the Laws of the State of Idaho, that the Planning and Zoning Commission of the City of
Meridian will hold a public hearing at the Meridian City Hall, 33 East Idaho Street,

STORMVVATER MANAGEMENT RECOMN~NDATIONS
We recommend that the first one half inch of stormwater be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact to groundwater
and surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for stormwater
disposal and design a stornawater management system mould be used~fogr

Street
APA staff reviewed the conditional use permit for a thrift store and farmers market at 231 and
249 E. 1st Street. The site plan for the proposed thrift store and farmers market shows existing
sidewalks on E. 1st Street adjacent to the subject properties. The thrift store site plan indicates
sidewalks will be constructed on E. King Street adjacent to it, providing sidewalks along the
roads. However, the farmers market site plan does not show any future sidewalks on E. King
Street adjacent to it. APA recommends sidewalks be constructed on E. King Street adjacent to
the farmers market. These commercial stores are within walking distance of existing employment
centers and residential areas and sidewalks would encourage more walking to these businesses
as well as expand the pedestrian walkway system in Meridian.

The applicant is requesting conditional use approval to remodel the existing Food Town at the
southwest corner of E. 1st Street and King Street and relocating a building to the northwest
corner of E. 1st Street and King Street for a farmers market. The 1.3-acre site is comprised of
two parcels, located at the northwest and southwest corners of King Street and East 1st Street.
This development is estimated to generate 270 additional vehicle trips per day based on the
Institute of Transportation Engineers Trip Generation manual.

Re: Request for Conditional Use Permit for a~ Thrift Store and Farmers Market by
Idaho Youth Ranch, Inc., and Hill's Farmers Market
We have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
1. Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate imgadon/drainage district, or lateral users association, with written
confirmation of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface
soil conditions as prepared by a soil scientist with the development plans.
4. All paving, striping and signage of parking lot to be in accordance with Meridian City
Ordinance Section 11-2-414 and the Americans with Disabilities Act. All off-street
parking spaces are to be paved. Parking stalls are to be 9'x19' minimum with 25'
driveways.
5. Submit a drainage plan designed by a State of Idaho licensed architect or engineer for all
new off-street parking areas for approval by the City EngineerJPublic Works Department
(Ord. 557, 10-1-91).

6. Lighting shall not illuminate residential properties or cause glare problems, as determined
by the City of Meridian.
7. Each applicant shall obtain certificates of occupancy prior to opening for business.
8. All signage shall be in accordance with the standards set forth in Section 11-2-415 of the
City of Meridian Zoning and Development Ordinance. All signage shall receive design
approval of the Planning & Zoning Department. Multiple A-frame signs are not desirable
on East First Street. Sign permits are needed for all signage.
9. Coordinate fire access and hydrant locations with the City of Meridian's Water
Superintendent and Meridian Fire Department policies. Any new fire hydrant locations
shall be depicted on building plans.
10. Indicate any existing FEMA Floodplain Boundaries on the Site Plan Map, and/or any plans
to reduce said boundaries.
11. All construction to be in compliance with the Americans with Disabilities Act (ADA) and
all required Uniform Codes.
SITE SPECIFIC COMMENTS
1. Sanitary sewer and water service to the Idaho Youth Ranch store is existing. Sewer for
the proposed Hill's Farmers Market is currently located in the alley north of Osprey Boats.
Water is available from a main in King Street.
2. As East First Street is designated as an entrance comdor, particular attention must be paid
to landscaping this frontage. Applicants for other projects have been required to maintain
a minimum 20-foot-wide planting strip along East First Street. With continued use of the
existing gas tanks proposed, the opportunity for landscaping is very limited. However,
since the Hill's Farmers Market site is currently undeveloped, this 20-foot-wide planting
strip is required. A minimum of one (1) three-inch caliper tree is required for every 1,500
square feet of pavement. All landscaping and pressurized irrigation system shall be in
place prior to obtaining a certificate of occupancy. Appropriate bonding must be secured
prior to temporary occupancy.

