Broadway Avenue Meridian, Idaho 83642 Re: Jayker's Subdivision Preliminary Plat Extension and Development Agreement Modification/ TE-09-022 Jayker Subdivision. Dear Mr. Pazsons: Jayker's Subdivision /The Tree Farm was recently purchased by Spurwing Greens LLP. It is the desire of the new Owner to make several upgrades to the project over the up and coming months. The first upgrade to the project the Owner would like to construct new common area tennis courts in the unplatted land of Spurwing Greens. The Owner is proposing to enter into an agreement with Spurwing Country Club to install tennis court that can be shared by Spurwing Country Club Members as well as the residents of The Spurwing Greens Subdivison.(Formerly the Tree Farm). In exchange the Residents of Spurwing Greens will have access to the Spurwing Country Club swimming pool and restaurant. This arrangement will require the construction of a driveway across the existing golf course to tie both subdivisions together and to provide access to the tennis courts, the clubhouse and the swimming pool for the Residents of Spurwing Greens and the Members of Spurwing Country Club. In addition and in order to protect the golf course from unwanted access and to control the use of the private tennis courts the Owner is requesting the installation of entry gates at both ends of the driveway to the tennis courts. All members of the Country Club and Residents of Spurwing Greens will have the access to the driveway and the tennis courts through the gated entry. Please note Ada County has approved the application for the portion on the work that falls on the Spurwing Golf Course. Please see the attached letter from Ada County. We have contacted Meridian Fire Department to review the proposed driveway to the tennis courts so it will provide adequate access for emergency vehicles. Meridian Fire Department has indicated the layout is acceptable so long as the Owner is willing to meet the load requirements for the fire truck and there is an override system on the gate to allow access during and emergency. Please see the attached Memo from Joe Silva In an effort to explain our request we have list the items we would like to modify in the Development Agreement in order to gain approval of the tennis courts and allow the construction to proceed. We have noted each of our requests in the items: Allow the tennis courts to be constructed in non platted ground. This would require modifying the condition in the Development Agreement that no building permit can be issued until the final plat is recorded. Please note the building department only requires a permit for the fence around the tennis courts. The question of modifying this section will need to be determined by City Council. Please see the attached email from the Building Department regarding the permits required for the tennis courts. 2. The City would allow for the construction of the tennis courts as additional common area to the Estate Lots Section of Spurwing Greens The tennis courts will satisfy the requirements for open space in the Phase Two Estate Lot Area of Spurwing Greens. The Owner will meet the minimum ten percent city requirement for any addition Phase of the Estate Lots. 4. Provide a temporary easement for ingress and egress on the non platted ground to access the tennis courts. The easement will be vacated once the final plat and the street improvements are completed past the tennis court access point. Complete a final plat on the tennis courts and the two lots to the west within 24 months. 6. Request the gates on the access drive to the tennis courts to protect the tennis courts from public use and restrict access to the golf course. 7. Delete the pedestrian requirement access in the north east corner of the project. Lot 18 Block 11. We have designed the driveway to the tennis courts to have an entry elements at each access point. These elements will consist of a 8 foot by 8 foot vertical element on each side of the driveway to designate the entry into a private area. The vertical element will have a metal sloped roof and a combination of stone and stucco for the walls. A planter has been integrated into the each element to bring down the scale and to create interest. Lighting at each vertical entry feature will be providing using a down light at the soffits. In addition, an automation card key controlled gate will be added to provide access to members only. We feel it is important to restrict access to the golf course to prevent unwanted vehicle damage as well as prevent pedestrian interference with daily golfing activities. The best way to provide a restricted access is through a controlled entry gate. We have also had many requests from Spurwing Home Owners to provide the gates to prevent unwanted traffic down a the existing quiet cul-de-sac. The tennis courts are proposed to be day use only with no outdoor lighting. Berms and landscaping with will used around the tennis courts to screen the courts from the adjacent residential lots and to provide some noise screening. There will a concrete viewing area along the south side. This area will also serve for event seating on days when the Club decides to have a tournament with neighboring clubs. Any tennis court equipment will be stored inside one the vertical entry elements to prevent thief and keep the items out of sight. Any outdoor event seating could also be stored in the vertical entry elements. Please see the attached renderings and drawings for the proposed look of the project. In addition to the above noted items the Owner is proposing to upgrade