Kleiner Memorial Park DESCRIPTION OF APPLICANT'S REQUEST The applicant, Steve Siddoway, Meridian Parks & Recreation, requests Certificate of Zoning Compliance (CZC) and Design Review (DES) approval for the development of a 60 acre park to be donated to the City of Meridian as a City park. The site is located off the north east corner of E. Fairview Avenue and N. Eagle Road. DECISION The applicant's request for CZC & DES is approved with the conditions listed in this report. Note: This is not a building permit. Prior to any construction, you should contact Building Services at (208)887-2211 to verify if any additional permits anrUor inspections will be required Site Specific Conditions of Approval 1. The applicant shall construct all proposed fencing and/or any fencing required by the UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11-3A-6B. 2. The landscape plan prepared by Parametrix on March 10, 2010, labeled Sheets LS1-4 is approved (stamped "approved" on March 26, 2010 by the City of Meridian Planning Department) with the following changes: a. Include bicycle parking in accord with UDC 11-3C-6G and 11-3C-SC. b. Include details for proposed fencing. The landscape plan shall not be altered without prior written approval of the City of Meridian Planning Department 3. A detailed final landscape plan is required to be submitted within 6 months of the date of this approval. 4. The site plan prepared by Parametrix on March 10, 2010, labeled Sheets 1-5, is approved (stamped "approved" on March 26, 2010 by the City of Meridian Planning Department) with the following changes: a. Include bicycle parking in accord with UDC 11-3C-6G and 11-3C-SC. b. Include details for proposed fencing. A photometric lighting plan is required to be submitted within 6 months of the date of this approval. 6. Per Council's approval, the applicant shall be allowed to the the following irrigation facilities: Finch/South Slough and Stokesberry Lateral. The applicant shall also the all other irrigation facilities as set forth in UDC 11-3A-6A. 7. The applicant shall install bicycle parking facilities capable of holding a minimum of 29 bicycles as set forth in UDC 11-3C-6G and 11-3C-SC based on a total of 703 vehicle parking spaces provided. 8. The subject approval is only for the park site and associated improvements and is not for approval of any structures on the site. All future structures (i.e. library, senior center, recreation center, band shell, picnic shelters, maintenance building, restrooms, etc.) proposed on the site shall be approved through subsequent CZC and design review applications. 9. The applicant shall develop the site consistent with the letter & plan submitted by Parametrix, dated March 25, 2010, and approved by the Fire Department attached in Exhibit C. Process Conditions of Approval 1. The applicant shall pay any applicable impact fees prior to the issuance of a building permit. 2. If any changes must be made to the site plan to accommodate ACI-ID requirements, the applicant shall submit a new site plan to the City of Meridian Planning Department for approval prior to issuance of the building permit. 3. Upon installation of the landscaping and prior to inspection by Planning Department staff, the applicant shall provide a written certificate of completion as set forth in UDC 11-3B-14A. 4. The applicant shall complete all required improvements prior to issuance of a Certificate of Occupancy. It is unlawful to use or occupy any building or structure until the Building Official has issued a Certificate of Occupancy. 5. The approved site plan and landscape plan shall not be altered without prior written approval of the City of Meridian Planning Department. 6. No signs are approved with this application. Prior to installing any signs on the property, the applicant shall submit a sign permit application consistent with the standards in UDC Chapter 3 Article D and receive approval for such signs. 7. The applicant shall complete all improvements related to public life, safety, and health as set forth in UDC 11-SC-3B. A surety agreement may be accepted for other improvements in accord with UDC 11-SC-3C. Ongoing Conditions of Approval 1. The applicant and/or assigns shall have the continuing obligation to provide irrigation that meets the standards as set forth in UDC 11-3B-6 and to install and maintain all landscaping as set forth in UDC 11-3B-5, UDC 11-3B-13 and UDC 11-3B-14. 2. The applicant has a continuing obligation to comply with the outdoor lighting provisions as set forth in UDC 11-3A-11. Conditions Document 2 Julius M Kleiner Memorial Park CZC 3. The applicant shall have an ongoing obligation to maintain all pathways. 4. The project is subject to all current City of Meridian ordinances and previous conditions of approval associated with this site (Development Agreement Inst. 110021914). 5. The issuance of this CZC does not release the applicant from any previous requirements of the other permits issued for the site. 6. The applicant and/or property owner shall have an ongoing obligation to prune all trees to a m;n;mum height of six feet above the ground or sidewalk surface to afford greater visibility of the area. 7. The applicant and/or property owner shall have an ongoing obligation to maintain all landscaping and constructed features within the clear vision triangle consistent with the standards in UDC 11-3A-3. ANALYSIS OF UDC REQUIItEMENTS RELATED TO SITE SPECIFIC CONDITIONS: Per UDC 11-3C-6G, one bicycle parking space shall be provided for every 25 proposed vehicle parking spaces or portion thereof. Because a total of 703 vehicle parking spaces are proposed for this site, a minimum of 29 bicycle parking spaces are required. Fencing is depicted on the site plan; however, no details are provided. All fencing on the site shall comply with the standards listed in UDC 11-3A-7. Fencing details shall be provided within 6 months of this approval with the detailed landscape plan. A photometric lighting plan has not been submitted with this application as plans have not progressed to that point. The applicant shall submit