3. Provide five-foot-wide sidewalks on both sides of King Street and on East First Street in
accordance with City Ordinance Section 11-9-606.B. Driveways are to meet the
requirements of the Ada County Highway District.
4. Any proposal for a supplementary connection from the City's water system to the
pressurized irrigation system will need to be reviewed closely due to the size of the area
to be watered.
5. If significant changes from the plan submitted are made, additional hearings may be
required at the City's discretion. The conditional use permit shall be subject to yearly
review upon notice to the Applicant. All building plans are subject to detailed review.
Applicant to submit remodeling plans for approval prior to construction.
6. Utility locations need to be included on the plan for approval by the Public Works
Department.
7. Screened trash enclosures are to be provided in accordance with City Ordinance.
Coordinate dumpster site locations with the City's solid waste contractor, Sanitary
Services, Inc. Locate dumpsters so as not to impede fire access.
8. Applicant shall supply the Public Works Department with anticipated sewer and water
usage for analysis in determining whether additional assessment fees should be charged.
A re-assessment agreement will be entered into with the Applicant prior to issuance of a
building permit.
Idaho Youth Ranch has been cooperative to date and has presented a plan for the Foodtown Store
site that should greatly enhance the appearance of this property. Idaho Youth Ranch and Hill's
Farmers Market occupancy certificates will be tied to required improvements on their respective
sites.

Stiles: Chairman Johnson and Commissioners, due to the fact that the representative of
the applicant is having some health problems, we stressed him out too bad. I think it is a
very straight forward project, it is the Food Town existing grocery store. They have
submitted their plan that they are showing adding the parking and some landscaping that
hasn't existed at the site before. Ada County Highway District has placed some restrictions
on in and out because they plan to still use the existing pumps as part of their program
plus probably open to the public. The smaller 8 1/2 by 11 drawing you have is for Hills

Farmers Market which is directly north of King Street adjacent to this parcel. Hills or Idaho
Youth Ranch has agreed to our conditions and has agreed to be responsible for the

MacCoy: Let me try to clarify something here, are you telling us that the tanks that are
buried out there are not going to be torn out and are going to be used?
Stiles: They are, they have been tested and 1, we would request a letter from Health and
Welfare or the appropriate agency to get that approval to leave them in place.
Johnson: We are talking about continued use is what we are talking about because they
have been used all along right?
Stiles: Yes
Johnson: So in order to be used, they have met compliance in the past. Are they all

of the A frame signs. t think we can talk to him, Mr. Hill, doesn't quite understand but I
think we can let him know what our expectations are.

Oslund: One more clarification, they are going to actually operate the gas station and a
thrift store?
Stiles: Yes
Borup: At this point are they intending to move the existing building from Fairview over to
here?
Stiles: That was Mr. Hill's plan.

Stiles: He currently operates in a building that is east of the Idaho Athletic Cluka, it is in the
County. It sits back up against the adjacent residential lots. He knows he is going to have
to comply with the building code requirements but he believes that he can use that existing
building and it will save him money. I think part of it is metal but the front portion is, I don't
know what it is. Daunt will have to inspect the building and make sure that it is up to code
before he get's an occupancy permit for that building.
Oslund: So he is not going to use the Food Town building?
Stiles: That is where the Idaho Youth Ranch will be. It is confusing because these are
redly two separate pieces of property but the Idaho Youth Ranch agreed to let Doug Hill
come in as part of their conditional use permit to save him some money. Do you have an

Borup: That was my concern what the building was going to look like. (Inaudible)
Stiles: Mr. Hill stated that it would cost him $6000 to move the building, he was going to
move the building initially because he got a temporary permit from the City Council so he
could use it temporarily. But even if they had to move it 2 feet from the position that he had
it set he would have to pay another $6000 to move it onto a foundation later. He can't get
a building permit until he gets a conditional use permit.
Shearer: Are they going to landscape the parking on the farmers market part?
Stiles: One of my comments was they should provide a 20 foot landscape strip on that
parcel. It is not really possible on the Idaho Youth Ranch parcel because of maintaining

