The applicant proposes. to construct a 260 square foot restroom facility and in ground pool with associated site improvements. The site is located at 5703 N. Dehaas Avenue. DECISION The applicant's request for CZC and DES is approved with the conditions listed in this report. Note: This is not a building permit. Prior to any construction, you should contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required Site Specific Conditions of Approval 1. The site/landscape plan prepared by Breckon Land Design on 4/19/10, labeled Sheet L1.00, is approved (stamped "approved" on 4/29/10 by the City of Meridian Planning Department) with the no changes. 2. The elevations prepared by Douglas Kruse on 4/17/10, labeled Sheet A2.0, are approved (stamped "approved" on 4/29/10 by the City of Meridian Planning Department) with no changes. 3. The site\landscape plan and building elevations shall not be altered without prior written approval of the City of Meridian Planning Department. 4. A final plat modification (MFP-10-002) is currently in process to convert the buildable lot into common open space. The MFP must be approved by City Council before occupancy is released for the community pool. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. Madelynn Estates Community Pool CZC and DES 4. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 5. If any changes must be made to the site plan to accommodate ACRD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 6. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-313-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (CZC-05-044; PP -09-001; FP -09-007). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. 6. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS: Currently Lot 1, Block 8 is a buildable lot within the Madelynn Estates Subdivision. A final plat modification application is currently in process and is scheduled to be heard on the May 25, 2010 City Council meeting. The purpose of the meeting is to receive City Council approval to convert Lot 1, Block 8 from a buildable lot to common open space. Staff has conditioned occupancy for the community pool area upon approval from City Council. The subject lot is at 5703 N. Dehaas Avenue and is legally described as Lot 1, Block 8. An application for a final plat modification to address plat note changes is also being concurrently submitted for City Council approval. As discussed, the Meridian Code will allow changes to platted subdivisions when building lots are being reduced in number and amenities are being increased. The requested change requires a Certificate of Zoning Compliance and Design Review. A site/landscape plan is included in our application package, along with elevations for the rest room/pool house building. We have also included an example plan and cross section of the pool. The R-4 zoning of the property and the location have determined Design Review using the Suburban Design Guidelines. The 12 page Design Guidelines Checklist is attached. Please note the following design characteristics: The rest room/pool house will be constructed of the same materials as the subdivision homes. The siding and fascia will be constructed of concrete composite material (Nardi Plank) and wood. As noted on the elevations, the cultured stone wainscot will wrap around the building on the exposed sides. The roof will be 30 -year architectural composite shingles. The entry into the pool house/rest rooms will be through a covered overhang. The columns supporting the entry add architectural interest and fenestration. The mechanical equipment for the pool will be located beside the pool house structure and screened by a low fence and landscaping. The building colors will match those in the subdivision, typically natural beige, taupe and brown. The pool is located in the center of the lot and the pool house structure is located in the back of the lot adjacent to the common open space, and away from the residences. Parking, if needed, is located adjacent to the open space lot to the south. The site/landscape plan indicates lawn areas for lounging by the pool. The site landscaping will provide some privacy and screening; however, landscaping is designed to be open adjacent to the street and common area to provide visual safety, since the pool will likely be used by younger residents and children. A small covered table and chairs will be located next to the pool for rest and relaxation. The community pool and pool house will be a convenient recreation facility and will _provide a valuable amenity to the Madelynn Estates neighborhood.
