DESCRIPTION OF APPLICANT'S REQUEST
The applicant, City of Meridian, requests Certificate of Zoning Compliance (CZC) approval to
upgrade the communication infrastructure for the Meridian Water Department. The new
equipment consists of an 80 -foot tower and associated communication equipment used to
monitor the City's water system. The proposed use is classified as a public utility, minor. The
subject facility is located at 2235 NW. 8`h Street.
DECISION
The applicant's request for CZC is approved with the conditions listed in this report.
Note: This is not a building permit. Prior to any construction, you should contact Building Services at
(208)887-2211 to verify if any additional permits and/or inspections will be required
Site Specific Conditions of Approval
1. The location of the tower and base detailed on the site plan prepared by BRS Architects, dated
February, 2006, is approved with no changes from the Planning Department.
2. Comply with all bulk, use, and development standards of the L -O zoning district listed in UDC
Chapter 2 District regulations.
3. Comply with the outdoor service and equipment area standards as set forth in UDC 11-3A-12.
4. Install all utilities consistent with the standards as set forth in UDC 11-3A-21 and 11 -3B -5J.
5. Existing landscaping around the tower and base shall remain protected during construction on the
site.
Process Conditions of Approval
1. The applicant shall pay any applicable impact fees prior to the issuance of a building permit.
2. The applicant shall complete all required improvements prior to issuance of a Certificate of
Occupancy. It is unlawful to use or occupy any building or structure until the Building Official
has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The project is subject to all current City of Meridian ordinances and previous conditions of
approval associated with this site.
2. The issuance of this CZC does not release the applicant from any previous requirements of the
other permits issued for the site.

Please find attached a Certificate of Zoning Compliance Application for the property located at
parcel No. S1201314850 in Meridian, Ada County, Idaho.
The described parcel is approximately 4 acres located in an LO Zone and is the current location
of the City of Meridian Water Department. An 80 foot steel antenna tower is proposed to be
constructed on the site. Antennas will be mounted to the top of the tower which will receive and
transmit communication signals to the water department from multiple wells and pressure
reducing valves throughout the City. This communication to the water department allows the
water operators to monitor facilities, receive alarm of emergencies and make adjustments as
needed. The tower will also allow for the installation of a repeater for the Waste Water
Treatment Plant and lift station radios.
The tower will be approximately 80 feet in height and located on the north side of the water
department office building and will replace the existing 40' tower. The tower is self standing
and will be mounted to a 10 foot by 10 foot concrete footing.

AGREEMENT FOR RECONVEYANCE OF REAL PROPERTY
AND
USE OF THE PROPERTY BY GRANTOR
THIS AGREEMENT, made and entered into this day of�/ 1998 by and between
the STATE BOARD -OF EDUCATION, a department of the State of Idaho, as the Board of
Trustees for Boise State University. hereinafter sometimes referred to as "GRANTOR," and THE
CITY OF MERIDIAN, an Idaho municipal corporation, hereinafter sometimes called
"GRANTEE."
WITNESSETH:
The GRANTEE and the GRANTOR entered into an agreement for conveyance of certain.
real property on April 9,198 1, wherein the GRANTEE agreed to transfer the property hereinafter
described to the GRANTOR, for training and education of GRANTOR S students in connection
with the operation of a waste water management treatment plant;
That Boise State University, GRANTOR, was able to secure the financial assistance of the
Government of the United States ofAmerica in providing funds for the erection of a building for
use as a waste water treatment laboratory;
GRANTEE had previously used the property as the. City of Meridians Waste Water
Treatment Plant, but constructed a new waste water treatment plant, and had no need for the
waste water treatment plant -that was gifted to, and granted to, GRANTOR and
WHEREAS, GRANTOR no longer has students desiring to be enrolled in the training and
education of students to learn to operate a waste water management treatment plant, and
GRANTOR still has a need for a portion of the facilities to utilize in the Boise State University
Electrical Line Worker Program.
NOW THEREFORE, FOR, AND IN CONSIDERATION OF, THE COVENANTS AND
AGREEMENTS HEREIN CONTAINED, GRANTOR desires to gift and convey to the
GRANTEE, subject to the covenants and restrictions contained herein, the following described
premises, all situated in Ada County, Idaho, to -wit:
A parcel of land in Section 1 of Township 3 North and Range 1 West of the Boise
Meridian, more particularly described as beginning at the Center of said Section 1;

NOW THEREFORE, it is agreed as follows:

GRANTOR reconveys, now conveys, and gifts, to GRANTEE that real property
described above to be used by GRANTEE for any purpose GRANTEES desire to use it for.

GRANTOR shall release and quitclaim to GRANTEE the real property described above.

GRANTEE shall, subject to the to the terms of the Provision for Use of the Property by
Grantor as contained herein, from the date hereof be responsible for all utility, maintenance, and
operating costs in connection with the premises and any improvements thereon. GRANTEE shall
bear the expense of any title insurance policy issued in connection herewith.
All the terms and conditions of this Agreement between the parties hereto are stated above
with the exception of the PROVISION FOR USE OF THE PROPERTY BY GRANTOR below,
and no representations or inducements have been made to GRANTEE by GRANTOR other than
those herein set forth. The conditions contained herein are enforceable by either party. Should
such enforcement be necessary, attorney s fees and costs shall be paid by the party not in
compliance.
PROVISION FOR USE OF THE PROPERTY BY GRANTOR
GRANTEE agrees to, and shall, allow GRANTOR to use a portion of the property until
July 1, 2018, as GRANTOR needs to use the facility for its Electrical Line, Worker Program.
GRANTOR shall have the option to extend this use an additional ten (10) years.
The portion of the property GRANTOR may use includes the chemistry lab and the yard
north of the previous location of the sewer treatment plant. GRANTOR agrees to properly use
the property without committing any damage to the property, either physically or environmentally.
AGREEMENT FOR RECONVEYANCE - 2
In consideration for its use of the property, GRANTOR shall pay GRANTEE the sum of
one dollar ($1) per year.
In the event GRANTOR offers Wastewater Treatment Training, the City of Meridian will
cooperate by offering a classroom and lab facilities at the Meridian Wastewater Treatment Plant
currently located at 3401 N. Ten Mile Road, Meridian, Idaho.
In the event GRANTOR offers Water Treatment Training, the City of Meridian will
cooperate by offering a classroom at the Meridian Water Department at 2221 N. W. 8th Street,
Meridian, Idaho.
The parties may enter into a more formal lease agreement which is consistent with
this document. In addition, it is understood by the parties that each parry will be responsible for
their own costs, utilities, liabilities and insurance.
With regard to the portion of real property, described herein, as used by GRANTOR:
GRANTOR shall be responsible for all utility, maintenance, and operating costs in
connection with the property and any improvements thereon.
GRANTOR shall indemnify and hold harmless GRANTEE from and against any and all
claims arising from GRANTOR'S negligent act or Qmission in connection with the use of the
premises or the conduct of its business or from any activity, work, or thing done, permitted or
suffered by GRANTOR in or about the property.
GRANTEE shall indemnify and hold harmless GRANTOR from and against any and all
claims arising from GRANTEE'S negligent act or omission in connection with the use of the
premises or the conduct of its business or from any activity, work, or thing done, permitted or
suffered by GRANTEE in or about the property.
Parties shall at all times during the term hereof and at their own cost and expense, procure
and continue in force bodily injury and property damage liability insurance or self-insurance
adequate to protect the other parry.
