Re: Inspection of Children's Unique Style Day Care Center
Date: 09-27-96
On September 11, at approximately 4:00 p.m., I conducted an inspection, in conjunction with
the Meridian Fire Dept. of the Children's Unique Style Day Care Center located at 1915 W.
Cherry Lane. This inspection was in regards to the facility's Conditional Use Permit.
The office area is located in the front main room and is not physically separated from areas
occupied by children. There are objects such as scissors, staplers, and paper clips which could
be a hazard to children. A circuit breaker panel had the cover removed exposing 110 volt and
220 volt wires within reach of children. In the infant sleep room a crib was placed against the
west wall approximately 1 1/2 feet below the window. On the window sill a radio with the
electrical cord running down the wall just outside the crib was plugged into an electrical outlet.
Carpets throughout the center were stained and appeared very dirty. A bookshelf approximately
6 feet tall had children's toys, games and stacks of other papers on every shelf including the very
top. The bookcase was not secured to the wall and I was able to rock the bookshelf with
minimal effort. A child climbing on the shelf to reach a toy or game could cause the bookshelf
to fall. Outside, children were seen drinking out of a hose held by one of the staff. Hoses are
suspectable to cross -connection and can become contaminated.
During the inspection the Fire Dept. found smoke detectors inoperable in both sleep rooms.
Windows in both sleep rooms were higher (47") than the required 44" for fire exists. In the
front sleep room a wood cabinet had been installed directly under both windows which would
hinder children exiting through the windows during an emergency. Also in the west window of
the front sleep room a fan was installed on the outside of the building which would have blocked
the use of this window as an escape. A floor plan of the center was posted by the front door but
no escape routes were shown.
At the conclusion of the inspection, I provided Peggy Jenkins with a letter (attached) stating that
the City of Meridian would hold a hearing to determine the status of Children's Unique Style
Child Care Center's Conditional Use Permit. The letter stated that as a condition of the permit,
the center was to provide a copy of a State of Idaho Day Care License and copies of Day Care
Permits for each of the day care providers. On August 26, 1996, the City requested copies of
the required license and permits or a letter from the Dept. of Health and Welfare stating that the
required documents had been applied for and that they be received within ten (10) days. The
City did not receive the requested information.

A Conditional Use Permit to operate a Day Care Center within the City of Meridian requires a
current state license and operator license issued by Idaho Dept. of Health and Welfare.
According to the City of Meridian records we have not received a copy of Children's Unique
Style state day care license.
On August 26, your facility was inspected and a request was made to see your state license and
operator license for each day care provider employed at your facility. You stated that you were
in the process of obtaining your license. A written request was made at this time to provide the
City of Meridian a copy of your state license and day care permits for each day care provider
or a letter from Dept. of Health and Welfare stating that you were in the process of obtaining
the appropriate permits. These items were to be received by the City of Meridian by September
5, 1996.
As of September 11, 1996, the City of Meridian has not received a copy of the required
documents. Due to your failure to provide the required documents, the City of Meridian is
hereby notifying Children's Unique Style that revocation proceedings will be held in 15 days on
September 26, 1996. You may present information at this hearing to the City Council as to why
your Conditional Use Permit should not be revered.

PERMIT FROM KIDZ CONNECTION TO CHILDREN'S UNIQUE STYLE:
Corrie: I will open the public hearing at this time and ask that the applicant come forward.
Steven Jenkins, 7200 Southdale, Boise, was sworn by the City Attorney.
Jenkins: We are requesting a transfer of conditional use permit from an existing day care
center to new ownership and a new name.
Rountree: You would be the operator under the new ownership and new name?
Jenkins: My wife is the operator.
Rountree: The conditions under the previous conditional use are acceptable to you, you
have seen them?
Jenkins: Yes and yes.
Corrie: Anybody else from the public that would like to issue testimony at this time.
Council, discussion?
Morrow: Mr. Mayor I have a question of Mr. Gary Smith with respect to Bruce Freckleton's
comment. Sanitary sewer and water services to this facility is from an existing service line.
The past years water meter records for this facility indicate the use is slightly higher than
was anticipated when the assessments were calculated for Children's Unique Style. The
heavier usage is less than 1 additional equivalent residential unit. Therefore no adjustment
will be applicable at this time. Could you comment on that. The other other day cares we

