The applicant is Advantage Auto Sales, Inc., an Oregon Corporation, dba Auto Finance America, to be located on the premises at south 231 E. 1st St., Meridian, Idaho, currently located at 80 Centennial Loop, Eugene, Oregon, 97401, 1-800-659-0648 (hereafter "Applicant"). 2. The current owner of the property is Zamzow, Inc., an Idaho Corporation, 4741 Glenwood Ave., Boise, ID 83714, 2f~-375-0022 (hereafter "Oavner"). 3 . The legal description of the property is attached as exhibit A to the warranty deed, which itself is attached as exhibit 1 to this application. The property described by such legal description shall hereafter be referred to as the "Premises". 4. The Premises has been vacant since November, 1995, and to the best of Applicant's knowledge no variance nor conditional use permit has ever been issued with respect to the Premises. 6. The Premises is presently vacant. 7. Applicant proposes to use the Premises in and for the same purposes as the prior tenant, Meridian Ford, Inc., as an automobile and truck sales lot and as an automobile repair shop. APPLICATION FOR CONDITIONAL USE PERIVIIT - 1 8. The Premises is presently zoned C-G, according to the updated county zones provided by the Ada County Zoning Commission, dated 1-10-89, page 13 of the Official Zoning Maps of Meridian, Idaho. 9. Vicinity maps required by §2-418 are attached to this application as exhibit 2. 10. The Premises currently has improvements on it consistent with use as an Automobile Sales lot and automobile repair shop. These improvements were constructed long before zoning ordinances were effective over the Premises, and were used for many years by Meridian Ford, Inc., as its primary sales lot and warranty and repair shop. Because of such long term use, the Premises is essentially already developed for the use proposed by Applicant, and the uses of surrounding properties are consistent with the proposed use of the Premises. Certainly the Les Schwab tire sales and service center immediately south of the Premises is compatible with the proposed use, and in fact such uses complement each other. Other surrounding commercial uses, consisting of J & J recreation sales (Snowmobiles), the Meridian Speedway, also complement the proposed use of these Premises. 11. The documents attached as exhibit 3 to this application are records obtained from the Ada County Recorder's office by Alliance T'ttle Company which reflect the 33 record owners of all property within three hundr~ feet (300') of the external boundaries of the land being considered. Only the Owner of the Premises, Zamzow, Inc., is within the area being considered for a conditional use permit. 12. APPLICATION FOR CONDITIONAL USE PERMIT - 2 • • AMENDMENT TO APPLICATION FOR CONDITIONAL USE PERMIT In further support of the application for conditional use permit of Applicant Advantage Auto Sales, Inc., an Oregon Corporation, dba Auto Finance America, dated the 22nd day of March, 1996, Applicant provides the following additional information: 14. Applicant for this Conditional use permit is being joined by co-applicant Zamzow's, Inc., an Idaho Corporation (hereafter "Co-applicant") and Owner of the Premises, who should be named in the Permit issued as co-applicant and co-holder of such Conditional Use Permit; 15. Applicant is applying for conditional use only of the easternmost two hundred fifty feet (250') and the southernmost two hundred feet (200') of the Premises described in its original application. The building currently on the Premises is one hundred thirty feet (130') by sixty feet (60'), and the landscaping strip as required by the City of Meridian shall be twenty feet (20') in width (including a five foot (5') sidewalk) along the easternmost side of the Premises two hundred feet, leaving a net asphalt square footage of thirty eight thousand two hundred square feet (38,200 sq. Ft.) (50,000 - 4,000 - 7,800), thereby requiring the 25 trees proposed in the site plan submitted with this amendment as exhibit A (38,200/1500 = 25.467). 16. Two parking spaces are provided for handicapped parking as shown on the site plan, and include adjacent eight foot (8') access aisles as required. Such parking spaces shall be striped and marked by the appropriate signage as required. 17. Despite the fact that landscaping will not be uniform along the entrance corridor due to current conditions on other properties along the corridor, Applicant and co-applicant propose to remove asphalt, resurface a five foot (5') wide sidewalk, to place underground sprinklers along the two hundred foot (200') frontage to East 1st. Street, to lay sod fifteen feet (15') wide along the same frontage and to place trees at twenty foot (20') intervals along such corridor to enhance the aesthetics of this approach into the City of Meridian, pursuant to the site Plan. The remaining trees shall be planted as shown on the site plan. 18. The trash receptacle for the Premises shall be located immediately behind the building currently existing on the Premises, surrounded by a filled chain link fence. The location was chosen for maximum concealment from view along the entrance corridor. AMENDMENT TO APPLICATION FOR CONDITIONAL USE PERNIIT - 1 • • 19. The sales lot shall be striped roughly as shown on the site plan. Even in an extremely busy vehicle sales lot, there are rarely more than a total often (10) salesmen and customers on the lot at any one particular time. However, due to contemplated further use as a service and repair facility, striping is included for such parking. 