Mayor, the Idaho Youth Ranch is non-profit organization founded in 1954 in Rupert, Idaho.
Approximately 12 years ago the thrift store ~°oncept came about in Boise and since then
there have been 14 thrift store locations, l3 in Idaho, 1 in Ontario, Oregon. The purchase
of the Food Town grocery store was done about 2112 years ago and leased back to David
Foods. They have since vacated September 1, at that time we took over. Didn't know
exactly what the procedures were to get that building occupied and running. I personally
have been involved in 11 other locations and did not know, did not have to go through the
steps I've had to go through here. So there has been some stumbling and some help that
I got from Planning and Zoning I have had to hire an architect and engineer all of which
has been done. I think now we are basically ready to proceed, I have got the signed
engineered drainage plan for the parking lot which is one of the requirements that was
presented by Planning and Zoning. The one d~tange I need to make to the application is
to remove Doug Hill and Farmers Market from the application. I talked to Doug on Monday,

he has completely withdrawn his desire to lease that piece of property on the comer of
King and 1st adjacent to the thrift store property on the grounds that he does not have the
money to do so. He has completely dismantled that building on Fairview in pieces that he
was going to move over in one whole section, I saw on Tuesday it was in pieces and parts
on a trailer. He just feels that it is just too much money. I don't think he really knew what
he was getting into at the beginning. I think he thought he could just kind of set up a tent
seasonally and shut down when the weather got cold and that is basically what he was
doing on Fairview. That was not what the City Council Planning and Zoning had in mind
for Doug. They wanted him to construct a building on a foundation with sewer, water hook
ups and he was not prepared to do that. He was just intending on building just basically
a fruit and vegetable stand without the need for electricity or water and sewer. We had
tentatively made an agreement to go in jointly to save some money to let Doug save some
money on his application in exchange he was going to let his customers use our restroom
facilities if need be and hook into our power which is on that light post there on the sign
post. I guess just use bottled water if need be. But anyway that is no longer an issue and
that needs to be stricken from the application. So the project would be and I think that you
have got it on your at least a very shrunk down version is on Ada County's picture of the
site. I have a drawing of the site where it pictures the existing building with new sidewalk
in accordance to Ada County Highway Department. And all of their conditions are being
followed by Idaho Youth Ranch. The parking lot I have a signed approved copy of a
drainage, French drain program for the parking lot that is going to be done just as soon as,
actually it could be done right with the signed drainage plan. But there is enough parking,
handicap parking on site that I proposed that we completely omit the property that was
originally designated as the Farmers Market location. It would be on the northwest corner
of King and First Street. Just completely leave that untouched. And thus doing all of the
improvements to the southwest portion where the existing building is now. The one
recommendation from Shari was that the landscaping was not going to fit into the scheme
due to the gas pump an'angements which we are going to leave intact managed by United
Oil out of Caldwell doing the CFN cardlock system. It would be managed completely by
them and then we would just get 2.5 cer~s per gallon. on. every gallon pumped throw the
system. Basically we have no handling in that operation whatsoever. It is completely
handled by them. The landscaping requirements although not on First Street would be
handled down the southwest comer of the property parallel to the alley. Improvements also
would be done to the alley, completely paved at our expense and that is right of way. But
the landscaping would be on our property with the required amounts of trees, shrubs,
irrigation, along the whole, it would be completely down the alley along the back chain link
fence against those apartments and then along First Street up to the curb cut. There
would be 37 parking spaces which is the exact number based on the amount of square
footage inside the building for retail and for storage. Any questions?
Bentley: Mr. Mayor, I have a couple. One do you know what the, if those gas tanks have

been changed out or if there is a (inaudible)
Beamguard: No they were installed in 1984, they are metal, we have installed cathodic
protection which is an EPA law that has to be in place by 1999. We put that in now just
because we are going to do the asphalting and we wanted it to be under ground. What
that is, is a device that actually takes metal out of the ground. Not metal, it takes, it is an
electronic that takes the deterioration away from the tank, away from the metal. They pump
the fuel out of those tanks, tankology went down and sent a scope into the tank and took
a picture of the tanks and I haven't got that report back. That report would be made
available to you just as soon as I can get it.
Bentley: The next question, if the Farmer Market is not going to be there what is going to
happen with atl of the equipment you have stored across the street?
Beamguard: I talked to Doug about that equipment which was in the back of the property,
back behind the store in the dirt, what he had planned on doing with that. I told him to
move it because we were getting ready to do the parking lot. Well he just took it upon
himself to move it across the street. I told him that needs to get out of there. He asked me
if it would be okay if he left it there over the winter covered up and I said no that would be
a complete eye sore especially for that neighbor that is next door an older gentleman that
I have talked to is already concerned about it. So I have told him personally that stuff
would be out of there. I just haven't been able to find Doug since Monday.
Corrie: Jeff, is there only one entrance into that building?
Beamguard: No, there are several ,probably six.
Morrow: Mr. Mayor, I have questions of Gary and Shari, comments?
Stiles: I just had one comment !~~at I have noticed since the application was submitted tnat
there are some off premise signs affixed to the fence and the front of the building.
Beamguard: That fence is going down (inaudible)
Stiles: I think they have done quite a bit of work, it is looking pretty nice and then I think
it will be a great improvement to that area.
Bentley: Did you get all of the bicycles fixed?