the Spurwing Restroom Facility and make it into a Tennis Facility. This is on the Ada County side of the project and will include adding a covered patio area that can be used for outdoor events by both the tennis courts as well as the golf course. An outdoor fireplace and score board will also be added to the Tennis Facility. The building will be expanded to provide a small locker area, additional open space and a beverage counter. Hard surface paving will be added to connect the Tennis Facility to the tennis courts and the golf course. Please see the attached renderings and drawings for the proposed look of the project. Please note we have received approval from Ada County for this expansion. As a side noted each lot in Spurwing Greens will be required to join the Spurwing Country Club as a social member. The fee for each lot that will be paid to the Spurwing Country Club for use of the swinuning pool and clubhouse. The Owner hopes the City Council will help in moving the project forward by approving the above noted requests. The Owner feels the upgrades noted above will benefit the City, Spurwing County Club, Spurwing Greens Home Owner's Association and future lot purchasers. Spurwing Greens, LLC, Owner/Developer This Third Addendum to the Development Agreement ("Addendum") is made and entered into this day of _ , 2010, by and between CITY OF MERIDIAN, a municipal corporation of the State of Idaho, hereafter called "CITY', and Spurwing Greens, LLC, whose address is 3405 E. Overland Road ,Meridian, Idaho, 83642, hereinafter called "OWNER/DEVELOPER". RECITALS A. CITY and OWNERIDEVELOPER entered into that certain Development Agreement that was approved August 23, 2006 and recorded September 21, 2006 (Instrument # 10651218) and the First Addendum to Development Agreement that was approved on February 1, 2007 and recorded on February 22, 2007 (Instrument # 10702555), and the Second Addendum to Development Agreement dated September 19, 2007 (Instrument # 107141993)(collectively "Development Agreement"). B. CITY and OWNERlDEVELOPER now desire to amend the Development Agreement in accordance with the terms of this Third Addendum, which terms have been approved by the Meridian Planning and Zoning Commission and the Meridian City Council in accordance with Idaho Code Section 67-6511. NOW THEREFORE, in consideration of the covenants and conditions set forth herein, the parties agree as follows: 1. OWNER/DEVELOPER shall be bound by the terms of the Development Agreement, except with regard to Section 5, "CONDITIONS GOVERNING DEVELOPMENT OF SUBJECT PROPERTY" of the Development Agreement, which is hereby amended as follows: a. That Section 5.2 is hereby amended by deleting the first sentence and replacing it with: "Developer will develop the Property generally in accordance with the plans attached as Exhibit C, Exhibit C-1 and Exhibit C-2 (collectively "Concept Plan"), unless otherwise modified by this Agreement." New Exhibit C-1 and Exhibit C-2 attached hereto are hereby incorporated THIRD ADDENDUM TO DEVELOPMENT AGREEMENT (MI 07-004 TREEFARM ANNEXATION) PAGE 1 OF 7 into this Addendum and the Development Agreement. b. Section 5.5 is hereby deleted and replaced with the following: Section 5.5: "5.5 Intentionally Omitted." c. Anew Section 5.12 shall be added as follows: "5.12 Developer is hereby permitted to construct the tennis courts and related improvements within the tennis court area, in the locations shown on the Concept Plan (Exhibits C-1 and C-2), and all improvements necessary for vehicular ingress and egress to the tennis court area in the locations shown on the Concept Plan. If and when constructed, the tennis court area will be utilized as common area for the Property, and will be considered open space. Developer may install vehiculaz gates at the entrance of the tennis court area to ensure use only by permitted persons. Subject to the approval of all necessary property owners, Developer shall record a final plat of the tennis court area within two (2) years from the date of this Addendum. " 2. OWNER/DEVELOPER shall be bound by the terms of the Development Agreement, except with regard to Section 6, "COMPLIANCE PERIOD/CONSENT TO REZONE" of the Development Agreement, which is hereby amended by adding the following underlined text to the Section: "within two (2) years after the effective date of the last addendum to this Agreement". 3. This Addendum shall be binding upon and inure to the benefit of the parties' respective heirs, successors, assigns and personal representatives, including CITY's corporate authorities and their successors in office. This Addendum shall be binding on the OWNER/DEVELOPER of the Property, each subsequent owner and any other person(s) acquiring an interest in the Property. Nothing herein shall in any way prevent the sale or alienation of the Property, or portions thereof, except that any sale or alienation shall be subject to the provisions herein and any successor owner or owners shall be both benefited and bound by the conditions and restrictions herein expressed. CITY agrees, upon written request of OWNER/DEVELOPER, to execute appropriate and recordable evidence of termination of this Addendum if CITY, in its sole and reasonable discretion, determines that OWNER/DEVELOPER has fully performed its obligations under this Addendum. If any provision of this Addendum is held not valid by a court of competent jurisdiction, such provision shall be deemed to be excised from this Addendum and the invalidity thereof shall not affect any of the other provisions contained herein. In the event of any conflict between this Addendum and the Development Agreement, the terms and conditions of this Addendum shall control. 