Pine St. The new addition will be built on the east end of the existing building and will run north and south to form an "L" with the present building. In May, before starting the building plans, Dale Newberry and James Shearer, the architect, met with Sherrie Stiles and explained the project to her. Our plan was to build within 5 feet of the property line at that time in order to get the needed space in the building. Based on the city zoning plans that establish this whole area as commerciaUlight industrial zoning, we all assumed that the setbacks would fall within those criteria which require "0" setback. Sherrie told us at that time that she did not see any problem with what we wanted to do. Subsequently, we have drawn up complete plans that have a 7' 10" setback on the east side. This setback was established by the engineering design of the interior metal structure for the building and the best span distance from side to side. In the meantime, Sherrie Stiles has received a letter from the relatives of Lilian Reamon, the owner of the property bordering ours on the east side. They are contending that they are a residential property and want us to have a 20' setback with a fully landscaped area adjacent to their property. Earlier this year, I approached Mrs. Reamon about buying her property. I talked with her several times and later to her son-in-law, Harry Graham of Nampa. During the talks, both acknowledged that they were aware of how the area was being rezoned and that they had been contacted by other people looking at commercial applications. They both also indicated that when the property was sold, it would be sold based on commercial prices. Eventually, Mrs. Reamon's daughter, Janet Graham, called and said that they did not want to sell at that time because she and her two sisters did not want their 86-year-old mother to go to a retirement center. Both properties will be commercial/industrial zoned in the not-too-distant future. 2. The plans have been submitted for approval and changing the building design and plans would cost thousands of dollars and cause considerable delay in the project. 3. There is a solid wall of trees on the Reamon property that completely block the view of the Hi-Micro building and the extra 12' would make no difference in that respect. (See photos) 4. The front of the building is designed with a front plaza and complete landscaping that will be very pleasing to the eye. (See landscape plan) 5. There is a hedge planned on the edge of our property line that goes back about 160' from the street. This would serve as an additional buffer between the buildings. (See landscape plan) 6. We do not generate noise or fumes that would disturb Mrs. Reamon nor would there be any kind of traffic or activity on that side of the building. The building construction is concrete tilt-up with the interior walls studded and insulated. One can stand next to our building and hear nothing coming through. 7. B. The applicant is proposing to expand an existing warehouse on the east side of the site to form an `L' and additional parking along the north side of the building. Even after this proposed expansion, there will remain an undeveloped portion of the site to the north. The site is abutted by two minor arterials, Locust Grove Road on the west and Pine Avenue on the south. Both roads are planned to be 5 lane streets in the future. Thirty-feet of right-of- way from section line was dedicated through Maw's Subdivision on Pine Avenue and 33-feet on Locust Grove Road. Maw's Subdivision at the northwest corner of Locust Grove Road and Pine Avenue has been developed with single family dwellings and curb, gutter, and sidewalk abutting Locust Grove MV696. WPD Page 2 i • Road and Pine Avenue. The homes in Maw's Subdivision have been constructed with 15- foot (approximate) rear yard setbacks abutting Locust Grove Road and Pine Avenue. Neither roadway could be expanded in the conventional manner without severely impacting the existing residential properties. In two previous development applications, Railside Subdivision and MCU-2-96, the District has required all additional right-of--way on Locust Grove Road and Pine Avenue to be dedicated from the parcels opposite Maw's Subdivision, leaving Maw's Subdivision as is. Staff recommends that this practice be continued on the subject site over time. If the entire site were reviewed in compliance with District policy, the site would be impacted by the additional right-of--way and closure of driveways that do not meet separation standards. Staff recommends that the applicant be required to dedicate right-of--way and meet District policy only on any new development of the site and address the existing development/driveways when the District has a construction project abutting the site. C. District policy requires the applicant to provide a $1,062.50 deposit to the Public Rights-of- Way Trust Fund for the cost of constructing 5-foot wide concrete sidewalk on Pine Avenue abutting the expansion on the parcel (approximately 125-feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. D. District policy requires the applicant to provide a $1,190.00 deposit to the Public Rights-of- Way Trust Fund for the cost of constructing 5-foot wide concrete sidewalk on Locust Grove Road abutting the expansion on the parcel (approximately 140-feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. E. District policy states that direct access to arterials and collectors is normally restricted and that the developer shall try to use combined access points. In accordance with District policy the applicant should be required to provide a recorded cross access easement for the parcels to the east to use this parcel for access to the public streets prior to issuance of a building permit (or other required permits). The District intends to require a similar agreement of that parcel, if