Spurwing Greens Tennis Facility CZCCERTIFICATE OF ZONING COMPLIANCE DATE: TO: FROM: SUBJECT OWNER: June 10, 2010 Spurwing Greens, LLC Bill Parsons, Associate City Planner ~E IDIZ IAN,~- ~J Spurwing Greens Tennis Facility -CZC-10-033; DES-10-025 Spurwing Greens, LLC DESCRIPTION OF APPLICANT'S REQUEST The applicant, Spurwing Greens, LLC, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval to construct a new tennis facility located on annexed un-platted property, zoned R-2 (Low- density Residential). City Council approved a development agreement modification (MDA-10-004) which allowed the applicant to move forward with the requested use of the property. With that approval, the subject property is required to plat as a common lot and will be included as an amenity/common open space with a future plat. The time frame for the subject property to plat is two years from the Council approval date of the third addendum to the development agreement. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Prior to any construction, you should contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required. Site Specific Conditions of Approval 1. The site/landscape plan prepared by The Land Group, dated 6/10/10, labeled L1.00, is approved (stamped "approved" on 6/10/10 by the City of Meridian Planning Department) with the following change (see redlines on the approved plans): a. The applicant shall install a bicycle parking facility capable of holding a minimum of ~ bicycle as set forth in UDC 11-3C-6G and. l 1-3C-SC. b. Remove the proposed driveway from the southern perimeter landscape buffer and ~tb~oe lvitbj landscaping. Future home access shall be taken from the extension of the local streoF with al future final plat and ~ from the gated access drive. 2. The site plan prepared by Larson Architects, dated 5/OS/10, labeled SP-1, is approved (stamped "approved" on 6/10/10 by the City of Meridian Planning Department) with the following change (see redlines on the approved plans): a. The elevations prepared by Larson Architects, dated 1/13/10, labeled Sheet A-5, are approved (stamped "approved" on 06/10/10 by the City of Meridian Planning Department) with no changes. 4. The site/landscape plan and/or building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. Spurwing Greens Tennis Facility CZC and DES 5. Prior to Certificate of Occupancy, the applicant shall submit a ropy of the recor+dod crossr access/ingress-egress easement per the requirement of the DA provision approved with MDA~ 10-004 Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11- SC-3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 5. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 6. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The project is subject to all current City of Meridian ordinances and any applicable conditions of approval associated with this site (MDA-10-004). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3B. ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS: The proposed site/landscape plan is approved as submitted with the inclusion of a bike rack. Per UDC 11-3C-6G one bike space is required for every 25 parking stalls. The submitted plan depicts 12 parking stalls; therefore the applicant shall provide a bike rack capable of holding one bicycle. Further, UDC 11-3C-SC outlines the location and design standards. The parking facility shall be located as close as possible to the front entrance without impeding sidewalks. Spurwing Greens Tennis Facility CZC and DES 2 Access to the tennis facility is proposed from a gated drive to a future public street located on the west end of the facility. The proposed access drive is not intended for through traffic nor approved as a public or private street. The recorded DA requires the applicant to plat the tennis facility property within two years. At that time, a local public street will provide a means of access to the residential lot planned next (south) to the facility. Thus, the proposed driveway located along the southern boundary of the proposed access drive shall be removed and landscaped. Future home access shall be taken from a local street once the lot is created through the recordation of a final plat. Deaz Mr. Pazsons: Jayker's Subdivision /The Tree Farm was recently purchased by Spurwing Greens LLP. It is the desire of the new Owner to make several upgrades to the project over the up and coming months. The first upgrade to the project the Owner would like to construct new common azea tennis courts in the unplatted land of Spurwing Greens. The Owner is proposing to enter into an agreement with Spurwing Country Club to install tennis court that can be shazed by Spurwing Country Club Members as well as the residents of The Spurwing Greens Subdivison.