consideration as conditions of the Applicant during the hearing process:

This annexation request is for the Kent and Mary Barney property that is surrounded by City
residential development. Mr. and Mrs. Barney agreed to the annexation so the property is no

FINDINGS OF FACT AND CONCLUSIONS OF LAW
The above entitled annexation and zoning application having
come on for consideration on January 9, 1996, at the hour of 7:30
o'clock p.m. on said date, at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, and the Commission having heard and taken
oral and written testimony and the Applicant appearing through his
representative, Steve Bradbury, and having duly considered the
matter, the Planning and Zoning Commission makes the following:
FINDINGS OF FACT
1. That notice of public hearing on the annexation and
zoning was published for two (2) consecutive weeks prior to the
said public hearing scheduled for January 9, 1996, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the January 9, 1996,
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
made available to newspaper, radio and television stations.
2. That the property included in the application for
annexation and zoning is described in the application, and by this

reference is incorporated herein; that the property is 0.95 acres
in size; it is located 1/2 mile south of Ustick Road and 1/4 mile
west of Ten Mile Road on a portion of the Southeast Quarter of
Section 3, T.3N., R.1W of Cherry Lane Village No. 5 Subdivision.
3. That the property is presently zoned by Ada County RT
(Rural Transition); that the Applicant requests that the property
be zoned R-4; that residential development land exists on all sides
of this proposed project.
4. This 0.95 acres will be combined with the presently
approved Cherry Lane Village No. 5 Subdivision.
5. That this zoning is desirable at this location as this
property is situated next to City annexed lands and is planned for
being combined with the presently approved Cherry Lane Village No.
5 Subdivision.
6. That this zoning request and annexation will comply with
the Meridian Comprehensive Plan.
7. That the owners of record are Rent and Mary Barney and
they have requested the annexation and consented to the
Application.
8. The Applicant's representative, Steve Bradbury, testified
that this annexation might be described as a "clean-up" matter;
that this little parcel of ground was simply left out by Applicant
of previous annexation applications.
9. That there was no public testimony.
10. That the Planning and Zoning Administrator, Shari Stiles,
the Assistant City Engineer, Bruce Freckleton, the Meridian Police

Department, Meridian Fire Department, Central District Health
Department and the Nampa & Meridian Irrigation District submitted
comments regarding this application and such comments are
incorporated herein.
11. Ms. Stiles commented that this property is surrounded by
City residential development; that Mr. and Mrs. Barney agreed to
the annexation so that the property is no longer an enclave; that
hookup to City sewer and water should be accomplished and the
existing well used for landscape irrigation only.
12. The Assistant to the City Engineer, Bruce Freckleton,
commented that the legal description submitted meets all of the
criteria required by the City of Meridian and the Idaho State Tax
Commission for annexation; that the Applicants shall supply the
City Clerk's office a map that accurately depicts the parcel being
annexed and shall include all of the bearings and distances as well
as ties to the government corners described in the legal
description.
13. That the R-4, Residential District is described in the
Zoning Ordinance, 11-2-408 B. 3. as follows:
(R-4) LOW DENSITY RESIDENTIAL DISTRICT: The purpose of
the (R-4) District is to permit the establishment of low
density single-family dwellings, and to delineate those
areas where predominantly residential development has, or
is likely to occur in accord with the Comprehensive Plan
or the City, and to protect the integrity of residential
areas by prohibiting the intrusion of incompatible non-
residential uses. The (R-4) District allows for a
maximum of four ( 4 ) dwellings units per acre and requires
connection to the Municipal Water and Sewer systems of
the City of Meridian.;
that the R-4 zoning district requires 1,400 square foot minimum

