The Applicant, Gramercy, LLC, has submitted an application requesting approval to vacate three (3) 20-foot by 20-foot City of Meridian water and sewer easements on Lots 1 and 2; Lot 2 and Lot 10, Block 2 recorded with Gramercy Subdivision No. 1. II. STAFF RECOMMENDATION Staff recommends approval of the subject application. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located on the south side of E. Overland Road, midway between S. Wells Avenue and S. Bonito Way in the northeast '/ of Section 20, Township 3 North, Range 1 East. B. Owner/Applicant: Gramercy, LLC P O Box 344 Meridian, ID 83680 C. Representative: Becky McKay, Engineering Solutions 1029 N. Rosario Street Meridian, ID 83642 D. Applicant's Statement/Justification: Please see applicant's narrative for this information. Gramercy VAC Page 1 V. PROCESS FACTS A. The subject application is a request to vacate a number of City of Meridian water and sewer easements. Per Meridian City Code, a public hearing is required before the City Council on this matter. The UDC does not require posting of the site. B. Newspaper notifications published on: May 31, and June 14, 2010. C. Radius notices mailed to properties within 300 feet on: May 24, 2010. VI. LAND USE A. Existing Land Use(s): The subject site is vacant developable commercial property zoned C-G. B. Character of Surrounding Area and Adjacent Land Use and Zoning: 1. North: Vacant Commercial Property, zoned C-G 2. East: Multi-tenant Commercial Building, zoned C-G 3. South: Vacant Commercial Lots, zoned C-G 4. West: Bank and Multi-tenant Commercial Buildings, zoned C-G C. History of Previous Actions: • In 2006, the Gramercy development was annexed and zoned (AZ-06-021) C-G and R-15 and preliminarily platted (PP-06-019) for 64 single family detached residential lots, 24 alley loaded/attached single family residential lots, 9multi-family residential lots, 25 common lots, and 32 commercial lots on 77.66 acres. As part of that approval, a development agreement was required and approved; recorded as instrument #106141056. • A final plat (FP-06-048) was approved for 50 residential lots, 32 commercial lots, one city park lot and 21 common lots on 62.01 acres. D. Utilities: 1. Public Works: a. Location of sewer and water: currently installed from E Gala Ct. b. Issues or concerns: The applicant will be required to abandon any and all services not utilized with this development. The applicant will be responsible for all cost involved with the abandonment of any services or mains affected with the vacation of easements. E. Physical Features: 1. Canals/Ditches Irrigation: No Major facilities transverse the property. 2. Hazards: Staff is not aware of any hazards that exist on this property. VII. AGENCY COMMENTS MEETING No comments were received by the Planning Department from other City departments for the subject application. Please see the public record for the VAC file for any written comments that may have been submitted by other agencies. Please review Section 6D above for Public Works comments. Gramercy VAC Page 2 VIII. ANALYSIS Analysis Leading to Staff Recommendation: A. VAC Application: The applicant is requesting approval to vacate three (3) 20-foot by 20-foot public water and sewer easements on Lots 1 and 2; Lot 2 and Lot 10, Block 2 recorded with Gramercy Subdivision No. 1(see Exhibit A.2). The applicant has indicated a future building is planned for the area which may conflict with one of the easements that was platted on the shared lot line between Lot 1 and Lot 2. Futures services can be provided to the proposed building from the sewer and water easement platted on Lot 7 and Lot 8, Block 2. The two other platted water and sewer easements (platted on Lot 2 and Lot 10) requested for vacation are not needed to serve the development. However, services are located within the three easements proposed for vacation and Staff is recommending the applicant coordinate with Public Works to determine the need to abandon the service lines. Based on the aforementioned information, Staff supports vacating the easements as identified in Exhibit A.2. IX. EXHIBITS A. Maps/Other 1. Zoning Map & Aerial Map 2.
