Morrow: Mr. Mayor, due to new information that we are receiving from staff and also some
things that Mr. Goldsmith was supposed to have completed but as of yet has not I would
suggestion that we table this item to our April 2nd meeting.

Corrie: Counselor, where are we on that?
Crookston: I submitted my comments to the City and I haven't received any new CC&R's.

Corrie: Evidently Council this was received today, the covenants, conditions and restriction
for Gemtone office center. So evidently you haven't had a chance to get copies of it yet.
Crookston: I have not reviewed what has been resubmitted.
Corrie: I think we had better table this again to the April meeting until we get that
straightened out.

Attorney submit our comments to Gemtone and their attorney and then we receive back
today their comments is that what you have in your hand Will?
Berg: I have received some comments for a new set it even has a recorded date on it but
I can't tell you if that was in response to Wayne's comments because I haven't even had
time to review them.
Corrie: I thought I saw Tom Wright out there.
Wright: I am confused, did we send you a copy, did you get a copy.
Crookston: Yes you mailed me a copy and that is what I commented on and sent back to
the City.
Wright: That is clear, 1 was sure the attorney had gotten a copy. We sent an extra copy to
Will Berg to make sure he had a copy of it, we are really routing it through attorney
Crookston.
Rountree: Which set is that? The only set that I know we have received is dated stamped
February 5th.

Berg: Wayne we received your comments on the 15th.
Crookston: I believe that they were submitted the 11 th.
Berg: I have the 15th on here those are the ones you gave to me, we highlight it and mail
it back to
Crookston: Those could be what we are talking about.
Berg: I received a copy hand delivered today this afternoon I believe that are recorded.
Crookston: I believe the ones that 1 reviewed initially were recorded,

Corrie: Right, that shows recorded March 8, 1996. Wayne take a look at that one, that is
the one we received today delivered to us. Tom have you had a chance to see the
comments the City attorney made on the original?

Wright: I am not sure I have Mr. Mayor, I think our attorney has though. Mr. Mayor with,
respect to your agenda we have no quarrel if you want to put this aside and look at it later.
The next item on the agenda is fairly important to us.
Crookston: It would be my suggestion that you go ahead and approve that subject to my
review and approval.
Morrow: Mr. Mayor I would move that we approve the CC&R's for Gemtone Center subject
to the review and approval by City Attorney Crookston.

conditions and restrictions for Gemtone Center subject to the review and approval of the

ITEM #5: FINAL PLAT FOR GEMTONE CENTER NO. 2 BY GEMTONE INC.:
Corrie: Staff comments?
Stiles: Mr. Mayor and Council we did get the response to our comments today, I looked
over my portion of the response. The only real item of concern I have remaining is that
they do not consider our requirement to have a bike lane on Pine Street to be valid
because Ada County Highway District hasn't required that. However our comprehensive
plan does require a bike lane a separate striped bike lane and it is designated as a minor
arterial in our comp plan and not a collector as ACHD has referred to it.
Corrie: Gary, have all of your questions been answered?
Smith: Mr. Mayor and Council members, we received a response from Gemtone's
engineers today and I think in general terms everything has been commented to,
responded to. We have a couple of minor questions I guess that we need to ask but they
are of little significance.
Morrow: Gary, what was the resolution of the issue with the well lot and the access road?
Smith: We are having to quit claim a portion of the access road to Gemtone which I don't
have any problem with at all in order to complete their extension of Hickory I believe it is.
At this time we will maintain the access road as it exists, there is a possibility because they

Rountree: Walt, Mr. Mayor, I would assume that you would have the meeting with John
and (inaudible).
Morrow: That is correct my preference would be that two councilmen, the Mayor and Mr.
Shipley meet concerning this and also we review the development agreement at that time
and each of the Councilman would (inaudible) prior to our next meeting. I would ask that
you be involved in that Mr. Rountree since your background is environmental.
Rountree: Thank you.

Corrie: Alright, Walt, Charlie and myself will meet with you John. We will set up the
meeting within the next, probably this week or next week for sure. And we will get the
results and the other councilmen can read the development agreement.
ITEM # 3: TABLED FEBRUARY 20, 1996: COVENANTS, CONDITIONS AND
RESTRICTIONS FOR GEMTONE CENTER:
Corrie: Counselor?
Crookston: I have reviewed a set of covenants, I would like to check and make sure what
I have reviewed is actually what is being requested to be approved. The findings that I
have come from March of 1995. 1 would just like to make sure that is what Gemtone wants
to have approved. What I have reviewed is basically fine, but what I have reviewed is
mostly statements about a well agreement and to be deeded to the City. If the City does
not use it for a one year period, not necessarily from now and for a year but for any one
year period that it is to be deeded back to Gemtone. Do you have any of those Shari, any
other? This is not what I have reviewed. I need to get a copy of those and review them.
Morrow: These are received February 5th and you have not reviewed them.
Crookston: Correct
Morrow: Mr. Mayor, I would move to table the covenants, conditions and restrictions for
Gemtone Center until our March 19, 1996 meeting or the opportunity for the City Attorney
to review the CC&R's as submitted February 5.

ITEM #15: FINAL PLAT: GEMTONE BUSINESS CENTER SUBDIVISION NO. 1, 1 LOT

Rountree: I have a question for both Mr. Smith and Ms. Stiles. Have the questions and
comments you provided been responded to?
Smith: Mr. Mayor, Mr. Rountree yes they have.
Rountree: Satisfactorily?
Smith: I guess there was one comment we raised about the dedication of the right of way
along the extension of Pine Avenue. They responded that phase 2 of this subdivision of
Gemtone, Gemtone No. 2 subdivision would be submitted within 120 days which would
include the dedication of that portion of the street. Their major issue with this plat is to get
done as soon as possible so that property can be conveyed to their prospective purchaser
Blue Cross. The dedication of right of way at this time would be, the Highway District
would hold up signing of the plat until all the improvement plans were improved for that
length of Pine Extended. So that is why they want to delay the inclusion of that portion of
Pine right of way until the next phase. Their engineer's letter says that will be done within
120 days. The second phase would be submitted to us I believe. Their representative is
here this evening President of Gemtone is here as well as their engineer. I am sure they
can respond to that also.
Corrie: Mr. Rountree would you like to have them respond?
Rountree: Did Shari have any other comments? She got up and left I don't know.
Morrow: I would like to see Mr. Mayor a presentation by the engineer.
Bowcutt: I am here tonight kind of pinch hitting for Van this is Mr. Elg's project and he had
a sledding accident with his children and his back is out and he can't be here this evening.
So I am subbing here. As you well know this particular lot here is 24.72 acres that is the
proposed Blue Cross office facility. We are platting that one lot originally it was proposed
for 32 smaller commercial type lots and they basically have not substantially changed their
plan, just eliminated lot lines and created one large lot. The issue, I think the question was
Pine Street, we have to expedite this to get the project up and running, they need to close
immediately so they can get underway in their design and so forth. So it was essential that
we cut down on the review time therefore the best way to do that was not to plat Pine with
this Phase 1 but to plat Pine with this Phase 2. We have done this before on other projects
where a particular street is platted with the second phase and it runs out in a singular
fashion or if this were the first phase it would run out and then this would be platted at a