homes in the R-4 zone; that in annexation the City may, as a
condition of annexation, require a higher minimum house size than
1,400 square feet.
14. That the Findings of Fact adopted when the land included
in Cherry Lane Village No. 5 Subdivision was annexed and zoned and
are incorporated herein as if set forth in full.
15. That proper notice was given as required by law and all
procedures before the Planning and Zoning Commission were given and
followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met; including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicant's
property.
2. That the City of Meridian has authority to annex land
pursuant to 50-222, Idaho Code, and Section 11-2-417 of the Revised
and Compiled Ordinances of the City of Meridian; that exercise of
the City's annexation authority is a Legislative function.
3. That the Planning and Zoning Commission has judged this
annexation and zoning application under Section 50-222, Idaho Code,
Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, the
Meridian Comprehensive Plan, as amended, and the record submitted
to it and things of which it can take judicial notice.
4. That all notice and hearing requirements set forth in
Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of

Meridian have been complied with.
5. That the Commission. may take judicial notice of
government ordinances, and policies, and of actual conditions
existing within the City and State.
6. That the annexation application has been initiated by the
owners and the annexation is not upon the initiation of the City of
Meridian.
7. That since the annexation and zoning of land is a
legislative function, the City has authority to place conditions
upon the annexation of land.
8. That the annexation application has been initiated by the
Applicants, which are the titled owners; that the annexation is not
upon the initiation of the City of Meridian.
9. That the development of annexed land must meet and comply
with the Ordinances of the City of Meridian and in particular
Section 11-9-616 which pertains to development time schedules and
requirements and 11-9-60.5 M, Piping of Ditches; that the
development of the property shall be subject to and controlled by
the Subdivision and Development Ordinance; that as a condition of
annexation, the Applicant, or if required, any assigns, heirs,
executors or personal representatives, shall pay, when required,
any development fee or transfer fee adopted by the City.
10. Therefore, based on the Application, the testimony and
evidence, these Findings of Fact and Conclusions, and the
Ordinances of the City of Meridian it is ultimately concluded that
Applicant's property should be annexed and zoned R-4; that the
FINDINGS OF FACT AND CONCLUSIONS OF LAW - BARNEY

conditions should be those stated above and upon issuance of final
platting and other conditions to be explored at the City Council
level; that such annexation would be orderly development and
reasonable if the conditions are met; that the property shall be
subject to de-annexation if the requirements of these Findings of
Fact and Conclusions of Law are not met.
11. That since Steve Bradbury, Applicant's representative,
commented that this land was simply left out by Applicant of
previous annexation and zoning applications for Cherry Lane Village
No. 5 Subdivision and it is found that the Findings of Fact for
Cherry Lane Village No. 5 Subdivision are incorporated herein, the
Conclusions of Law for Cherry Lane Village No. 5 are incorporated
herein as if set forth in full.
12. That all ditches, canals, and waterways required to be
tiled by City Ordinance shall be tiled as a condition of annexation
and if not so tiled the property shall be subject to de-annexation.
13. With compliance Af the conditions contained herein, the
annexation and zoning or R-4, Low Density Residential District
would be in the best interest of the City of Meridian.
14. That if the conditions of approval are not met the
property shall be subject to de-annexation.

Bradbury: Mr. Chairman and members of the Commission. This item and the next item are
annexation which are really I think what I might describe as clean up matters. They were
little parcels of ground that were, at least the next one is a little parcel of ground that was
inadvertently left out of a previous annexation approval by the City for I believe it was the
Lake at Cherry Lane No. 3. Mr. and Mrs. Bamey's property is immediately adjacent to that
other piece and it was also intended to be annexed by the City in connection with the
previous application and simply got left out through inadvertence or some other mistake.
Beyond that I don't have anything in addition to tell you and I would be pleased to respond
to questions if I can.