have done tonight required the 2 fesidential equivalent units. That doesn't seem to be
appropriate in this case.
Smith: Just looking at it strictly from their water usage only it is a policy of the City Council
to require, is this an in home day care use or is this a commercial building? I don't know
right off hand. If it is a commercial building if it is set up for a day care use then we would
go by the water usage. If it is a residential building then the policy in the past has been
that yes there is an additional assessment that is made to a residence being used as a
business.
Morrow: Could we have the applicant maybe answer that please?
Jenkins: The home was originally a residential home and it has been turned into a
commercial day care center. There is no residence living at that site.
Morrow: So then everything would be based on the commercial rates is that right?
Smith: Yes sir it would work against the water usage as far as the assessment is
concerned.
Morrow: I have no further questions.
Rountree: Would that be clear in the conditional use that exists?
Smith: I am sorry?
Rountree: The commercial rate for water and sewer, would that be clear in the conditional
use permit that currently exists?
Smith: Well their request is that they enter into an assessment agreement so that we can
monitor their water usage for a period of time for 12 months and then we will make an
adjustment if that is the case up or down. The rates that we charge are the same as
residential, we don't have a commercial rate that is variance from the residential.
Corrie: Any further discussion?
Bentley: Which rate would the trash fall under?
Smith: I have no idea Councilman, I don't know.
Morrow: It would be commercial if it is a commercial building.

permit.

Corrie: Not on a transfer. All those in favor? Opposed?

Smith: Mr. Mayor may I ask a question on procedure, when a conditional use permit is
issued or transferred and there are conditions attached to that, how do we myself the
public works department know that these conditions are being adhered to. Is there a paper
that is issued for the conditional use permit. For instance on the last one there is an
additional assessment that is being charged what brings that applicant into door of public
works department to pay for that additional assessment. Also on this this applicant needs
to come to the public works department and sign a reassessment agreement as part of
your approval conditions. What makes those people follow through and do that.
Morrow: Well I would think the conditional use permit wouldn't take effect until those
provisions have been complied with. In other words we notify them by letter of what it is
that has to happen in order for the conditional use to become effective.
Smith: That is the thing that I don't know, I don't know what happens to a conditional use
permit. Is it actually a piece of paper that has conditional use permit written on it that says
it has been granted to the applicant and signed by the Mayor for the Council or signed by
the City Clerk for the Council. I just need to know I guess so I know that these conditions
are adhered to by the applicant through the public works department particularly but
through any of the other city departments also.
Rountree: Great question.
Corrie: I don't think that we do.
Berg: I know what the accessory use application is dealt with that is dealt with the P & Z
Administrator and that is just on letterhead authorizing that they have an accessory use.

I haven't really seen any CUP's in my file but I will research that out. At least research and
see what kind of a procedure we had before and report back to you. If we need to change
it starting working on (inaudible)
Crookston: I have never had to deal with that because I have not gone that far with it. But
there should be a written document that says that they are granted a conditional use and
on a transfer that they should come back in and a letter to that effect needs to be stated
also. And that if it is -to be conditioned upon for transfer for the prior findings of fact that
should be stated on that letter.
Corrie: That would also be along with the reassessment agreement and evaluation should
be on that too. We can certainly do a letter up to that effect and let the Council review it
too it that be the desire. Do you want the Planning and Zoning Administrator to write a
letter or do you want the Mayor to (inaudible)
Crookston: It should be by the Mayor, the Accessory Use can be done by the Planning and
Zoning (inaudible)
Smith: Mr. Mayor, excuse me again, would we need the zoning enforcement officer to
verify that the applicant's aren't in operation without that letter?
Crookston: I think that should be done yes.
Smith: I am just afraid as busy as we all are that and I am not thinking that the applicant's
would do this on purpose, but they could walk out the door and go back to business as
usual and nothing would ever happen as far as a follow up is concerned to make sure the
conditions are, your conditions of approval are being met. Such as the reassessment
agreement and payment of additional connection fee. I really don't know what those
mechanisms should be like I am just, I just feel as though something is dropping through
a crack here.
Morrow: Let me offer this suggestion and maybe we need to get moving on here but the
way you deal with this is that under normal circumstances with conditional uses or any
other type of action there is an appeal period. We may or may not have that. The point
is that generally speaking the head of the P & Z department is the one that signs and
makes the notification to the applicant that the conditional use for example is affective ten
days hence and was passed by the Council on May 7th subject to these conditions that
you must meet. It will be effective at the end of the appeal period which might say for
example May 17th. At that point in time after having met these conditions then you can
begin your business. Now under normal circumstances. it is something along that line that
is done with respect to conditional use permits. So the process is fairly simple. Maybe we

