Location, size of property and e~sting zoning: The subject property consists of 1.15 acres and is zoned C-G. It's
located on the NWC of E. Fairview Avenue and N. Lakes Place.
Adjacent Land Use and Zoning: This site is surrounded by commercially developed property, zoned C-G.
Application Summary:
• CUP approval for a drive through establishment within 300' of another drive through establishment in a C-G
district.
• Design Review approval is also requested for the proposed structure and site
• Alternative Compliance to UDC 11-3A-19, which allows a maximum of one drive aisle with associated parking to
be located between the fagade of a structure and adjacent street.
Outstanding Issue(s) for Commission:
Staff spoke with the applicant prior to the hearing and he would like to discuss the following items:
• Condition of approval #l.l.a, requires the existing sidewalk along Fairview to be widened to 10' or a new 10'
wide multi-use pathway constructed within the street buffer in accord with the Pathways Plan & UDC 11-3A-8.
The Master Pathways Plan depicts a segment of the City's multi-use pathway system along the Fairview frontage
of this property. When the subdivision improvements for this development were originally approved & installed,
the Master Pathways Plan had not yet been adopted. Because new development is proposed, the current
provisions in UDC 11-3A-8, Pathways, apply to development of this property.
• Condition of approval #1.1.b, requires a total of 4 trees to be added at the south ends of rows of parking in accord
with UDC 11-3B-8Cd.
Code requires each interior planter that serves a single row of parking spaces to be landscaped with at least 1
tree & vegetative groundcover. The applicant may apply for Alternative Compliance to this requirement and
demonstrate how the alternative means for compliance meets the requirements' intended purpose.

One or the required street buffer trees along Fairview has been cut down; Staff recommends the
Commission add a condition of approval that it be replaced with development of this property.
The existing pathway along Fairview stops about 25' short of the west property boundary. Staff
recommends the Commission add a condition of approval that states, "The applicant shall eztend the
detached pathway along Fairview Avenue to the west property boundary in a location approved by the
Parks Director."

Staff Recommendation: Staff recommends approval of the subject applications per the conditions listed in Exhibit B of
the staff report and the aforementioned recommended additional conditions of approval.