Mike Weutzel, 310 South Harding, Boise, was sworn by the City Attorney.
Weutzel: We would like to get the conditional use permit transferred into our name. I am
a partner with Candace in the purchase of the property. We are going to continue to use
the place as a day care and we are really not going to change much other than a little paint
and spruce things up a little bit. Also take care of, there are some requirements that the
Fire Department wants us to do with the doors and a few other miscellaneous things and
also some Central District Health requirements that we need to complete before we can
start operating. Other than that, like I said we just'want to continue to use the property as
a day care center just like it has been.
Crookston: Do you have you Central District Health or Health and Welfare day care
license?
Weutzel: Yes, currently we have a day care on Cherry lane up the street 11th and Cherry
lane. What we have intentions of doing is this is a larger facility is moving our operation
down to this facility.
Crookston: You will be closing the other one?
Weutzel: That is still kind of up on the air, we have talked about some office space, we
have talked about selling that. piece of property and we are really not quite sure what we
are going to do with it yet. Also Candace has also talked about operating the current
center that is on Cherry Lane now is kind of a baby centerwith just very small children and
then the bigger center on Crestmont for the older kids like age 3 and up to after school.

STORMWATER MANAGEMENT RECOIVIlVIENDATIONS
We recommend that the first one half inch of stormwater be pretreated through a
grassy swale prior to discharge to the subsurface to prevent impact to groundwater
and surface water quality. The engineers and architects involved with the design
of this project should obtain current best management practices for stormwater
disposal and design a stormwater management system that is preventing
groundwater and surface water degradation. Manuals that could be used for
guidance are

CITY OF MERIDIAN ANNEXING AND ZONING CERTAIN
IS DESCRIBED AS A PORTION OF THE E 1/2 of
1 W., B.M., ADA COUNTY, IDAHO; AND PROVIDING
WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest of
said City to annex to the said City real property which is
described in Section 1 below:
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council
of the City of Meridian, Ada County, Idaho:
Section 1. That the real property described as:
A parcel of land being a portion of the Southeast Quarter
of Section 3, T.3N., R.1W., B.M., Meridian, Ada County,
Idaho and more particularly described as follows:
Beginning at a Brass cap marking the Southeast corner of
the Southeast Quarter of the Northeast Quarter of Section
3, T.3N., R.1W., B.M., Meridian, Ada County, Idaho:
thence along the Southerly boundary of the said Southeast
Quarter of the Northeast Quarter of Section 3, which is
also the Northerly boundary of Cherry Lane Village No. 5
Subdivision as filed for record in the office of the Ada
County Recorder, Boise, Idaho, in Book 69 of Plats at
pages 7033 and 7034, North 88°55'29" West 1051.00 feet to
an iron pin, said iron pin being the REAL POINT OF

is hereby annexed to the City of Meridian, and is zoned R-4
Residential; that the reason for the R-4 zoning is to allow the
residence that is already constructed on the premises to be
consistent with the surrounding property which is R-4 single family
dwelling units; that the annexation and zoning is subject to the
conditions referenced in the Findings of Fact and Conclusions of
Law as adopted by the Meridian Council; that all ditches, canals
and waterways shall be tiled including those that are property
boundaries or only partially located on the property.
Section 2. That the property shall be subject to de-
annexation if the owner changes the lay out of the property or by
adding any residence to the property, have water and sewer line
extended to serve the property and connect the residence to the
Meridian Sewer and water if both have not already been done,
dedicate any roadways which provide public access to the residence
to the Ada County Highway District if not already done so, meet the
requirements and conditions of the Findings of Fact and Conclusions
of Law and of this Ordinance; if Applicant fails to meet these
conditions the property shall be subject to de-annexation, which
conditions subsequent shall run with land and also be personal to
the owner.

Section 3 . That the City Clerk shall cause one (1) copy of
the legal description, and map,. which shall plainly and clearly
designate the boundaries of said property, to be filed with the Ada
County Recorder, Ada County Assessor, and the State Tax Commission
within ten (10) days following the effective date of this
Ordinance.
Section 4. EFFECTIVE DATE: There being an emergency,
which emergency is hereby declared to exist, this Ordinance shall
be in full force and effect from and after its passage and approval
as required by law.
PASSED by the City Council and approved by the Mayor of the
City of Meridian, Ada County, Idaho, this 2nd day of April, 1996.