don't have the capability of doing that. If we don't then we need to acquire that capability
so that staff knows what has to happen, the applicant at the point of making the application
and going through the process understands what has to happen before they can start up.
So I think that if we don't have any of those things in place right now that we need to adjust
our procedure so that they are all in place so everybody has a fair chance of knowing what
is expected of them.
Smith: Thank you
Morrow: So I guess to finish the thought out is that we can have Wayne and Will research
if we have that capability now or let's find out what it is we have got. Then we implement
the procedure. If we need to modify it then we will cover it at a strategic planning session
and get it committed by ordinance or whatever it takes to get it done.
Crookston: It would created as of the Council action, people have 30 days to file an
appeal, but the approval would be effective as of the date that the conditional use was
granted unless we put in there that it is granted upon the issuance of a letter from either
the City Clerk or the Planning & Administrator.
Morrow: Well I think it makes certain sense to, if you grant somebody the opportunity to
press ahead with something than an appeal comes through. Then what do you do tell
them to stop?
Crookston: Yes, if that is part of it, but it is granted unless an appeal is filed of the granting
or if it is denied an appeal is filed because of the denial.
Morrow: Well that is something that we can deal with at a later time.

Corrie: I will open the public hearing and invite the representative from Railside
Subdivision.
Morrow: Before we press on with this hearing, I do want to ask the Council, I am a titled
owner of a parcel that was bought in Layne Industrial Park which was also developed by
the Yanke group. I would ask the Council whether they see that to be a conflict or not in
hearing of this issue and if so then I will stand down.

I am writing to inform you that it is our understanding that your child care center is still operating
illegally, i.e. without a valid state Basic Child Care License issued to you by the Idaho Department
of Health and Welfare.
To be included in Child Care Connections' referral database, you must hold a current, valid license
and have less than three complaints registered on your facility during a twelve month period. I
also want to inform you again that since the beginning of June 1996 we have received four
separate complaints from parents about the quality of care at your facility. The complaints are as
follows:
1) 6/4/96 Parent reported to Child Care Connections when she visited Children's Unique Style
she observed all children in the TV room. The director was abrupt and had no interaction with
this parent's child. A caregiver pulled a child by the foot to keep him in the room. The infant
room was dark, a baby crying, door shut. Baby awakened, no-one around, another baby propped
in bean bag chair with bottle in a hallway. Carpets unclean.
2) 6/17/96 Child had bruised eye, other scratches and bruises on back, no notification to parent.
When questioned, director said child was playing. Children unsupervised on playground. Two
teenage girls on playground not interacting with children. Infant in seat near edge of counter in
danger of falling.
3) 6/21/96 Carpets very dirty, looked like urine stain. Coffee table with sharp corners, trinkets
inappropriate for children. Parent was shown the "two/three year old playroom" which was a
small bedroom with a curtin down the middle, cribs on one side (told it was the infant area) and
two old wooden school desks on the other.
4) 6/27/96 School age child told parents that during two hour nap for younger children, older
children not allowed inside even for water or bathroom. Poor supervision by teenagers; child

says they are mean, don't allow children to use equipment or get drinks from the hose. Director is
gone leaving teenagers in charge.
We urge you call the Department of Health and Welfare immediately, 334-6800, ask for a
licensing packet and complete all necessary steps to make your facility a legally operating
business.
After you are in compliance with licensing, you can apply to become an eligible vendor for the
Idaho Child Care Program (ICCP) and JOBS programs. This is a separate application process
done through Child Care Connections. Until that additional application and documentation
process is complete, and you are approved, families on ICCP with children at your facility are not
eligibile for payments. Child care subsidies for low income families are essential for them to
afford child care and should be part of your financial planning.

I have reviewed this submittal and offer the following comments, for your information and
consideration as conditions of the Applicant during the hearing process:
1. Sanitary Sewer and Water service to this facility is from existing service lines. The past
years water meter records for this facility indicate that the usage is slightly heavier than
what was anticipated when assessments were calculated for Children's Unique Style. The
heavier usage is less than one additional equivalent residential unit, therefor, no adjustment
will he applicable at this time. Applicant will be required to enter into a re -assessment
agreement with the City, with a re-evaluation period of 12 months of actual usage.

T. DEFINITIONS:
1. Day care: Iay care means care and supervision
provided for compensation during part of a twenty-
four (24) hour day, for a. child or children not
related by blood or marriage to the person or
persons providing the care, in a place other than
the child's or children's own home or homes.
2. "Child" means a person less than twelve (12) years
of age.
3. "Day care center" means a place or facility
providing day care for compensation for thirteen
(13) or more children..
Note: Day care centers are required to license.
4. "Group day care zacil.i.ty" means a home, place, or
facility providing day care for seven (7) to twelve
(12) children.
Note: Group day care facilities are required to have
a fire inspection but not a license.
5. "Family day care home" means a home, place, or
facility providing day care for six (6) or fewer
children.
Note: Family day care homes are not required to have
a license or fire inspection.
6. "Licensing Authority" is the Idaho Department of
Health and Welfare.
Note: The minimum standards as outlined in the state
day care licensing act will not preempt any local
ordinance that is more stringent.