later time. We have done it vice versa, it doesn't create a problem. This did process
through Ada County Highway District, the final plat, the revision of the preliminary, it was
approved, they understand it was that we are doing this. The review time does take quite
a while. This property has legal frontage on Eagle Road, we have our right of way permits
in hand from the Idaho Department of Transportation, they are also signed by Ada County
Highway District so the property has access and frontage to Eagle Road. We are just
basically trying to do this in the quickest fashion we can. There are lots of agencies we
still have to go through. Do you have any other questions that I can answer?
Tolsma: (Inaudible) proposed Pine Avenue?
Bowcutt: I think they have a phased project and I think Tom can answer that question a
little bit better. They do have this one direct approach here and they show one ingress and
egress here. 1 am not sure where they are phasing and how that works out.
Wright: That is an affirmative, there is an access on Pine Avenue right here, an access
on Eagle Road right there and and access on whatever we end up calling that, I think
Eagle Brook has been outlawed. Anyway this north south street and by the way
(inaudible).
Tolsma: When will this Pine Street project be installed?
Wright: Immediately, we only have half of the Pine Street Mr. Councilman, but we will be
paving, curbing, guttering, sidewalking, all of that all of this street and as part of this
second phase that Becky just told you about this here and this here as well.
Tolsma: You are just not platting it at this particular time?
Wright: Well (inaudible) it is in the process, we will have that to ACHD within
Bowcutt: We are working on those construction drawings right now.
Tolsma: (Inaudible)
Wright: No, virtually it is simultaneously for all projects. As part of our contract with Blue
Cross we have to put in these improvements within 120 days of closing. We hope to close
sometime this month or we expect to close sometime this month.
Crookston: Question, Mr. Wright you are the owner of the property are you not?
Wright: That is correct Mr. Crookston.

Crookston: Do your covenant to put in Pine Street that not being part of this plat being
required by ACHD and the City of Meridian?
Wright: Yes we do.
Corrie: Thank you Tom.
Rountree: I have one question on the plat I have, I can't read your Becky, the width for the
future subdivision of Pine, is that 45 feet?
Bowcutt: I believe it is 45 feet from centerline.
Wright: The right of way Mr. Councilman is 45 feet, it would be 90 feet entirely. We will
pave the north half of the street curb, gutter and sidewalk.
Bowcutt: It is 45 from centerline so like you said a total 90 foot and a 41 back to back.
Corrie: Thank you Becky, any further questions from Council?
Morrow. I have one for Gary Smith, the sewer easement issue that we were working on
that is approximate to this property has that issue been resolved?
Smith: Yes it has, I received a revised second sheet from Mr. Wright's attorney Friday I
believe. They had deleted that paragraph that I was concerned about. They have been
very receptive and helpful on resolving that.
Morrow: I would like to thank Tom for the help in getting that resolved. It solves a lot of
problems for us as a City and the school district and allows some real progress to go
forward and it was with Tom's help and Gary's diligence that got accomplished. So with
that we will press forward. I have nothing further Mr. Mayor.
Corrie: Hearing nothing more from staff and Council I will entertain a motion for final plat
approval.
Morrow: Mr. Mayor I move we approve the final plat for Gemtone Business Center No. 1
lot 1.

Grantee, its successors and assigns forever.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto,
that all facilities installed pursuant to this easement shall be and remain the property of Grantee,
that the Grantee shall at all times safely operate and maintain Grantee's property and facilities
within the easement area and that the Grantee, in making use of the easement, shall not
unreasonably interfere with Grantor's use of the surface and shall expediently replace and restore
the premises to a condition comparable to that existent prior to undertaking such use. However,
the Grantee will not be responsible for repairing, replacing or restoring any permanent
structures, large trees or bushes placed within the permanent easement area described in this
easement.
THE GRANTOR retains the right to full use of the surface except that the Grantor
hereby covenants and agrees that it will not place or allow to be placed any permanent structures
(other than street improvements), large trees or bushes within the permanent easement area
described herein, which would interfere with the use of said easement area, for the purposes
stated herein.
THE GRANTOR does hereby covenant with the Grantee that it is lawfully seized and
possessed of the aforementioned and described tract of land, and that it has a good and lawful
right to convey said easement, and that it will warrant and forever defend the title and quiet
possession thereof against the lawful claims of all persons whatsoever; provided, however, that
all of the foregoing covenants and warranties of Grantor are subject to all easements, restrictions
and other encumbrances of record or appearing on the land on the date this instrument is
recorded.
FURTHERMORE, Grantor shall have the right, without incurring any extraordinary
expenses (other than standard connection and usage fees), to connect sewer facilities serving
property currently owned by Grantor within a one (1) mile radius of the easement area
("Grantor's Property") to Grantee's existing or future sewer system at a location convenient to
Grantor (whether within or without the easement area described herein).