20. Due to the fact that the Premises do not include access to Meridian Street, such access is not demonstrated on the site plan. Access from East 1st Street include two (2) existing curb cuts as shown. The Premises for which Conditional Use is sought does not include any square footage not already asphalted, and thus the requirement to pave the west end of the lot, outside of the Premises for which conditional use is sought, is moot. I am bringing this application on behalf of co-applicants Advantage Auto Sales Inc. and Zamzows Inc. We have received and reviewed the findings of fact and conclusions of law of the Planning and Zoning Commission. We would have some comments regarding the landscaping strip width and the sidewalk and other concerns with the landscaping and the Council is probably aware from the findings of fact and conclusions of law that is the main problem that we have with Ms. Stiles and the Planning and Zoning Commission. We have not been able to resolve this yet. I did have a meeting with Ms. Stiles and I understand what here position is now with respect to the landscaping. When we presented our arguments and our facts before the Planning and Zoning Commission we did discuss the fact that we wanted to match the dimensions of landscaping immediately to the south of the site which is the Les Schwab Tire Center. Now I hope the Council understands that what we are attempting to do here is take a car sales lot and change it into a car sales lot. It was pretty difficult to explain to our client why it is necessary to get a conditional use permit to continue the use of something that has been used as a car sales lot for several years. But having done that and having presented argument to the Planning and Zoning Commission we are a little bit disturbed at the findings of fact and conclusions relating to the landscaping. There is approximately 92 feet of property between East First Street and the front of the Old Meridian Ford sales building. There are transport trucks that are approximately 75 feet long that bring vehicles into sales lots. My client informs me that they have a turning radius of approximately 100 feet. That is one of the concerns that we have about the landscaping. All of those things add aesthetically to the coming in and out of our City. I think this is an excellent opportunity of the City of Meridian and probably the only opportunity obviously that we have had come up where we can do something with that eye sore. I think our feeling is at least mine personally that it can be worked out with Shari and we don't have to hold to the exact 20 feet and I realize that is in opposition to our ordinance and perhaps the desires of our Planning and Zoning Administrator. But with the extra amenities put in for lack of a better term I believe the public viewing that is not going to notice the discrepancy in width. I think this is a good opportunity for us to improve that total length and we should strongly consider doing that. I don't know if that is the answer that you wanted. That the zoning of General Retail and Service Commercial, (C-G) is defined in the Zoning Ordinance at 11-2-408 B. 11. as follows: (C-G1 General Retail and Service Commercial: The purpose of the (C-G) District is to provide for commercial uses which are customarily operated entirely or almost entirely within a building; to provide for a review of the impact of proposed commercial uses which are auto and service oriented and are located in close proximity to major highway or arterial streets; to fulfill the need of travel-related services as well as retail sales for the transient and permanent motoring public. All such districts shall be connected to the Municipal Water and Sewer systems of the City of Meridian, and shall not. constitute strip commercial development and encourage clustering of commercial development; 5. That 11-2-409 B states that a sales lot for automobiles is only allowed as a conditional use in the C-G district. 6. That the Applicant is not the owner of record of the property; that the owner of record is Zamzow, Inc., an Idaho Corporation; that the owner has submitted a consent to this application. 7. That the property and building are currently vacant and has been vacant since November 1995.. 8. That the proposed use by the Applicant is to use the FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 2 ADVANTAGE AUTO SALES, INC. • premises in and for the same purposes as the prior tenant, Meridian Ford, Inc., as an automobile and truck sales lot and as an automobile repair shop. 9. That the Applicant represented in the Amendment to Application for Conditional Use Permit that conditional use will be only of the eastern most two hundred fifty feet (250') and the southernmost two hundred feet (200'); that the building currently on the premises is 130' x 60', and the landscaping strip as required by the City shall be twenty feet (20') in width (to include a five foot (5') sidewalk) along the eastern most side of the property 200 feet; that two (2) parking spaces are provided for handicapped parking and include adjacent eight foot (8') access aisles as required; that parking spaces shall be striped and marked by the appropriate signage; that Applicant and co-applicant propose to remove asphalt, resurface a five foot (5') wide sidewalk, to place underground sprinklers along the two hundred foot (200') frontage to East 1st Street, to lay sod fifteen feet (15' ) wide along the same frontage and to place trees at twenty foot (20') intervals along this corridor to enhance the aesthetics of this approach into the City of Meridian; that trash receptacles shall be located immediately behind the building currently existing, surrounded by a filled chain link fence; that the sales lot shall be striped. 