5. This Addendum sets forth all promises, inducements, agreements, conditions, and understandings between OWNER/DEVELOPER and CITY relative to the subject matter herein, and there are no promises, agreements, conditions orunder-standings, either oral or written, express or implied, between OWNER/ DEVELOPER and CITY, other than as are stated herein. Except as herein otherwise provided, no subsequent alteration, amendment, change or addition to this Addendum shall be binding upon the parties hereto unless reduced to writing and signed by them or their successors in interest or their assigns, and pursuant, with respect to CITY, to a duly adopted ordinance or resolution of CITY. Except as herein provided, no condition governing the uses and/or conditions governing development of the subject Property herein provided for can be modified or amended without the approval of the CITY in accordance Idaho Code Section 67-65 I 1 A. 6. This Addendum shall be effective as of the date herein above written. The application was originally submitted as a modification to file #93-18 CU; However, based upon fuxther review, the correct application to request for modification is 95-02 TD. This application approved the country club, swimming pool and tennis areas. The staff report• and finding of fact documents have been updated to show this change. Based on staff's review of the Ada County Code, this application has been given tentative approval, subject to the Conditions of Approval attached to the Findings of Fact, Conclusions of Law and Order listed as Exhibit "A". Please note, this approval shall become null and void if the Conditions of Approval have not been met, and if you have not obtained a valid Zoning Certificate within 1 year of the date of this approval letter. This. determination was made based upon current information contained in the public record and interpretation of the Ada County Zoning Ordinance. You may appeal this decision to the Board of Ada County Commissioners. To do so, you must file the appeal within fifteen days of the date of this letter. The fee for filing an appeal is $350. Pursuant to Idaho Code § 67-6535, this letter is to further inform you that to the extent a final decision has been made on asite-specific land use request, an applicant has the right to request a regulatory Takings analysis under Idaho Code § 67-8003. A. The Director finds that the record is comprised of: 1. Exhibit A to the Findings of Fact, Conclusions of Law and Order. 2. All other information contained in Ada County Development Services File for Project No. 95-02 TD-M. B. As to procedural items, the Director finds the following: 1. On February 4, 2010, Development Services accepted Project #95-02 TD-M. C. As to the project description, the Director finds based on the application materials found in the file for Project No. 95-02 TD-M the following: 1. PROPOSED USES: Expand the country club to include tennis courts and a tennis center on the western edge of the subdivision. Only a small portion of the tennis courts will be within the Spurwing Golf Course and subdivision. The majority of the tennis courts will be within the boundaries of the Jayker Subdivision (aka Spurwing Greens) to the west, which is within the Meridian City limits. 2. PROPOSED STRUCTURES: Remodel and expand an existing 645 square foot restroom facility to a tennis center and add approximately 677 square feet of outdoor patio space. 3. PROPOSED SITE IMPROVEMENTS: Construct a 24-foot emergency access drive from West Balata Court to North Sunset Maple Way. At each end of the emergency access road there will be monument buildings, landscaping walls and gates to define it is a private drive for club members. Based on the materials found in the file for Project No. 95-02 TD-M, the Director finds the following concerning the project description: 1. PARCEL NUMBER AND LOCATION: 88081770010 and 8808177022; 3904 6800 North Spurwing Way 2. OWNERSHIP: Spurwing Ltd. Partnership and Pacific Links Company 3. SITE CHARACTERISTICS Propexty size: 27.6 acres Existing structures: 645 square foot restroom facility Existing vegetation: Golf course and landscaping Slope: The site is relatively flat with no areas of steep slopes but it is graded for greens and tee boxes. Irrigation: Settler's Irrigation District Drainage: The property is not within a drainage district Views: The property has sweeping views overlooking the foothills. Other Opportunities and/or Constraints: None E. Based on the officially adopted Ada County land use maps, the Director finds the following concerning the current land use and zoning: The property is zoned RUT and the land use is a Golf Course and Country Club. F. Based on the officially adopted City of Meridian land use maps, the Director finds the following concerning the surrounding land use and zoning: North: Low-Density Residential; Golf Course and Single-Family Residential South: Low-Density Residential; Golf Course and Single-Family Residential East: Low-Density Residential; Golf Course and Single-Family Residential West: Medium Density Residential; Single-Family Residential G. Based on the officially adopted Ada County land use maps and materials found in the file for Project No. 95-02 TD-M, the Director finds the following concerning services: Access Street and Designation: West Balata Court, a local street Fire Protection: Meridian Fire District Sewage Disposal: Septic System Water Service: United Water FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER 95-02 TD-M, Spurwing Greens Page 2 Irrigation District: Settlers Irrigation District Drainage District: None H. The Director finds the site plan was approved in file 95-02 TD. With respect to Section 8-4E-3 of the Ada County Code the proposed alteration to the Master Site Plan complies with the following requirements: F. The Director may approve specified minor modifications to an approved master site plan, provided such minor modifications were not subject to review or appealed during the original approval or at public hearing and will not adversely impact adjacent properties. Such minor modifications include, but are not limited to, the following: 2. Increase in building square footage, not exceeding twenty percent (20%) provided that the minimurn dimensional standard, off street parking and loading, landscaping and screening, sign and/or lighting requirements of this title are met. The Director finds thaf the original application, 95-02 TD approved 21,169 square feet of building. space for a country club, swimming pool and tennis courts. The Director finds . that the tennis courts have not been built to date and that the applicant is now proposing to move the location to the west. The Director finds that the majority of the tennis courts will be within the Spurwing Greens Subdivision, which is within the Meridian City Limits. The Director finds that approximately 350 square feet of the tennis courts will be within the Spurwing Subdivision and Ada County jurisdiction. The Director finds that the tennis courts are not subject to the setback requirements because it is a concrete pad and no structures are proposed within the tennis courts. The Director finds that the applicant is proposing to remodel and expand an existing 645 square foot restroom facility into the tennis center building. The Director finds that the total square footage of the restroom facility will be approximately 1,322 square feet. This includes the existing 645 square feet and the approximate 677 square foot expansion. The Director finds that the site plan dated January 13, 2010 shows the expanded patio structure to be 37 feet from the western property line. This is the nearest property line to the structure. The Director finds that the applicant is proposing 12 parking stalls, including one (1) handicap accessible parking space. All of the parking stalls are adjacent to the tennis courts and are within the Meridian City Limits. If the parking were within Ada County jurisdiction, the total required parking would be 11 parking stalls. The Director finds that off-street parking is within Meridian City Limits. The Director finds that the applicant is proposing monumentation on both sides of the access road that extends from West BaIata Court. The Director finds that the applicant is proposing approximately fwo (2) 112 square foot monument structures for a total of 224 square feet within the Spurwing Subdivision and Ada County jurisdiction. The Director finds that Ada County Code allows landscaping and structures under 200 square feet within the setback. FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER 95-02 TD-M, Spurwing Greens Page 3 The Director finds that the total square footage of proposed expansion is 1,896 square feet. The Director finds that 20 % of 21,169 square feet is 4,234 square feet. The Director finds fhnt proposed expansion does not exceed 20 % of the building space approved in file #95-02 TD and that the proposed structures meet the minimum setbacks of 25 feet for the RLIT District, where applicable. The Director finds that the Spurwing Final Plat recorded in 1995 shows an emergency access road from West Balata Drive to the west and to the norfh. The Director finds that the proposed access road that will connect with North Sunset Maple Way can be used as the emergency access road. The Director finds that fhe Meridian Rural Fire Protection District approves the access road as proposed for emergency access for the Spurwing and Spurwing Greens Subdivision as demonstrated in their letter dated January 14, 2010. CONCLUSIONS OF LAW If any of these Conclusions of Law are deemed to be Findings of Fact they are incorporated into the Finndings of Fact section. 1. The Director concludes that Project No. 95-02 TD-M complies with Section 8-4E-3 of the Ada County Code. ORDER Based upon the Findings of Fact and Conclusions of Law contained herein, the Director approves Project #95-02 TD-M, subject to the Conditions of Approval attached as Exhibit A and the Site Plan Drawing date stamped January 13, 2010. The applicant shall obtain the applicable building permits for the tennis center building and the monument structures. Contact the Building Official at 287-7900 for information regarding building permits. Zoning certificates will be issued at the time of building permit issuance. Terms of Approval 2. A zoning certificate and/or a building permit may not be issued until 15 days after the Director issued the written decision on the proposed development. In the event the decision of the Director is appealed, the building permit may not be issued until the appeal is resolved in favor of the proposed development. See Section 8-7-7 of the Ada County Code for more information on appeals. 3. Signs that require a separate zoning application and fee and shall comply with Article 8-4I of the Ada County Code. Further, signs require a separate building permit and fee. 4:. The property must be managed and maintained consistent with the standard regulations in Title 8, Chapter 4, Article A of the Ada County Code.