5.1 Eatabtishmott and Anwitu um of Members. 7b= .h hereby astablished a
Denko moat Control Committee which Shad consist of three (3) regular members, appointed
initially by the Declarant; pxwkk d, however, that so long as Blue Cross of Idaho Health
Service, Inc., an Ida >ro corporation ("Blue Cross") owns a Building Site, Mae Cross shall be one
of the aaembers of the Committee. So long as the Declarant owns a minimum of five (5) acres
in the Canter, the Declaraat shall be the appoirming suthority and shall appoint an members of
the Committee and shall have do right to wi nove any and all members (edw than Bhw Cross)
from the Committee at any time for any reason, with or without Caruso. Declarant at any time
may assign in writing, for a definity or indefinite period of time, this right of appointment and
removal, of one or more of said mambas. When the Declarant no longer owns five (5) or more
acnes in the Center, a majority of the Owners shall be the appointing authority.
5.2 Terns. The reegular term of office of each member of the Committee shall be one
(1) year, ending December 31, or Cantil such member'S successor has been duty appointed.
5.3 Chixi md& The appointing K00-tity shall designate one (1) of the appointed
members of the Committee to be Chairman. The Cbairman shall take charge of and conduct ail

meetings and shall provide for reasonable notice to each member of the COmmittee prior to any
meeting setting forth the place and time of said me, which notice may be waived.
5.4 Vodng. The affirmative vote of a majority of the members of the Committee
present at air meeting at which a quorum is present sball constitute the action of the Committee
on any matter before it, except that, so long as Blue Cross is a member of the Committee, no
action may be taken without the consent of Blue Cross undoes Blue Cross fails to attend a
meeting after reasonable notice. At leant two (2) members must be present in person to
constitute a quorum. The Committee may also td o action witbout a meeting by unanimous
written +consent of its members.
5.5 Control. Except for Improvements which may be installed by the Declarant for
the benefit of one or mora of the Bing Sites in the Center, no Improv P i a1 1 shall be made
or altered on any Building Site nor any such wont commenced until M and complete plans and
specifications fbr such Improvements have bean approved by the Committee, provided that
alterations or remodeling which are complct y within a Building and which do not change the

approval. All construction shall bo in accordance with approval.
5.6 Limttadons and Eftcr of Acdopu. The approval or consent of the Committee on
matters properly coming before it shall not be unreasonably withheld, and actions UJM shall not
be arbitrary, capricious or discriminatory. Within such limits, however, decisions of the
Committee shall be conclusive and binding on all interested parties.
5.7 CenVcate of Compkanee. Upon payment of a reasonable fe% at from time to
time by the Committee, and upon the wzitten request by any Owner, the Committee shall mail
or deliver within thirty (30) days from receipt of the request, a certificate in recordable form
stating whether or not the Binding She of such Owner is in violation of any provision of this
Declaration. Said written statement shall be conclusive evidence of the facts stated therein in
favor of the persons who rely thereon in good fiiith. if the Committee fails to mail or deliver
such stat anent within said thirty (30) day period, the Building Site shad be conclusively
presumed to be in conformance with this Declaration as of the date of receipt of such request.

5.8 i iabilky of OmWare, Neither the Declarant, the members of the Committee,
or their officers, directors, agents, rEgresentatnres, successors or as*= ofdie Declarant or such
members shall be liable in damages to any person or entity submitting glans and specifications
for approval, or to any Owner or Occupant of any Binding Site or any other person by reason
of mistake in judgment, negligence or nonfeasance arising out of or in connection with the
approval process or the actions of members of the Committee when acting in that capacity.
Every pawn or entity agrees, by submission of such plans and speciik ations, and every Owner
and Occupant of any Building Site within the Center gems, by acquiring title thereto or an

office purposes and similar uses which do not constitute noxious uses as de=lmd in Section 7.7

occupant of the B uDdhlg Site on which it is located, and shall be compatible and harmonious
throughout tate Center.
7.1.4 Drainage. 'The Owner of each Building Site shall submit to the Committee
a drainage plan in conjunction with Building and site plans. The drainage plan shall be certified
by a licensed a*neear gwdiftW in drainage design. Building Site drainage Improvements shall
be designed so as to limit surface water discharge from a Building Site to a ratio sat to exceed
the discharge multing from a twenty-five (25) year stone under pre -development (natural)
conditions.
7.1.5 Opera SOMxILandscaping. Open. Area shall equal or exceed ten percent
(10 %) of the gross land area of each Building Site, and shall be lalti iseaped. Bach owner or
occupant within the Center shall be responsible far the consOuction, installation and
maintenance of functional and aesthetically suitable X owisc� rog on the Building Site. Such

limitation, by reason of unsightliness, emissive emission of fumet, odors, glare, vibration,
gases, radiation, electrieW disturbance, fire hazard, dust, liquid wWa, amoke, debris, water
pollution, air pollution or noise.
7.5 C.crtr.nmcdm Requirements.
7.3.1 &C pnpamg0n. All Building Shag are to be cared and excavated in a
workmanldae manner with considemdoft for sufmUnding Budding Site Owners and Occupants.
All dirt and debris not to be used in construction are to be rowed fiUM the Center or
stockpiled in an assigned location approved by the Committee.
7.5.2 Baler Darrtaga. The Owner and the Owner's agents shall be
responsible for repairs of any damage which may occur drams excavation to sidewalh, Streets,
utilities or outer existing Impaovea mts on or off the $wilding Site. Owners and their agents
shall inspect any impraveincam installed by Declarant prior to commawment of construction
and report any probl ms to the Committee. Unless odwwiae tlodfled prior to commaoscement
of consttvetion, any Improvements hwaMd by Declasant shall be ca Acral in good repair and
all damages occurring during constriction will be the responsibility of the Owner and the
Owner's agents. Said repairs shall be made immediat* tin ocemm mm.
7.5.3 Comtrw don Mme. Job sites are to be leapt as clean as possible
during construction. All dirt, rutile, gravel auld other building materials must be promptly
removed from Stets and side"ucs. No materials aro allowed to be kept on adjoining bxilding

materials and debris prior to each weekend. Dumpsters are the nsibilitp of the Owner and
shall be located as desigra0ed by the Commifte. Said facMies am to be kept orderly at all

may grant or deny such application for a change ar a variance, subject to the following

8.1 Proadum and Controla. All submissions to the Committee far spprevals re 0uld
by this Declaration shalt be made in accordance with thin Article 8. In the event the Committee
fails to approve or disapprove a proposal within dmtY (30) days after said proposal has been
submitted in such form as may be required by the Committee, the Applies may deliver to the
Committee a written notice of inaction. Should the Committer fait to MPOM within five (5)
days of receipt of the notice of inac dm, the Applicant may eider the praposai approved,
except in the case of a variance request witich shall be 000sidered disapproved. All references

8.45 Use. A description of tits proposed uses of the Belding Site and any
accessory uses and a comment on thdr suitability under the provisions of this Declaration and
the ordinances of the City of Meridian.