a photometric lighting plan that complies with the standards listed in UDC 11-3A-11 within 6 months of the date of this approval. The landscape plan provided does not include the ultimate planting details. A detailed final plan will be submitted within 6 months of the date of this approval. Kleiner Memorial Park is a 60-acre urban park located to the northeast of the Fairview Avenue/Eagle Road intersection. The HIeiner Park Trust is designing and developing the park that will be deeded to the city upon construction completion as a public Meridian City Park. The HIeiner Park Trust, lead by Julius' son, Eugene HIeiner, is intended to be a legacy in honor of Julius, who escaped from Bolshevik, Russia to the United States in the early 1900's. The park has two large ponds, rolling hills, an arboretum with labyrinth, an active recreation area with decorative splash pad, and an abundance of trees. The site also includes a civic complex featuring a new Meridian Branch Library and Senior Center. The park provides over 3 '/a miles of pedestrian pathways, and a loop roadway system with a bike lane. The Grand Promenade and Memorial Plaza are the signature park amenities, with colored concrete, pavers, ornamental pedestrian lighting, benches and a bronze statue honoring local businessman and gentleman farmer Julius M. HIeiner. The Julius M. HIeiner Memorial Park Master Plan was approved by the Meridian City Council on August 18, 2009. A development agreement modification was approved for the park property by the Meridian City Council on March 2, 2010. The Development Agreement and annexation ordinance were approved by the Meridian City Council on March 9, 2010. A property boundary adjustment may be added to the park, to include tax lot #S1104314800. The lot is currently part of the Redfeather Subdivision, and would add approximately 1.25 acres to the park site. The plans included in this application reflect the additiona11.25 acres. However, if for some reason, the property boundary adjustment does not occur, the overall site plan for the park will not be impacted. For purposes of this Certificate of Zoning Compliance application, we are requesting approval of the overall park site. We have forgone providing final planting and photometric lighting plans in this submittal with the understanding that design has not progressed to that point. When design of these elements is completed, we will provide these documents to the City as a condition of approval. In addition, separate CZC applications will be submitted in the future for the ancillary structures, library and senior center. On March 11, 2010, the Sanitary Service Company approved the cover sheet of the full-size site plan for this submittal. However, minor changes were made to the cover sheet following that approval, and a copy of the original cover sheet is included with this application. The overall site plan was discussed with Rick Jackson on March 11, 2010, for the Fire Marshall approval. Rick cannot approve any modifications to the International Fire Code. The lane widths in and out of the roundabout on the loop road are less than 20', which is a variation to the IFC. However, the lane widths designed are necessary for a functional roundabout design. HIeiner Memorial Park was designed to closely align with the City of Meridian .Design Manual for Urban/Suburban Design Guidelines where appropriate. For this submittal, we are seeking approval for the overall park site. We have forgone providing final planting and photometric lighting plans in this submittal with the understanding that design has not progressed to that point. When design of these elements is completed, we will provide these documents to the City as a condition of approval. In addition, separate design review applications will be submitted in the future for the ancillary structures, library and senior center. The site plan for the park was carefully thought out to provide the best use of space on the 60 acres. The most active uses, including the active recreation area, parking, and library and senior center structures were proposed for the southwest portion of the park. The passive uses, including open space, ponds, and picnic shelters, were proposed for the areas closest to the adjacent residential neighborhoods. Access for the park is provided at two locations, the main entrance off of Records Avenue, and off of "Park Lane" (the east-west connection between Venture and Records). An additional access just north of the western parking facilities off of Records Avenue is proposed for the future, once Records Avenue is extended.. Once in the Julius M. HIeiner Memorial Park, a loop road provides access to the entire park site from the main entrance, through the parking facilities on the west, around the perimeter of the north and east portions of the site and through the parking facilities near the library and senior center. This loop road is two-way from the entrance through the parking lots on the west side, as well as the portion between the two ponds and the parking lots near the library and senior center. The remainder of the loop road (from the northwest parking lot termini through the connection with the two way road near the senior center) is a one-way road with on-street parking. This circulation loop road provides access the majority of the park site, as well parking for the north and east portions of the park. Over 3~i miles of pedestrian pathways are scattered across the park site. Ranging in width from 6 to 12 feet, these pathways provide pedestrian access to the entire site, including the Grand Plaza and Promenade, loop road, arboretum area, ponds, civic plaza, labyrinth, recreation complex, and adjacent residential neighborhoods. In addition, two pathways at the northwest side of the park will cross Records Avenue and connect with the CenterCal development in the future. A 6 foot gravel pathway, intended for jogging, is located along the perimeter of the park from the northwest parking lot termini through the connection with the concrete sidewalk near the picnic shelter in the arboretum area.