problems with the comments that were provided to him by Public Works, were there any
concerns.
Morrow: Did you hear that the Hill portion his request was to drop that portion of it.
Smith: That is what I understood, Shari merrtioned that to me before I left.
Beamguard: No, most of the questions and comments dealt basically with Doug, let me go
through them again, you are talking about the Planning and Zoning Meeting on the 16th,
your recommendations.
Smith: The memorandum that was written dated September 12. Memorandum to the
Mayor and Council and Planning and Zoning.
Beamguard: Oh, the general comments?
Smith: Yes, general comments and site specific comments.
Beamguard: Absolutely not, all of that is going to be followed exactly. The parking lot was
the main obstacle and that has been approved and picked up just today.
Smith: Thank you, I don't have any other comments.
Cowie: I guess I have a question of Counselor, do we need to redo this since some of the
portions the Farmers market was taken out?
Crookston: You could approve them and strike them. I would mention though that with
regards to the Farmers Market, the City needs the request from Mr. Hill to withdraw his
part of the application. We need to send a letter to him (inaudible) but we ~o need the
written acknowledgement of the fact that he wants to be withdrawn.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
September 16, 1996, at the hour of 7:30 o'clock p.m., a
Petitioner's representative not appearing due to health reasons,
and the Planning and Zoning Director, Shari Stiles, presenting the
Application, the Planning and Zoning Commission of the City of
Meridian having duly considered the evidence and the matter makes
the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional Use
Permit was published for two (2) consecutive weeks prior to the
public hearing scheduled for September 16, 1996, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the September 16, 1996,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
available to newspaper, radio and television stations.
2. That this property is located within the City of Meridian
and the Applicant, Idaho Youth Ranch, Inc. is the owner of the
property; that the property is described in the application which

description is incorporated herein.
3. That the property is zoned Old Town, which requires a
conditional use permit for the operation of a thrift store and
farmers market.
4. That the Old Town District is described in the Zoning
Ordinance, 11-2-408 B. 12. as follows:
(OT) Old Town District: The purpose of the (OT) District
is to accommodate and encourage further expansion of the
historical core of the community; to delineate a
centralized activity center and to encourage its renewal,
revitalization and growth as the public, and quasi-
public, cultural, financial and recreational center of
the City. A variety of these uses integrated with
general business, medium-high to high density
residential, and other related uses is encouraged in an
effort to provide the appropriate mix of activities
necessary to establish a truly urban City Center. The
District shall be served by Municipal Water and Sewer
systems of the City of Meridian. Development in this
district must give attention to the handling of high
volumes of traffic, adequate parking, and pedestrian
movement, and provide strip commercial development, and
must be approved as a conditional use, unless otherwise
permitted.
5. That the uses proposed by Applicant is a specifically
allowed conditional use as retail stores in the Zoning Schedule of
Use Control, 11-2-409.
6. That the property had been the Foodtown Grocery Store,
flower shop and gasoline distributor and is currently vacant.
7. That sewer and water is available to the property.
8. That the Applicant stated in the Application that the
building is in need of some cleaning up, some minor repair to the
concrete block, and painting; that landscaping with underground
sprinklers, planters and asphalt and new sign will be completed