8.4.7 Odwr. Any other infoamation which may be reamnably required by the
Committee in order to ensure compliance with the requireamats contained herein.
8.4.8 Fee. Payment of any Devebpment Review Fan required by the
Committee.
8.5 Submtttala. All submissions to the Committee shall be in duplicate adginak and

shall diligently proceed with the approved work. If the work is not commenced within one (1)

8.5.2 Approval of plans by the Declarant or the C.ommitree maybe secured prior
to the acquisition of a Building Site pursuant to the terms of a sale contract.
8.6 Revision. in the event an Owner or Occupant desires to deviate from an
approved proposal, the Owner or Occupant sball submit a revised motion indicating the

be in violation shall pay the attorneys' fees of the prevailing party or parties, in such amount as
may be fared by the court in such proceeding. All r medks provided herein or the law or in
equity shall be cumulative and not exclusive.
10.4 Inspediam After reasonable notice to an Owner, the Declarant and any member
of the Committee may from time to time at any seasonable hour or hours eater and inspect any
portion of a Building Site to ascertain compliance with this Declaration.
10.5 Sey-Help. In the event the Owner or Ooeapant fails to comply with the provisions
of this Declaration, the Committee, at its sole discretion, may notify said Owner or Occupant
of such noncompliance in writing, detailing any and all work which must be performed by said
Owner or Occupant to bring said Building or Building Site into compliance with this Declaration.
If said Owner or Occupant fails to perform such work within thirty (30) days after receipt of
notice of noncompliance, then, and in that event, the Committee may pmfvrm any and all
necessary work detailed in the nancrpliance notice and submit in coats and evenses therrefor
to said Owner or Occupant for prompt payment. if said Owner or Occupant fails m reimburse
the Committee for such work within thirty (30) days dweafber, the Committee may collect all
such costs and expenses through any appropriate proceeding at law or in equity or may file
against the property of said Owner or Occupant a real property lien in an adequate amount to
cover all costs and expenses incurred by tate Committee in cotmeadon with said work, and

Rountree: I have a question for both Mr. Smith and Ms. Stiles. Have the questions and
comments you provided been responded to?
Smith: Mr. Mayor, Mr. Rountree yes they have.
Rountree: Satisfactorily?
Smith: I guess there was one comment we raised about the dedication of the right of way
along the extension of Pine Avenue. They responded that phase 2 of this subdivision of
Gemtone, Gemtone No. 2 subdivision would be submitted within 120 days which would
include the dedication of that portion of the street. Their major issue with this plat is to get
done as soon as possible so that property -can be conveyed to their prospective purchaser
Blue Cross. The dedication of right of way at this time would be, the Highway District
would hold up signing of the plat until all the improvement plans were improved for that
length of Pine Extended. So that is why they want to delay the inclusion of that portion of
Pine right of way until the next phase. Their engineer's letter says that will be done within
120 days. The second phase would be submitted to us I believe. Their representative is
here this evening President of Gemtone is here as well as their engineer. I am sure they
can respond to that also.
Corrie: Mr. Rountree would you like to have them respond?
Rountree: Did Shari have any other comments? She got up and left 1 don't know.
Morrow. I would like to see Mr. Mayor a presentation by the engineer.
Bowcutt: I am here tonight kind of pinch hitting for Van this is Mr. Elg's project and he had
a sledding accident with his children and his back is out and he can't be here this evening.
So I am subbing here. As you well know this particular lot here is 24.72 acres that is the
proposed Blue Cross'ofFce facility. We are platting that one lot originally it was proposed
for 32 smaller commercial type lots and they basically have not substantially changed their
plan, just eliminated lot lines and created one large lot. The issue, I think the question was
Pine Street, we have to expedite this to get the project up and running, they need to close
immediately so they can get underway in their design and so forth. So it was essential that
we cut down on the review time therefore the best way to do that was not to plat Pine with
this Phase 1 but to plat Pine with this Phase 2. We have done this before on other projects
where a particular street is platted with the second phase and it runs out in a singular
fashion or if this were the first phase it would run out and then this would be platted at a

later time. We have done it vice versa, it doesn't create a problem. This did process
through Ada County Highway District, the final plat, the revision of the preliminary, it was
approved, they understand it was that we are doing this. The review time does take quite
awhile. This property has legal frontage on Eagle Road, we have our right of way permits
in hand from the Idaho Department of Transportation, they are also signed by Ada County
Highway District so the property has access and frontage to Eagle Road. We are just
basically trying to do this in the quickest fashion we can. There are lots of agencies we
still have to go through. Do you have any other questions that I can answer?
Tolsma: (Inaudible) proposed Pine Avenue?
Bowcutt: I think they have a phased project and I think Tom can answer that question a
little bit better. They do have this one direct approach here and they show one ingress and
egress here. I am not sure where they are phasing and how that works out.
Wright: That is an affirmative, there is an access on Pine Avenue right here, an access
on Eagle Road right there and and access on whatever we end up calling that, I think
Eagle Brook has been outlawed. Anyway this north south street and by the way
(inaudible).
Tolsma: When will this Pine Street project be installed?
Wright: Immediately, we only have half of the Pine Street Mr. Councilman, but we will be
paving, curbing, guttering, sidewalking, all of that all of this street and as part of this
second phase that Becky just told you about this here and this here as well.
Tolsma: You are just not platting it at this particular time?
Wright: Well (inaudible) it is in the process, we will have that to ACHD within
Bowcutt: We are working on those construction drawings right now.
Tolsma: (Inaudible)
Wright: No, virtually it is simultaneously for all projects. As part of our contract with Blue
Cross we have to put in these improvements within 120 days of closing. We hope to close
sometime this month or we expect to close sometime this month.
Crookston: Question, Mr. Wright you are the owner of the property are you not?
Wright: That is correct Mr. Crookston.

Wright: Yes we do.

