The existence of a recorded final plat (two lots and a small portion of right-of--way) for Farmington Estates Subdivision No. 2 went unnoticed during the previous vacation application, hearing, and approval process involving Farmington Estates Subdivision No. 1. We understand that City Council approval of the plat vacation and/or easement relinquishments is required. Council approval of the vacation of plat for Farmington Estates Subdivision No. 2 is required prior to our submitting an application, with the Ada County Highway District (ACHD), for the vacation of Right-of--Way. Once Council approves the vacation of plat, ACHD will process the vacation of Right-of--Way for Farmington Estates Subdivision No. 2. Council's approval to vacate the relinquished easements, at a public hearing, will free the property from any easement encumbrances created by the plats. Tom Ensley, 1197 Main Street, Boise, was swum by the City Attorney. Ensley: We are requesting as noted a zone change on a piece of property. You are all perhaps familiar with the new library that is under construction East of Linder Road and East of 13`h. The property on Cherry Lane existing Library is sitting on about 2.2 acres in the midst of a residential area. You entertained and approved a rezone change on this I think it was last Fall of 1996 or 1995. The existing library facility as I said is under construction due to be completed in another month or two. There are two drive ways off of Cherry Lane that surround the (inaudible) with existing parking on the north and south of the building. The library district is looking at purchasing additional parking area. Of course which is our request tonight. Apiece of property that is just under a'/ acre, actually it is 3.9 acres. It abuts to the East of the existing library property. There are three (inaudible) to the East and one to the north. The property is L-shaped as you can see Leisure Lane is a private lane ~ to the east of this property. We are not gong to access onto Leisure Lane at all. What we are looking at is providing 21 additional parking places one of which is a handicapped parking. It will access off of this East drive way and it will be landscaped around the perimeter. The cedar fence then matches the fence that will be around the library property fence. It will be lit, it will be (inaudible) grassed with trees around as you can see around the perimeter. Then off the existing driveway a grassed area that will accommodate both the on site drainage and will serve as a garden area or a green area for the library people. So we are requesting that you approve this zone change. • Meridian Planning & Zoning Commission December 10, 1996 Page 20 the other side with the sidewalk. • Shearer: So we want to equal that out so that the sidewalk is equal distance from the property line on both sides of the street, the edge of the sidewalk or the edge of the street. As you can see, the two lots in Farmington Estates No. 2, with a dedicated roadway that serves no purpose and has no access, clearly should be vacated. The Applicant is merely going through the public hearing process to meet Ordinance and State Code requirements. Ada County Highway District also has a lengthy process for vacation, but they will not accept an application until a letter is received from the City of Meridian approving of the vacation. The Applicant's representative requested that this item be brought up in the 12/3/96 City Council meeting to enable a letter of approval to be written. In addition is the part I took it from out of the Laws & Rules Booklet. Items under heading #1 have been completed by Briggs Engineering, Inc. for our client, Mr. Bews, on 10/11/94. Items listed under #2, appear to be directed at the city that the request is being submitted. If that is the case, it appears that the following items need to be completed by your department or another department at City of Meridian, on specific dates. I will present the following scenario: # 1 Hearing dates for City Council are 1st and 3rd Tuesdays, therefore, since submittal was on 10/11/94 and could have been heard on the 3rd Tuesday in November which was missed, we will pick the next hearing date of 12/06/94. #2 10 days prior to date of public hearing, written notice by certified mail with return receipt, to all property owners within 300 feet of the boundaries of the area described in the petition (list of property owners was submitted by Briggs Engineering to City of Meridian on 10/11/94), therefore, on 11/26/94 notice must be postmarked. #3 Notice of public hearing shall also be published once a week for 2 successive weeks in the official newspaper, the last of which shall be not less than 7 days prior to the date of said hearing. The 1st notice for our application should be 11 /22/94, 2nd notice should be on 11/29/94. #4 Cost of mailings shall be charged to the petitioner. Please submit billing so that Briggs Engineering can forward billing to Mr. Bews. Extraterritorial authority -Property within the area of city impact. All plats situate within an officially designated area of city impact as provided for in section 67526, Idaho Code, shall be administered in accordance with the provisions set forth in the adopted city or county zoning and subdivision ordinances having jurisdiction. In the situation where no area of city impact has been officially adopted, all plats situate within one (1) mile outside the limits of any incorporated city shall first be submitted to the said city, and approved by the council of said city before the same shall be recorded. Items which may be considered by the city include, but aze not limited to, continuity of street pattern, street widths, and drainage provisions. If the city has adopted a subdivision ordinance and/or a comprehensive plan, then these documents may be used as guidelines for approving plats. Such city approval shall be in addition to county approval. Within one (1) mile of the city, a city subdivision ordinance shall prevail over a county subdivision ordinance unless the city and county mutually agree upon any differences. Vacation of plats -Procedure. (1) Whey any person, persons, firm, association or corporation may desire to vacate a plat or any part thereof which is inside or within one (1) mile of the boundaries of any city, it shall be lawful for such person, persons, firm, association or corporation to petition the city council to vacate. (3) When the procedures set forth herein have been fulfilled, the city council may grant the request to vacate with such restrictions as they deem necessary in the public interest. (4) When the platted area lies more than one (1) mile beyond the city limits, the procedures set forth herein shall be followed with the county commissioners of the county wherein the property lies. The county wmmissioners shall have authority, comparable to the city council, to grant the vacation, provided, however, when the platted area lies beyond one (1) mile of the city limits, but adjacent to a platted area within one (1) mile of the city, consent of the city council of the affected city shall be necessary in granting any vacation by the county commissioners. (5) In the case of easements granted for gas, sewer, water, telephone, cable television, power, drainage, and slope purposes, public notice of intent to vacate is not required. Vacation of these easements shall occur upon the recording of the new or amended plat, provided that all affected easement holders have been notified by certified mail, return receipt requested, of the proposed vacation and have agreed to the same in writing. When public streets or public rights of way are located within the boundary of a highway district, the highway district commissioners shall assume the authority to vacate said public streets and public rights of way as provided in subsection (4) of this section. All publication costs shall be at the expense of the petitioner. Designation of townsite and addition -Necessity of distinctiveness -Limitations on rule. Plats of towns, subdivisions or additions must not bear the name of any other town or addition in the same county, nor can the same word or words similar or pronounced the same, be used in making a name for said town or addition, except the words city, place, court, addition or similar words, unless the same is contiguous and laid out and platted by the same party or parties platting the addition bearing the same name, or a party files and records the written consent of the party or parties who platted the addition bearing the same name. All plats of the same name must continue the ° block numbers of the plat previously filed. [1967, ch. 429, 225, p. 1249.] 50-1308. Approvals. (1) If a subdivision is not within the corporate limits of a city, the plat thereof shall be submitted, accepted and approved by the board of commissioners of the county in which the tract is located in the • same manner and as herein provided. If the city or county has established a planning commission, then all plats must be submitted to said commission in accordance with provisions of section 50-1106, Idaho Code. No plat of a subdivision requiring city approval shall be accepted for record by the county recorder unless said plat shall have first been submitted to the city and has been accepted and approved and shall have written thereon the acceptance and approval of the said city council and bear the signature of the city engineer and city clerk. No plat of a subdivision shall be accepted for record by the county recorder unless said plat has been certified, within thirty (30) days prior to recording, by the county treasurer of the county in which the tract is located. The county treasurer shall not withhold certification for any reason except for county property taxes due, but not paid, upon the property included in the proposed subdivision.