10. Mr. Sherer further testified that this Conditional Use Permit does not include any square footage not already in asphalt, FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 3 ADVANTAGE AUTO SALES, INC. • and thus the requirement to pave the west end of the lot, outside of the premises, is moot. 11. That at the hearing the Applicant's representative, Stephen Shearer, testified to many things and his testimony is incorporated herein as if set forth in full; his testimony included; that some of the things he testified to were that the location of this conditional use is the old Meridian Ford place of business; that he has seen the City staff comments; the fire department wants a sprinkler system if auto body work is done on the premises within the confines of the building; that the sidewalk should match the same as what Les Schwab has done; that the it was requested that the center curb cut be eliminated and Applicant will do that; that Applicant will abide by Planning and Zoning comments regarding the landscaping issue; that this project is for a used car lot; that detailing will be performed off-site, as well as repair work; that the use of the west side of the building is unknown at this time; that all of the building is leased; Advantage Auto Sales, Inc. is not using all the building; that the exterior of the building will be repainted and the offices recarpeted. 12. Rick Zamzow testified to many things and his testimony is incorporated herein as if set forth in full; his testimony included that Zamzow's is the owner of the property; that this lessee can't afford to sell junker cars; that he has checked out this lessee and Applicant will be a good user and will be painting the exterior of the building; that there were hazardous wasted on the property but FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 4 ADVANTAGE AUTO SALES, INC. • that has been cleaned up and he does not desire that to happen again. 13. Mike Cavin testified that he is the leasing agent for Zamzow's and this tenant will be a good one. 14. That there was no other public testimony regarding this application. 15. That sewer and water is available to the property, but the property will have to comply with the commercial sewer and water rates. 16. Central District Health Department, Meridian Fire Department, Meridian City Police Department, Nampa & Meridian Irrigation District, the Ada County Highway District and the Sewer Department submitted comments and they are hereby incorporated herein. 19. That the Meridian Fire Department Chief, Ken Bowers, commented that with the building being over 3,000 square feet, if there is any cutting or welding equipment to be used, that the building will need to have a fire sprinkler system installed. 20. The Nampa & Meridian Irrigation District commented that a Land Use Change/Site Development application be filed for review prior to final platting; that all laterals and waste ways must be protected; that municipal surface drainage must be retained on site. 21. That the Ada County Highway District submitted comments regarding this application and they are incorporated herein as if set forth in full; that the District's site specific comments include the following: 1. Construct a 5-foot wide detached concrete sidewalk of 7 foot wide attached concrete sidewalk on E. First Street abutting the parcel approximately 180 feet) prior to issuance of any required permits. 2. The existing southern driveway on East First Street FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 7 ADVANTAGE AUTO SALES, INC. • shall be reconstructed as a 30 foot wide curb return driveway with 15 foot radii in its present location, approximately 10 feet from the south property line. 3. That the existing norther driveway on East First Street shall be eliminated and replaced with standard vertical curb, gutter and sidewalk. The Applicant is permitted to construct a new 30 foot wide curb return driveway with 15 foot radii located a minimum of 150 feet from the southerly driveway (measured near edge to near edge). 4. Provide a recorded cross access easement for the parcel to the south to allow shared access to East First Street prior to issuance of a building permit (of other permits). The district intends to require a similar agreement of the owner of the parcel to the south if it is the subject of a future development application. 5. Replace any unused curb cuts on East first Street with standard vertical curb, gutter and concrete sidewalk. 6. Other than the two access points specifically approved with this application, direct lot or parcel access to East First Street is prohibited. 22. That John Shawcroft, Waste Water Superintendent, submitted comments and they are incorporated herein as if set forth in full; that the Sewer Department requires a copy of the internal plumbing plans and will require review of construction plans for pretreatment purposes. 23. That Commissioner MacCoy submitted statements regarding this application and they are hereby incorporated herein as if set forth in full; that if a nationally known dealer (i.e.-Ford) was to take over this site, there would be no problem with this request, but since none is named, the assumption is this use will be a "used car dealer"; that this type of activity being located at the FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 8 ADVANTAGE AUTO SALES, INC. • • entrance to the City of Meridian causes questions; that since Zamzow's is the co-applicant and holds ownership to this property, that the new user be held to strict compliance with the existing City Codes and Ordinances. 24. That Section 11-9-605 G 1. states as follows: "Planting strips shall be required to be placed next to incompatible features such as highways, railroads, commercial or industrial uses to screen the view from residential properties. Such screening shall be a minimum of twenty feet (20') wide, and shall not be a part of the normal street right of way or utility easement." 25. That the Applicant's representative stated that they did not desire to meet the 20 foot landscaping strip, the 20 foot strip would include sidewalk, and that they desired to do what Les Schwab Tire Store did to the south of the Applicant. Les Schwab Tire Store was allowed not to have an entire 20 foot landscape strip, but they did extend much of their landscape strip, which was in most case 15 feet off of East First Street, to the west from East First Street, and they did place landscaping next to parking areas, which is 20 feet or more in width. 26. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 9 ADVANTAGE AUTO SALES, INC. property. • 2. That the City of Meridian has authority to grant conditional uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of the Revised and Compiled Ordinances of the City of Meridian. 3. That the City of Meridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho. 4. That since Applicant's representative stated that the Applicant would abide by the Planing and Zoning Commission's comments and requirements pertaining to landscaping, would do what Les Schwab did for landscaping, that the Application could be conditioned on placing sprinkling inside the building if auto body work was done, cars would be detailed off-site, that the center curb cut would be eliminated, that the building would be painted ion the exterior, and other times, it is concluded that the Applicant shall meet and perform all of its representations. 5. That 11-2-418 C of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission concludes as follows: FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 10 ADVANTAGE AUTO SALES, INC. • a. The use, would in fact, constitute a conditional use and a conditional use permit is required by ordinance. b. The use should be harmonious with and in accordance with the Comprehensive Plan and Zoning Ordinance. c. The use apparently would be designed and constructed to be harmonious in appearance with the intended character of the general vicinity. d. That the use would not be hazardous nor should it be disturbing to existing or future neighboring uses. e. The property has sewer and water service available. f. The use would not create excessive additional requirements at public cost for public facilities and services and the use would not be detrimental to the economic welfare of the community. g. The use would not involve a use, activity, process, material, equipment or conditions of operation that would be detrimental to person, property or the general welfare by reason of excessive production of traffic or noise. h. That sufficient parking for the property and the proposed use will be required. i. The development and uses will not result in the destruction, loss or damage of a natural or scenic feature of major importance. 6. That all ordinances of the City of Meridian must be met, including but not limited to, the Uniform Building Code, Uniform Fire Code, Uniform Plumbing Code, Uniform Electrical Code, the Fire and Life Safety Code, all parking and landscaping requirements; that the Applicant should meet with Shari Stiles to work out an acceptable landscape plan. 7. That the comments of the Assistant to the City Engineer, Planning and Zoning Administrator, City Police and Fire Departments, Ada County Highway District (ACRD), Central District FINDINGS OF FACT AND CONCLUSIONS OF LAW Page 11 ADVANTAGE AUTO SALES, INC. Health Department, Idaho Power Company and Nampa-Meridian Irrigation District, must be complied with. 8. That, also as a condition of the conditional use permit, a landscape plan must be submitted to the Planing and Zoning Administrator; at a minimum it must provide for four thousand square feet of landscaping adjacent to East First Street; that the depth of the landscaping, measured from East Fist Street to the west, must be at least fifteen feet but not greater than twenty- five feet; that the sidewalk shall be separate, and to the east of the landscape strip, and not included in the landscape strip; that the required number of trees and their size shall meet the City requirements. In accordance with District policy, staff recommends that the applicant be required to construct a 5-foot wide detached concrete sidewalk or 7-foot wide attached concrete sidewalk on E. 1st Street abutting the pazcel (approximately 350-feet) prior to issuance of any required permits. D. There are a total of two driveways currently located on E. 1st Street abutting this site. The southern driveway on E. 1st Street is a 40-foot wide full access curb cut driveway located approximately 10-feet from the south property line and approximately 22-feet from an existing driveway which serves the site to the south. District policy requires a minimum separation of 150-feet between consecutive driveways on this section of E. 1st Street (measured from near edge to near edge). This driveway does not meet District policy. However, this driveway is aligned with an opening in the center landscape median in E. 1st Street. There are no other openings in the median along the frontage of this site. The driveway to the south was approved by the District as a part of the Les Schwab development and a shared driveway with cross access was not required of that applicant at the time that site plan was reviewed by the District. WPD Page 2 • • Staff recommends that the District grant a variance from the required 150-foot separation and permit the driveways to be separated by 22-feet because this is an existing driveway which was here before the driveway to the south was approved, and the driveway is aligned with the existing median opening. The driveway should be reconstructed as a 30-foot wide curb return driveway with 15-foot radii in accordance with District policy. The northern driveway on E. 1st Street is a 37-foot wide curb cut driveway located approximately 73-feet from the southerly driveway. District policy requires a minimum separation of 150-feet between consecutive driveways on this section of E. 1st Street (measured from near edge to near edge). This driveway does not meet District policy. This driveway is not aligned with an opening in the center landscape median in E. 1st Street and functions as a right-in/right-out driveway. Staff recommends that the northern