Rountree: I have one question on the plat I have, I can't read your Becky, the width for the
future subdivision of Pine, is that 45 feet?
Bowcutt: I believe it is 45 feet from centerline.
Wright: The right of way Mr. Councilman is 45 feet, it would be 90 feet entirely. We will
pave the north half of the street curb, gutter and sidewalk.
Bowcutt: It is 45 from centerline so like you said a total 90 foot and a 41 back to back.
Corrie: Thank you Becky, any further questions from Council?
Morrow: I have one for Gary Smith, the sewer easement issue that we were working on
that is approximate to this property has that issue been resolved?
Smith: Yes it has, I received a revised second sheet from Mr. Wright's attorney Friday I
believe. They had deleted that paragraph that I was concerned about. They have been
very receptive and helpful on resolving that.
Morrow: I would like to thank Tom for the help in getting that resolved. It solves a lot of
problems for us as a City and the school district and allows some real progress to go
forward and it was with Tom's help and Gary's diligence that got accomplished. So with
that we will press forward. I have nothing further Mr. Mayor.
Corrie: Hearing nothing more from staff and Council I will entertain a motion for final plat
approval.
Morrow: Mr. Mayor I move we approve the final plat for Gemtone Business Center No. 1

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
GENERAL COMMENTS
Any existing irrigation/drainage ditches crossing the property to be included in this project,
shall be tiled per City Ordinance 11-9-605.M. Plans will need to be approved by the
appropriate irrigation/drainage district, or lateral users association, with written confirmation
of said approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be removed
from their domestic service per City Ordinance Section 5-7-517. Wells may be used for non-
domestic purposes such as landscape irrigation.
3. Determine the seasonal high groundwater elevation, and submit a profile of the subsurface soil
conditions, as prepared by a soil scientist, with development plans.
4. Submit copy of proposed restrictive covenants and/or deed restrictions to the Meridian City
Clerk's Office for review.
5. Provide a statement as to whether the pressurized irrigation system in this development is to
be owned and maintained by the Irrigation Dist. or the Lot Owners Assoc.

development timing for these roadways could possibly be delayed through the Non -
Development Agreement process with the Ada County Highway District.

On January 24, 1996, the Commissioners of the Ada County Highway District (hereafter called
"District") took action on the Preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for acceptance, the Developer shall
cause the following applicable standard conditions to be satisfied prior to District certification
and endorsement:
1. Drainage plans shall be submitted and subject to review and approval by the
District.
2. If public street improvements are required: Prior to any construction within the
existing or proposed public right-of-way, the following shall be submitted and
subject to review and approval by the District:
a. Three complete sets of detailed street construction drawings prepared by
an Idaho Registered Professional Engineer, together with payment of plan
review fee.
b. Execute and Inspection Agreement between the Developer and the District
together with initial payment deposit for inspection and/or testing services.
C. Complete all street improvements to the satisfaction of the District, or
execute Surety Agreement between the Developer and the District to
guarantee the completion of construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by the Local
Government Agency having such authority together with payment of fee charged
for the manufacturing and installation of all street signs, as required.
4. If Public Rights -of -Way Trust Find deposit is required, make deposit to the
District in the form of cash or cashier's check for the amount specified by the
District.
5. Furnish easements, agreements, and all other datum or documents as required by
the District.
6. Furnish Final Plat drawings for District acceptance, certifications, and
endorsement. The final plat must contain the signed endorsement. The final plat
must contain the signed endorsement of the Owner's and Land Surveyor's
certification.
7. Approval of the plat is valid for one year. An extension of one year will be
considered by the Commission if requested within 15 -days prior to the expiration
date.

Eagle Road north of Pine Street
Gemtone Business Center (Treasure Valley Business Center No.2) is a 39 -lot commercial/industrial
subdivision on 74.35 -acres. The site is located on the west side of Eagle Road approximately 1,000 -
feet south of Fairview Avenue, on the north side of Pine Street. This development is estimated to
generate 9,000 to 14,900 additional vehicle trips per day.
This subdivision was approved by the District on February 8, 1995, and a modification was
approved on November 29, 1995. The November 29, 1995, preliminary plat has been modified to
combine 22 lots on the east end of the site into 1 large lot and eliminating the streets within the
proposed large lot: State Avenue east of Edenbrook Avenue, Olive Avenue between State Avenue
and Pine Street, and Washington Street between Edenbrook Avenue and Olive Avenue.

B. The applicant is proposing to combine Block 1, Block 6, and Block 7, (preliminary plat dated
received November 3, 1995) into one lot, proposed to be labeled Lot 1, Block 1. The
applicant is proposing to eliminate the public roads within the new Lot 1, Block 1, State
Avenue between Edenbrook Avenue and State Street, Olive Avenue between State Avenue
and Pine Street, and Washington Street between Edenbrook Avenue and Olive Avenue. Staff
has no objection to the elimination of the above stated roadway segments. Hickory Avenue
will provide a street connection from this subdivision to Treasure Valley Business Center
No. 1. Because Olive Avenue will not be extended, a paved turnaround will be required.
The applicant is proposing to dedicate and construct a turnaround at the southern terminus of
Olive Avenue within Treasure Valley Business Center No. 1; the turnaround will not be
within the boundaries of this subdivision. Once this turnaround has been dedicated and
constructed, the District can release the temporary easement for a turnaround on Lot 1,
Block 1.

The applicant is proposing to retain driveways where Olive Avenue was proposed to intersect
Pine Street and where State Avenue was proposed to intersect Eagle Road. There are no
driveways on the south side of Pine Street from which to align or offset. The driveway on
Pine Street is proposed to be offset approximately 300 -feet to the west of Eagle Road, which
meets District policy (175 -foot offset for a full access driveway on a collector street from a
signalized intersection). In the future, staff anticipates that the intersection of Eagle Road
and Pine Street will be signalized.
The driveway on Eagle Road is proposed to be located approximately 330 -feet north of Pine
Street. District policy requires an offset of 440 -feet for a full access driveway on an arterial
from a signalized intersection, however, a permit for this location was previously approved
by ITD.
C. State Highway 55 Eagle (Road) is under the jurisdiction of Idaho Transportation Department
(ITD). The developer is required to submit application materials to ITD for review and
requirements of that Department. Contact District III Traffic Engineer Gary Moles at 334-
8340. The applicant has provided documentation of ITD's approval for a driveway on Eagle
Road.
D. In accordance with District policy, staff recommends that the applicant be required to deposit
to the Public Rights -of -Way Trust Fund the cost of constructing 5 -foot wide concrete
sidewalk on Pine Street abutting the parcel. These improvements are estimated to cost a total
of $21,590.
E. Street connections with Treasure Valley Business Center No.1 to the north are proposed as a
continuation of the existing Hickory Avenue to the proposed Pine Avenue on the south
subdivision boundary.
F. An east -west internal street (State Avenue) is proposed from Edenbrook Avenue to the west
boundary, to provide for future extension to the unplatted property to the west. A paved
turnaround and public turnaround easement will be provided to the District for the west end
of State Avenue.
G. Right-of-way for Pine Street is being provided along the south property boundary. Ninety -
feet of right-of-way is being provided adjacent to Lot 1, Block 6, where the subdivision
property is on both sides of the quarter section line, and 45 -feet of right-of-way is being
provided along the north side of the quarter section line.
H. The construction of Pine Street is listed in the Five Year Work Program as an unfunded
project.