prior to opening; that the Applicant agrees to pay any additional
fees regarding trash, sewer, or water; that the Farmer's Market
agrees to pay their portion for trash, sewer and water for their
lot.
9. That Ms. Stiles, presented the application to the
Commission and stated that the Applicant has submitted a straight
forward project; that they are adding the parking and some
landscaping that hasn't existed at the site before; that the Ada
County Highway District has placed some restrictions on "in and
out" traffic because the Applicant plans to still use the existing
pumps as part of their program plus probably open them to the
public; that to the north of Ring Street, adjacent to this parcel,
will be Hill's Farmers' Market; that the Applicant has agreed to
staff's conditions and has agreed to be responsible for the roadway
improvements and landscaping improvements that are a part of Hill's
Farmers' Market; that the tanks have been tested and are planned to
be used by the Idaho Youth Ranch; that the City will request a
letter from the Health and Welfare or appropriate agency for
approval to leave the tanks in place; that Hill's Farmers' Market
is planning to erect on the parking lot adjacent to this parcel a
building which is north of Ring Street, hook up to sewer and water
and have their own parking lot; that at this time it is not known
if the Applicant is planning to use the existing sign, however, for
Hill's Farmers' Market and Mr. Hill's use of A frame signs, the
City's expectations will be made known; that Mr. Hill is intending

to move the existing building from Fairview Avenue to the King
Street location; that the building inspector will inspect the
building and make sure that it is up to Code before an occupancy
permit is obtained.
10. That Ms. Stiles added that the Idaho Youth Ranch agreed
to let Mr. Hill come in as part of their conditional use permit to
save Mr. Hill some money; that staff comments require that a 20
foot landscape strip on the Hill parcel and because of the use of
the tanks by the Idaho Youth Ranch, they would have to meet the
tree and landscaping requirements.
11. That the Meridian Planning and Zoning Administrator,
Shari Stiles, and Assistant City Engineer, Bruce Freckleton
submitted comments and they are incorporated herein as if set forth
in full as follows:
1. That any existing irrigation/drainage ditches
crossing the property shall be tiled.
2. That any existing domestic wells and/or septic
systems within this project will have to be removed
from their domestic service per City Ordinance, but
wells may be used for non-domestic purposes such as
landscape irrigation.
3. Determine the seasonal high groundwater elevation,
and submit a profile of the subsurface soil
conditions as prepared by a soil scientist with the
design of site drainage plan.
4. All paving, striping and signage of parking lot to
,be in accordance with Meridian City Ordinance and
the Americans with Disabilities Act. All off-
street parking spaces are to be paved. Parking
stalls are to be 9'x 19' minimum with 25'
driveways.
5. Submit a drainage plan designed by a State of Idaho

licensed architect or engineer for all new off-
street parking areas for approval by the City
Engineer/Public Works Department.
6. Lighting shall not illuminate residential
properties .or cause glare problems, as determined
by the City of Meridian.
7. Each applicant shall obtain certificates of
occupancy prior to opening for business.
8. All signage shall be in accordance with the
standards set forth in Section 11-2-415 of the City
of Meridian Zoning and Development Ordinance. All
signage shall receive design approval of the
Planning & Zoning Department. Multiple A-frame
signs are not desirable on East First Street. Sign
permits are needed for all signage.
9. Coordinate fire access and hydrant locations with
the City of Meridian's Water Superintendent and
Meridian Fire Department policies. Any new fire
hydrant locations shall be depicted on building
plans.
10. Indicate any existing FEMA Floodplain Boundaries on
the Site Plan Map, and/or any plans to reduce said
boundaries.
11. All construction to be in compliance with the
Americans with Disabilities Act (ADA) and all
required Uniform Codes.
12. That Bruce Freckleton and Shari Stiles submitted site
specific comments and they include the following:
1. Sanitary sewer and water service to the Idaho Youth
Ranch store is existing. Sewer for the proposed
Hill's Farmers Market is currently located in the
alley north of Osprey Boats. Water is available
from a main in Ring Street.
2. As East First Street is designated as an entrance
corridor, particular attention must be paid to
landscaping this frontage. Applicants for other
projects have been. required to maintain a minimum
20 foot (20') wide planting strip along East First
Street. With continued use of the existing qas
tanks proposed, the opportunity for landscaping is

