FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
February 13, 1996, at approximately 7:30 o'clock p.m. on said date,
at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho,
and the Applicant appearing through his representative, Jerry
Ellis, and having heard and taken oral and written testimony, and
having duly considered the matter, the Meridian Planning and Zoning
Commission makes the following:
FINDINGS OF FACT
1. That notice of the public hearing on the vacation of the
sewer and water easement was published for two (2) consecutive
weeks prior to the said public hearing scheduled for February 13,
1996., the first publication of which was fifteen (15) days prior to
said hearing; that the matter was duly considered at the February
13, 1996, hearing; that the public was given full opportunity to
express comments and submit evidence; and that copies of all
notices were available to newspaper, radio and television stations.

2. That this property is located in the Futur.-Ida
Subdivision in the Southeast 1/4 of Section 12, T.3N., R.1W., Boise
Meridian, Ada County, Idaho, and is owned. by Sundance Imrestments
Limited Partnership.
3. That the Applicant requests a vacation of the sewer and
water easement which easements were reconfigured on this particular
property; that both water and sewer lines were relocated on the
site so as not to conflict with the expansion of the building being
occupied by the Friedman Bag Co.
5. That the property is currently zoned I-L, Light
Industrial District.
6. That the Light Industrial District is defined in the
Zoning Ordinance at 11-2-408 B. as follows:
(I-Lj Light Industrial: The purpose of the (I-L) Light
Industrial District is to provide for light industrial
development and opportunities for employment of Meridian
citizens and area residents and reduce the need to commute to
neighboring cities; to encourage .the development of
manufacturing and wholesale establishments which are clean,
quiet and free of hazardous or objectionable elements, such as
noise, odor, dust, smoke or .glare and that are operated
entirely or almost entirely within enclosed strictures; to
delineate areas best suited for industrial development because
of location, topography, existing facilities and relationship
to other land uses. This district must also be in such
proximity to insure connection to the Municipal Water and
Sewer systems of the City of Meridian. Uses incompatible with
light industry are not permitted, and strip development is
prohibited.
7. That Bruce Freckleton, the Assistant to the City
Engineer, the Police and Fire Department and the Nampa i Meridian
Irrigation District, submitted comments and such are incorporated
herein as if set forth in full.
8. That comments from the Planning and Zoninq Director,

Shari Stiles are forthcoming and shall be incorporated as if_ set
forth in full, if received.
9. That there was no public testimony objecting to the
vacation of easements.
10. That proper notice was given as required by law and all '
procedures before the Planning and Zoning Commission were given and
followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian and of
Idaho Code, Section 50-1306A have been met. '
2. That the City. of Meridian has authority to vacate
easements pursuant to Idaho Code, Section 50-1306A and Section 11-
9-611A, Vacations and Dedications, of the Revised and Compiled
Ordinances of the City of Meridian.
3. That since the Public Works Department has approved plans
and construction for the relocation of the existing sewer and water
mains of the proposed site and the legal descriptions and
supporting documentation for the vacation have been reviewed and
approved by the Public Works Department, and since there is no
objections to the vacation of the easements, the easements should
be vacated.

Johnson: That is a good point.
Rackham: One other concern and I want to get with the developer myself or Wayne who
is working with that on it, the Franklin Road property that I refer to 305 West Franklin, I
don't know what considerations are necessary for emergency or safety in and out of that
or between the properties. But, recently I was on West 7th and while I was on the street
problems developed with a fire and I had to go clear out around down to Linder Road and
out before I could get out of there because the Fire Department closed that off. With this
property behind I didn't see any addressing of that to speak of and if there is than I would
like to be made aware of that or what the plan for that is.
Johnson: I appreciate your comments and this will be incorporated in our minutes and will
be available for us at the next meeting and also for the City Council. Is there anyone else?

Johnson: I will now open the public hearing and invite the applicant or his representative
to come forward.
Jerry Ellis, 502 Aurora Drive, Nampa, was sworn by the City Attorney.
Ellis: Mr. Chairman and Commissioners the vacation that we are requesting is in regards
to a sewer and water easement that sewer and water easement was reconfigured on this
property. The water line and sewer line were both moved and we are just asking for a
vacation of the existing easement or excuse me the proceeding easement.
Johnson: Thank you very much. Anyone have any questions? Is there anyone else that

Johnson: That is a good point.
Rackham: One other concern and I want to get with the developer myself or Wayne who
is working with that on it, the Franklin Road property that I refer to 305 West Franklin, I
don't know what considerations are necessary for emergency or safety in and out of that
or between the properties. But, recently I was on West 7th and while I was on the street
problems developed with a fire and I had to go clear out around down to Linder Road and
out before I could get out of there because the Fire Department closed that off. With this
properly behind I didn't see any addressing of that to speak of and if there is than I would
like to be made aware of that or what the plan for that is.
Johnson: I appreciate your comments and this will be incorporated in our minutes and will
be available for us at the next meeting and also for the City Council. Is there anyone else?
Okay we will adjourn this public hearing then until March 12, we need a motion to that
effect.
Shearer: I move we defer this to March 12.

Ellis: Mr. Chairman and Commissioners the vacation that we are requesting is in regards
to a sewer and water easement that sewer and water easement was reconfigured on this
property. The water line and sewer line were both moved and we are just asking for a
vacation of the existing easement or excuse me the proceeding easement.
Johnson: Thank you very much. Anyone have any questions? Is there anyone else that

be aligned with the fence as approved in #1. South of these two lots is the Eight Mile
Creek, and then they could go back to the 20 foot planting strip beyond there. But it really
doesn't make any sense to have a 20 foot planting strip on these two lots, at least the
alignment of the fence should be only 10 feet.
Corrie: Any further comment from Council or questions? Hearing none I will entertain a
motion for the final plat.
Morrow: Mr. Mayor, I would move that we approve the final plat for Salmon Rapids No. 3
subdivision subject to all staff conditions, P & Z conditions, ACHD and Nampa Meridian

Jerry Ellis, 9520 Fairview Avenue, Boise, was sworn by the City Attorney.
Ellis: The request for vacation is in regards to a development on Taylor Street. We were
asked as a condition of approval for a building permit to move an existing sewer and water
line. That was accomplished bads in, I am close on the dates, July or August of last year.
Since that time we have been going through this procedure to finalize the vacation of the
existing easement that has been granted originally for that sewer and water line. The
easements have been recorded the water and sewer lines have been moved and we are
just asking to complete the vacation.

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
The Public Works Department has approved plans and construction for the relocation of the
existing sewer and water mains on the proposed site. The mains were relocated so as not to
conflict with an expansion of the building being occupied by the Friedman Bag Co.. The legal
descriptions and supporting documentation for the vacation have been reviewed and approved
by Public Works Department.