(Formerly the Tree Farm). In exchange the Residents of Spurwing Greens will have access to the Spurwing Country Club swimming pool and restaurant. This arrangement will require the construction of a driveway across the existing golf course to tie both subdivisions together and to provide access to the tennis courts, the clubhouse and the swimming pool for the Residents of Spurwing Greens and the Members of Spurwing Country Club. In addition and in order to protect the golf course from unwanted access and to control the use of the private tennis courts the Owner is requesting the installation of entry gates at both ends of the driveway to the tennis courts. All members of the Country Club and Residents of Spurwing Greens will have the access to the driveway and the tennis courts through the gated entry. Please note Ada County has approved the application for the portion on the work that falls on the Spurwing Golf Course. Please see the attached letter from Ada County. We have contacted Meridian Fire Department to review the proposed driveway to the tennis courts so it will provide adequate access for emergency vehicles. Meridian Fire Department has indicated the layout is acceptable so long as the Owner is willing to meet the load requirements for the fire truck and there is an override system on the gate to allow access during and emergency. Please see the attached Memo from Joe Silva Tn an effort to explain our request we have list the items we would like to modify in the Development Agreement in order to gain approval of the tennis courts and allow the construction to proceed. We have noted each of our requests in the items: 1. Allow the tennis courts to be constructed in non platted ground. This would require modifying the condition in the Development Agreement that no building permit can be issued until the final plat is recorded. Please note the building department only requires a permit for the fence around the tennis courts. The question of modifying this section will need to be determined by City Council. Please see the attached email from the Building Department regarding the permits required for the tennis courts. 2. The City would allow for the construction of the tennis courts as additional common azea to the Estate Lots Section of Spurwing Greens 3. The tennis courts will satisfy the requirements for open space in the Phase Two Estate Lot Area of Spurwing Greens. The Owner will meet the minimum ten percent city requirement for any addition Phase of the Estate Lots. 4. Provide a temporary easement for ingress and egress on the non platted ground to access the tennis courts. The easement will be vacated once the final plat and the street improvements are completed past the tennis court access point. , 5. Complete a final plat on the tennis courts and the two lots to the west within 24 months. 6. Request the gates on the access drive to the tennis courts to protect the tennis courts from public use and restrict access to the golf course. 7. Delete the pedestrian requirement access in the north east corner of the project. Lot 18 Block 11. We have designed the driveway to the tennis courts to have an entry elements at each access point. These elements will consist of a 8 foot by 8 foot vertical element on each side of the driveway to designate the entry into a private area. The vertical element will have a metal sloped roof and a combination of stone and stucco for the walls. A planter has been integrated into the each element to bring down the scale and to create interest. Lighting at each vertical entry feature will be providing using a down light at the soffits. In addition, an automation card key controlled gate will be added to provide access to members only. We feel it is important to restrict access to the golf course to prevent unwanted vehicle damage as well as prevent pedestrian interference with daily golfing activities. The best way to provide a restricted access is through a controlled entry gate. We have also had many requests from Spurwing Home Owners to provide the gates to prevent unwanted traffic down a the existing quiet cul-de-sac. The tennis courts are proposed to be day use only with no outdoor lighting. Berms and landscaping with will used around the tennis courts to screen the courts from the adjacent residential lots and to provide some noise screening. There will a concrete viewing area along the south side. This area will also serve for event seating on days when the Club decides to have a tournament with neighboring clubs. ~ Any tennis court equipment will be stored inside one the vertical entry elements to prevent thief and keep the items out of sight. Any outdoor event seating could also be stored in the vertical entry elements. Please see the attached renderings and drawings for the proposed look of the project. In addition to the above noted items the Owner is proposing to upgrade the Spurwing Restroom Facility and make it into a Tennis Facility. This is on the Ada County side of the project and will include adding a covered patio area that can be used for outdoor events by both the tennis courts as well as the golf course. An outdoor fireplace and score board will also be added to the Tennis Facility. The building will be expanded to provide a small locker area, additional open space and a beverage counter. Hard surface paving will be added to connect the Tennis Facility to the tennis courts and the golf course. Please see the attached renderings and drawings for the proposed look of the project. Please note we have received approval from Ada. County for this expansion. As a side noted each lot in Spurwing Greens will be required to join the Spurwing Country Club as a social member. The fee for each lot that will be paid to the Spurwing Country Club for use of the swimming pool and clubhouse.