Access is provided to Block 6 (2 lots south of Pine Street) from Pine Street. If development
(excluding drainage facilities) is proposed on Block 6 prior to the District's construction of
Pine Street, the developer will be required to construct Pine Street with a 24 -foot wide street
from Eagle Road for access. If the developer decides to wait to develop Block 6 until the
District constructs Pine Street, a non -development agreement for Block 6 will be required
prior to final plat approval.
If the developer wants to access Hickory Avenue, Edenbrook Avenue, or Block 1, via Pine
Street prior to the District's construction of Pine Street, the same requirement for a 24 -foot
wide paved road from Eagle Road applies.
K. The internal street section is proposed as a 41 -foot back-to-back street section with 5 -foot
sidewalks and vertical curbs within 56 -feet of right-of-way, as previously approved by the

this proposed development.
N. This application was scheduled to be heard by the Meridian City Council on February 6,
1996.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
Comply with requirements of ITD for State Highway 55 (Eagle Road) frontage. Submit to
the District a letter from ITD regarding said requirements prior to issuance of building
permit (or other required permits). Contact District III Traffic Engineer Gary Moles at 334-
8340.
2. Dedicate 90 -feet of right-of-way for the future Pine Street abutting where applicable west of
Hickory Avenue (proposed Block 6) and a minimum of 45 -feet of right-of-way north of the
quarter section line abutting the parcel. The owner will be compensated for this additional
right-of-way at pre -development value from available impact fee revenues in this benefit
zone. If the owner wishes to be paid for the additional right-of-way, the owner must submit

a letter of application to the impact fee administrator prior to breaking ground, in accordance
with Section 15 of ACHD Ordinance #188.
Provide a $21,590 deposit to the Public Rights -of -Way Trust Fund at the District for the
required street improvements of approximately 2,540 -feet of 5 -foot wide concrete sidewalk
on Pine Street abutting parcel.
4. Pine Street shall be constructed with a 24 -foot wide paved road from Eagle Road if access to
Block 6 (excluding drainage facilities), Hickory Avenue, Edenbrook Avenue, or Block 1, is
needed prior to the District's construction of Pine Street. Prior to the District's approval of
the final plat that includes Block 6 (south of Pine Street), either a non -development
agreement shall be signed with the District or Pine Street shall be improved as stated above.
Coordinate with District staff.
5. Construct a 30 -foot wide driveway on the Pine Street alignment, located as proposed,
approximately 300 -feet west of Eagle Road.
6. Except for Lot 1, Block 6, and the above approved driveway for Block 1, direct lot or parcel
access to Pine Street is prohibited. Lot access restrictions shall be stated on the final plat.
7. Provide an access easement for Lot 2, Block 6, to Pine Street across Lot 1, Block 6.
8. Internal streets shall be constructed to a 41 -foot back-to-back street section with 5 -foot wide
sidewalks and vertical curbs within a 56 -foot right-of-way.
9. Direct lot access to Hickory Avenue and Edenbrook Avenue, will be prohibited 50 -feet or
more north of Pine Street, depending upon traffic volumes.
10. State Avenue shall be extended as a stub street to the west boundary. Provide a paved
turnaround with an appropriate temporary easement to the District.
11. Dedicate and construct a paved turnaround with curb and gutter to District standards at the
south terminus of Olive Avenue. The District will release the temporary turnaround
easement shown on Lot 1, Block 1, after the applicant dedicates and constructs the above
mentioned turnaround.
12. Shared lot access will be encouraged.
13. The distances between driveways and public roads shall be a minimum of 50 -feet, as
measured from near edge to near edge.

Standard Requirements:
1. A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the Development Services Supervisor. The request shall
specifically identify each reQuirement to be reconsidered and include a written explanation of
why such a requirement would result in a substantial hardship or inequity.
Requests received prior to the date scheduled for Commission action shall be rescheduled for
discussion with the Commission on the next available meeting agenda.
2. A request for an appeal of the Commission's action shall be made in writing to the
Development Services Supervisor within 15 calendar days of the action and shall include a
minimum fee of $110.00. The appeal will be scheduled to be heard by the Commission
within 20 calendar days after receipt. The request for appeal shall specifically identify each
requirement to be reconsidered and include a written explanation of why such a requirement
would result in a substantial hardship or inequity.
A right-of-way permit must be obtained from ACHD for any street or utility construction
within the public right-of-way. Utility cuts should be combined where practical to limit
pavement damage. Utility street cuts in roads paved within the last five years will not be
allowed unless annroved by the District Commission. Contact Construction Services at 345-
7667 (with file number) for details.
4. Submit site drainage plans and calculations for review and appropriate action by ACHD prior
to issuance of building permit (or other required permits). The proposed drainage system
shall retain all storm water on-site and shall conform to the requirements of Meridian.
Public street drainage facilities shall be located in the public right-of-way or in a common lot
owned by a homeowners association set aside specifically for that use. There shall be no
trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage
lots and their use restrictions shall be noted on the plat (when applicable).
5. Locate driveway curb cuts a minimum of 5 -feet from the side lot property lines when
driveways are not being shared with the adjacent property.
6. Construct pedestrian ramps on the corner of all street intersection in compliance with Idaho
Code, Section 40-1335.

7. Dedicate up to a 20 -foot x 20 -foot right-of-way triangle (or appropriate curve) to keep street
improvements within the public right-of-way at all intersections abutting and/or within the
development prior to issuance of building permit (or other required permits).
8. Continue existing irrigation and drainage systems across parcel.
9. Continue borrow ditch drainage abutting parcel (culvert may be required).
10. Provide written approval from the appropriate irrigation/drainage district authorizing storm
runoff into their system.
11. If street improvements are required, locate obstructions (utility facilities, irrigation and
drainage ditches and appurtenances, etc.) outside of the public right-of-way. Authorization
for relocations shall be obtained from the appropriate entity. If determined by the District,
existing irrigation facilities may remain in the right-of-way with District review and approval
of easements recorded for future relocation at a later date.
12. Locate proposed sign(s) out of the public right-of-way and out of the clear -vision sight -
triangle of all street and driveway intersections.
13. Install a stop sign on every unsignalized approach of a project street to an intersection
involving a collector or arterial as the cross -street. The stop sign shall be installed when the
project street is first accessible to the motoring public.
14. The developer is required to install street name signs at the locations approved by the Ada
County Highway District. Purchase street name signs, sign poles, and mounting hardware
from ACHD's Traffic Operations Department or an approved outside supplier. The District
will not manufacture street signs until a copy of the recorded plat showing the recording data
has been provided to Development Services staff.
15. Provide a clear vision sight triangle at all street intersections. Within this triangle no
obstruction higher than 36 -inches above the top of pavement will be allowed, including
landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg
measured down the centerline of any collector 350 -feet; and the short leg measured down the
centerline from the collector street curb line 20 -feet. Provide notes on the plat and street
construction plans of these restrictions.
16. Submit three sets of street construction plans to the District for review and appropriate
action.