driveway be eliminated and replaced with standard vertical curb, gutter and sidewalk. The applicant should be permitted to construct a new 30- foot wide curb return driveway with 15-foot radii located a minimum of 150-feet from the southerly driveway (measured near edge to near edge), which would be located north the site the applicant proposes to lease, but on property under the same ownership. E. District policy states that direct access to arterials and collectors is normally restricted and that the developer shall try to use combined access points. In accordance with District policy staff recommends that the applicant provide a recorded cross access easement for the parcel to the south to allow shared access to E. 1st Street prior to issuance of a building permit (or other required permits). The District intends to require a similar agreement of the owner of the parcel to the south if it is the subject of a future development application. The proposed development is to be leased from a larger parcel. Staff is not recommending cross access easements to the north or the west, because there is no change in ownership. F. The transportation system will be adequate to accommodate the additional traffic generated by this proposed development. G. This application is scheduled for a public hearing by the City of Meridian Planning and Zoning Commission on May 14, 1996. The following requirements are provided to the City of Meridian as conditions for approval: Site Specific Requirements: Construct a 5-foot wide detached concrete sidewalk or 7-foot wide attached concrete sidewalk on E. 1st Street abutting the parcel (approximately 180-feet) prior to issuance of any required permits. 2. Provide a recorded cross access easement for the parcel to the south to allow shared access to E. 1st Street prior to issuance of a building permit (or other required permits). B. This site was previously occupied by the Meridian Ford dealership. The only change that the applicant is proposing for the site is to eliminate the existing northerly curb cut driveway on S. E. 1st Street. C. In accordance with District policy, staff recommends that the applicant be required to construct a 5-foot wide detached concrete sidewalk or 7-foot wide attached concrete sidewalk on S. E. 1st Street abutting the parcel (approximately 350-feet) prior to issuance of any required permits. D. There are a total of three driveways currently located on S. E. 1st Street abutting this site. The southerly driveway on S. E. 1st Street is a 40-foot wide full access curb cut driveway located approximately 10-feet from the south property line and approximately 22-feet from an existing driveway which serves the site to the south. District policy requires a minimum separation of 150-feet between consecutive driveways on this section of S. E. 1st Street (measured from near edge to near tidge). This driveway does not meet District policy. This driveway is aligned with an open2~~g in the center landscape median in S. E. 1st Street. There are no other openings in the. median along the frontage of this site. The driveway to the south was approved by the District as a part of the Les Schwab development and a shared driveway with cross access was not required of that applicant at the time that site plan was reviewed by the District. The driveway should be reconstructed as a 30-foot wide curb return driveway with 15-foot radii in accordance with District policy. The middle driveway on S. E. 1st Street is a 37-foot wide curb cut driveway located approximately 73-feet from the southerly driveway. District policy requires a minimum separation of 150-feet between consecutive driveways on this section of S. E. lst Street (measured from near edge to near edge). This driveway does not meet District policy. This driveway is not aligned with an opening.in the center landscape median in S. E. 1st Street and functions as a right-in/right-out driveway. Staff recommends that the driveway `be eliminated and replaced with standard vertical curb, gutter and sidewalk. The applicant should be permitted to construct a new 30-foot wide curb return driveway with 15-foot radii. located a minimum of 150-feet from the southerly driveway (measured near edge.. to near edge). The applicant is proposing to replace the existing northerly curb cut driveway on S. E. lst Street with standard vertical. curb and gutter. Staff recommends that the northerly driveway be eliminated as proposed.. E. District policy states that direct access to arterials and collectors is normally restricted and that the developer shall, try to use combined access points. In accordance with District policy staff recommends that the applicant provide a recorded cross access easement for the parcel to the north and-south to allow shared access to S. E. 1st Street prior to issuance of a building permit (or other required permits). The District intends to require a similar agreement of the owner of the parcel to the south if it is the subject of a future development application. F. The transportation system will be adequate to accommodate the additional traffic generated by this proposed development. G. This application is scheduled for a public hearing by the City of Meridian Planning and Zoning Commission on May 14, 1996. The following requirements are provided to the City of Meridian as conditions for approval: Site Specific Requirements: 1. A request for modification, variance or waiver of any requirement or policy outlined herein shall be made in writing to the Development Services Supervisor. The request shall specifically identify each requirement to be reconsidered and include a written explanation of why such a requirement would result in a substantial hardsh' o~ r inequity. The written request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for Commission action. Those items shall be rescheduled for discussion with the Commission on the next available meeting agenda. Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action do not provide sufficient time for District staff to remove the item from the consent agenda and report to the Commission regarding the requested modification, variance or waiver. Those items will be acted on by the Commission unless removed from the agenda by the Commission. 2. After Commission action, any request for reconsideration of the Commission's action shall be made in writing to the Development Services Supervisor within two days of the action and shall include a minimum fee of $110.00. The request for reconsideration shall specifically identi each requirement to be reconsidered and include written documentation of data that was not available to the Commission at the time of its original decision. The request for reconsideration will be heard by the District Commission at the next regular meeting of the Commission. If the Commission agrees to reconsider the action, the applicant will be MCU896.WPD Page 4 notified of the date ~ime of the Commission meeting at ~h the. reconsideration will be heard. 3. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #188, also known as, .Ada County Highway District Road Impact Fee Ordinance. 4. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards, Construction Services procedures and all applicable ACRD Ordinances unless specifically waived herein. 5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 6. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. 7. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. 8. Any change by the applicant in the planned use of the property which is the subject of this application,, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless awaiver/variance~of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. Dear Mr Sherer: We have reviewed the above mentioned site and as we discussed, we have determined some methods for handling the storm water. The enclosed report reviews the present conditions of the site and presents some methods for handling the storm water such that the water remains on the site. The methods fit the site quite well, however we will need to dig some test holes to determine the soil type and permeability. We will then be able to determine the subsurface drain trench dimensions. Sharp, P.E. v ~~~Y~~IT A _ • LOT ANALYSIS FOR STORM WATER RUNOFF FOR STEPHEN SHERER EXISTING SITE CONDITIONS This site is the old lot occupied by Meridian Ford. The site consists of approximately two acres and is composed of a asphalt parking azea with a 8200 + squaze foot building. The area was used as a automobile sales and service lot. The asphalt surface appeazs to be in good condition with only one azea that shows any breakup. This area is southwest of the building corner and indicates that water ponds in the low spot. The asphalt and base material indicates failure and will continue to be a problem unless repaired. The rest of the asphalt surface appears to be drained and does not show signs of stress due to water ponding. The asphalt surface has a surface sealer which covers the asphalt except at the construction and expansions joints or cracks. The age of this seal coat is not known. The building has down spouts which drain to the asphalt pazking azea. From the appeazance of the spouts, one half .. of the building roof drains to the north and one half drains to the south. The enclosed sketch indicates the drainage patterns and location of the drainage facilities. As can be seen on the sketch, the north portion of the lot and building, drains to the north and into two drop inlets and a subsurface drain. The size of the drainage trenches aze not known, however the asphalt does not show any deterioration or water mazks. Thus the indications aze that the storm water runoff in this area is being handled by the drop inlets. The westerly side of the lot drains to the west and to the vacant lot to the west. This area is bare ground with a gravel surface. The area also drains to the west and towards Meridian street and to a ditch parallel to the street. This ditch appears to be a street drain ditch as well as an irrigation delivery ditch. If any storm drain water from the site would get to the street, the water would be intercepted by the ditch and carried away. The southeast corner of the lot appeazs to drain towazd the south and east. A portion of the storm water runoff from this area drains onto First Street and to a drop inlet approximately twenty feet north of the entrance to the lot. The south portion of the lot drains to the south and appeazs to drain onto the properties to the south. The southwest corner has a low spot that appeazs to pond water and has weakened the asphalt and base to a point of breakup. Also in this corner, there is a paved access road from Meridian Street to this lot. This access road drains to the south properties and to Meridian Street. The size of the drain fields are not known, however based upon the asphalt around the drop inlets, this area appears to be adequately drained. In addition the water can pond in the area to assist in containing the storm water. Thus, in this area we recommend that the area be maintained as it is and that the two drop inlets be maintained. The west side of the lot appears to drain to the vacant lot to the west. This area needs a drainage swell constructed along the west boundary of the site to retain the storm water. The south side of the lot should have a trench drain constructed along the entire south boundary of the lot, probably in front of the proposed landscaping and in front of a raised curb. The south east drainage area, near First street should have a trench drain, a raised asphalt drainage block , or possibly a concrete valley gutter across the entrance to intercept the water prior to it reaching the street. The valley gutter or the raised asphalt block