Continental Dr. Meridian, Idaho 83642 AGENT: J.J. Howard 2626 N. 32nd St. Boise, Idaho 83703 SUMMARY This is a request for an expedited, 21ot subdivision on 2.77 acres. The site is located within the Locust View Heights Subdivision and is a replat of lots 23 and 24 and two remnant, unplatted parcels directly to the south of lots 23 & 24. The property is located east of Locust Grove and north of I-84 in the southwest quarter of Section 17, Township 3 North, Range 1 East. The application is comprised of: 1. ~ Application forms prepared and submitted by the applicant's representative. 2. Preliminary plat of Hummingbird Subdivision. 3. All other information contained in file 96-05-PDR. PROCEDURAL ITEMS 1. Application # 96-05-PDR was accepted by Ada County Development Services Department on February 20, 1996 and was scheduled for expedited approval. 2. Appropriate public agencies were notified of this request and solicited for their comments February 29, 1996. 3. Announcements of the application were mailed to the owners of all property located within 300' of the subject property on February 29, 1996. 96-OS-PDR Hummingbird Subdivision 1 • APPLICABLE LAW 2 U The site lies within the Meridian Area of Impact and Urban Service Planning Area. Section 5.40 of the Ada County Comprehensive Plan and Section 9-4-3-A of the Ada County Code adopt the Meridian Comprehensive Plan as the applicable comprehensive plan for this azea. Section 8-5-1 of the Ada County Code lists the purpose statements for the residential zones in Ada County. For the Rl (Estate Residential Zone) the following is listed: The purpose of this Zone is to provide for larger lot residential development with densities which allow sufficient open space to permit extensive gardening, outdoor recreation and the keeping of limited numbers of animals on anon-commercial basis for the occupants' personal use and enjoyment.. This Zone is appropriate for use in Urban Service Planning Areas where physical limitations of the environment such as problems with soils, topography, hydrology and flooding make large lot development more appropriate. An individual wastewater treatment system and an individual water system may be permitted; however, community water systems and municipal wastewater collection and treatment are preferred. 4. Section 8-5-7-1 of the Ada County Code specifies the design, dimensional, and density standazds for the residential zones. Planned developments which qualify for use of abbreviated process: A planned development may be processed according to the procedures set forth in subsection B below, if it meets the following criteria: 1. It complies with the permitted uses and dimensional standards of the base zone; and 2. It complies with the goals and policies of the applicable comprehensive plan; and 3. It does not require a waiver, modification, or variance of any of the base zone or of Chapter 10 (Subdivision Regulations); and 4. The planned development is to be located within the urban service planning azea of an adopted Area of Ciry Impact. 96-OS-PDR Hummingbird Subdivision 2 • . B. Procedures: A developer seeking approval of a planned development which meets the requirements of subsection A above shall submit an application for preliminary plat approval as required by Chapter 10 of this Title, which shall constitute an application for planned development approval. An applicant shall be entitled to a planned development approval if he qualifies for this abbreviated process, and receives an approval for a final plat in accordance with the procedures of Chapter 10 of this Title. 5. Subdivisions may be permitted in the Rl zone only through the planned development procedure established in Chapter 9 of Title 8 (§ 8=5-2, Ada County Code). 6. Chapter 10 of Title 8, Ada County Code,. aze the. Subdivision Regulations which "apply to the subdivision of land within the unincorporated territory of Ada County" (§ 8-10-2B, Ada County Code). Section 8-10-1A of the Ada County Code (Design Standazds) states: These standards shall be followed in all subdivisions regulated by this Title. In addition to these standards, all subdivisions shall meet the design standards and findings of fact listed in C~iapter 9 relating to planned developments and shall be in accordance with the Comprehensive Plan. 7. Section 8-9-3C5 specifies the findings which shall be made by the Commission and the Boazd when considering applications for planned developments. This Section states: Findings of Fact: The Commission, before recommending action on a preliminary development plan, and the Board before taking action on said plan, shall first make findings of fact and conclusions of law which shall be supported by evidence in the hearing record to determine whether: a. The site design conforms to the topography and natural landscape features and shows consideration for the location and function of land uses and structures to achieve this purpose; b. The development is compatible with existing and planned permitted uses and would not cause damage, hazazd or nuisance to persons or property in the vicinity; c. The internal street system is designed for the efficient and safe flow of vehicles and pedestrians without having a disruptive influence upon the activities and functions contained within the development nor place an undue burden upon the existing transportation and other public services in the surrounding area; d. Community facilities, such as pazk, recreational and open space areas aze functionally related to all dwelling units and are easily accessible via pedestrian and/or bicycle pathways. Any common usable open space which may be provide (See Section 8-5-7- 1 C) shall be directly