STORMWATER MANAGEMENT RECOMMENDATIONS
We recommend that the first one half inch of stormwater be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact to groundwater
and surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for stormwater
disposal and design a stormwater management system that is preventing

On November 29, 1995, the Commissioners of the Ada County Highway District (hereafter
called "District") took action on the Preliminary Plat as stated on the attached staff report.
In order that the Final Plat may be considered by the District for acceptance, the Developer shall
cause the following applicable standard conditions to be satisfied prior to District certification
and endorsement:
Drainage plans shall be submitted and subject to review and approval by the
District.
2. If public street improvements are required: Prior to any construction within the
existing or proposed public right-of-way, the following shall be submitted and
subject to review and approval by the District:
a. Three complete sets of detailed street construction drawings prepared by
an Idaho Registered Professional Engineer, together with payment of plan
review fee.
b. Execute and Inspection Agreement between the Developer and the District
together with initial payment deposit for inspection and/or testing services.
C. Complete all street improvements to the satisfaction of the District, or
execute Surety Agreement between the Developer and the District to
guarantee the completion of construction of all street improvements.

3. Furnish copy of Final Plat showing street names as approved by the Local
Government Agency having such authority together with payment of fee charged
for the manufacturing and installation of all street signs, as required.
4. If Public Rights -of -Way Trust Find deposit is required, make deposit to the
District in the form of cash or cashier's check for the amount specified by the
District.
5. Furnish easements, agreements, and all other datum or documents as required by
the District.
6. Furnish Final Plat drawings for District acceptance, certifications, and
endorsement. The final plat must contain the signed endorsement. The final plat
must contain the signed endorsement of the Owner's and Land Surveyor's
certification.
7. Approval of the plat is valid for one year. An extension of one year will be
considered by the Commission if requested within 15 -days prior to the expiration
date.

Modified Preliminary Plat - Treasure Valley Business Center No. 2
Eagle Rd north of Pine Street
Treasure Valley Business Center No.2 is a 60 -lot commercial/industrial subdivision on 74.35 -acres.
The site is located on the west side of Eagle Road approximately 1,000 -feet south of Fairview
Avenue, on the north side of Pine Street. This development is estimated to generate 9,000 to 14,900
additional vehicle trips per day.
This subdivision was approved by the District on February 8, 1995. The preliminary plat has been
modified to add two public streets intersecting with Pine Street (Edenbrook Avenue and Olive
Avenue), and the number of lots has been reduced from 66 to 60.

B. The locations of the two streets that have been added to the preliminary plat meet District
standards, one on Pine Street and one on Eagle Road. There are no driveways to the south
from which to align or offset. The Olive Avenue intersection with Pine Street is proposed to
be offset approximately 400 -feet to the west of Eagle Road, which meets the District's
standard offset of 300 -feet between a local street (Olive Street) and an arterial (Eagle Road),
as measured between centerlines.
C. State Highway 55 Eagle (Road) is under the jurisdiction of Idaho Transportation Department
(ITD). The developer is required to submit application materials to ITD for review and
requirements of that Department. Contact District III Traffic Engineer Gary Moles at 334-
8340. The applicant has provided documentation of ITD's approval of State Avenue
intersecting Eagle Road.

D. In accordance with District policy, staff recommends that the applicant be required to deposit
to the Public Rights -of -Way Trust Fund the cost of constructing 5 -foot wide concrete
sidewalk on Pine Street abutting the parcel. These improvements are estimated to cost a total
of $21,590.
E. Street connections with Treasure Valley Business Center to the north are proposed as a
continuation of the existing Hickory Avenue to the proposed Pine Avenue on the south
subdivision boundary, and a connection to Fairview Avenue and Eagle Road via the existing
Olive Avenue, Jewel Street and Florence Street.
F. An east -west internal street (State Avenue) is proposed to access Eagle Road and provide for
future extension to the unplatted property to the west. A paved turnaround and public
turnaround easement will be provided to the District for the west end of State Avenue.
G. Right-of-way for Pine Street is being provided along the south property boundary. Ninety -
feet of right-of-way is being provided adjacent to Lot 1, Block 9, where the subdivision
property is on both sides of the quarter section line, and 45 -feet of right-of-way is being
provided along the north side of the quarter section line.
H. The construction of Pine Street is listed in the Five Year Work Program as an unfunded
project.
I. Access is provided to Block 9 (2 lots south of Pine Street) from Pine Street. If development
is proposed on Block 9 prior to the District's construction of Pine Street, the developer will
be required to construct Pine Street with a 24 -foot wide street from Eagle Road for access.
If the developer decides to wait to develop Block 9 until the District constructs Pine Street, a
non -development agreement for Block 9 will be required prior to final plat approval.
J. If the developer wants to access Hickory Avenue, Edenbrook Avenue, or Olive Avenue, via
Pine Street prior to the District's construction of Pine Street, the same requirement for a 24 -
foot wide paved road from Eagle Road applies.
K. The internal street section is proposed as a 41 -foot back-to-back street section with 5 -foot
sidewalks and vertical curbs within 60 -feet of right-of-way.
L. Some access restrictions should be anticipated for specific developments within this project.
For example, shared lot access will be encouraged and direct lot access to Hickory Avenue
near Pine Street may be controlled.
M. The transportation system will be adequate to accommodate additional traffic generated by
this proposed development.