very limited. However, since the Hill's Farmers
Market sit is currently undeveloped, this 20 foot
(20') wide planting strip is required. A minimum
of one (1) three inch (3") caliper tree is required
for every 1,500 square feet of pavement. All
landscaping and pressurized irrigation system shall
be in place prior to .obtaining a certificate of
occupancy. Appropriate bonding must be secured
prior to temporary occupancy.
3. Provide Five foot (5') wide sidewalks on both sides
of King Street and on East First Street in
accordance with City Ordinance Section 11-9-606.B.
Driveways are to meet the requirements of the Ada
County Highway District (ACRD).
4. Any proposal for a supplementary connection form
the City's water system to the pressurized
irrigation system will need to be reviewed closely
due to the size of the area to be watered.
5. If significant changes from the plan submitted are
made, additional hearings may be required at the
City's discretion. The conditional use permit
. shall be subject to yearly review upon notice to
the Applicant. All building plans are subject to
detailed review. Applicant to submit remodeling
plans for approval prior to construction.
6. Utility locations need to be included on the plan
for approval by the Public Works Department.
7. Screened trash enclosures are to be provided in
accordance with City Ordinance. Coordinate
dumpster site locations with the City's solid waste
contractor, Sanitary Services, Inc. Locate
dumpsters so as not to impede fire access.
8. Applicant shall supply the Public Works Department
with anticipated sewer and water usage for analysis
in determining whethe:.• additional assessment fees
should be cha=ged. A re-assessment agreement will
be entered into with the Applicant prior to
.issuance of a building permit.
13. That Central District Health Department, Meridian Fire
Department, ,Meridian City Police Department and the Nampa Meridian
Irrigation District submitted comments and they are hereby

incorporated herein as if set forth in full.
14. That the Meridian Fire Department commented that all
Codes will need to be met when remodeled and if the underground
fuel tanks are not put to use they will need to be pulled out of
the ground.
15. That the Ada County Highway District submitted comments
and they are incorporated herein as if set forth in full; that the
site specific comments are as follows:
Northwest Parcel - Farmers market:
1. Replace the existing 27 foot wide curb cut on the
northern parcel on East 1st Street with standard
curb, gutter and concrete sidewalk to match
existing iaq~rovements .
2. Construct standard vertical curb, gutter, 5 foot
. wide concrete sidewalk and match paving on Ring
Street abutting the parcel. Improvements shall be
constructed to one-half of a 41 foot street
section.
3. Eliminate the. perpendicular parking proposed on the
north side of Ring Street. The Applicant may
construct 24 to 30 foot wide curb cuts if they are
located a minimum of 50 feet west of East 1st
Street and separated 50 feet from any existing or
planned driveways on either side of Ring Street
(this included the driveway listed in (10.) below)
as measured from near edge to near edge.
4. Direct lot or parcel access to E. 1st Street is
prohibited.
5. Pave all driveways their full required width of 24
to 30 feet w~ie and to a point 30 feet beyond the
.edge of pavement.
Southwest Parcel - Idaho Youth Ranch Thrift Store
6. Reconstruct the existing 40 foot wide curb cut on
E. 1st Street as a 20. foot wide curb return
approach. This driveway shall be restricted to

entering vehicles only with appropriate signage.
7. Pave the alley abutting the site's south boundary
• its full required width of I7 feet abutting the
parcel (300 feet).
8. Construct standard vertical curb, gutter, 5 foot
wide concrete sidewalk and match paving on Ring
Street abutting the parcel. Improvements shall be
constructed to one-half of a 41 foot street
section.
9. The existing driveway on the south side of Ring
Street, located approximately 15 feet west of E.
1st Street shall be approved as proposed provided
the Applicant reconstruct the driveway as a 20 foot
wide curb cut, restricted to exiting vehicles only
with appropriate signage.
10. Construct a 24 to 30 foot wide curb cut on Ring
Street, as proposed, located approximately 185 feet
west of E. 1st. Street.
11. Pave all driveways their full required width of 24
. to 30 feet wide to a point 30 feet beyond the edge
of pavement.
12. Other than the approved entrance only curb cut on
E. 1st. Street, direct lot or parcel access to E
1st. Street is prohibited.
16. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
given and followed.
17. That no other testimony was offered regarding this
application.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property