can be constructed to drain to the south boundary of the lot and into a trench drain. The small deteriorated asphalt area, near the southwest corner, should be repaired so that further breakup does not occur. The access road to the west is not on this site, however, a raised asphalt berm should be constructed along the west boundary of your site to prevent storm water runoff from leaving the site. AUTO SALES LOT, AUTO REPAIR SHOP BY ADVANTAGE AUTO SALES, INC.: Johnson: At this time I would invite the applicant or the applicant's or the applicant representative to address the Commission. Steve Sherer, 2090 Star Lane, was sworn by the City Attorney. Sherer: I am representing Advantage Auto Sales on the unique application to change an automobile sales lot into an automobile sales lot. As most of you are aware Meridian Ford has been at that location of the premises of the current application for several years. In fact it was there predating the City ordinances and zoning ordinances which is why it is necessary for us to come before you with a conditional use permit. We have proposed very few physical changes to the building. Our application includes the possibility of an automotive repair shop as a subtenant. That automobile repair shop would be required to meet and address the comments that have been provided by the Fire department, by the Sewer department, and by the plumbing department as well and the City Engineer. The comments to our application have been and seem to be limited, the Fire department was concerned about a sprinkler system. In the event the auto repair shop uses cutting torches or welding torches something that would create sparks and would create the need for a sprinkler system. We would have no problem of granting of the application be conditioned upon installation of a sprinkler system in the event that type of auto repair facility is sublet into the back part of the premises. It is expected at this time that any use of the repair facility will be simply a mechanics shop however not related to auto body work. The Ada County Highway Department has indicated and Ms. Stiles has also indicated in her comments that she believes either a five foot detached sidewalk or a seven foot attached sidewalk be included on the arterial of E. 1 st Street. We would propose that instead of the proposals of the Ada County Highway District in the Administrator Stiles' recommendations that for the purpose of continuity and to satisfy the City and to really beautify and keep it aesthetically pleasing that the dimensions of the landscaping and the sidewalk would match the dimensions of the Les Schwab tire store which is immediately to the south. We believe that makes more sense for the entry way of the City. We would entertain the Commission's recommendations in that matter but it seems like if we are attempting to beautify that corridor that we would want to be symmetrical in terms of the landscaping strips. The Ada County Highway District has also recommended that we eliminate the center curb cut to the premises. There are actually 3 curb cuts into the old Meridian Ford lot, the southern most one opens from the northern lane of traffic as well, that is where the break in the median strip is that is why that one has been allowed to stand by ACHD. The northern most one is I think more than 150 feet away from the other one. The center one will be closed as required by ACRD, we believe that is a pretty major concession on the part of our clients because it does limit access to that premises but we are willing to do • • Meridian Planning & Zoning Commission May 14, 1996 Page 49 that., Additionally ACRD requested a cross easement into the Les Schwab property. , Franklin the Les Schwab properties that I have seen have been in their location about a year, this one has been too close to 40 or 50 years and I don't think Les Schwab is every going to be in a position to grant that easement, a corresponding easement. It seems like something was missed there in their application but we had no problem in granting an easement to their property should that ever become a possibility. The Nampa and Meridian Irrigation District was concerned about run, off of excess water from the premises. I submitted this afternoon a proposed plan that was drafted by John Sharp and I chose Mr. Sharp because he is Nampa and Meridian's engineer and he would have to approve any plan that my engineer would submit and I would have to pay for his approval any so I decided to get the stuff right and go to him in the first place. He submitted a drainage plan which includes asphalt berms on the property and a drainage trench along the southern most side of the property. We have no problem in complying with those as well. The sewer department was concerned with a single containment (inaudible) automobile repair shop. We will address the sewer departments concerns at the time that we obtain a tenants for that portion of the premises. We would be glad to comply with any concerns that they have and would in fact make that a condition of the tease of the premise of the back premises there. Now, with, again, I haven't seen any other objections to the plan I believe I am fairly current unless something was filed late today. Johnson: The only thing that was filed late today was a letter from you. Sherer: Okay, I wish I had been able to get that in earlier. The engineer had problems getting that finished. The ordinances as I read them do not concern themselves exactly with landscaping. I think the landscaping is the issue along E. 1st Street that we have a problem with. We will abide by the Commissions recommendations whatever they are. It is very important that this project move forward as quickly and with all expediency as possible. We believe it would make more sense to match dimensional the landscaping that was put in next to us at Les Schwab and that it would