it is the subject of a future development application. F. A traffic signal is anticipated to be constructed at the intersection of Locust Grove Road and Pine Avenue in the future. District policy requires that the proposed driveways on Locust Grove Road and Pine Avenue be located a minimum of 315-feet from a traffic signal for a full access driveway, or 220-feet for aright-in/right-out driveway. The site has 405-feet of frontage on Pine Avenue and 580-feet of frontage on Locust Grove Road. If the proposed eastern driveway on Pine Avenue is moved approximately 8-feet to the east, it will meet the required offset of 315-feet. If the current policy were applied to the existing driveway on the developed portion of the site, the existing driveway would be required to be eliminated upon installment of a traffic signal. The proposed northern driveway on Locust Grove Road does not meet the required offset of 220-feet from Buchman Court. If the driveway is moved to the south to meet the 150-foot MV696. WPD Page 3 • • separation, the driveway will not meet the required 315-foot offset for a full access driveway. Staff recommends the driveway be located aligned with Buchman Court, approximately 520- feet north of the section line of Pine Avenue; this allows adequate space for aright-in/right- out driveway in the future. G. Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with past action by the District the applicant should be required to pave the driveways their full required width of 30 to 40-feet to at least 30-feet beyond the edge of pavement of Pine Avenue or Locust Grove and install pavement tapers with 15-foot radii abutting the existing roadway edge. H. As required by District policy, restrictions on the width, number and locations of driveways, may be placed on future development of this parcel. The existing transportation system will be adequate to accommodate the additional traffic generated by this proposed development with the requirements outlined within this report. The following requirements are provided as conditions for approval: Site Specific Requirements: Dedicate 30-feet of right-of--way from the section line of Pine Avenue (5 additional feet) abutting the new development on the parcel (125-feet from the east property line) by means of recordation of a final subdivision plat or execution of a warranty deed, prior to issuance of a building permit (or other required permits), whichever occurs first. The owner will be compensated for this additional right-of--way from available impact fee revenues in this benefit zone. If the owner wishes to be paid for the additional right-of--way, the owner must submit a letter of application to the impact fee administrator prior to breaking ground, in accordance with Section 15 of ACRD Ordinance #188. 2. Dedicate 51-feet of right-of--way from the section line of Locust Grove Road (26 additional feet) abutting the new development on the parcel (an 140-foot segment located 260-feet north of the Pine Avenue section line) by means. of recordation of a final subdivision plat or execution of a warranty deed, prior to issuance of a building permit (or other required permits), whichever occurs first. Pave the driveway its full required width of 30 to 40-feet to at least 30-feet beyond the edge of pavement of Locust Grove Road and install pavement tapers with 15-foot radii abutting the existing roadway edge. Provide a $1,062.50 deposit to the Public Rights-of--Way Trust Fund for the cost of constructing 5-foot wide concrete sidewalk on Pine Avenue abutting the expansion on the parcel (approximately 125-feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. 6. Provide a $1,190.00 deposit to the Public Rights-of--Way Trust Fund for the cost of constructing 5-foot wide concrete sidewalk on Locust Grove Road abutting the expansion on the parcel (approximately 140-feet) prior to issuance of any required permits or District approval of a final plat, whichever occurs first. 7. Do we have that information (inaudible). Crookston: Mr. Mayor and Council I think that the suggestion was by Mr. Newberry that he was going to buy this property that is to the east of Hi-Micro Tool. BENTLEY P & Z COMMISSION JIM JOHNSON, Chairman TIM HEPPER JIM SHEARER GREG OSLUND MALCOLM MACCOY September 13, 1996 SUBJECT: Request for Variance from the 20-foot Planting Strip Requirement Adjacent to Residential Use by Hi-Micro Tool Company This application was submitted due to the fact that building plans have been received showing a new building to be constructed at Locust Grove/Pine that will be only seven feet away from the property line of an existing residence. Section 11-9-605.G, PLANTING STRIPS AND RESERVE STRIPS, reads as follows: "Planting strips and reserve strips shall conform to the following: 1. Pl rte' g trio -Planting strips shall be required to be placed next to incompatible features such as highways, railroads, commercial or industrial uses to screen the view from residential properties. Such screening shall be a minimum of twenty feet (20') wide and shall not be a part of the normal street right-of--way or utility easement; and" When visiting the site with Mr. Newberry and Mr. Shearer, and noting the extensive existing vegetation on the site and the condition of the property, I did not see any particular problems that might occur with locating the building closer than the 20 feet. However, since my site visit, I received a call from the neighbor's son-in-law objecting to the expansion plans. I think an important part of the Ordinance is that the planting strip is to "screen the view from residential buildings". The size and height of the building will obviously be a screen. The Applicant needs to ensure that the exits on the east side are to be used only on an emergency basis and that this seven-foot area, if approved, does not become an area for employee loitering during breaks.
