Southridge Phase 1 CZCCERTIFICATE OF ZONING COMPLIANCE REPORT DATE: April 7, 2010 TO: Jim Jewett FROM: Sonya Watters, Associate City Planner SUBJECT: Southridge Phase 1 — CZC-10-020/DES-10-014 OWNER: Linder 109, LLC DESCRIPTION OF APPLICANT'S REQUEST E IDIAN-- l�Al•1C The applicant, Jim Jewett, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval for the site and utility improvements for five future buildings to be constructed with the first phase of development in Southridge Subdivision. Future buildings on the site will be reviewed under subsequent CZC & DES application(s). The site is located on the southwest comer of W. Overland Road and S. Linder Road. DECISION The applicant's request for CZC & DES is approved with the conditions listed in this report. Note: This is not a building permit. Prior to any construction, you should contact Building Services at (208)887-2211 to verify if any additional permits and/or inspections will be required Site Specific Conditions of Approval 1. The site plan prepared by The Land Group on 10/23/09, labeled Sheet C2.01, is approved (stamped "approved" on 4/7/10 by the City of Meridian Planning Department) with the following change: a. Widen the pathway along Linder Road to 10 feet in accord with the Meridian Pathways Master Plan. 2. The landscape plan prepared by The Land Group on 10/23/09 labeled Sheet L1.01, is approved (stamped "approved" on 4/7/10 by the City of Meridian Planning Department) with the following change: a. Widen the pathway along Linder Road to 10 feet in accord with the Meridian Pathways Master Plan. 3. Prior to issuance of any future Certificate of Occupancy, the applicant shall close any and all existing access points to the arterial and/or collector roadway as set forth in UDC 11 -3A -3A. 4. The subject property shall be subdivided in accordance with the UDC prior to issuance of any building permit, per provision of the development agreement. 5. Public street frontage as shown on the revised master concept plan, or a cross-access/ingress- egress easement, shall be provided to Parcel #S1223110500, which is located on Linder Road, prior to issuance of any future Certificate of Occupancy. If an easement is granted, a copy of said easement shall be submitted to the Planning Department in accord with the provisions of UDC 11 -3A -3A2. Conditions Document 1 Southridge Phase 1 CZC 6. A 10 -foot wide multi -use pathway is required along the west side of Linder Road on this site in accord with the City's Master Pathways Plan. This pathway may be installed in lieu of the 5 -foot sidewalk shown on the site plan. 7. The applicant shall incorporate and build at least one transit stop, including benches and covers, per requirement of the development agreement, prior to occupancy of any structure within the boundaries of the phase 1 final plat, per requirement of the final plat. The applicant shall work with Valley Regional Transit staff to determine the exact location for the transit stop, prior to submittal of a Certificate of Zoning Compliance for the first building permit on this site. 8. Construct a solid 6 -foot tall masonry fence adjacent to the lots in Val Vista Subdivision and Aspen Cove Subdivision, prior to issuance of building permits within the boundaries of the phase 1 final plat, per requirement of the Development Agreement and final plat. Process Conditions of Approval 1. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 2. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other improvements in accord with UDC 11 -5C -3C. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11 -3B -14A. 4. Neither the site plan nor the landscape plan is to be altered without prior written approval of the City of Meridian Planning Department. 5. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 6. If any changes must be made to the site plan to accommodate ACHD requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 7. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. The applicant shall be responsible for all plat improvements prior to release of Certificate of Occupancy for the first structure within such plat. 9. Prior to Certificate of Occupancy of any future buildings on this site, the applicant shall record a public access easement for the multi -use pathway along Linder Road and submit copy of said easement to the Planning Department. 10. At such time that the multi -use pathway along Linder Road connects from one major street to another and is greater than one-half mile long, the applicant may petition the City to assume maintenance responsibilities. Conditions Document 2 Southridge Phase 1 CZC Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-313-5, UDC 11-313-13 and UDC 11-313-14. 2. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (AZ -06-031; PP -06-031; FP -08-017; MFP-09-004; MDA -08- 004). 3. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 4. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a minimum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 5. The applicant shall have an ongoing obligation to maintain all pathways. 6. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A- 11. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11- 3A-3. ANALYSIS OF UDC REQUIREMENTS RELATED TO SITE SPECIFIC CONDITIONS: Since the Southridge development was annexed, the City adopted the Meridian Pathways Master Plan, which provides a comprehensive network of pathways that provides numerous recreation opportunities while connecting to neighborhoods, schools, parks, community centers, and business districts. The plan depicts a segment of the Eagle Island pathway along the east boundary of this site adjacent to Linder Road. A 10 -foot wide multi -use pathway is required along the west side of Linder Road on this site in accord with the City's Master Pathways Plan. SITE PLAN -Description: .The Phase 1 Site Plan incorporates the development of the parking area along with utility extensions to the building pad locations and stormwater drainage for the development (excluding landscape at the future buildings). The future buildings will be serviced by city services as they are currently stubbed to this development. Site Plan and Building Layout: Locations for the future buildings are shown and dimensioned on the plans. The locations of these building pads have been street oriented and the parking provided accounts for the two story construction required by the TN -C zone. The buildings are also clustered enhancing the pedestrian feel for the development. Parking areas have been situated internally to the site and have been separated into smaller areas by landscape planters. The parking lot design also incorporates some berms within the large planter areas, to create a smaller confined area distribution for parking and internal screening to enhance the pedestrian nature of the development. Access to the site is provided by three access drives as approved by ACHD for the street construction of S. Spanish Sun Way. The western most access is aligned with the termination of S. Spanish Fork Way. The other two access points are aligned with the future entrances to the future Library Site across the street. Pedestrian access is provided by the detached sidewalk system at the perimeter of the site. The street layout is as approved by ACHD for construction of the street network for the overall master planned development and includes all provisions of the development agreement in place for this development. These corridors enhance the pedestrian experience while also separating pedestrian traffic from vehicular traffic at the site. The small size of this development provides for straightforward pedestrian accessibility to the building clusters through the use of this perimeter corridor. For pedestrian mobility internal to the site; the parking areas have been modulated into small areas in close proximity to the building clusters and individual buildings. The internal screening. and close proximity limit the exposure of pedestrians to vehicular traffic, therefore enhancing their experience. Additionally, at each side of the western most entrance, area is available for transit shelters in the event they would be desirable in the future. This project will provide a desirable destination for residents in the area, and substantially complies with the intent of the City of Meridian Design Manual and is in compliance with Zoning and the 10 Mile Plan and we look forward to completing this project.