N. This application was scheduled to be heard by the Meridian Planning and Zoning
Commission on February 14, 1994.
The following requirements are provided as conditions for approval:
Site Specific Requirements:
1. Comply with requirements of ITD for State Highway 55 (Eagle Road) frontage. Submit to
the District a letter from ITD regarding said requirements prior to issuance of building
permit (or other required permits). Contact District III Traffic Engineer Gary Moles at 334-
8340.
2. Dedicate 90 -feet of right-of-way for the future Pine Street where applicable west of Hickory
Avenue and a minimum of 45 -feet of right-of-way from the quarter section line abutting the
parcel. The owner will be compensated for this additional right-of-way at pre -development
value from available impact fee revenues in this benefit zone. If the owner wishes to be paid
for the additional right-of-way, the owner must submit a letter of application to the impact
fee administrator prior to breaking ground, in accordance with Section 15 of ACHD
Ordinance #188.
3. Provide a $21,590 deposit to the Public Rights -of -Way Trust Fund at the District for the
required street improvements of approximately 2,540 -feet of 5 -foot wide concrete sidewalk
on Pine Street abutting parcel.
4. Pine Street shall be constructed with a 24 -foot wide paved road from Eagle Road if access to
Block 9, Hickory Avenue, Edenbrook Avenue, or Olive Avenue is needed prior to the
District's construction of Pine Street. Prior to the District's approval of the final plat that in-
cludes Block 9 (south of Pine Street), either a non -development agreement shall be signed
with the District or Pine Street shall be improved as stated above. Coordinate with District
staff.
5. Internal streets shall be constructed to a 41 -foot back-to-back street section with 5 -foot
sidewalks and curbs within 56 -feet of right-of-way.
6. Except for Lot 1, Block 9, direct lot or parcel access to Pine Street is prohibited. Lot access
restrictions shall be stated on the final plat.
7. Provide an access easement for Lot 2, Block 9, to Pine Street across Lot 1, Block 9.

8. Shared lot access will be encouraged.
9. The distances between driveways and public roads shall be 50 -feet, as measured from near
edge to near edge.
10. Olive Avenue shall be located as proposed, approximately 400 -feet west of Eagle Road, as
measured between centerlines.
11. Direct lot access to Hickory Avenue, Edenbrook Avenue, State Avenue, and Olive Avenue,
will be prohibited 50 -feet or more north of Pine Street or west of Eagle Road, depending
upon traffic volumes.
Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the Development Services Supervisor. The request shall
specifically identify each requirement to be reconsidered and include a written explanation of
my -such a requirement would result in a substantial hardship or inequity.
Requests received prior to the date scheduled for Commission action shall be rescheduled for
discussion with the Commission on the next available meeting agenda.
2. A request for an appeal of the Commission's action shall be made in writing to the
Development Services Supervisor within 15 calendar days of the action and shall include a
minimum fee of $110.00. The appeal will be scheduled to be heard by the Commission
within 20 calendar days after receipt. The request for meal shall specifically identify each
rg- irement to be reconsidered and include a written explanation of why such a requirement
would result in a substantial hardship or inequity.
A right-of-way permit must be obtained from ACHD for any street or utility construction
within the public right-of-way. Utility cuts should be combined where practical to limit
pavement damage. Utility street cuts in roads2aved within the last five years will not be
allowed unless annrove I by the District Commission. Contact Construction Services at 345-
-
7667 (with file number) for details.
4. Submit site drainage plans and calculations for review and appropriate action by ACHD prior
to issuance of building permit (or other required permits). The proposed drainage system
shall retain all storm water on-site and shall conform to the requirements of Meridian.

Public street drainage facilities shall be located in the public right-of-way or in a common lot
owned by a homeowners association set aside specifically for that use. There shall be no
trees, fences, bushes, sheds, or other valuable amenities placed in said easement. Drainage
lots and their use restrictions shall be noted on the plat (when applicable).
5. Locate driveway curb cuts a minimum of 5 -feet from the side lot property lines when
driveways are not being shared with the adjacent property.
6. Construct pedestrian ramps on the corner of all street intersection in compliance with Idaho
Code, Section 40-1335.
7. Dedicate up to a 20 -foot x 20 -foot right-of-way triangle (or appropriate curve) to keep street
improvements within the public right-of-way at all intersections abutting and/or within the
development prior to issuance of building permit (or other required permits).
8. Continue existing irrigation and drainage systems across parcel.
9. Continue borrow ditch drainage abutting parcel (culvert may be required).
10. Provide written approval from the appropriate irrigation/drainage district authorizing storm
runoff into their system.
11. If street improvements are required, locate obstructions (utility facilities, irrigation and
drainage ditches and appurtenances, etc.) outside of the public right-of-way. Authorization
for relocations shall be obtained from the appropriate entity. If determined by the District,
existing irrigation facilities may remain in the right-of-way with District review and approval
of easements recorded for future relocation at a later date.
12. Locate proposed sign(s) out of the public right-of-way and out of the clear -vision sight -
triangle of all street and driveway intersections.
13. Install a stop sign on every unsignalized approach of a project street to an intersection
involving a collector or arterial as the cross -street. The stop sign shall be installed when the
project street is first accessible to the motoring public.
14. The developer is required to install street name signs at the locations approved by the Ada
County Highway District. Purchase street name signs, sign poles, and mounting hardware
from ACHD's Traffic Operations Department or an approved outside supplier. The District
will not manufacture street signs until a copy of the recorded plat showing the recording data
has been provided to Development Services staff.

15. Provide a clear vision sight triangle at all street intersections. Within this triangle no
obstruction higher than 36 -inches above the top of pavement will be allowed, including
landscaping, berms, fences, walls or shrubs. The triangle shall be defined by the long leg
measured down the centerline of any collector 350 -feet; and the short leg measured down the
centerline from the collector street curb line 20 -feet. Provide notes on the plat and street
construction plans of these restrictions.
16. Submit three sets of street construction plans to the District for review and appropriate
action.
17. Provide design data for proposed access to public streets for review and appropriate action by
ACHD.
18. All public streets and drainage systems shall be designed and constructed in conformance
with District standards and policies.
19. Specifications, land surveys, reports, plats, drawings, plans, design information and
calculations presented to ACHD shall be sealed, signed and dated by a Registered
Professional Engineer or Professional Land Surveyor, in compliance with Idaho Code,
Section 54-1215.
20. The applicant shall submit revised plans for staff approval, prior to issuance of building
permit (or other required permits), which incorporates any required design changes.
21. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.

I have spoken with Tom Wright and a decision has been made to extend the sewer to the south
through Edenbrook. The design plans of the sewer through Treasure Valley Business Center
shows that there is a 12" stub heading to the east out of the manhole at Hickory and State
Avenue. The 12" should be extended to Edenbrook with an 8" stub to the east out of the
manhole at Edenbrook and State Avenue. Also, there should be an 8" stub to the east out of
the manhole at Edenbrook and Pine Street.