within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to
11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian.
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the property
pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418 D of the
Revised and Compiled Ordinances of the City of Meridian, Idaho;
4. That 11-2-418 C of the Revised and Compiled Ordinances of
the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and a review of the facts presented and the
conditions of the area, the Planning and Zoning Commission
concludes as follows:
a. The use, would in fact, constitute a conditional
use and a conditional use permit is required by
Ordinance.
b. The use should be harmonious with and in accordance
with the Comprehensive Plan but the Zoning
Ordinance requires a conditional use permit tc~
allow the use.
c. The .use apparently would be designed and _
constructed, to be harmonious in appearance with
the intended character of the general vicinity.
d. That the use would not be hazardous nor should it
be disturbing to existing or- future neighboring
uses.

e. The property has sewer and water service available.
f. The use would not create excessive additional
requirements at public cost for public facilities
and services and the use would not be detrimental
to the economic welfare of the community.
g. The use would not involve a use, activity, process,
material, equipment or conditions of operation that
would be detrimental to.person, property or the
general welfare by reason of excessive production
of traffic or noise.
h. That sufficient parking for the property and the
proposed use is required.
i. The development and uses will not result in the
destruction, loss or damage of a natural or scenic
feature of major importance.
5. That the comments of the City Engineer, the Planning and
Zoning Administrator, and Ada County Highway District must be met
and complied with.
6. That all ordinances of the City of Meridian must be met,
including but not limited to, the Uniform Building Code, Uniform
Fire Code, Uniform Plumbing Code, the Uniform Electrical Code, the
Fire and Life Safety Code, all parking and paving requirements.
7. That the structure on the property must be brought up to
all Codes prior to issuance of an occupancy permit.

E. 1st. Street is improved with 3 lanes with curb, gutter and sidewalk abutting the two
parcels.
B. Utility street cuts in the new pavement on East 1st Street are not allowed unless approved in
writing by the District. Contact Construction Services at 345-7667 (with file numbers) for
details.
C. District policy requires the applicant to construct curb, gutter and 5-foot wide concrete
sidewalk and pavement widening to a 41-foot street section on King Street abutting the

parcels (approximately 300-feet on the south parcel and 150-feet on the north parcel) prior to
issuance of any required permits or District approval of a final plat, whichever occurs first.
D. District policy states that direct access to arterials and collectors is normally restricted.
There is an existing 40-foot wide curb cut on East 1st Street, located 83-feet south of King
Street. The driveway does not meet the District's separation requirement of 220-feet for
access to E. 1st Street from King Street. There is an existing driveway on King Street,
located 15-feet west of the back of curb on E. 1st Street; this driveway does not meet the
District's required separation of 50-feet. The existing driveways on E. 1st Street and King
Street serve the existing fuel pumps between E. 1st Street and the existing building. If the
two driveways that are not in compliance with District policy were removed, the fuel pumps
would not be accessible.
Staff recommends a variance of District policy of the required driveway offsets, if the
driveways are modified as follows: the applicant should reconstruct the curb cut on E. 1st
Street as a 20-foot wide curb return approach restricted to entrance-only, and the applicant
should construct a 20-foot wide curb cut on King Street located as far from E. 1st Street as
possible (approximately 20-feet west of the back of curb on E. 1st Street) restricted to exit-
only. Additional access to the southern parcel can be provided by the alley on the southern
parcel's south boundary and further west on King Street. District policy allows access to the
alley and King Street a minimum of 50-feet from East 1st Street with a minimum of 50-feet
of separation between driveways on King Street.
E. There is an existing 27-foot curb cut on the northern parcel on E. 1st Street, located 28-feet
north of King Street. The driveway does not meet the District's separation requirement of
220-feet for access to E. 1st Street from King Street. District policy requires the applicant to
replace this curb cut with curb, gutter, and sidewalk to match the existing improvements on
E. 1st Street. Access to the northern parcel can be provided by King Street. District policy
allows access to King Street a minimum of 50-feet from East 1st Street with a minimum of
50-feet of separation between driveways.
F. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. The District requires driveways to be paved to their full required
width of 24 to 30-feet wide and to a point 30-feet beyond the edge of pavement.
G. The existing transportation system will be adequate to accommodate the additional traffic
generated by this proposed development with the requirements outlined within this report.
H. This application is scheduled for a public hearing by the Meridian Planning and Zoning
Commission on September 10, 1996.
The following requirements are provided as conditions for approval:

Site Specific Requirements:
Northwest Parcel:
1. Replace the existing 27-foot wide curb cut on the northern parcel on East 1st Street with
standard curb, gutter and concrete sidewalk to match existing improvements.
2. Construct standard vertical curb, gutter, 5-foot wide concrete sidewalk and match paving on
King Street abutting the parcel. Improvements shall be constructed to one-half of a 41-foot
street section.
3. Eliminate the perpendicular parking proposed on the north side of King Street. The applicant
may construct 24 to 30-foot wide curb cuts if they are located a minimum of 50-feet west of
East 1st Street and separated 50-feet from any existing or planned driveways on either side of
King Street (this includes the driveway listed in (10.) below) as measured from near edge to
near edge.
4. Direct lot or parcel access to E. 1st Street is prohibited.
5. Pave all driveways their full required width of 24 to 30-feet wide and to a point 30-feet
beyond the edge of pavement.
Southwest Parcel:
6. Reconstruct the existing 40-foot wide curb cut on E. 1st Street as a 20-foot wide curb return
approach. This driveway shall be restricted to entering vehicles only with appropriate
signage.
7. Pave the alley abutting the site's south boundary its full required width of 17-feet abutting the
parcel (300-feet).
8. Construct standard vertical curb, gutter, 5-foot wide concrete sidewalk and match paving on
King Street abutting the parcel. Improvements shall be constructed to one-half of a 41-foot
street section.
9. The existing driveway on the south side of King Street, located approximately 15-feet west of
E. 1st. Street shall be approved as proposed provided the applicant reconstruct the driveway
as a 20-foot wide curb cut, restricted to exiting vehicles only with appropriate signage.
10. Construct a 24 to 30-foot wide curb cut on King Street, as proposed, located approximately
185-feet west of E. 1st. Street.
11. Pave all driveways their full required width of 24 to 30-feet wide to a point 30-feet beyond
the edge of pavement.

12. Other than the approved entrance-only curb cut on E. 1st Street, direct lot or parcel access to
E. 1st. Street is prohibited.
Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACHD Development Services Supervisor. The request shall
specifically identi each requirement to be reconsidered and inchir~e a wr;rren Pxplanation of
why such a requirement would result in a substantial hard hip or inequity The written
request shall be submitted to the District no later than 9.00 a m on the day scheduled for
ACHD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission
action do not provide sufficient time for District staff to remove the item from the consent
agenda and report to the Commission regarding the requested modification, variance or
waiver. Those items will be acted on by the Commission unless removed from the agenda
by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Development Services Supervisor within two days of the
action and shall include a minimum fee of $110.00. Th_ a request for reconsideration shall
~pecificall id n i each requirement to be reconsidered and include written documentation
of data that was not available to the Commission at the time of its original decision, The
request for reconsideration will be heard by the District Commission at the next regular
meeting of the Commission. If the Commission agrees to reconsider the action, the applicant
will be notified of the date and time of the Commission meeting at which the reconsideration
will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #188, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and construction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services
procedures and all applicable ACHD Ordinances unless specifically waived herein.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building
permit (or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.

7. No change in the terms and conditions of this approval shall be valid unless they are in
writing and signed by the applicant or the applicant's authorized representative and an
authorized representative of the Ada County Highway District. The burden shall be upon the
applicant to obtain written confirmation of any change from the Ada County Highway
District.
8. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances,
plans, or other regulatory and legal restrictions in force at the time the applicant or its
successors in interest advises the Highway District of its intent to change the planned use of
the subject property unless awaiver/variance of said requirements or other legal relief is
granted pursuant to the law in effect at the time the change in use is sought.
Conclusion of Law:
1. ACRD requirements are intended to assure that the proposed use/development will not place
an undue burden on the existing vehicular and pedestrian transportation system within the
vicinity impacted by the proposed development.