accessible to the lots which have been reduced in size from the minimum lot size, and to multi-family development(s) within the PD; 96-OS-PDR Hummingbird Subdivision • • - e. The proposal complies with the lot size and density standards set forth in Section 8-5-7- 1 f. The overall plan is in conformance with the applicable Comprehensive Plan(s), Future Acquisition Maps, Area of City Impact ordinances and other pertinent ordinances; g. The proposed design appears to conform to the topography and natural landscape features and shows consideration for the location and function of existing land uses. 96-OS-PDR Hummingbird Subdivision 4 • b. All of the area surrounding the proposal is zoned Rl and is currently developed with single family dwellings. This proposal is compatible with the existing and allowed uses in the Rl zone. c. Locust Grove Road and Continental Drive are classified as local streets by the Year 2000 Urban Functional Street Classification System and will provide access to the proposed development. d. No community facilities are proposed with this development. e. This development proposes two lots on 2.77 acres. STAFF ANALYSIS and CONCLUSIONS This is a request for an expedited, planned residential development which consists of 2 single family lots on 2.77 acres of land. The subject site is located south 2065 East Continental Drive in the Locust View Heights Subdivision. This application is a replat of lots 23 and 24 with the inclusion of two unplatted, remnant parcels lying to the south of the subject lots. The site has a Rl (Estate Residential) zoning designation which requires a minimum lot size of one acre. Each of the proposed lots meets or exceeds the design and dimensional standards for the Rl zone. The overall density of the development is .72 units per acre. The proposal complies with the density and lot size requirements established for the Rl zone. By platting this ground the applicant will be able to incorporate the two remnant parcels into the platted lots which result in one additional buildable lot. . The site lies within the Meridian Area of Impact. This Zone is appropriate for use in Urban Service Planning Areas where physical limitations of the environment such as problems with soils, topography, hydrology and flooding make large lot development more appropriate. An individual wastewater treatment system and an individual water system may be permitted; however, community water systems and municipal wastewater collection and treatment are preferred Section 8-5-7-1 of the Ada County Code specifies the design, dimensional, and density standards for the residential zones. It does not require a waiver, modification, a variance of any of the base zone or of Chapter 10 (Subdivision Regulations); and 4. The planned development is to be located within the urban service planning area of an adopted Area. of City Impact. B. Procedures: A developer seeking approval of a planned development which meets the requirements of subsection A above shall submit an application for preliminary plat approval as required by Chapter 10 of this Title, which shall constitute an application for planned development approval. An applicant shall be entitled to a planned development approval if he qualifies for this abbreviated process, and receives an approval for a final plat in accordance with the procedures of Chapter 10 of this Title. 96-OS-PDR Hummuigbird Subdivision • • 5. Subdivisions may be permitted in the Rl zone only through the planned development procedure established in Chapter 9 of Title 8 (§ 8-5-2, Ada County Code). 6. Chapter 10 of Title 8, Ada County Code, aze the Subdivision Regulations which "apply to the subdivision of land within the unincorporated territory of Ada County" (§ 8-10-2B, Ada County Code). Section 8-10-1A of the Ada County Code (Design Standazds) states: These standards shall be followed in all subdivisions regulated by this 7"rtle. In addition to these standards, all subdivisions shall meet the design standards and findings of fact listed in Chapter 9 relating to planned developments and shall be in accordance with the Comprehensive Plan. 7. Section 8-9-3C5 specifies the findings which shall be made by the Commission and the Boazd when considering applications for planned developments. This Section states: Findings of Fact: The Commission, before recommending action on a preliminary development plan, and the Boazd before taking action on said plan, shall first make findings of fact and conclusions of law which shall be supported by evidence in the heazing record to determine whether: a. The site design conforms to the topography and natural landscape features and shows consideration for the location and function of land uses and structures to achieve this purpose; b. The development is compatible with existing and planned permitted uses and would not cause damage, hazard or nuisance to persons or property in the vicinity; c. -The internal street system is designed for the efficient and safe flow of vehicles and pedestrians without having a disruptive influence upon the activities and functions contained within the development nor place an undue burden upon the existing transportation and other public services in the surrounding azea; d. Community facilities, such as pazk, recreational and open space areas aze functionally related to all dwelling units and are easily accessible via pedestrian and/or bicycle pathways. Any common usable open space which may be provide (See Section 8-5-7- 1 C) shall be directly accessible to the lots which have been reduced in size from the minimum lot size, and to multi-family development(s) within the PD; e. The proposal complies with the lot size and density standazds set forth in Section 8-5-7- 1. f. The overall plan is in conformance with the applicable Comprehensive Plan(s), Future Acquisition Maps, Area of City Impact ordinances and other pertinent ordinances; g. For any change of zone, the Commission and Boazd shall also make the findings outlined in Section 8-18-9B. 96-OS-PDR Hummingbird Subdivision • • FINDINGS OF FACT If any of these findings of fact are deemed to be conclusions of law, they are incorporated into the Conclusions of Law Section. 