9 units to the acre. We are going to show you a detached dwelling concept. So the overall density of the project is as a result also reduced. I guess there is probably nothing more on the overall site but this one simply shows the location and a layout that, I want to just quickly go through the fact that what we are going to talk about are again detached dwellings. The proposal as submitted to the Commission and as discussed anal as recommended for approval both as a conditional use permit and as a preliminary plat accommodates five different dwelling units ranging from 1225 square feet up to 1881 square feet. All of the information that was presented is in the packet that you received last week so I am trusting you will have read that if you have questions specifically we can go through but generally we are talking about just a variety of fairly traditional appearing dwellings, lap siding, shake roofs, and the floor plans. all of these floor plans and elevations are in blue print form in the files in your planning department. In addition these boards have been retained here during the hearing process and were there for review. I think it is probably more appropriate to look at the cluster concept that is being proposed. I would like to provide to the Council two different renderings. These are actually copies of the renderings that were submitted. to and reviewed and approved by the Planning Commission. (Inaudible) Believe it or not through the modem technology the exact duplication of what we show as kind of a salmon pink here is kind of a faded out yellowish green on your copies. This is the technical site plan and I want to emphasize the fact that the architectural firm that designed the units has also designed the layout. Hutchinson: Mr. Chairman and members of the Commission, this is the second phase of Dove Meadows No. 2, as you recall the original portion of this when it was approved did expire and we have now completed the application and brought it forward to you in this form. There is a slight change from the original form thaf was reviewed and approved by this body and that is on the northwest end. Originally there was a stub street that went to the west to the Avest property, however because of the changes in the development plan on that property we have looped the street and connected it up and also have connected with the stub street into Wingate Place Subdivision No. 2. We have reviewed the comment sheet from Bruce Freckleton in the City Engineer's office.. We responded in writing to his comments and submitted the amended preliminary plat, I believe you should have that before you today. We have gone through those comments, we have no problem with complying at those comments with the exception of I believe it is lots 3 and 4 of Block 3 we do have a problem with the frontage on those because it is on a curve. Johnson: This is item #3 on the site specific comments? Hutchinson: Site specific comments from Mr. Freckleton. Lots 3 and 4 of Block 3, Lots 21, 20 on Block 2 have been adjusted so that they do have the proper frontage on the revised plat. Lots 3 and 4 because they are on the outside of the curve we are unable to get the 65 feet of frontage at the street line. They are a little bit closer if you are at the setback line however we are going to have to request a variance from the street frontage standard and that application will be forthcoming. The lots do, Lot 3 I believe is about 9000 square feet, Lot 4 is 8000 square feet or vice versa I can't recall exactly which one is which. They are both in excess of 8000 square feet. System shall be designed such that no lateral lines run parallel within the street right-of- ways. Crossings from block to block will be allowed. Any proposal for a supplementary connection from the City's water system to the pressurized irrigation system being proposed will need to be reviewed closely due to the size of the area to be watered. Applicant shall provide a statement as to the ownership of and operation/maintenance of the pressurized irrigation system. All street lights shall be installed, at subdivider's expense. Typical locations are at street intersections and/or fire hydrants. 3. The Meridian Fire Department and Meridian School District need to review and approve of the travel way widths. I am concerned about the narrower width of the roadways as it will make it more difficult to navigate with school busses and emergency vehicles. As an absolute minimum, "No Parking" signs should be posted along one side of the street. I don't know how enforcement of the "No Parking" will be accomplished. 4. The treatment capacity of the City of Meridian's Wastwater Treatment Plant is currently being evaluated. Approval of this application needs to be contingent upon our ability to accept the additional sanitary sewage generated by this proposed development. 5. Many concept versions of this project have been submitted to the City of Meridian over the last year or so. Shari Stiles and I reviewed and submitted comments to the Planning and Zoning Commission for the Preliminary Plat of the Lake at Cherry Lane No's. 5 & bon March 10, 1995. There were eight General Comments, eleven Site Specific Comments -Public Works, and ten Site Specific Comments -Planning Department. Prior to the City Council meeting of October 1?, 1995, I reviewed my files to try and determine if our review comments had been addressed by the applicant. On October 13, 1995, I prepared a memorandum to the City Council in which I requested that the Preliminary Plat for the Lake at Cherry Lane No. 5 & b be tabled until we receive and review a Preliminary Plat map that represented the most current proposal as well as address all of our comments. City Council approved the Plat at the October 17, 1995 meeting with the conditions that a note be added to the Preliminary Plat map regarding the R-4 Zone along the southerly boundary and meeting the staff conditions. To this date I still don't have a revised Preliminary Plat map that has been revised to show the "three zone concept" nor have all of Shari's and my comments been addressed. The Approved Preliminary Plat indicates that there will be two phases to this project, the phase line shows that the project will be divided in more or less anorth-south fashion. From the Plat map I assume that one would be "The Lake at Cherry Lane No. 5" and the other would be "The Lake at Cherry Lane No. b". The application before you doesn't include the north portion of what I assume was presented as being "The Lake at Cherry Lane No. 6"; therfore it is not in conformance with the Approved Preliminary Plat. I respectfully request that a condition of this application be that the applicant address all of our previous comments and submit a Preliminary Plat Map that represents the current development proposal. City of Meridian 33 East Idaho Meridian, Idaho 83642 Re: The Lake at Cherry Lane No. 6 Subdivision Dear Councilmen: I have reviewed the application for The Lake at Cherry Lane No. 6 Subdivision and find that it includes approximately 52 homes assuming a median value of $115,000. We also find that this subdivision is located in census tract 103.10 and in the attendance zone for Linder Elementary School, Meridian Middle School and Meridian High School. Elementary students from this development will be transported to Lake Hazel Elementary, due to overcrowding at Linder Elementary. Using the above information we can predict that these homes, when completed, will house 15 elementary aged children, 12 middle school aged children, and 15 senior high aged students. At the present time Linder Elementary is at 146.40. The Meridian School District is not opposed to growth, however this subdivision will cause increased over-crowding in all three schools. There is little opportunity to shift attendance boundaries since the surrounding schools are also well over capacity. The Meridian School District will support this development but we will need land dedicated to the district or at least made available at a minimum price for a school site in this area. The site would need water and sewer services available. In addition we would need to pass another bond issue for the construction of schools. The cost per student for newly constructed schools, excluding site purchase price and offsite improvements, exceeds $5,000 per elementary student and $10,000 per middle or high school student. • We are in a difficult position and need your help in dealing with the impact of growth on schools. Oslund: Point of interest, page 17, item 7, recommended that the vacant parcel to the west be developed as a park with maintenance provided by homeowners association of Valerie Place Subdivision. I guess I wonder do we have the authority to place it in their, within their responsibility to maintain? Do they have anything to say about this? Johnson: Does anyone have a valid recommendation here? Mr. Crookston, are we making a valid recommendation here? Crookston: It is something that would have to be worked out between Smith's and the homeowners association of Valerie Place. It is a recommendation to the Council hopefully they would come to the City and talk about it. We cannot require that. Oslund: If we can't come to an agreement and that deal falls through what happens with our, it just evaporates altogether or what? Crookston: Well it would. It is my understanding that the City does not want to have an approximately 2 acre park to maintain and care for. That is why that is in there the way it is. Their proposal was to either have it as a .park or to make it part of a residential subdivision is what they said at the hearing. Johnson: Understand? Oslund: It is clear as mud I guess. Johnson: Well the park was one of two alternatives proposed as I recall.