be aesthetic for the City. I did also submit another landscape plan and I have put part of this plan up on the (inaudible) clarifies what we have already proposed with the trees across here the trees down the side. We would have the drainage trench along this side as well. We would have the asphalt berms across here and across the back of the premises (inaudible). Johnson: I can't see dimensions from this view point is that 15 or 20 feet wide. Sherer: The sidewalk and landscaping together is 20 feet wide on Les Schwab's plan. Johnson: I really don't know about Les Schwab's plan, this is proposed for your plan right? Sherer: Yes • • Meridian Planning & Zoning Commission May 14, 1996 Page 50 Johnson: And is that 15 or 20 feet there? Sherer: The sidewalk is five feet and the remainder of the landscape is 15 feet being a total of 20 feet. When we had a preliminary site review the statement was made that the City requires a 20 foot wide landscaping strip along E. 1st with a five foot sidewalk and underground sprinkler system. We believe that complies with the requirements of the site plan. We do have the requisite number of trees, we have our landscape architect has determined what trees to use that will fit in with the City's plan and will be aesthetically satisfactory to the City. We would request that in the event that Council or the Planning and Zoning Commission approves this request this evening that we move forward with all due diligence. It is my understanding that it would not be necessary to have a public hearing before the City Council because of the fact that this is commercial property and therefore only one public hearing is required pursuant to the zoning ordinance. We would hope to hasten this through and to address this at a special meeting of the Council to be held on June 4th. In the event that the commissioner approve this tonight we will arrange for bonding, Mr. Rick Zamzow Inc. is the coapplicant in this matter is willing to arrange for immediate bonding to have the work begun immediately to have it ready so that on Council's approval we can get a temporary occupancy permit until the project is finished. Johnson: I don't know who you have talked to about your timing schedule but conditional use permits require findings of fact and conclusions of law. We won't handle those until our June 11th meeting. Sherer: Well I guess we will proceed with as much diligence that we are allowed. Johnson: And then the City will have to review those. I hope you haven't been mislead in that regard as to how quickly this can be processed through. I feel an obligation to tell you that. Sherer: I appreciate that, thank you. Johnson: Any questions of Mr. Sherer? MacCoy: I have one, since I didn't see any major car name on there, it says auto sales, is this going to be a-used car lot? Do you use that word or do you call it something else or what? Sherer: The name of the lot here will be called Auto Finance of America and it is a used vehicle lot. So I am wondering if they are aware that this is not a new dealership, this is dated May 8. MacCoy: That is the reason I asked the question because I couldn't find any place that said that it was an agency and I know they change names nowadays. They call it various things other than used cars. Sherer: The Ada County statement is an approval for a new auto sales and service facility. As implying a new facility, you could read it one way or another. MacCoy: I realize that and I just wondered what your interpretation was. Sherer: My interpretation is that they will be marketing used cars. not new cars. MacCoy: And these cars come from other lots and so on. Sherer: They will be purchased at auctions brought from other lots, taken as trade ins. MacCoy: What I am concerned about is the same thing you are talking about here and that is avenue to our city and I just don't like to see somebody Joe drives his car down here and sells my car and all of a sudden it becomes just a big lot to park your car on. I have seen this down in other parts of the country. Sherer: I had occasion to talk to Mr. John Popell who is the president of Advantage Auto Sales Inc. when I received the water application from the water district I talked to him and talked to some engineers about run off and my concern is what would happen when the cars are washed and stuff like that. He stated that the cars would all be detailed off site and brought onto the Site. So, they are expecting a very clean and orderly operation. MacCoy: Okay, that was my next question, where are you planning to work on these if you are going to bring one and not just take any old car and then work on it. Sherer: They are planning to do any repair work off site, they don't expect to have any broken down cars. I think as you may have seen from the photographs that were submitted they do run a clean and aesthetically respectable car sales lot. They have one in Oregon, they have 2 in Missouri and I believe they have some in Florida but I am not sure exactly. This has been quite a process that we have been through in selecting a tenant for this building. We have seen a lot of different people interested in it. We feel we have selected the best tenant not just in dollars (inaudible) but in the type of business that they are doing the cleanliness of the business as far as contamination looks and so forth. So we have spent some time researching who and what is going into the building. As far as the rest of the property we intend to do the same thing as we come in with new tenants for the rest of the property. We will be going through a building permit process and we will need to show landscaping at that time. If it is a conditional use we will be back in front of you to do that. Again Mr. Zamzow does have quite a bit of investment in the City of Meridian not just this site. He wants to keep it that way. Johnson: Any questions for Mr. Caven?