1. The site is 2.77 acres, is zoned Rl (Estate Residential) Zone and owned by Gary Bird. 2. The site is located on lots 23 and 24 of Locust View Heights in the southwest quarter of section 17, Township 3 North ,Range 1 East. 3. Land uses surrounding the site consist primarily. of low density residential development with lots of one acre or greater. 4. The site lies within the Boise Area of City Impact. Section 9-3-3A of the Ada County Code and section 5.30 of the Ada County Comprehensive Plan adopt the Policy Plan for the Boise Metropolitan Area as the applicable comprehensive plan for the area. 5. This development meets the design and dimensional standazds for the Rl (Estate Residential) Zone. 6. All streets in the vicinity of the. site aze classified as local streets by the Year-2000 Functional Street Classification System-Urban Area. 7. Fire protection is currently provided by the Meridian Fire Department. 8. With regard to the Findings of Fact of Section 8-9-3C5 of the Ada County Code, the Director finds that: a. The site is relatively level and lacks any distinguishing physical characteristics. The design proposed adequately conforms with the nature landscape features of the site. b. The proposed use is compatible with the chazacter of the existing land uses within the immediate azea, which is composed low density residential development on one acre or larger lots. c. All streets in the vicinity aze classified as local streets by The Yeaz 2000 Urban Functional Street Classification System and will provide access to the proposed development. No information was submitted to indicate that the proposed internal street design is inappropriate or unsafe. d. No community facilities or common open space is proposed within this development. e. Information contained in the application materials indicates that each of the lots within the development will be lazger than 43,560 square feet and each will have at least 100 feet of frontage on a public street. The density proposed complies with the standards established for the Rl (Estate Residential) Zone. Provided that this application is approved with the recommended Conditions of Approval, the proposed development would comply with applicable provisions of the Meridian 96-OS-PDR Hummingbird Subdivision 4 • • Comprehensive Plan and the Ada County Code. g. Carla Olson, 4735 East Castlewood Drive, was sworn by the City Attorney. Olson: Mr. Mayor and Council members I am here tonight as a planning consultant representing Jerry Cobler the applicant for this neighborhood child care center that he is proposing as the lot that is directly across the best way I can describe where it is, it is the lot that is directly across the street from Chief Joseph elementary school. We feel that this is an ideal existing building, it is unusual to find in a neighborhood in terms of being able to convert it to a child care center. We also feel that it is an ideal location. It is is a large one level home, again it is located directly across the street from Chief Joseph school so there is a lot of child activity in the area anyway. It is within a neighborhood, it is largely single family detached housing with many young families. The child care is really not expected to draw children from all over the valley, there appears to be an existing need within this neighborhood for qualifi° child care. The proximity of the child care center to th - _ elementary school will make it handy for before and after school care of elementary -_ students as well as a one stop destination for parents delivering older children to school and younger children to the child care center. Because the child care center expects to attract clients within the neighbofiood many of whom are already travelling to Chief Joseph school the child care center should not noticeably increase traffic levels. The size and the layout of this existing home lends itself nicely to conversi~ to a child care center. The rooms are spacious, airy and well lighted with separate areas for playing, sleeping and eating. It has two restroom for boys and girls rooms. There is a fenced yard, actually two fenced yards suitable for outdoor play. The child care operators plan to accommodate two different play levels playing out doors at one time. This Subdivision Plat appears to meet the criteria of a development within the City of Meridian's Area of Impact. 2. Plat notes no. 1 & 2 refer to easements for public utilities, drainage, and irrigation. The widths of these easements according to the notes are 10' wide adjacent to the public right- of-way and 5' width along the side lot lines, however the plat map graphically shows the easement adjacent to the public right-of--way as being 20' wide and the side lot easement being 6' wide. The map also indicates that there shall be a rear lot easement with a width of 12' . Please clarify this situation. 3. Remove the City of Meridian reference from plat note no. 3. 4. Add the rear lot dimension to lot 1, block 1. 5. The bearings and distances called out between the point of commencement to the point of beginning in the Certificate of Owners doesn't match the calls shown on the face of the plat.
